No. Yeah. Now you're going to jail. >> What? >> Get out of the car. >> Why? For what? For what? >> Wait, what? >> He's trying to give you an opportunity. >> On February 23rd, 2026, in Charlotte County, Florida, a bar disturbance call became a textbook case study in how a single decision can flip a preventable situation into a criminal conviction. Under Florida statutes section 3161 193, a person commits driving under the influence if they are driving or in actual physical control of a vehicle while their normal faculties are impaired by alcohol. >> Hello. >> How are you? >> Good. How are you? >> Two females are in this here. We want her at least to leave the premises. Do you want them trespassed or no? >> Um, >> I don't I don't think trespass is necessary. She's just intoxicated and >> Okay. Did they >> first time she just belligerent? >> Okay. >> Running her mouth saying everything and just went and sat in the car. >> She just called in and played number and stuff. >> Okay. I'll just have them log it just in case. Oh, >> if they would stop talking. Um, okay. I'll have a chat with them real quick. Nothing physical happened. Just all verbal swing. >> No, she was >> We had to hold back a couple times to swing at him and stuff like that. >> Yeah, she wishing she could >> Hey, just just wait right there. >> Wait there. >> Um, I mean, she may end up getting arrested really, so I'll take care of y'all. You need to stay in your car. Get in your car. >> Get in your car. Close the door. Roll your window down. >> I don't have a Sir, I don't have a my car keys. >> Where are your car keys? >> I don't know. >> Okay. Have you been drinking tonight? >> Yeah. Damn. Well, like one glass and suddenly >> I don't know where. >> You know, you can't find your keys. Okay, sit tight for me. Just wait. 74. >> Can you run my arm? >> Here. >> What's your name? Arlene. Are you Arlene? >> No. Emily. >> You're Emily? >> Yes, sir. >> Okay. What's going on? >> I don't know. >> You don't know? Okay. >> Sir, I don't know. >> Okay. Who's this here? >> Laying down, >> girl. >> Hello. The officer is talking to you. Tell them who you are. >> Tell them who you are. >> What's going on? >> Tell him who you are. >> Your name is John. >> Tell them who you are. It's okay, girl. You're good. >> So, what's what what's going on here with you [music] guys fighting with the bar staff. >> It's okay. >> Oh, absolutely. No, I've just been sleeping. >> That's a lie. So, let's be honest, >> bro. All right. Listen, here's the thing. We came here to We've been here a million times. Okay. I'm a little bit intoxicated. So is she. Okay. >> So is everybody else who comes here. Okay. >> Okay. >> We have a slight problem with, you know, some sort of altercation with owner slash girl who lives here. Right. This is my person who's passed away's [music] mother. >> I'm the one here. Okay. >> Are you okay, girl? >> You know, I stay here. >> At the end of the day, >> everybody gets up here and there and that [ __ ] is just super abnormal. I don't think I'm 23 years old. She's like 44. I don't think that for us, you know, to be drinking is a problem. Um, >> he's sat here and >> so it it's not a problem. It becomes a problem if you start fighting with people. It becomes a problem if you try and drive when you're intoxicated. >> Oh, we don't Who the is Why is this problem happening? >> Because you're drunk and you won't listen to them telling you to leave. >> You want to talk to them? >> I did just talk to them. >> Okay. So, they said I was drunk and I'm the problem. Have you wanted to them about have you talked to me about how they might be a problem? >> Okay. Why don't you step out of the car? Come back here. >> You wait in here. >> Come back here. We're going to my car. >> Going to be signal one. >> This young lady and her friend are extremely intoxicated. I wanted to fight with the bario. >> She got into her car, was trying to leave, >> but cannot find her keys. >> So, that is where we are going with this. >> They said that they were telling us to leave. >> Shush. Sh. I'm not talking. >> Why are you shushing? >> Because I'm talking to him and you're interrupting me. Stop. >> It's a good question. They said they tried to have them leave and get them out >> and they continued to argue with them and say no. They don't want him trespass. They just want him to leave. But clearly, >> yeah, we're his friend passenger seat. >> Well, we'll get the out of here. That's fine. But Jesus Christ. >> Yeah. >> So, this has been her attitude the whole time. >> My attitude and I think we're >> going to go that route. have anything to do with you, sir. I've had problems with these people before listen to you for a second. >> The problem we have now is that you're drunk behind the wheel of a vehicle. >> I haven't even kicked out of the car. Nothing like that. I haven't driven nothing, sir. >> That's You're sitting in the driver's seat in the car. >> Intoxicating driving. There's nothing. You >> told me you were into Sir, >> you pulled me over in a drivethru. I was not driving behind the wheel. I have not driven, sir. >> Ma'am, >> are you willing to perform feel soiety? >> If you are joking, you pull you perform half that on half these people. They're all intoxic. Yes or no question, man. >> I'm not driving my car, bro. >> You have to make a determination based on your current state. >> Okay. So then what? >> Who drives my car? What happens to my car? I understand I can't drive my own car. No, that is not getting told. >> I'm sorry. Sorry. >> What is your answer? Yes or no? >> Are you foreigner standard? >> You don't talk to I'm sorry. >> He's the one that's working here. So, >> y'all don't understand. >> No, you don't understand. >> Okay. How about you drunk? >> No, I'm not too drunk, sir. I've had I know that. >> Then how come you can't How come you can't follow basic in >> I told you to wait in your vehicle. You open your door. You tried to walk out. >> It's just the fact >> I tell you to let me talk to him. You interrupt me. Like >> it's a yes or no question. Will you perform SF? >> Sure. >> You will. Fantast. Yes. >> Perfect. >> Yes, I will. >> Wait right here. >> My bad. >> You're going to have to listen to his instruction cuz he's going to be the one giving you this. >> Understand? Like I know I'm intoxicating you. That's not what the we were doing here. I wasn't even trying to drive. He pulls me over. I'm not even trying to drive. When he pulls me over, I was sitting on the side road. I wasn't even trying to drive. >> I'm 23 years old, bro. I'm trying to get my kid back. I'm not ridiculous, dude. I'm just She's 44 years old. Like, we're just trying to have a good time. Her son just died. Like, I just had a case. I have a case open with you, mother. Bro, >> for what? >> For domestic violence, sir. I asked somebody who's out no bond. Well, I'm trying to fight against. >> So, you got arrested or >> his mother like >> Did you get arrested or did >> No, I've never been arrested in my life. >> Okay. >> You said you had a case. I don't know if you meant that meant you were not. He got arrested for sexual battery like and I mean on domestic violence and I'm trying to fight the case. [music] >> I just came here. This is my first night out with like my friend's mom. >> Okay. Can you hear my instructions here? Or do we need to go somewhere where it's not as loud? >> Yeah, >> you can hear. Okay. >> Are you sick or injured? >> I'm going to talk to your passenger. >> Hello, Corporal Stangle with the sheriff's office. How are you? >> Uh, just trying to >> Yeah. Okay. So, what happened at Gators? >> I don't know. >> That they wanted you guys kicked out. >> Yeah. I'm just sitting there and I got uh my friends coming to pick me up. >> Okay. Were you arguing with the the female that was in the driver's seat? >> Absolutely not. >> So, what what happened inside that they called us? >> I don't know. >> You have no idea? No, I I >> literally don't know. >> Okay. So, okay. Well, that's fine. I mean, you're a little intoxicated, but you're not driving, so that's fine. You seem to be drunk. >> I'm not I'm not I'm not going to do that. >> Okay. >> You know, >> were you guys getting ready to leave? Um, so they were and I was like, I'm rock and I don't I don't drink and drive. >> That's good. >> I mean, I'm sorry. I just don't >> Who is the female you were here with? >> Uh, Emily. >> Do you see the tip of my pen here? >> Yes, sir. >> Can you focus on it with your eyes? >> Yeah. >> Okay. With your eyes, and only your eyes, I want you to follow the tip of this pen as it moves back and forth across your field of vision. Do you understand the instructions I gir? >> Okay. Do not move your head to [music] follow the path. >> Okay. >> Okay. [music] Now it's done. [music] >> Last one. It's the same thing. Follow the tip of this pen with only your eyes. Yes, sir. One more time. >> Okay, you can relax. Shake it out. All right, >> sir. What am I supposed to do here? >> Just wait. >> Everything's okay. What am I? Is this going to be on my driving record? >> What do you mean? >> Is this going to be on my driving record? >> This test? >> No. >> So, this is just on a perfect driving record. I don't want to. >> Here's the deal. Right. >> This test shows me whether or not you are good to drive. Right. Because clearly you've had some drinks. Yes, sir. >> Right. You even admitted it. >> Yes, sir. >> I want to make sure you are okay to drive before I tell you get your butt out of here. miss. >> Okay. You doing these exercises helps me feel comfortable letting you do that because the way you're acting over here when we first show when I first showed up, >> that's not normal. >> You got to think about it though. You got to really invest in why though. You can't just assume it's me. You got to really invest in these people here. >> Okay. Well, it it is you. It is your behavior that >> partly. Yes. >> It is your behavior that has me concerned, right? >> That is why we're here. So, The next one. >> Okay, good. >> Next thing we're going to do right here, you can stand right there. >> Just on that crack. You can face me. I want to just go over there. All right. So, what you're going to do, I want you to put your left foot down with your right foot behind it. [music] Heel to toe. >> Okay. Take your right foot. That's going to be this one. >> Yeah. >> Imagine a line coming directly No, no, no. Just Just wait. [music] I'm trying. I'm explaining. >> Listen to what I'm Okay. >> Your right leg. Imagine a straight line coming directly out from your front toe. Okay. Can you imagine a line? >> Yes or no? >> Yes. >> Okay. Take your left foot. Put it directly in front of your right foot. Heel to toe. >> Other way around. Okay, >> I want you to put your hands at your sides >> and stay like that until I tell you to begin. Okay, this test is called the walk and turn. I'm sorry. This exercise is called the walk and turn. All right, with your hands at your sides, toe to heel. I want you to look at your front toe and take nine heel toe steps down that imaginary line. Okay, I'm going to move over here. When you reach the ninth step, I want you to keep that front foot planted. Take a series of small steps to turn yourself around. Take nine heel to toe steps back down the line. >> Okay. People can >> I am. Um >> I don't think you're right. All right. Ready? >> So, hold on. While you do this, I want you to make sure you're heel to toe. I want you to keep your hands at your sides, and I want you to count out loud. 1 2 3 4 and so on. until you reach the end. Okay. You may begin whenever you feel comfortable. >> Do you have any questions regarding the instructions? No. Okay. >> It's pretty basic. >> One I don't know. Can I redo that? >> No, just keep going. >> I don't feel like that was good enough. >> Okay, whatever. >> Just let me know when you're done. Sorry. That's okay. >> All right. Um, >> that's so wild, though. >> What's >> That's not what we're doing. That's >> She's done with the exercise. Yeah, she's just practicing. >> Do you think you could do it? >> Right next to me. >> Right now, wait. >> 5 6 7 8 9 steps. >> Oh my god, you're >> one two three four five six seven eight. >> Are you ready for the next one? >> So the next one is called the one leg stand. So again, heel to heel to heel, toe to toe with our hands at our sides. >> I did. >> Um, so just keep your >> seat. Is she sleeping? >> It's mine. Jesus. >> Okay. Put your arms down at your sides like this. Okay. >> So stay in this position until I tell you to scar. >> It's okay. >> Do it on the other side of the car. >> What do you mean? >> Look at all these people. Like, are you kidding? Do you know how embarrassing that is? >> So, here we're going to start like this. They're >> looking at me. >> Okay, they're actually watching the man mostly. Um, >> stay in this position until I tell you to start. Okay, you can choose your left or your right foot. Whichever one is more comfortable for you. You will raise it approximately 6 in off of the ground. You will keep that foot level with the ground. Staring at that front toe with your hands at your sides. You will count out loud 100 1,002 1003 and so on until I tell you to stop. >> Okay. >> Do you understand? >> Yes, sir. >> Okay. So, eyes on the toe, counting out loud, arms at the side, keep your legs straight. You can choose whichever leg you want and you can start. Give me one second. I don't know why that's not in my widgets, but it's not. Okay. You can start whenever you would like. Ready? >> Whenever you would like. >> Does it matter which foot? >> No, it's whichever one you want. >> Whichever one. >> Wait, wait, wait. Don't go yet. >> Whichever one you decide. >> Yeah. Okay. I'm ready to go this way. >> Okay. Go for it. All right. Ready? Oh my god. Wait. [music] >> Pause. Wait. [music] Bro, I can't even do this. Sober. [music] >> Okay, you can stop. >> The phrase actual physical control is where this case gets legally interesting. Florida courts in state versus cliff house 771. Though 2nd 16, Florida 4th District Court of Appeal 2000 established that physical control requires both the presence of the driver in the vehicle and the realistic ability to operate it. When the officer discovered that the keys were not in the vehicle, but in the bar's bathroom, that missing element destroyed the physical control element required for a lawful DUI arrest at that stage of the encounter. The officer's decision not to arrest at that point was not leniency. It was legal precision. Without the keys, probable cause for DUI could not survive a motion to suppress under Florida Rule of Criminal Procedure 3190. For field sobriety testing, the National Highway Traffic Safety Administration publishes a standardized protocol under DOTHS 811624. Three tests are validated. The horizontal gaze nestagmus, the walk and turn, and the one leg stand. The walk and turn and one leg stand are divided attention tests. They measure the subject's ability to follow instructions, maintain balance, and count simultaneously all indicators of central nervous system impairment from alcohol. The subject agreed to perform all three exercises voluntarily. That consent is legally significant. Under Florida case law established in Bernett versus state 980. Second one, Florida 4th DCA 2008. A subject's voluntary participation in SFST produces admissible evidence of impairment without triggering fourth amendment concerns. Performance on the walk and turn showed multiple NHTSA clues. Stepping off the line, failure to maintain heelto toe contact and loss of balance during the turn phase. Two or more clues on the walk and turn carries an 88% accuracy rate in predicting blood alcohol content above 0.08 08. Per NHTSA research, one leg stand performance showed sustained imbalance and inability to count correctly while maintaining the raised foot position. The subject herself acknowledged difficulty which courts treat not as exculpatory but as further indication of impaired coordination. The finger-to-nose test administered here is not part of the NHTS, a validated battery. It is a non-standardized supplemental exercise. Florida courts will consider it alongside other observations, but its weight is lower than the three standardized tests and defense council will challenge it accordingly. After the keys were returned from the bar and the subject was explicitly warned twice that driving the vehicle would result in immediate arrest, the subject moved the vehicle under Florida statute section 316 193. That movement, however brief, established actual physical control beyond any reasonable legal dispute. The quantum of vehicular movement is not a statutory element. Florida law does not require the subject to travel a specific distance. In Filman versus state 97 926, Florida Supreme Court 1 957, the court confirmed that any movement of a vehicle by an impaired person satisfies the driving element of the statute. At the moment the vehicle moved, the officer had one, observed signs of impairment throughout the encounter. Two, received the subject's admission of alcohol consumption. Three, documented multiple SFST clues across three separate exercises. And four, the subject was in the driver's seat with the keys in the ignition. Probable cause was airtight. >> We got one more exercise. >> When you're done with that one, just hold off on doing anything else. >> Okay. Copy. Yeah, sounds good. >> Bro, wait. Don't make a phone call. >> It's not related to you. >> Phone call, please. He >> He's a boss, so he's got to he's got to deal with all of us. [music] >> Okay, so this last one is called the finger to nose. All right, it's gonna be a little weird. You're going to stand with your feet together, hands at your sides right like this. And then we're going to put them out like this, palms facing up. You're going to when I tell you to start, you'll tilt your head back and close your eyes. And then I will tell you left or right hand, you will take your pointer finger of that hand, touch the tip of your nose, and bring it back down without being told to do so. Do you understand? Okay. So, tilt tilt your head back for me. Close your eyes. Left. Right. [music] [singing] >> Left. >> Right. [music] >> Right. >> Left. [singing] >> Okay, you can relax. [music] >> Are these shoes so ugly? >> Yeah. >> What's up? Are these shoes ugly? >> Your shoes? >> I don't know. I'm not a shoe guy. >> Really? >> Look at what I got on. >> Yeah, but I >> Mine look like yours. >> These look like new shoes. >> No, I don't think so. >> Who told you that? >> My dad. >> Your dad did? >> Yeah. >> I know you got good shoes. You have good shoes? Yeah, I got shoes. >> They're comfortable. I don't know about >> That's what's so upset about this is I'm in the progress. I'm trying to figure out like I'm trying to I I have a domestic violence like sexual assault case open right now with Charlotte County. >> My goal in life is to kind of be there for people who have been through it. You know what I mean? >> Victim advocate. >> This is my a victim advocate. This is my first time out >> and I'm already getting like you know what I mean? >> Well, I can I can tell you this. it it's probably not a good idea to be fighting with bartenders and stuff. >> Yeah. When the bartender is going to be a grown man talking to a little girl, you're not going to see that. You're going to see the call. You're not going to see what happened. >> Well, they told you to leave and they have the right to do so. So, >> and I understand that. I do. They do have the right to tell me to leave. You were also sorry to say that, but you don't put your hands on a on a child, a little girl. So, I stood up for myself and here I am. >> All righty. [music] >> All right, my friend. Hop on out for me. Or you can actually stay there if you want to stay warm. Um, so here's the deal, right? You you are very you are unbelievably lucky right now, okay? Based on how you performed in those exercises, if you had your keys in that car, you would be going to jail tonight. The manager at the bar here found your keys in the bathroom. Okay? So, you did not have physical control of the vehicle, so you will not be going to jail for DUI. Having said that, if you get in that car and you drive that car, you will go straight to jail. >> I'm not going to drive it. I'm not going to drive You and your friend need to find a way home because sleeping in your car in the parking lot of Gators is not the way to go. >> Come back for your car in the morning when you're sober or have a friend come and get it when they're sober. >> But do not drive drunk. >> Do you have your phone on you or is your phone? >> I think it's in my car. [music] >> Okay, >> let's go. >> Yeah, you can search my car. Whatever you want to do. >> We're not even going to go there. We're >> No, you can't. I mean, I just bought it two days ago, so >> No, I >> Oh my god. >> Your keys are on the hood. Grab the keys. [music] >> You did. All right. Go to your car. Grab your phone. Call an Uber. [music] >> If you drive that car, you will go to jail. If she drives that car, she'll go to jail. I'm >> sorry. I'm not >> Can I ask you a question while I have you here? I know it's so stupid. >> Sure. >> What do I do with that? What do you mean? >> Can I put I heard that it's illegal to put a plate on it. Is that true? >> A plate? You mean you mean a cover? >> You have to cover it in a plate. >> Yeah, you can't. I have it for 30 days. That >> Yeah, you can't you can't cover it. If you If you obstruct any bit of this or this, you will get pulled over. You can go to jail. So after the 2026 is over, that's when I can go get a car. >> If you No, if you just go to If you just go to the DMV, they will give you a license. >> You have to have the paperwork though that says that it's >> They told me it's like 30 bucks. >> Yeah, you got to pay for it. >> Well, yeah. Also 30 days. >> It doesn't take a full 30 days. >> So, go find your phone. Call an Uber. Do not drive your car. I'm I'm leaving. Okay. Do I have like any information? I can get a hold of you guys. >> 911. >> I give a review. >> We don't need reviews. >> Go in your car. Get home safe. You don't want to get in an accident. Okay. Go inside. Get your phone. Don't go back in there. If you go back in there and they call us back, you'll get trespassing. And then if you go back in there again, you go to jail. Yes, sir. >> So go in there. Call call a ride. >> Uh just go in, son. Let them the manager, whoever knows. Is >> there anything else that you guys need from me? >> Nope. You are free to go, my friend. >> Well, he told me I need to get it home. So, >> you can come get it tomorrow. >> I'm probably going to have somebody come and pick us up. >> Go get your phone and start making calls. >> Yes, sir. What's your name? >> Corporal does not want any contact. My problem, >> guys. You guys are men. You've never been a woman. And sometimes you're in a relationship with a a man who is toxic. And this is the type of is going to make a [ __ ] be at home. You guys don't know what the doing. >> Then call someone else to get you home. I want to hear you. You don't even know what the you're doing to civilians. >> Trying to help you cuz the alternative is you going to jail. Roll the window down. >> What >> is someone coming you? >> Is someone coming to get you? Cuz we can't wait here all night. >> You want >> I just asked you, >> bro. I already answered whoever the I don't want to answer to you. >> It's a yes or no. Emily, >> you don't understand. No. Yes. No. Get the away from my car. >> So, how are you getting out of here? >> Go the way. >> How are you getting out of here? >> Go away. I will call a million other people besides your Go away. >> Are you going to call someone to come pick >> He's already on the way. Go away. >> He's already on the way. That's what I was asking. >> Out of here. Yes. Go away from my car. >> Okay. >> Get the away from my car. Thank you. You Goodbye. She said no, but then she said yes, she's on the way. So, >> somebody come or not? >> I don't know. But I think that um it would behoove both of their safety potentially to not have access to this vehicle. You literally think it's funny. Like you find joy in that, bro. >> You find joy in that. >> Hey, no. Yeah. Now you're going to jail. >> What? >> Get out of the car. >> Why? For what? For what? >> Wait. What? >> We tried to give you an opportunity and then you did something stupid. Like, you just drove the car. We told you not to drive. >> Wait, wait, wait, wait, wait, wait, wait. We're not allowed to drive. Wait, hold on. We literally told you you weren't going to go to jail because the keys weren't in there or we allowed you to sit in the vehicle. >> So you came in Hold on. >> It doesn't matter. >> Christ, what do you mean it doesn't matter? >> You're going to jail for DUI. >> What do you mean? It's my What do you mean? I haven't even sir. >> You were just leaving. We were standing here. >> Well, we were waiting for you to get picked up so you didn't go to jail. >> Bro, wait. What are you doing? >> Taking you to jail. >> No. Why? >> Because you just drove your car. >> No, sir. That's not how it goes. >> That is how it goes, actually. >> You're given ample opportunity. >> Seriously, please. God. Like, Jesus Christ. >> The car. >> Do you have anything in your pocket? >> No, sir. Of course not. >> No drugs? >> No, sir. >> Even if you bring weed in? >> No. Go ahead. I've never had a Go ahead. >> Nothing in here? >> Yes. No, sir. I've never had anything. >> Sir, this is not Sir, I have a cat. >> Okay, >> then maybe you should make better life decisions. >> Please, I need help here. I don't want to be >> We tried to offer you. No, I >> We tried to offer you help. >> Please let me talk to you. >> Get in the car. I'm done talking to you. >> This is ridiculous. >> Please, bro. Please, let me talk to you. >> No, you don't understand. You do not understand the severity between the problem and that child. You do not answer, sir. You do not understand it, bro. >> Hello. >> I don't have a hungry. >> Who are you? >> Uh, I'm Emily's husband. >> Okay. Emily's going to jail. So, >> in the back of that car, >> she going to jail cuz we said she could sit in the car. However, she decided she was going to drive. So >> where did she drive to? >> From there to there. >> You told her a bajillion times you can sit in the car. >> Please let me take them. >> We've already given her so much leash. >> Please let me take >> It's too late. It's on body cam and the whole night. >> It's fine. Please. >> Negative. You can take this young lady home. She needs a ride home. >> I'm not going to jail, right? No, Jennifer, you just need to go home. >> May I talk to my man talking to her, please? >> Probably not, cuz she's me. I just I got off work, man. So, if you could just do that, man, please. >> I'm going to guarantee it's probably not going to go well, but [snorts] this was going to be her ride. You just want to roll down the back window. They want to yell at each other for a second. Sure. >> All right. You can walk up here. >> Are we blocking you guys? >> Yeah, that's all right. Whatever it takes. >> It's all right, mama. Just relax, baby. You just got to relax. >> I know. They won't let you do anything. >> It's okay. >> Babe, stop. You need to stop that. That's going to give you more trouble. Nova is okay. >> Okay, I will. Look at >> You just need to relax. If you act out, if you act out, I swear to God, they're going to add more charges on you. It's not cool. This ain't cool. I'm your man. You need to relax right now. You're acting out. I could have been taking you on. You're acting out now. I love you. Just relax. >> I know. Hey, >> what about Nova? >> A child. >> He's not. >> That's not what you need to >> smirk on your face. Can you look up >> what it is? >> Now for the grades. The officer receives a B+. He demonstrated accurate application of the physical control doctrine at a critical decision point. Issued explicit and repeated warnings before the arrest became necessary and maintained composure under sustained verbal provocation throughout a 30-minute encounter. The deduction from a full A reflects two concerns. The inclusion of the non-standardized finger-to-nose test may complicate the evidentiary record in a contested hearing, and the ambient noise conditions during SFST instruction could give defense council an argument that the tests were not administered in full compliance with NHTSA protocol. The subject receives a C. She did not physically resist. She admitted to drinking voluntarily, and she agreed to SFST, all of which demonstrate baseline cooperation during the investigative phase. Her husband arrived and a clear path out of the situation existed. However, the subject drove the vehicle after receiving explicit warnings. That single act converted a situation she was about to walk away from into a DUI conviction carrying 12 months of probation, 50 hours of community service, mandatory DUI classes, and a 10-day vehicle empoundment under Florida statutes section 316 193 subsection 2. Five lessons emerge from this encounter that are worth carrying forward. Every case and every encounter with law enforcement teaches something if you are paying attention. Lesson one, the absence of your keys from your vehicle is a meaningful legal distinction under Florida law. If you are intoxicated and seated in a vehicle, the physical location of your keys relative to the ignition directly affects whether an officer can establish actual physical control under Florida statutes section 316 193. Lesson two. When an officer tells you that a specific action will result in your arrest, that warning carries legal weight. It documents the officer's knowledge, the subject's awareness, and the subsequent valitional decision, all of which become part of the probable cause analysis and will appear on the body camera record. Lesson three, voluntary consent to field sobriety testing produces fully admissible evidence. You are not legally required to perform SFST in Florida. Once you agree, however, your performance becomes part of the probable cause record, and Florida courts have upheld DUI convictions based substantially on SFST clue documentation. Lesson four, personal circumstances, a child, an open legal case, emotional distress, have no bearing on the elements of a DUI charge under Florida statutes. Section 316, 193. Officers are not authorized to weigh those factors against the statutory elements they are obligated to enforce. Lesson five. The legal system provides remedies for situations where you believe law enforcement has acted improperly, including motions to suppress under Florida rule of criminal procedure 3190 and civil claims under 42 USC section 1983. The street is not the venue for those remedies, and attempting to resolve a legal dispute through confrontation or non-compliance adds charges, not solutions.
