large volume of boats at the John's Pass Sandbar officers observe an operator of a jet ski quickly accelerate and pass two other jet skis in a slow speed zone today's body can is another great but sad example as to why you shouldn't cooperate with officers in regards to the seated field saret task I'm not too entirely sure about this I know over there is no way I'd assume this is no way coming up to these J Cas yeah the one the the gray one actually hopped in front of him I think he was playing with him oh the way the way he jumped in front of them like that oh gotta easily easily just grabbed okay and that's that's the whole purpose of it sure I was having such a good day today okay if I could have you please sit straight at the front edge of your seat okay thank sir right there and put your arms down at your sides and place your feet all right thank you sir and place your feet shoulder width apart so you are comfortable and stable are you stable yes yes all right and don't move your feet until the tasks are over stay in this position and don't do anything else until I tell you to do so do you understand yes sir right get you just focus on the tip of this pen with your eyes and your eyes only all right you able to do that for me I'm going to check your eyes hold your head still and follow the simus with your eyes only do you understand all right what I'm going to do is going to do a finger to nose task you're going to make a fist with both of your hands and you're going to extend your you're going to extend your index fingers and turn your palm forward you're going to remain in this position while I explain a task okay just like this all down by your sides all right all right just like this you understand sir yes all right when I say begin you're going to tilt your head back to about a 45° angle and you're going to close your eyes okay all right all right Don't Close Your Eyes yet cuz I want you to follow along with me okay when I tell you to you're going to touch the tip of your nose with the tip of your index finger and immediately return it to your side okay this is the tip of your index finger right here very tip this the side this the other side and this is the pad of your finger it's going to be the very tip of your index finger to the very tip of your nose the dime siiz portion of your nose farthest from your face when I say right you must touch your right index finger to your nose when I say left you must touch your your left index finger to your nose do you understand MH do you understand everything that I've explain to you or do you do you understand the first task you must perform are the first task is to count loud from 1 to four while you move your fists in a step- like fashion making contact between your fists at each step okay like this 1 2 3 4 the second task is to memorize the position of your fists after you've counted to four clap your hands three times and return your left return your fist to the memorized position okay so it's going to like this the third task is to move your fist in a step like fashion in reverse order counting out loud from 5 to eight and return your left fist to your chest so you're here five 6 7 eight 1 two 3 four okay that was in the beginning okay okay the fourth task is to open your hands with your palms down and place them in your lap all right go ahead and begin do what you okay so I'm seeing impairment and that's what we're concerned about which you melt amount of alcohol you have in your body um uh based on you know what you've eaten what you haven't eaten um it's what what's affecting your impairment okay as far as the breath test goes we have a breath test for you I can take I can hook you up to the instrument and you can provide a sample of your breath to determine it alcohol content are you willing to do that sir um I don't know just is crazy I don't know I feel like I'm you know being compant and saying okay give me a break but um honestly I do everything right that's not no I understand absolutely stupid turn your head for and blow blow keep blowing keep blowing keep blow no no no normal breath normal breath and blow until I tell you stop said what I've seen heard smelled everything based on the tasks and everything you're you're under the influence of an alcohol or chemical drug to the point where you're not able to safely operate Your Vessel that's what you're arrested for okay u based on your breath sample uh illegal per se it's not 08 but it is above a 05 which is uh it's presumed okay okay so I have to articulate you know the whole uh reason why you were arrested okay 05 and I'm getting sir like I said you're not arrested based on your mouth on your mouth alcohol content I dementia okay I'm 62 all right so if I can't
