You have the right to remain silent. >> Right now, you're being placed under arrest for driving under the influence. >> Upon December 4th, 2025, a 21-year-old named Remy was arrested for driving under the influence after crashing into a parked vehicle at an estimated 45 mph in what started as a routine property damage call. Before we get to the grades, three legal issues in this footage are worth examining carefully because each one carries real consequences that most people and some officers get wrong. >> No. No. Somebody just stole my trailer and I was like, I need to put up a security camera. It was like a I didn't care much about it. Like the officer was so sweet. He's like, "Send me pictures. I'll find it." I'm like, "It was a $300 trailer. I just want the tag reported." But it's principal for me. Like >> Like I'm trying to whip everyone into shape here. >> Sign to deter in case. >> Yeah, that's right. >> I'm looking for cameras. I'm like, I don't see anything. >> No. No. >> You got me. >> No. I'm going to see that little thing right there. Going to try to tie it into that little old light. So, did you were you inside? You heard the crash. What happened? >> So, I was I was right in the back of this garage with the door open messaging my boss and I heard it. If you're familiar with this area, there's a lot of crashes. So, I went in instant like, "Are my kids okay? How I I heard it. I knew it was bad." So, I ran out the side fence. The car was smoking. I immediately went to go check on the nurse and I just literally went to go check on the patient. I was like, "There isn't anybody there." And I I walked around to see like, did they leave? Like I was a hit and run. I didn't even realize it was my brother's girlfriend's car. Like I was just in shock. >> This driver is a brother's girlfriend. >> Yes. >> I mean, you heard about So that's >> what >> Yeah. I didn't even know until like she You know, I was, you know, I'm in here. >> Yeah. She comes here a lot. You know, it's my brother's girlfriend. So >> I just didn't know if she was driving. >> I know the car. No. No. Yeah. I know the car. >> But uh Say it again. Where is she now? >> She's inside, I think. I don't Are you guys still in there? >> I think they're here. >> Do you mind having her come out so we can talk to her? >> Huh? >> We just got to do the crash. >> I don't know. >> You're You were the driver. >> What happened? >> I genuinely was just pulling in too fast. I didn't realize how fast I was pulling in. and I accidentally hit her car. I come here I come here all the time. Like I'm used to it. I just genuinely didn't realize how fast I was now. >> Gotcha. Okay. Do you have your like the driver's license, registration, and stuff like that? >> I have my I have my license. >> Your car? >> Yeah. I mean I have a co-signer, my grandpa. His name is first on the car. I have my registration in the car. >> Are you also a registered owner? >> I believe so. >> Okay. Yes. >> Name's on the registration. >> Yeah. Do you want me to grab him for you? >> You said you have the insurance in the car. >> It's in the car. Can you grab it for Yeah. Where are you coming from? Um, I'm just coming from my friend Victoria's house on Gulf of Bay. Oh, >> but where were you? But like here >> like Yeah, like right here. >> You're coming in here? >> Yeah, I pulled pulled in on that little like uh decline right there. Back there. >> Okay. >> And pulled in through. >> Pulled in through how? >> Like I came in this way and pulled right in and clipped her backside. Unfortunately, >> that's all right. Let me see if uh she has the insurance for that that car somewhere. You got the on the plate. Perfect. >> Were you hurt at all? >> I'm sorry. >> Were you hurt at all? >> No. Like I hit my head a little bit, but I think I'm okay. >> Okay, I got you. I'm going to stick this here for right now. >> Yeah, no worries. Whatever you need to do. >> All right. Was nobody else was in the car? About how fast do you think you're going? >> Probably like 45. >> Okay. And you drove kind of in that little divot there and then through the grass there on this Iwalk here. >> You see where that divot like starts? >> Yep. >> It goes in and then I drove past this pole like right here. >> Pass the pole on which side? >> The right side. >> Okay. So through here and then that >> is it >> I come I I come here all the time. I just didn't realize how fast I was. >> Gotcha. Okay. You just came in too high. >> Yeah. >> Okay. I got you. >> Um >> I literally feel so bad. >> All right. So, um >> cuz I got to do my my job and just because of the circumstances here, I got to read you something. It's just so that you understand what's going on and uh can make an informed decision. But it's essentially your rights. It doesn't mean that you're going to jail or anything like that. Uh, it just means that uh I want to talk to you a little more specifically. Okay. >> Yeah. No, you have you have the right to remain silent. >> Do you understand each of these rights as I've explained to you? Having these rights in mind, do you wish to talk with me now? >> No. Okay. >> I'm sorry. I'm just cold. >> You're cold. Do you want a jacket? >> Yeah. Can I have your sweater? I'm just calling here. >> Will you do me a favor? You hang out back in the house or a little further away? >> Yeah. >> Thank you. Okay. So, I understand you don't want to talk to me. Is that because you were cold or you just still want to talk in general? >> I mean, we can talk if you want to. >> Okay. So, tell me. I just want to kind of get a clearer picture here. >> Romy, do you mind walking it with me? >> Okay, come on. >> Yeah. >> And then just tell me kind of step by step what happened. >> Like I said, I come here all the time. This is my ex-boyfriend. We just broke up recently. But >> your ex-boyfriend? Yes. But I still I still see him all the time. I still come here all the time. We're on very good terms. It's not like that. You know what I mean? >> All right. So, a friend that happens to be an ex, >> right? So, I came here to see him to pick him up to bring him to the lighthouse so we could go spend the night there. And I come in and I pull in and like I said, >> coming from here, right? I pull in here and like I said, I genuinely did not realize how fast I was going. That's I I take complete accountability. I understand it was my fault. And I clipped the side of her car >> and then I pulled forward. I pulled all the way forward and then I backed up >> and then that's >> what the going on. And then all the cops showed up and it was like, oh, you know what I mean? >> And you weren't hurt. Was anybody else in the car? >> No. Like I genu I hit my head a little bit, but I I'm >> Were you wearing your seat belt? >> Yes. >> Where did you hit your head? >> Right here. >> On the where in the car? >> I don't know. >> Okay. Was it like a window? >> I know it's right here. >> It was either it was it was like steering wheel windshield vicinity. You know what I'm saying? Gotcha. >> But I genuinely just came in too hot and didn't know how to control it and I accidentally clipped her car. You know what I'm saying? >> That makes sense. Um, how much have you had to drink today? >> A little bit, but not very much. >> What do you mean by that? >> Maybe like two shots. >> Two shots of what? >> Tequila. >> Okay. When was that? >> Um, about 3:00. >> 3:00 today. >> Yes. Wow. >> Yes. >> Okay. Okay. All right. Um, the two shots of tequila, did you have anything else? >> No. >> Were they just straight shots or were you drinking it in a mixed drink or >> No, it was straight shots. I was chasing it, but I stayed for a while before I left. You know what I mean? >> I got you. So, you're not impaired or anything? >> No. Like, I'm fine. And I plan on staying here anyways. >> Okay. You were taking him back to your house. >> Well, if I was so, he was going to drive. >> Okay. I got you. >> I I genuinely I genuinely just came in too hot. You know what I'm saying? >> Okay. What happened after the crash? >> I just got out of the car and started lowkey freaking out and I was like, I don't know what the to do. What should we do? And he was like, the cops are on the way. And I was like, "Okay, >> okay." >> And then anything else >> now? We're here. Yeah. >> Okay. Inside. Uh, where'd you go inside? >> Um, just right past that first front door right there. I was just sitting right there waiting for you guys to like, you know, ask? No. No. No. Do >> you consume any substances? >> No. Just water. >> Just water. Anything else like marijuana, drugs, prescription medications, anything? >> No. >> Do you take prescription medications typically? No. >> Any any recreational, including marijuana? Uh, marijuana recreationally. But >> when was the last time you did? >> Uh, probably like two days ago. >> Okay. How do you use it? Uh, smoking, edibles, vaping, smoking, plant-based. >> Yeah. >> Okay. And you said 2 days ago? >> Yeah. >> So, nothing would be in your system. So, >> I mean, it lasts for >> psychoactive. Nothing's going to be psychoactive in your system. >> Oh, no, no, no, no, no, no, no, no. >> Okay. Do you mind? Do you mind if I check your eyes real quick? >> You can. Yes. >> Okay. Uh, we'll step we'll go to this flat portion of the sidewalk here. Um, what I'll have you do is stand with your toes and your heels touching and your arms down by your side. Okay. Have you stand like this? Are you sick or have any injuries right now? >> I'm a little cold, so if I'm shaking, that's why. >> I got you. No worries. Uh, any physical defects? >> No. I'm a little off balance even when I'm sober, but I promise I'm okay. >> Okay, I got you. Uh, are you a diabetic? >> Do you take insulin? >> No. >> Okay. All right. Um, actually, I'm going to have you turn uh and face this way so that we don't have those lights bouncing off. No worries. I appreciate you. Do you see this blue light? >> Yeah. >> What I want for you to do is follow that blue light with your eyes and your eyes only. I don't want you to move your head at all. Do you understand that? Do you have any questions for me? Keep following it that whole time. Okay. Keep looking. Keep not quite looking at the light. I want you as like stare at it directly. Okay, there you go. I'm sorry, my eyes are just watering >> from keeping them open. I'm sorry. I mean, I'm going to go up and down this time. Okay. Okay. I'm going to make circles around your face. I'm going to bring this uh towards your nose. I just want you to keep following that light. It's going to feel like your eyes are going to like go crosseyed. Just let them do that. All right. >> I'm sorry. There we go. All right. Can you do me a favor? Can you rest your eyes closed for me for just a second? You can open. All right. So, I'm going to ask that you continue with some evaluations like a walk and turn one like stand. Is that something you'll do for me? >> I'm sorry. One more time. So, I'm going to ask that you continue with uh like standardized fields evaluations. Is that something you'll do? It's like a walk and turn one leg stand outside. >> Okay. >> All right. Just give me one second. I'm going to grab something for my car. Okay. Just hang out right here. Okay. Do you mind walking down here? >> You can hang out right here. Yeah. >> If you don't mind standing on that for me, I'm going to pull that way. This is just a nice flat section of the sidewalk here. So, >> all right. Can you take two steps backwards for me? >> Backwards? >> Yeah. Just off the line. That way I can flatten it out so it doesn't go anywhere. >> How old are you? >> 21. >> 21. Okay. All right. What I'm going to have you do, if you don't mind, just place your left foot on that line for me. With your right foot in front of your left foot, heel touching toe. I want you to put your arms down by your side and stay just like this until I tell you to begin. Do you understand that? >> Yes. >> Do you have any questions for me? >> No. >> Okay. When I tell you to begin, I want you to take nine heel totoe steps down this line. >> You're then going to turn around in a manner which I'll describe and demonstrate. >> You're then going to return back down the line again, taking nine heel totoe steps down the line. Do you understand that? >> Yes. >> Do you have any questions so far? >> No. I have really bad balance. >> Okay, I understand. I I will take that into consideration. Okay, so I'm gonna move up a little bit. That way you can see this in full here. It's going to look exactly like this, counting each step out loud. It's going to go 1 2 3 and so on until you reach nine. When you reach nine, I want you to leave your front foot planted on that line. Step off with your rear foot and turn just like this until you're facing the line again and return back down the line. Again, counting each step out loud in the manner 1 2 3 and so on until you reach nine again. Do you understand that? >> Yes. >> Okay. Do you have any questions for me? >> No. >> All right. While you're doing this, I want you to look down at your feet. I want you to count each step out loud. And I want you to stop walking once you've begun. And I don't want you to use your arms for balance. >> You said nine steps, >> correct? >> Okay. >> Any questions for me? >> No. You understand? >> I'm trying my best. I know this looks crazy, but I have terrible balance, guys. Do you do you understand all the instructions that I've given you so far? >> Yes. >> All right. Whenever you're ready, you may begin. nine. >> Yes, ma'am. >> Okay. >> Are you done? >> Yeah. >> Okay. All right. So, uh, you've completed the evaluation. >> Nine steps. Yes. >> Are you done, though? >> I mean, I can keep going if you'd like. >> Nope. It's up to you. Have you finished the evaluation? >> Here, I'll finish. I'll finish. >> Okay. >> Now, you're done? >> Yes. >> Okay. All right. >> I want the whole line. >> So, for this next one, what I'll have you do is stand with your toes and your heels touching and your arms down very side. >> Okay. For this one, what I'm going to ask that you do is elevate either your left or your right foot when I tell you to. It's whichever one's most comfortable for you. You're going to elevate it approximately 6 in above the ground, keeping both of your legs straight. You can keep your foot down until I tell you. >> Okay? >> You're going to keep both of your legs straight and your arms down by your side. >> Then I want you to look at the foot that you phrase and count in the manner 1,002 1,003 and so on until I tell you to stop. >> Okay. Heard. >> You understand that? >> I think so. >> What What could I better explain for you? Cuz I want you to Tell me to lift a leg and then count until I say till you say not to count anymore. >> Yeah. So, you're going to elevate either your left or right. It's whichever one you want in this manner, keeping both your arms down by your side, your legs straight, and your foot parallel. And then count in that manner until I tell you to stop. >> Okay. I think >> you have any questions for me? >> I don't think so. >> Okay. We're going to pause for just a second. We're going to let this gentleman pass here. Watch on your back here. >> No problem. I just don't want him to interrupt your evaluation here. >> No worries. >> Okay, now you can scoop back to the the center there if you want. And >> do you you remember all the instructions? >> Hold my leg up and wait until you say otherwise. Basically, >> I'm going to tell you when to when to stop counting. Do you have any questions? Do you want me to repeat the instructions since we had that brief break there? >> I think I'm okay. >> Okay. All righty, ma'am. Whenever you're ready, you may begin. >> Okay. You said either leg, right? >> That's correct. >> Okay. >> Don't forget to count. 1 Mississippi 2 3 Mississippi 4 Mississippi 5 Mississippi 6 Mississippi 7 Mississippi 8 Mississippi 9 Mississippi 10 Mississippi 11 Mississippi 12 Mississippi 6 Mississippi 14 Mississippi 15 Mississippi >> You can put your foot down. All righty then. So, for this next one, what I'm going to have you do is stand with your toes and your heels touching and your arms down by your side. For this one, what I'm going to ask that you do is when I tell you to, I'm going to have you close your eyes and tilt your backwards if you're looking up towards the sky. >> Okay? >> Then, I'll give you a command to either left or right. And I want you to use the respective tip of your index finger to touch the tip of your nose and return your arm back down your side immediately without me telling you to do so. >> Okay? >> Do you understand that? >> Without you telling me to do so. So, you're going to give me left or right and I touch my nose with that hand and I put it back down. >> Yes, ma'am. >> Okay. All right. >> Any questions? >> I think I'm okay. >> Okay. You think so or you know so I want you to be certain about that. >> I know so. >> Okay. All right. Uh silly question, but do you know the difference between your lefts and your rights? >> Yes. >> Okay. Go ahead and uh make two fists. Leave your arms down by your side. Put your index fingers out and rotate your palms so that they're facing me. >> Are you able to roll the cuffs up just a little bit? That way that doesn't interfere with you at all. >> I'm sorry. I'm worried. Yeah. I just don't want it to be a factor here. So, just stand like that. I'll have you go ahead and close your eyes and tilt right backwards for me. Left. >> Wait, I'm sorry. Am I supposed to be moving my hands? >> Yes, ma'am. We're going to touch the tip of your nose with the tip of your nose. >> Right. Okay. Left. >> Put your arm down. Keep your head tilted backwards for me. Right. And put your arm down. Left. Put your arm down. Right. You put your arm down. Right. You can put your arm down. Left. You can put your arm back. Okay. Go ahead and put your hands behind your back. Right now, you're being placed under arrest for driving under the influence. >> The first issue is Miranda timing under Miranda versus Arizona 384US436 1966. Miranda rights are only required when two conditions are met simultaneously. The person is in custody and the person is being interrogated. At the moment the officer read those rights, Remy had not been formally arrested. She was still a participant in an accident investigation. Reading Miranda was not required there, but it created a procedural complication immediately after. When Remy said, quote, "No," end quote. The officer re-engaged her in continued questioning. Under Burgess versus Tomkins 560 US 3702010, invoking the right to silence must be clear and unambiguous. Her full statement was cold. End quote. That is not an unambiguous invocation, so the continued questioning was lawful, but it is exactly the gray area defense attorneys exploit at trial. The officer administered the three NHTS standardized tests, horizontal gaze nestagmas, walk and turn and onele stands plus a non-standardized finger-touse evaluation. That distinction matters in court. Carry scientific validation recognized nation nose test. The finger-to-nose test does not. Its admissibility my varies by juris factor is is a decision that can fall apart on cross-examination. There is also a complication before testing that she has naturally poor balance even when sober. NHTSA protocol requires that documented. If it is not in the report, the defense will use it. The third issue is the breathalyzer refusal. Remy declined, which is her right under versus California 384 US7 fish in 1966. States may attach legal consequences to that decision. That refusal became a standalone charge. Combined with DUI battery and resisting arrest, it turned one offense into a 4-count case. Knowing your rights matters, but so does understanding what it costs to exercise them. The Hobble device deployment also fits within legal bounds. 490US 386 1989 Force must be objectively reasonable based on offense severity, immediate threat, and whether the subject was actively resistant. All three applied here. Officers issued verbal warning the Hobble and once secured placed Remy in a recovery position, which is trained protocol specifically designed to reduce positional asphixxia risk. for 10:15. I don't care. Uh, I'm going to ask that you submit to a breath sample. Is that something you'll do for me? >> I'm sorry. What did you say? >> I'm going to ask for a breath sample. Is that something you'll do for me? >> Like a breathal a breathalyzer? >> Yes, ma'am. >> No. >> Okay. All right. We're going to turn around and have you walk towards my car. Is there anything on you that's going to poke out or hurt me? >> Can I talk to my boyfriend? >> Uh, not right this second, though. >> Wait. No. No. No. Please, please, please. >> Not right this second. >> No. Please. I've been to jail. Please don't. Please don't take me to jail. Come on. >> Do you have anything on you? >> No, I can't. I have my phone on me. That's it. I can't afford this. Come on. >> Are we going to take this? >> No. No. I literally don't. >> Do you have any pockets? No. >> No, I don't have pockets. Can I just see my boyfriend? >> Not right this second. No. All right. Nothing tucked or put anywhere. Right. >> Are you serious? >> Yeah, dead serious. Why would I joke around about something like that? >> I don't know. Like, what are you doing? >> Have a seat for me. >> No, guys. >> I need to see my boyfriend. >> Okay. >> Yes, right now. >> Swing in there so I can put the seat belt on you. >> No. Like, please. I don't need to go back to jail. >> Watch yourself. >> Are you kidding me? >> I have work in the morning. >> All right. Watch your life. >> Let me please talk. Let me Don't do that. You're not going to be able to do that right now. >> Are you kidding me? >> No. The way you're behaving like this, I'm absolutely not going to bring somebody else over here. LET'S TRY THIS. [screaming] >> GET IN THE CAR. >> I think we're going to get in the car. [ __ ] We're not We're not going to be successful here. So, let's um Hey, look at me. >> This is your one and only warning. You're about to be hobbled, which means that your legs get tied to your handcuffs. Do you want that? Answer the question. Yes or no? Do you want that? >> Then get in the car and sit like an adult. >> Put your foot in. >> Are you This is a waste of your time. >> You're just going to bail me right out. >> And that's how the system. >> Okay. Well, then let's get the move on. >> Okay. Sit back. >> Let's go. Are you kidding me? This is >> Oh my god. I don't need a seat belt. >> Well, you do. All right. >> No, I don't. I'm in a cage. I don't need a seat belt. >> That's your choice. >> She's going to end up hobbled. >> This is going to be >> Yeah. Let me grab mine. The arresting officer receives a B. The Miranda adisement was proactive and rights protective. The NHTSA evaluations were properly conducted and the balance disclosure was verbally acknowledged on camera. The officer issued a hobble warning before deploying it and held composure as sustained profanity and personal provocation. No chemical agents, no taser, no impact weapons. Measured legally defensible force progression throughout. Remy receives a C+ during the investigation. Honest about her alcohol and disclosed her balance condition before testing. That transparency is both legally smart and practically the right call. The problem is what followed the arrest. Sustained resistance kicking at officers and fusing the vehicle produced three additional charges on top of the DUI. The battery charge almost certainly stems from physical contact during that transport phase. The backup officers receive a B minus. No excessive force. The hobble composure held throughout. The only flag is dismissive language toward Remy's stated breathing difficulty, which should always be documented regardless of context. This footage puts five legal realities on display that go beyond this one case. Each one worth knowing before you ever interact with law enforcement. First, Miranda requires custody plus interrogation, not just investigation. If you have not been arrested and the officer is asking questions about an incident, you may not yet have those protections, even if the rights were read aloud. Second, if you want to invoke your right to silence, say it directly and completely. Saying quote, "No, I am just cold." End quote is not enough. Courts do not infer intent. The words must be unambiguous. Third, refusing a breathalyzer is legal, but it is not free. In most states, it triggers automatic license suspension and a separate criminal charge. Know what that choice costs before you make it. Fourth, if you have a physical condition that could affect a sobriety evaluation, disclose it before the test begins. That disclosure creates a record that protects you in court, but only if it ends up in the official report. Fifth, resistance during a lawful arrest does not help you. It adds charges, escalates available force options, and gives prosecutors more leverage. Your legal fight belongs in a courtroom, not in the backseat of a patrol vehicle.
