I'll be up to talk to you here in a minute. Okay. >> Okay. >> All righty. Thank you guys. >> I don't. >> Yes, sir. >> Yeah. Just basically the driver essentially >> from anywhere. >> Doodle. >> Yeah. And she said she'd been drinking. >> Okay. >> Sounds good. >> Um passenger lives here. I'm going to cut him loose if that's cool. >> Yeah. >> Hello. >> How's it going? I'm off police department. So, you're not being audio video recorded. You go ahead and step out for me. >> Yes. Do >> you have any issues walking, standing, or balancing? >> Both. >> Both. And how's that? >> Um, well, I don't wear my contacts regularly, so I don't uh walk straight, I guess. >> Okay. So, do you have like issues like walking? Where do you work at? Yeah. Um, currently I work at the station saloon. >> Station saloon? >> Yeah. >> Okay. And you're just a bartender there? >> Mhm. >> Okay. >> Server, of course. >> And a server. Do you have any problems walking at all there? >> Yes, from time to time. Yes. >> Okay. Do you take any prescription medications? If so, what and when? >> Not currently. Um, I have been prescribed like a really strong ibuprofen. >> Okay. Have you taken that? >> I'll get that. Yeah, I'll take that now. >> Okay. Are you diabetic? >> Yes, >> you are. Okay. When's the last time you uh or what kind of diabetes or anything like that? >> Type one, type two. >> Low blood sugar. >> Low blood sugar. >> So, which type? >> Type two. >> Okay. When are you diagnosed that? >> Uh 18, I believe. >> Okay. >> 18. >> Have you had any recent head injuries? Um, not according to a doctor. No. >> Okay. Have you had any like want to force trauma to your head? >> Okay. Do you have any medical issues that would prevent you from performing these tests? >> I'm not sure then. >> Okay. >> I'm probably blood temperature. >> So, let's just let's just get through this. >> Suited up and stuff. >> Yeah, I know. You got to put your arms at your side, though. Okay. >> Mhm. >> Can you do that? I don't think so. >> Okay. Are you not wanting to do these tests? >> Are you choosing not to do the test? >> I'm definitely just cold, sir. >> Okay. Well, why don't we go back to our police department's form and if you're fine, we'll bring it back. >> I don't feel safe there. >> You don't feel safe at a police department? >> No, not at all. >> What? What's wrong with the police? >> Okay, we're either got to do these tests or not. >> I let you know quick and easy. Oh my god. >> How about the quick and easy gas station? You feel safe there? >> No, not at all. >> Okay. All right. Well, can we do these tests? >> You got to put your arms at your sides, though. Okay. >> Oh my god. I cannot believe that's really cool. >> You have a coat. >> I'm This is all I work full >> Oh, she's got no coat. She's got nothing. >> But she'd also >> Would you like to wear my work coat? >> That'd be fantastic, actually. Ma'am, >> would you like to wear his workout coat? >> Yes. >> A little bit warmer. >> Said yes. >> Feel free to zip it up too if you want. >> All righty. So, like he he was saying, just feet together, arms at your sides. >> Mhm. >> Arms at your sides. >> Can you put your arms to your sides? >> Currently, no. Right now, I can't. I'm so freaking cold. >> Well, now we have the same amount of layers on. Not sure if you guys are aware, but there is this disease called Rainol syndrome, and I happen to have it. >> Okay. All right. Well, we have the same layers on now. So, if you wouldn't mind putting your hands at your sides just like I am. I can do it. I think you can do it, too. I'm not jump. >> So, are you going to do this test or not? Yeah, >> you're not going to >> What are we doing? >> Are you going to do these tests? >> We're doing these tests or not? >> We can do the We can do the tests here. We can go to the quick and easy and do them where it's warmer. We could go to the police department and do it where it's warmer. I guess we have four options or you can not do them. >> So, we have four options on the table. If you I would just prefer that you choose one and then we'll go from there. >> You obviously don't want to do them out here because it's cold, which is perfectly fine and understandable. Uh but as far as warmer locations, we have the Quick and Easy, which is close, and we also have the police department, which is close. >> I just don't feel like you guys are going to get a proper uh what is the word? gauge, per se. >> Okay. >> Right now, all we're doing >> right now, all we're doing is delaying. We're just giving you the option to basically prove that you're good to drive. Okay. And we're just trying to go from there. Okay. You said you've been drinking. I know you said that it was earlier, but I can smell alcohol coming off of you. I can smell coming out of the car, too. Okay. And I know that you said that it's probably from other people because you take other people different places, which I understand. and you dropped a coworker off here and then you were planning on going home. Okay. So, basically, we're giving you the opportunity to do the test. And if you don't want to do the test, then that's fine as well. Do you want to do the test or you don't want to do the test? I need an answer. >> I just I've I've made it to my destination where I'm supposed to be tonight. Can I just go or >> You just told me that you live back on Lafayette. >> That is where I live, but this is my destination for the night. know I'm here. >> Okay. >> And I really just want >> I'm going to give I'm going to give you this the last time I'm asking. Do you want to perform the test or do you not want to perform the test? >> I don't feel like that's necessary when I'm here where I'm supposed to be for the night. >> Can you take the jacket off, please? >> Okay. >> Thank you. >> Yep. >> All right. So, right now you're going to be placed into custody for driving under the influence. Okay. I don't understand why. >> Put your hands behind your back. >> Please explain to me at least. >> Can you explain? Can you explain my rights to me, please? >> Please. Actually, cuz I don't understand what's going on. >> All right. Bring your hands behind your back. >> Please explain to me what you're doing to me before you do it. >> Stop. >> That doesn't make sense to me. >> Raise your hand. Raise your hands behind your back because they are going to be going into handcuffs. Okay. >> Can you explain? >> I don't want to have to use any sort of force on you. You are tiny. >> Can you explain? >> You are under arrest. >> You're under arrest for driving under the influence of alcohol right now. Okay. >> So, put your hands behind your back >> because you didn't do any tests. I show you test. >> Yeah, you do. >> Nope. Do not unfortunately. >> Put your hands behind your back. >> Place your hand behind your back. Please. >> Please explain. >> Please place your hand behind your back. >> Place your hand behind your back. >> Arrest me for >> Place your hand behind your back for not doing your test. You can't do that. I know for a fact you can't do that. I have a lawyer. I have a lawyer. Please stop. Please, I am allowed to call my lawyer. Please, >> please, you cannot do that. Please >> stop. >> Please, I actually don't understand. Please. >> All right. >> Can you please explain to me what's going on? Cuz I don't understand. >> Please. >> No, this is not rational thinking. Okay. >> No. What? We gave you an order of what to do. >> Please. >> We gave you an order of what to do. Okay. >> Very cool though. And I literally can't feel my fingers because I >> Okay, let's watch my car. All right. >> Yeah. >> All right. >> Would you stop? You're going to get another charge of resisting. >> I don't I'm resisting right now. I don't understand. >> Stop resisting us. >> Tell me what's going on. You are under arrest for driving under the influence of alcohol. >> And how can you how can you testify against that when I don't >> because I have my observations. >> Observations is not I have probable cause to arrest you. >> I have a lawyer and I behind now. >> Sit your butt in the car. >> Please, please, please, please explain. Please explain to me what's going on in the car. >> Please explain to me what's going on. >> Will you stop? You're being under arrest right now. You're under arrest. Sit in the car now. Stand up. >> Sit in the car. >> I don't understand. I don't understand. I don't think this is allowed. I don't I really don't think this is allowed. >> Uh, obviously it's not a great time, but her handcuffs aren't double locked. So, basically going to have to deal with that whole situation when we get back. Hopefully, she's calmed down a little bit. >> All right. >> If you refuse to provide a breath sample, blood or urine, you'll be suspended. Your driver's license will be spinning for a year. Um, if you do provide a sample and it's over, it'll only be suspended for 6 months. >> So, um, when was our refusal? >> You haven't refused yet. Um, we got to wait 20 minutes and then I'm going to ask for a breath sample. At that point, if you refuse, then your driving crew should be singing for a year. >> I've explained this to you in so many ways. I don't know how else to explain it to you. Can you help me out? >> I'm reading it um a few reviews or >> are you are you going to sign this or not? Or else I'm just going to write refusal to sign. >> I'm still reading >> stuff. I have explained this to you several times. Okay. I I don't know how else I can explain it to you to make it any more simpler. Okay? If you've refused to fail, if you fail to complete this test, your lesson's going to be spent for a year. >> I'm not refusing anything. I just don't understand. So, what I've explained to you, >> can you possibly meet me in the middle here? >> There's no meeting in the middle. It's either you're going to do the test. >> I'm pulling up to >> Listen, it's very simple. Savannah, it's very simple. You either do the test or it's a refusal. >> This. >> Okay. >> That doesn't make any sense to me. You're either going to do the test or it's refusal >> because all out of the ordinary. >> Do you understand? >> Don't refuse a test. I got it. I could sign it, but you just signed it for me. >> No, we're not playing that game. >> Can you turn your fist down? >> You're not explaining anything to me. Apparently, you don't have the time to do so. >> It's going to appear or it's going to be refusal. >> Didn't you already mark it as refusal? >> No. That's refusal with a sign that it's more than ours. >> Okay. >> And then you're going to take the test. >> What happens if I refuse? >> I explained that to you. Your license will be spent for 12 months. >> Okay. >> If you do the test, it'll be six. It'll be 6 months. >> How can you revoke my license when you don't even know what's going on? Because I don't understand. >> No. Because >> And I literally just got your >> domestic relationship behavior >> and my adrenaline is boosting right now. >> Yeah. That's why. Thank you for asking. >> Okay. >> Thanks. >> So once again, you are here. He read >> my jacket, please. I don't care why I'm here. Can I have my jacket? >> I'll wait for the officer who arrested me to come back. >> Okay, fantastic. >> Can I have my jacket, please? I'm some criminal. No, there's nothing in my police jacket. I don't come to your work and tell you how to do your job. >> We could. Oh, and maybe I would better. >> Please do not tell me how to do mine. >> Hey everyone, it's Trent, prior deputy sheriff, patrol sergeant, and canine handler. So, this suspect is obviously thoroughly confused throughout the vast majority of this video. And I'm not entirely sure if that's due to her level of intoxication or she's just legitimately confused and feels that it's not being explained properly. It is notated in the officer's report that they later obtained her blood test results, which determined her BAC, blood alcohol content level, which is essentially the amount of alcohol she has in her system at the time of that test. And the suspect had a BAC of 0.102, which of course is above the legal limit of 08. Now, when it comes to DUI investigations, this is very common where law enforcement will stop somebody for an unrelated traffic offense. In this suspect's case, it's expired registration. And of course, by law, these officers are legally justified in investigating other potential crimes that they discover as a result of that unrelated traffic offense. And of course, the expired registration crime is a much lesser included offense with the DUI element. And when the suspect is questioning this officer about how he has the authority to arrest her for DUI, and he tells her it's based on his observations. So observations can mean a few different things. They could be driving obs, driving observations where law enforcement will observe a suspect all over the roadway swerving, maybe hitting something. Or there's other observations like this officer notates in his report for this suspect. Bloodshot, watery eyes, slurred speech, her admittance of the fact that she consumed alcohol earlier on in the evening, a strong odor of alcohol emitting from her person inside and outside of the vehicle. When she exited the vehicle to walk into the roadway to perform those FSTs, field sobriety test, the officer notated she was having difficulty maintaining her balance on the walk over. So those are additional observations that will get looked at when law enforcement is performing a DUI investigation. Very standard. And also the FST field sobriety test that the suspect refused at the end. Those are just another tool. That's another element that law enforcement will utilize to assist them in determining if somebody is impaired to the point where they are unable to safely operate a motor vehicle. And refusal of just that portion is not going to be the cause of arrest here. And after that arrest, by law, this suspect had to submit to a breath or blood test. But because of her refusal to do that, they had to write up a search warrant, have a judge sign off on it, and that's how they were able to pull a sample of the suspect's blood. And that's going to be it for this one. See you guys in the next one. >> She was charged with a traffic violation, DUI, and resisting peace officer, but remains innocent until proven guilty. [Music]
