substantial L armed to a person or you are suspected of driving or being on the duty time with respect to a commercial motor vehicle after consuming intoxicating beverage this law enforcement agency now wants to test one or more of your samples of your breath blood or urine to determine the concentration of alcohol or drugs in your system if any Test shows more alcohol in your system than the law permits while driving your operating privilege will be suspended if you refuse to take any tests that this agency requests your operating privilege will be revoked and you will be subject to other penalties the test results or the fact that you refuse testing can be used against you in court okay if you take all the requested tests you may choose to take further tests you may take the alternative tests that this law enforcement agency provides free of charge you also may have a test conducted by a qualified person of your choice at your expense you however will have to make your own arrangements for that test if you have a commercial driver license or operating a commercial motor vehicle other consequences may result from positive test results or from refusing testing such as being placed out of service or disqualified in addition your operating privileges will also be suspended if a detectable amount of restricted controlled substance is in your blood will you to an evidentiary chemical test of your blood yes or no no okay okay in that case we're going to do the search warrant okay and if he physically refuses then we do have to go up to jail and they tie him down all right so just to let you know what's going on because you refuse the test we are not going to draft a search warrant we're going to contact a judge okay show the search warrant to the judge our application for the search warrant he or she will approve or deny it I've never had one refused and then when the search warrant comes back we are going to force you to give a blood draw so that either means that we take you to the hospital and you give the the blood draw under the search warrant it's still marked as a refusal or if you're going to be problematic then we'll take you to jail and get the blood draw up there and they'll like you what should I do I can't give legal advice man you you he read it to you right yeah so I'm just going to reiterate what it said it said that if you voluntarily give a blood sample and the blood the test results here I can do that here well we go we have to go to the hospital okay so what do I do just if you voluntarily give the blood sample then we have to wait for the test results to come back if the test results come back above the legal limit then your license would be suspended for 6 months okay if you you have if you refuse to give the blood sample and just by saying no that's a refusal okay then we still have to get the blood sample so we get the search warrant we take you either to the hospital where where you give it voluntarily is or we take you to the jail where they strap you down to a gurnie and stick the needle in your arm and then when the blood results come back if they're above the legal limit um actually no matter what because it's a refusal your uh license is immediately going to be R and there are other penalties as well yeah okay so do you have any questions about those two I have questions is there any way I can leave tonight with my wife yes I need to know how I no matter what you're leaving tonight it's okay it's when you're going to leave and how long it's going to take okay that's understandable
