female who was found in the driver's seat it was immediately apparent that she was highly intoxicated as she exhibited severe impairment and struggled to manage the situation calmly her intoxicated State affected her ability to communicate clearly and respond to the officer's questions what's that alcohol this is alcoholic beverage right yeah so I'm just going to be straight up honest with you it doesn't matter so let me be honest with you right now you are in constructive possession of this vehicle you had an open container you can go to jail for a DIY right at this exact minute so it's best to be honest with us right now so we can figure this out me because the vehicle's running you're in the driver's seat and you had an open container I mean now where is your hus call your husband you have you have extremely slurred speech have what have you been drinking or is it your medication that has you slur she normally has SL but why is your spee slur right now like the first time I we alcohol container from her vehicle and began an investigation related to it the officer's focus on the open container was part of a broader effort to understand the circumstances and ensure a thorough and all that the female refused to provide any information related to the ongoing investigation and repeatedly asked the officer to release her despite her please the officer ignored her requests and persisted with the investigation the officer instructed the female to move her vehicle on to the road where's your son at why you always crying but you this is your second the second runin I've had with you when you're you on your medication I believe that you wasn't drinking but I do believe that you are off so much of your medication like you were last time cuz it's the same way exact way you that's why everything but you want to come in my so we need that checked out the officer informed the female that denying intoxication was not an option given that an open alcohol container had already been found in her vehicle the officer then conducted a search of the vehicle during which they discovered illegal drugs this finding added a new dimension to the investigation is so she need to go to the hospital you want a sugar check what that so she does need to go to the hospital but she's a sugar check essentially pretty much vering yeah so where you going she is so she's on a bunch of medications she says perk sets and all sorts of different things she mixed them all just stay up here you are sitting here pouring in sweat pouring in sweat you can see the sweat all over your chest you can so here's what's going to happen sweat on my chest be but at this point you're driving under medications that you shouldn't be driving under and mixed mixed medications on top top of it with open alcohol in your vehicle that is still cold the straw still is liquid in it and you were slumped over the wheel so I'm giving you all the all the basics of what's going on here so no I refuse participate in any testing which gave the officer legal grounds to make an arrest the officer adhering to protocol respectfully attempted to take her into custody while ensuring that the process was the female was presented in court where she faced charges including driving Under the Influence possession of illegal drugs and Drug rated offenses the court proceedings address these serious charges
