is to open your hands. >> Do this. >> Okay. >> I You're crazier than that. >> So, you are, >> you know, the Pope wouldn't be able to do that. >> Welcome back, everyone. Today's video comes to us from Wisconsin, where, similar to every other state that I'm aware of, they have no wake zones. For those of you who may not be familiar with what a no- wake zone is, it's essentially a place where you have to go very slow in your boat as to not create any waves coming off the back. This means that the hall has to be at full rest and it can't be angled up or on plane. Typically in a no wake zone and you're required to go the lowest speed possible to maintain forward motion and steerage. In the area shown in the video, there are clear buoys marking the no wake zone, but that didn't stop this group of individuals from taking off and getting on plane right in front of a boat filled with three different officers. Also of note, Wisconsin utilizes the standardized field sobriety test found in most other states such as Florida. If you're not familiar with this FST, it essentially turns into a complex game of patty cake that many people seem to struggle with. As you're watching it, be sure to try to follow along yourself to see if you can do the steps. You want to switch that buoy around pretty please? Thank you. Uh yeah, so we're the DNR wardens. Um I'm assuming you guys saw the buoys. >> Yeah, but we on the way here we everybody was going fast. It's our first time here. >> Okay. So I guess what's your understanding of the Sona wakeake zone here? >> The guy that at our lodge says during the week it's no wake. Okay. And then there you can go through here fast on the during the week or on the weekends, >> right? >> Is it true? >> So So which order did he say it in? >> River uh river resort. >> Okay. But what what what how did he explain it to you? >> He says what was it that the weekends they go fast? >> On the weekends it's open. >> It was one of the two. >> He said you got to really tie up your boat because people go fast. Uh, >> no. It was It was like I think the >> on Monday maybe. >> I think during the week they can go fast. On the weekends you go. >> Okay. >> You know, >> but on the way here we were following people. They were going through. >> Yeah. So, just I guess it sounds like your understanding is on the weekends, which is what we're in, you would have to go slow. >> Okay. >> Is that what your understanding was? >> Yeah. But on the way here, everybody was going fast. We were following them. >> No. Wasn't >> Is there a time limit? I don't think he would have done it if he knows the road. >> Okay. >> Well, that's why we're asking the question. We're trying to understand. >> Thank you. >> All right. Um our first time and uh you know, we were just trying to do what everybody else was doing. >> Sure. This is your first time like fishing or being on the Wolf River? >> Yeah, being on the Wolf River. First day. >> Okay. >> First day. >> Did you see us when you went by us? >> 2 hours ago. >> Oh, okay. No. >> No. No. Not fast. >> I gotcha. Um, but you saw the buoys, I assume. >> Okay. >> All right. Fair to say you were going faster than slow wake. >> Oh, yeah. >> Okay. >> I gota Yeah. >> Okay. >> Fair to say you were on pretty much a long way to go. I We're going to be here all in dark time to get home. >> Right. Where are you staying at? >> Rivers eagle. >> Rivers. >> Rivers. Rivers. >> Oh, I got you. in Fremont >> by the two, right? >> Yeah. So, like just up here at Joe's is where the Slowown Wake ends and then you can go quick up to Fremont. >> Okay. >> Yeah. But you're still still by the >> Almost there. That's Yeah. Um Yeah, you're a couple two three buoys away. >> Three buoys. Okay. Maybe do you happen to have your fishing licenses handy? >> And then do you have the boat registration? And I see there's no decals on here. >> Everything's right here. >> Okay. >> You guys been >> There's decals on this side. Is there not on this side? >> I don't see any stickers. >> You guys stopped for lunch anywhere or anything? >> No, we're just going to go have dinner. >> Oh, there you go. And then uh this is your boat, I presume. Uh do you have three life jackets or did >> Yes, >> I did not see life jacket. Got one here. Inflatable one under right here. We got the throwway under there. >> Yeah. And then if you can take that one. >> Okay. I can see it there. Yep. >> Okay. You want to check the horn? >> Uh, no. I believe it works. All good. >> You'll you'll blow me into next week sitting here. >> We had no fish. >> He caught a small fish. That's it. >> Okay. >> Okay. Sounds good. Well, um, if you guys want to hang out, uh, I'll get that back to you. We're just going to push off and chat for a little bit and we'll be right back with you. Okay. >> Thanks. >> Um, I gave it back to him. >> You could just uh if you want to drift or just if you put it into gear and just stay in here so you don't lose your progress if you just want to hang out right here. But you can turn it on and just put into gear. But don't leave obviously >> cuz we got your stuff. >> Yeah. I'm guessing you probably want your license back at some point. We're all good. >> Cool. >> We're good people. >> So, after a brief discussion with the other officers, they all determined that the operator was showing some signs of impairment and decided to move forward with a field sobriety test. >> What time did you guys say you got out today? >> Two. >> Two. Okay. >> Oh, three. I got you. Okay, sounds good. And it was Brian, correct? Okay. >> Um, I guess Brian, we got to ask. Obviously, you guys are all out here having a good time, which we're all about. Um, how much have you had to drink today? >> I had a couple beers. >> What's a couple? >> Three. >> Three. Okay. >> You had all of them? >> Sure. >> You know, >> I gotcha. Um, I guess what was the time frame that you had those three beers? It's like 7:00 now. >> Yeah. Within 5 hours. >> Okay. Hours, you know. >> Okay. >> Yeah. On a scale scale of 0 to 10. Zero completely sober and 10 being the most intoxicated you've ever been, where do you think you're at right now? >> Two. A two one two. Yeah. >> Okay, I got you. Sounds good. Um I guess just to make sure that you were and are safe to drive, what I'm going to have you do is put on a life jacket >> and hop over in our boat. We're going to have you do a couple quick tests. Okay. >> Um this probably would be a good time to anchor the boat. >> Yeah. And then uh you have to just put the light jacket on first. And it's just got to be properly put on with the straps and all. And then uh you have to just put the light jacket on first. And it's just got to be properly put on with the straps and all. >> And it may be easier when you get that snap just to put your hat and sunglasses. Just leave them in the boat there. My what? >> Never mind. >> Yeah, if you want to leave the sunglasses. >> Oh, I got you. Okay, sounds good. >> Um, and then if you want to have a seat in that seat for us and then, um, we're going to stay right by you guys, but just so we're not bumping into you, we're going to push off. Just hang out. We'll be right back with you. Okay. >> Um, have you ever been through field sobriety tests? No. Okay, sounds good. And then if you want to position the boat so you're avoiding the sun. All right, sounds good. Appreciate you working with us on this. Um, everything I'm going to read off of here, I have to read verbatim. This are seated, so you won't have to do anything standing or anything. And then >> I do have a a medical condition in my neck. >> Okay, I got you. >> It's hard for me to look up at you. >> Oh, okay. Yep, sounds good. We'll just do your best. >> Okay. Um, and I'll go through all these um, pre-EST questions to make sure that you're you're comfortable and good with everything. >> Okay. >> So, just like you're doing, please sit straight at the front edge of your seat. Put your arms down at your sides. There you go. Yep. Place your feet shoulderwidth apart so you are comfortable and stable. Are you stable? >> Yeah. >> Okay. Do not move your feet until the tests are over. And you'll hear this a bunch of times. stay in this position and do not do anything else until I tell you to do so. Do you understand? >> Yes. >> Okay. You kind of already mentioned this. Um, do you have any physical defects or disabilities? >> Uh, I have a um herated disc in my neck. >> Okay, I got you. Do you have any defects with your eyes? >> No. >> Are you sick or injured aside from the herniated neck disc? >> No. >> Are you under the care of a doctor or dentist? >> No. >> Okay. And um whether it's for your neck or anything else, legal or otherwise, are you taking any medications or drugs? Okay. What all are you taking? No. Do any of those have a prohibition against taking them while drinking? >> Um I imagine I you know probably you know everything is don't they? >> Yeah. A lot of stuff does nothing right after when you can't you know. >> Sure. I got you. Okay. I am going to check your eyes. What I'll have you do is hold your head still and follow the stimulus or my pen with your eyes only. Can you see my pen? >> Yes. >> Can you tell me what color it is? >> Black through green. >> Okay, sounds good. Yep. Perfect. Sounds good. Keep your head still and just follow it with your eyes only. Okay. >> Okay. They were bushike beers. There ain't nothing to add. >> Sure. And you think you had about three of them? >> Okay. Gotcha. >> Maybe not even three. A couple. >> Sure. I got you. Okay. >> Sounds good. Um, the next test I'll have you do is called the finger to nose test. And again, I'll explain everything, so bear with me. Make a fist with both hands. Extend your index finger like that. And turn your pulps forward. So that will look like that. >> Index fingers. Here you go. Perfect. >> Remain in this position while I explain the test. Do you understand? >> Yes. >> Okay. When I say begin, tilt your head back to about a 45° angle and close your eyes. So when I >> not be able to do that >> okay I gotcha >> I'll try but I might not >> Yeah we'll do do your best. Yep. So Yep. When I about it. >> Okay. Sure. >> Yep. When I say begin do that. So not yet. >> Right or left hand. >> Uh so when I say begin I have to explain all of this so you can relax and sit upright. >> But again when I say begin just like you did do your best 45° and close your eyes. Okay. When I tell you to touch the tip of your nose with the tip of your index finger and immediately return it to your side. So I have to explain this. This here just below the nail is the tip of your index finger. The pad sides or nail or not. And then this is the tip of your nose. This dime size portion. So anywhere else. So essentially tip of your index finger, tip of your nose and immediately bring it back down. When I say right, you must touch your right index finger to your nose. When I say left, you must touch your left index finger to your nose. Do you understand? >> Yes. >> Okay, you may begin. >> What do you want me to do? >> So, like I explained, um, tilt your head back, close your eyes, and then close your eyes. Okay. Left, right. left. [snorts] >> This hand's normal. >> Okay. >> Okay. For my nerve. >> Sure. Yep. Just Just do your best. >> It's tingling. It's numb. >> Okay. Uh right. Right. And left. All right. The next test I'm going to have you do is called the palm pat test. So again, I'll demonstrate and explain everything. >> Place your hands palm to palm with one hand up and one hand down like that. >> It's about as best as I can get, buddy. >> Okay, sounds good. >> A problem with my hands. >> Sure. Okay. I just ask you to do your best just like you're doing. >> Remain in this position while I explain the test. Do you understand? >> Yes. When I say to uh excuse me, when I tell you to begin, [clears throat] turn the top hand over and count out loud one. Then turn the hand back over and count out loud two. Counting only when the hands make contact like this. One, two, one, two, one, two, and so on. Repeat this. Speed up as you go and do not stop until told. Make sure to keep your hands and fingers parallel during each pat. So, just like you're doing. >> Yeah. >> This is parallel. Anything else is not parallel. >> Okay. >> Uh, Brian, do you understand? >> Yes. >> Like this, right? >> Um, just like I explained. So, it'll be like this. One, two, one, two, one, two. >> One, two, one. >> So, just basically top hand turn it over. One, two, one, two. >> Yep. Just like that. >> One, two. >> Yep. Okay. >> So, when I say begin, turn it out over. Count out loud one, then turn the hand back over. Count out loud two, counting only when they make contact like you did. Excuse [clears throat] me. Repeat this. Speed up as you go and do not stop until told. And then keep your hands and fingers parallel. >> Do you understand? >> Yeah. Not all the way, but you know. >> Would Would you like me to explain it again? >> One, two, one, two, one, two. Like that? >> Yes. Just like I explained. And then again repeat this speed up as you go and do not stop until told and keeping them parallel. >> I already >> Okay, you understand? >> Yes. >> Okay, you may begin. >> One, two, one, two, one, two. >> Speed up. >> One, two, one, two, one, two, one, two, one, two. One, two, one, two, one, two, one, two, one, two, speed up. One, two, one, two, one, two, one, two, one, two, one, two, one, two, one, two, one, two, one, two. >> Oh, okay. You can stop. >> Can't do much with this. >> Sure. >> All right. And then the last of these tests I'll have you do is called the hand coordination test. Um, Brian, this one has four different steps. I will explain them all. If you want me to explain it again at the end, I certainly can. So, bear with me as I explain it. >> So, what I'll have you do is make fists with both hands. Place your left fist at the center of your chest and your right fist against your left fist. Yep. Just like that. Left, right. Remain in this position while I explain the test. Do you understand? >> Yes. >> Okay. When I say begin, you must perform four tasks. The first task is to count out loud from 1 to four while you move your fist in a step-like fashion, making contact between your fist at each step. So that will look like this. 1 2 3 4. Good. >> The second task is to memorize the position of your fists after you have counted to four. Clap your hands three times and return your fist to the memorized position. So that will look like this and back to that memorized position >> after the four times. >> After the three claps. Yes. Yep. The third task is to move your fists in a step-like fashion in reverse order, counting out loud from five to eight and returning your left fist to your chest. So that will look like this. Five, six, 7, 8. Back to your chest. >> The four do one at a time. >> No, you have to go through all four when I say begin. That's why I have to explain them all. And then the fourth and final task is to open your hands with palms down and place them on your lap. >> Okay? Do you understand or would you >> No, I can't really hear you too good. >> Okay. Would you like me to explain it again and I'll increase my volume? >> All right. When I say begin, you must perform four tasks. Yep. Just like I'm explaining. Can >> you do me a favor? Sure. >> Take that page piece of paper over there and put it over there and then you tell me what's on there. >> Well, I have >> You're going to remember it and you wanted me to remember it. >> Same for for um >> saying you got to read it and you should know it by heart. Well, I do, but I have to read it off of this to make sure I'm reading it verbatim. That's our That's our training requirement. >> I know, but you're what? You should know it by heart the way it's said on that paper. >> I have to read it off this card. That is our training. >> I have to. Okay. >> The second task is to memorize the position of >> Do you understand? >> No. >> Would you like me to explain again? >> Yeah, it's it's too much. >> Okay. >> It's too much. >> So, back in this position. So you got left first and then right. >> Okay. >> All right. When I say begin, you must perform four tasks. >> The fourth and final task is to open your hands. >> Do this. >> Okay. >> I You're crazier than that. >> So you are, you know, the Pope wouldn't be able to do that. >> Sure. >> No, he wouldn't. I'm telling you. >> So you are refusing to do this one. >> No, but it's kind of ridiculous, ain't it? >> So are you going to do it or you? >> I'm going to have to try. >> That's That's up to you. >> Okay. Okay. Well, go ahead. You may begin. >> Ready? One, two, three, four. One, two, three. One, two, three, four, five. One, two, three. One, two, three, and left. Right. >> Okay. >> Right. >> All right. Are you done? >> Yeah. >> Okay. Sounds good. I got an F on there. >> What was that? >> I got an F on that. >> I I've seen worse, believe it or not. >> All right. And then Brian, appreciate you working with us. The last test we're going to have you do, which is just a confirmation of my observations based on these standardized field sobriety tests is called the PBT or preliminary breath test. Have you ever done one of these? >> Okay. >> Brand new tube unopen. Just opening it now. Essentially, what we'll have you do is place your lips around the tube in a nice tight seal and blow a long steady breath like you're blowing up a balloon until I tell you to stop. Deep breath. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Keep blowing. Keep going. Keep going. Keep going. Oh. All right. We'll try one more time. Nice deep breath. Eric, stand by. All right. Another tube. Sometimes when the first breath it wasn't strong enough or long enough, it uh basically contaminates the sample. Y All right. Nice deep breath for me. Keep blowing. Keep blowing. Keep blowing. Keep going. Keep going. All right. Have to try a little little deeper. And instead of putting your lips right on the tube, um try putting it in farther. Keep blowing. Keep blowing. There you go. Like that. But next time we'll try. >> Keep blowing. Keep blowing. Keep blowing. Keep blowing. >> Do we try a little deeper breath? We'll try one more tube here. >> Sooner we get this over, the sooner we life moves on. And maybe don't blow so hard. Just more constant. Okay, nice deep breath. Keep blowing. Keep blowing. Keep blowing. Keep blowing. Keep going. Keep going. Keep going. Keep going. Okay. Gotcha. Um, any idea what the legal limit is here in Wisconsin? >> Wisconsin. >> Okay. Do you have any guesses at all? >> What? 1.9 or eight. >> Okay. >> Um, yep. It's a 008. And you are below that. Okay. Um, I guess. Do you drink often? >> Uh, no. Not really. >> I got you. You know. >> Okay. >> You know, you know, if I did grip cutting the grass or something, I would let my son or my buddy I got you. >> And he's the one that drank me. You could tell he was. So, somebody's got to be >> re. Yeah. Yeah. I got you. So, you are um quite a bit below the limit. I will say though based on my test, the reason I ask about how much you drink is that a number of my tests indicated that even though you're below the legal limit, the amount you've drank is definitely impairing your ability. >> So, I guess just keep that in mind. Um, like you said, you felt like >> it might be the nor because it makes you relax, but right, I haven't took one in a while, but my neck is really hurting right now. >> Yeah, I understand. We'll get you back to your boat. Um, I'll get this back to you. I would highly suspect that it is the medication you're taking that influenced the test results. But I guess at this point, based on everything, um, you are not being placed under arrest for operating while impaired. Okay. and that was largely due to your cooperation with these tests. Um, I will say, Brian, and we're just telling you this to get you on your way sooner rather than later. We're actually largely out here today because we have been getting a bunch of complaints about Sloan Wakeake issues. So, to be honest with you, we are issuing a citation for the Sloan Wake issue. Um, you passed I think like two or three buoys on darn near full plane and we wouldn't be doing our job if we weren't addressing it. So, not something that'll impact your ability to fish out here. Um, essentially in the next few days either >> learning a little bit about it, too, you know. So, >> but you kind of like followed other people and they >> I know it sounds like there was bad examples, but hopefully you understand when you're ahead of us and you take off. >> I didn't see you. I thought you were just another fisherman, you know. So, >> for sure. So, we'll send that out in the mail to your address in the next few days. I don't know off the top of my head to shoot you perfectly straight. It's a set amount by a panel of judges that we don't have any say in. It's probably a couple hundred. Really? Mhm. >> That's a minimum. We can write it over. There's a max and a minimum. >> Yep. Um you'll have an optional court date, not mandatory in it'll be in Oshkosh, Wnebago County probably sometime in either late May or June. Sure. It's your right. Otherwise, if you >> wait, you know. >> Sure. Otherwise, if you pay for the citation on or before that date listed, it's resolved. But I have to let you know, there will also be instructions on how to handle that. Um, very similar to what I just said. And then before I forget, I will get you my card should you have any other questions so you know who you're chatting with. >> All right. >> Yeah. That being said, do you have any other questions at all for us right away? >> Where's the fish at? >> Yeah. Um, how long are you going to be up here for? >> Well, till Wednesday. We're fishing tomorrow and Tuesday. I got you. Okay. >> And Wednesday we blew. So, >> yeah. Um, hard to say. I mean, we saw a few fish today, but it's pretty slow. In the next week, >> it's going to get better. Could be tomorrow. Could be. >> The lilacs blooming yet? >> Um, no. Not the bush in my yard. >> Yeah. But the the water temperature seems to be rising. So, >> I would agree. It's almost 58. >> And you have a day like today, you know. Mhm. >> Yep. >> All right. Yeah, I know. I It was just, you know, >> Yeah. could have wrecked my whole weekend, you know, with my kid. I don't get out with him much, you know. So, >> I understand. I appreciate my buddy. He he his dad just died last month. This is the first time he got away. He was a caregiver for four or five years, right? >> So, he's living it up. All right. Just lift it up over there. >> Sure. >> Yeah. Just really yourself, if you're going to be the operator, just really watch it. >> Yeah. Here you go. >> Thank you. >> And appreciate you understanding, especially based on our demeanor. We're just out here doing our job. Y >> it's just some of them are kind of ridiculous. I >> sure. Yeah. Basically what these are designed to do is mimic the standing field sobriety which are tension test body coordination test but be able to do it while you're seated. >> Okay. >> Cuz doing it standing as I'm sure you could understand >> that's a lot of memorizing. >> Yeah. And that's but that's what they call divided attention you know similar to what you would do um standing. >> I got ADD. Sure. >> So, >> well, no, I appreciate you working with us to go through them. >> All right. Thanks. I won't happen again. >> Sure. >> Where's Joe's at? >> Uh, Joe's is going to be right up there kind of by that American flag. Uh, the second American flag. Yep. [snorts] All right. We'll get back to you here. >> Okay. Have a nice day. >> Yep. Take your time. Take your time. >> Easy. >> All right. You guys have a good rest of your night. Okay. You too. Have a good one. >> Thank you. >> Take it easy. >> Been pretty bad fishing lately, huh? >> Yeah. >> Haven't seen anyone get it. >> Yeah, we've seen a few fish here or there, but not many. So, hopefully with this weather, it picks up starting tomorrow. >> I caught one like in the first 20 minutes. >> Yeah. Right. It looked good in the first 20 minutes. Right. >> All right. See you later. All right. So, in the end, the operator was issued one citation for being in excess of the speed limit on a vessel. As you saw, showing some signs of impairment, the officer decided not to move forward with an operating while intoxicated charge in this specific case. Now, regarding the speeding citation, the individual did not contest it. He was adjudicated guilty, and he was ordered to pay $232 in cost and fines, which he later paid.
