What's going on? Well, >> Deputy Berg, the sheriff's office, they're going to do a quick safety inspection, but let me get tied up and then we'll go through it. Okay. All right. So, the first thing we get started is do you have your ID and the vessel registration? >> Yeah. >> It's still floating there. But I don't want your boy to put his hands through there. I don't want to get offense. >> I have your I have your registration. You getting you getting the other thing, >> huh? >> What are you looking for? What else? >> Your ID? >> Yeah. >> You said voter license. What year were you born in? >> 1990. >> Do you have your voter license? >> I have it online. >> Okay. >> Yeah. I lost my wallet. So, right now I have >> Can I see a life jacket for everybody and a type four throwable device? >> Throwable's right here. >> Okay. >> It's not a throwable. >> That's good. You can put that stuff back in there. >> And then a fire extinguisher and a horn or a whistle right here. >> Get that back right there. >> So, um, well, let me ask you this because there's an open beverage by the helmet. Have you had anything to drink today? >> I had one way earlier. >> Way earlier. Okay. >> That's fine, sir. >> Okay. I appreciate your honesty. What what I'd like to do, if you're willing to do so, just to um appease my suspicion, is have you put on a life jacket, board my boat. um do a couple seat of sobriety tests to make sure that you're okay to operate this vessel. You don't mind doing that? Yeah. Just uh I hate that you got to go back in there, but if you wouldn't mind grabbing one of your life jackets and putting that on for me >> and then if you want to leave your hat and your glasses here. >> I know. >> You can leave the beads if you want. I just needed to have glasses off that. >> Okay. >> Okay. So, I I've never done a if you're willing to do so. I just need you to board my boat. That's I'm not Yeah, I'm not coming on yours. All right, then before we get started, just turn around. You don't have anything in your pocket. It's going to hurt me, do you? No. >> I'm just going to feel the outsides. Okay, just have a seat right there for me. >> First thing I want to do is check your eyes. So, I need your feet flat on the ground, hands down by your side. >> You see my light? >> Yeah. >> What color is it? >> Blue. >> Follow with eyes only without moving your head. Okay. Eyes only. [Music] Make sure you're looking at the light. Don't look past it. >> That's a little too far. There you go. Trying to look at it, but it's Don't move your head. Keep your head still. Head still. Keep your head still. You're moving your head. >> Yeah. No, lean lean forward. Don't relax. Lean. Sit straight up for me. Don't lean against the There you go. Just keep eyes only without moving your head. relax. >> All right. So, I'm seeing some concerns. Um, so there's some other tests that I want to do. But before we do that, I'm going to read some to you because this is a criminal investigation and there's questions I do want to ask you. Okay. Um, you have the right to remain silent. Anything you say can't abuse against you in the court of law. Do you have the right to consult with an attorney before you make a statement or answer any questions? Do you understand these rights? >> Yeah. >> Are you willing to answer questions or make a statement without an attorney being present? >> Uh, wait. Am I being arrested? >> No. >> Well, here's the thing is, what I said, this is a criminal investigation. >> So, there's going to be questions that I want to ask you. So, in order to ask you those questions, you need to know what your rights are. You don't have to answer them if you don't want to, or you can answer them if you want to. But, I need to read this to you. I need to make sure that you understand that. So, so you do understand what I read? >> Yeah. >> Okay. Are you willing to answer questions or make a statement without attorney being present? >> Yeah. >> Has anyone threatened you, coerced you, or promised you anything that cause you to answer answer questions or make a statement? >> No. >> Okay. >> Do you have any kind of medical conditions? Anything Anything wrong with your neck, your head? >> Are your eyes okay? Can you see me just fine? >> Yeah. >> Okay. You don't wear contact lenses or glasses? >> Uh, I do, but I don't I don't have them on. >> But without them on, but you can see me. Okay. >> Yeah. >> Okay. There was the open container by the helm. There is an over alcohol beverage. Now, you said you had one. Is it just one or you had anything else to drink? >> Uh, I mean, we had one and then it was like a shot, but that was like way when we first got here. >> Okay. And the one drink the What was You said you had a beer. What was that? >> A salt. >> A Celzer. What was that? >> Yeah. >> And what was your shot? >> Uh, it was just tequila. >> Tequila. It was like around 10. >> Do you feel the Do you feel the effects of that at all? >> No. No. Okay. Not now. I mean, if anything, I feel like just nervous. Okay. You feel safe to drive the boat? >> Yeah. >> Okay. >> So, what's going to happen is there's three other exercises that we're going to do. I'm going to explain each one to you. Um, if at any time you don't understand it, say, "Hey, I didn't understand that." And I'll be more than happy to reexlain it to you. Okay. >> Front edge of the seat, feet flat on the ground. I need you to make a make a fist with both hands. Point your finger out. Hands down by your side. >> Don't rest up on the seat out just out in front of you. Just like that. When I say begin, you must tilt your head back at about a 45°ree angle. And you're going to close your eyes. I'm not going to close my eyes for safety reasons, but you're going to tilt your head about a 45 degree angle like so. Okay. When I tell you to, you're going to touch the tip of your nose with the tip of your index finger and immediately turn it to your side. When I say tip, I mean the portion that's directly underneath the fingernail, the front. >> Yep. Don't do anything yet. And then the tip of the nose is gonna be the dime sized portion at the ve at the dime size portion at the very end of your nose. Okay? So it's gonna be right here. >> Yeah. Tip to tip. >> Okay. >> When I say right, you must touch your right Oh, sorry. Yeah. You're tilting your head back. When I say right, you must touch your right index finger to your nose. When I say left, you must touch your left index finger to your nose. Do you understand that? >> Yeah. >> Go ahead again. Left. Immediately return to your side when you're done. >> Right. Remember, immediately return to your side once you're done. >> Left, right, right, left. All right, you can relax. All right, next we're going to do is called the palm flat. I need palm flat. I need you to place your hands palm to palm with one hand up and one hand down like this. I'm going to show you that. >> Just like that. Right there. You're going to remain in this position while I explain the task. You understand that? Go ahead and put get yourself out in front of you. Don't just stay just like that. I tell you to begin, you're going to turn your top hand over and count out loud one. Then turn your hand back over and count out loud two. counting only when your hands make contact like this. >> They were talking to me. >> You said that one more time. >> You guys know there were some waves coming. >> Okay. Do me a favor if you because I don't want him to be distracted by you and I construe it as something different. If you guys just want to move my move into the back of the boat. Thank you. We're going to start this over. Place your hands palm to palm. When I tell you to begin, you're going to turn your top hand over and count out loud one. And then turn your hand back over and count out loud two. Counting only when your hands make contact like this. One, two, one, two, one, two. >> Oh, okay. >> Don't start yet. I didn't tell you to begin. >> Repeat this. Speed up as you go and do not stop until told. Make sure to keep your hands and fingers parallel during each pat like this. Just parallel. Just like that. >> Don't start yet. >> Do you understand? >> Yeah, I guess. I mean, what I'm saying is >> Don't say you guess. Either you do, you don't. Don't start yet. But I can I can reexlain it to you. No, I know. Okay, I got what you're saying. I got it. >> You understand? >> You understand? >> Yep. >> Okay, go ahead and begin. >> 1 2 >> Remember to speed up. >> One, two, one, two, one, two, one, two, one, two, one, two, one, two, >> All right, you can relax. All right, next one's called the hand coordination. I need you to make a fist with both hands. You're going to place your left fist at the center of your chest and your right fist against your left fist like this. I'm going to show you. >> Just like that. >> Okay. Right against my chest. >> Uh-huh. Right fist in front just like this. Gotcha. >> Remain in this position while I explain the task. You understand that? >> Yep. >> Say just like that. When I say begin, you must perform four tasks. The first task is to count out loud from one to four while you move your fist in a step-like fashion, making contact between your fist on each step. So, it's going to look like this. 1 2 3 4. Don't start yet. The second task is to memorize the position of your fist. After you have counted to four, clap your hands three times and return your fist to the memorized position. So, it's going to look like this. So, I do count to four by switching my hands, right? And then I have to memorize my >> I can I can do that one more time. >> Yeah, I'll read it to you again. Third task is to move your fist in a step-like fashion. Reverse order, counting out loud from five to eight and returning your left fist to your chest. >> Five, six, seven, eight. Back to your chest. >> The four task is to open your hands with palms down and place them in your lap. >> Okay. >> Do you understand? >> Read that one more time. >> You read the thing. Okay. I I'm going to go from the beginning all the way through the steps. calm down and place them in your lap. >> Okay. >> Do you understand? >> All right. You got him again. >> 1 2 3 go. [Applause] >> Let that man go. Let that man go. Let me go. I need you to turn your body with your feet placing that way. No, stay seated. Stay seated. Turn feet that way and behind your back. >> I'm placing you on your wrist. We're voting under the >> What happened? >> We'll talk. We'll talk in a minute. Do >> you I'm going to take your watch off. Is this your wife or girlfriend? >> Neither. It's just a concern. >> Okay. Well, would you like that concerned citizen to have your watch? >> Yeah, I'll take it. >> And would you like that concerned citizen to have your necklace? >> Yeah, I'll take it. >> Well, it's up to him to answer. Okay. >> I don't think >> But but you But you are. But you are. Okay. >> I apologize for that. And if when when I'm done with him, I'll be more than happy to answer any questions you have. Okay. >> But what I need to know right now is do you have any shoes, sandals, or anything you want to put on? >> You're under arrest. Yeah. >> Yeah, I do. >> You're coming with us. So, are those your shoes or do you have sandals? >> They're on the inside. >> Okay. Um, we're at other. >> Do you know, ma'am? Do you know where his shoes are? Um, where they at? >> He's asking me a question. >> No worries. Um, pull those socks out for me and we're just going to have you slide the shoes on without the socks. Okay. >> Can you see these? >> Can I grab an emergency contact? >> Hey, buddy. Do you have anyone that can take possession though? Today all your all your friends been drinking stuff. >> Um >> and if I could ask where are you taking him? >> So he um because he's being charged with voting under the influence he has to remain in custody for 8 hours from the time of the arrest. Um, so what's going to happen now is we're going to take him to our our marine office. He's going to get processed. Then he's going to get transported to central booking um off Orient Road. I don't know if you guys are familiar with that is off booking. >> I'm sorry. Did you say off booking? >> No, no. Orient road. >> Orient road. >> Orient road. Jail is where we're going. >> Okay. >> And that's central booking is what it's called. Central booking. >> Yeah, that that's where he's going. Like I said, he has to remain in custody for 8 hours. When that 8 hours is up, he'll be released. You guys can post your bond at any time or somebody can you know >> at 8 hours it'll be like get out >> if if it's bonds post it. >> Okay. So yeah it's a misdemeanor. So 10% I think that's $500 10% 50 bucks somewhere in that ballpark. So if you if you contact Orient Road Jail and ask them they'll give you all the information that you need to know about that. You said your friends it you're going to call your friend. How are they going to get to it is my question. Are they on the water or are they going to drive? Okay. Um, do they know where the Davis Island boat ramp is? >> Yeah. >> Okay. Um, Fleming, what we can probably do if his buddy will go to the Davis Island boat ramp, you can drop me and him at the dock >> and then just tow this to the to the ramp and tie him up there until until his buddy gets there. >> Okay. >> I'm just hold I'm because you stood up. That's all. That's all. >> Have a seat. Do you have a wallet on the boat? >> Yeah. You you want them to you want them to keep all that? What do you What do you want to bring with you? Cuz if you bring anything, it's got to have your name on it. If not, the jail won't take it. >> So, I I have your ID. So, we can bring your ID and we can bring your phone. Um the phone. Well, we need the numbers out of it. But I'm going to turn it off to save your battery cuz you can't use it. But when you get out, you need to be able to use it. I don't want the battery to be dead. Make sense? >> Are you Are you guys calling this friend? >> No. Well, wait. >> So, are you good? Are you good releasing it to >> That's fine. >> Call my phone. >> Huh? >> Can I call my friend or >> Well, yeah. Well, they can do it right there. >> Oh, >> give her the number. She can call and put them on speaker and you can you can talk to them. >> My heart. >> No, I don't. >> Well, grab your Where's your Where's your phone at? >> It's on the I mean, I don't know where I pulled it out from there. >> Okay. You don't know where it is over there? What does it look like? >> Some red, right? >> Yeah. If you guys can find his phone, that'd be helpful. >> Yeah. Yeah. >> Stand up for me real quick. Stand up. >> Have seen it. >> It's probably in the front or in the back. I don't know. I was looking. It might be at the front because >> What's your What's your passcode? You would give it to hers. >> Yeah. Since uh ma'am, since we've been since we've doing all the communication here, do you have your ID? Just put it on speaker >> because I'm just going to put in the report that the boat was turned over to you. >> Sir, are you good with her having the boat until your buddy gets there? >> Yeah. >> Okay. >> What's your pass code? >> Can you type in his I know it's like a a >> towing it to Davis Island. My boat My trailer is at Lowry Park. >> Yeah. I I'm I mean I'm going to leave the boat there with my friends. They'll have my keys to the truck. >> All right. It's January 27th, 2024. I'm now requesting you submit a lawful test for your breath for the purpose of determining it alcohol content. >> Excuse me. >> But just wait. We'll wait till we get back cuz I got a feeling you're going to keep yelling this to me the whole time. >> Ma'am, he can't have anything to drink right now. >> He can't have any water? >> Not right now. I got to read something to you and you you're wanting to play games with me. >> Okay. >> We're having a conversation. >> Did you Did you hear me just say you're playing games with me? You just heard what I said, right? >> All right. >> See what I'm saying? He hit a wave and he flew hands behind gravity to the side. [Applause] I'm just here to help you, man. I'm extra handsome. >> Do they do they want these guys to stay >> or >> We got the subject so they can secure this boat somewhere >> cuz our plan was to take them to Davis Island and and make sure they had a ride and then this all went sideways. So, >> I'm up. Whatever you want to keep doing, I'm just here to back you up. his bag. >> I'm sure he wants his bag cuz his bag's up there >> and probably his computer. >> Yeah. >> Yeah. And you looked over your shoulder and you pushed yourself into the water. You sure did. I don't know what you were thinking, but that was extremely stupid. You could have hurt yourself. >> I did that with handcuffs. >> That's a good question. I don't know why you did that. It might be because you're impaired and you make poor decisions. >> That was very, very dumb. Very dumb. All right, we're gonna we're gonna try this again. He hired a criminal defense lawyer and negotiated a plea deal. He pled no contest to reckless operation of a vessel and his adjudication was withheld. The state agreed to drop the obstruction charge. He was ordered to pay $1,000 in restitution. It's unclear if there were any other consequences as the actual sentencing document is sealed, but the remaining balance of his fines had to be sent to collections.
