No one wants to go to jail, right? But, like I said, it's if I can figure out any way to make sure that doesn't have to happen, I'll facilitate that cuz I'm not trying to take someone to jail in this weather. All right? But, like I said, I can't make any promises and tell you like I'm not going to cuz there's certain charges that I don't have a choice with it, right? >> Okay. >> But, I don't even know if that's the case yet. Jasmine, if you don't listen to what I'm doing, you're going to go to jail. Right here, Jasmine. No. Not around this way. I haven't even verified how bad your license is yet, but I'm going to go out on a limb and say you probably already know that it's a felony, which is why you're acting like this. So, now we're going to have a seat in the back of this cruiser while I confirm everything. No. You can put your shoes on. Cuz you're not listening. Go on the other side. >> Come on this side, y'all. >> Good job. >> The stop was constitutionally valid from the first second under Delaware versus Prouse, 440 US 6 48 1979. Reasonable suspicion of a traffic violation is sufficient to initiate a stop. Tinted windows preventing occupant identification clear that bar without question. When the driver voluntarily disclosed her license was suspended and possibly at habitual traffic offender level, the legal weight of this stop changed immediately. Florida statute section 322 subsection 34 paragraph five classifies operating as a habitual traffic offender as a third-degree felony carrying up to five years in prison. The decision to place her in handcuffs while running her license is grounded in Terry versus Ohio 392 US 1 1968. Terry permits investigatory restraint when officers can articulate specific facts supporting concern for safety or flight risk. Both were present and on camera. Her refusal to comply with that detention and her repeated failure to remain in place after being seated triggered Florida statute section 843 subsection 02 obstruction without violence a first-degree misdemeanor. Each refusal was a separate documentable act. The charges were accumulating in real time. Her attempt to physically break from custody escalated the situation to Florida statute section 944 subsection 40 escape a second-degree felony. The physical resistance that followed brought Florida statute section 843 subsection 01 resisting with violence a third-degree felony into the charging picture. The force used to bring her to the ground falls under Graham versus Connor 490U S386 1989. Courts evaluate force against three factors the severity of the underlying offense whether the subject posed an immediate threat and whether she was actively resisting or fleeing. On this date, all three factors supported what was applied. One thing worth clarifying is the Miranda question. Under Berkemer versus McCarty, 468 US 420, 1984, roadside questioning during a traffic stop does not constitute custodial interrogation. The driver's admission about her license was legally voluntary. No Miranda warning was required at that stage, and none was owed. The officer's handling of the children is where he gets clear credit. Florida statute section 39, subsection 401, requires placement of minors with a verified adult or Department of Children and Families Contact. When a parent is arrested, he requested identification from every adult who arrived. He followed that statute precisely. The officer receives a B minus. His patience was documented and genuine. He explained his authority clearly, offered alternatives where the law allowed, and managed child welfare correctly. The deduction is tactical. He issued the same warnings too many times without enforcement, which communicated to the driver that his commands were negotiable. They were not, and that confusion cost everyone. The driver receives a D plus. She was honest at the start, and the officer credited her for it. But from the moment the handcuff detention was announced, every decision she made added a charge. Four counts, 120 days in jail. The D plus is for the honest start. The rest was self-inflicted. Before the grades disappear from screen, this footage teaches five things that anyone who drives in this country should understand. These are not opinions. They come directly out of what happened on camera and how Florida courts have treated it. First, voluntary disclosure is a double-edged tool. Admitting your license is suspended is honest, and the officer credited her for it. But that admission also became the legal foundation for a felony stop. Know what you are disclosing and what it triggers before you say it out loud. Second, compliance during detention is not the same as waving your rights. You can comply with a lawful handcuff order and challenge the arrest in court the next day. Refusing on scene does not protect you. It converts a misdemeanor stop into a felony docket, which is exactly what happened here. Third, a child in your arms is not a legal shield, and treating one that way creates new criminal exposure under Florida statute section 827 subsection 03. Courts treat the interposition of a minor between a subject and law enforcement as endangerment, not as a reason to back off. Fourth, every refusal after formal detention is a separate chargeable act under Florida statute section 843 subsection 02. You do not have to swing at anyone. Simply refusing to sit down repeatedly after being ordered to is enough. The meter starts running at the first refusal, not the first punch. Fifth, body cameras record everything. When the driver said it is all on body camera, she was right. But the footage documented 10 minutes of non-compliance, not misconduct. If you are on camera, assume it will be played in court because in this case it was, and it contributed directly to the sentence. The outcome was not written by the law alone. It was shaped choice by choice after the license question was answered. The law gave this officer authority to arrest. He did not rush to use it. The footage makes that distinction visible in a way no court transcript can.
