watched a 3-year-old child get hurled from a moving sedan the vehicle did not stop or turn around so he ensured the child was okay and called the police who quickly showed up on scene what happened coming so quick happened seen anything like that the silver car best I can tell it's silver pulls around I see the damn doors open and this kid comes falling out of it he falls out of the car he just came falling out of it slide rolls all the way over and the car took off and the car just kept Which Way It Go silver SUV pickup no a just a caravan a car just a car did it hit another car or no nothing like that is I was just I saw him I was in disbelief and I just I'm in disbelief right now hey are you all right pal he's got he's got a little cut let me see buddy thank you oh little cut on or she made a u-turn that white car is right there I'm sitting first one in line over there and I thought it was aent in the door but was the D door open and he fall the back and he just 14 says he like 20 minutes ago 20 minutes ago and you're driving four kids in the back seat I I had a window down you had your window down were you smoking in the car yeah you were smoking in the car with them everybody's car seats they could wear a seat Bel right um well you have that's going be four kids and that's only three seats so how get four kids for three seats with three seat belts they all fit there it doesn't matter if they all fit there how many seat belts are there there's three seat belts every juvenile needs to be in a seat belt so obviously someone's not in a seat belt if there's four kids I mean I just got this car I used to have a big van but I so just saying if I if I just get this car I want to sit four kids back seat I'm going to make sure there's four seat belts Bel the car I have six kids what do you I I know but I understand that Victors this what I didn't think that my son would ever do something like that I know but under state law every child needs to be in a seat Bel at least cck on now where were you guys coming from I'm coming from Florida well where in Florida where you at I where are you coming from in Florida trying to get South Carolina okay what part of the back of that car and three seat belts how does everyone have a seat belt on I think that they did so my question is if there's three seat belts and there's four kids how do you get three seat bels on four kids it it's impossible and obviously the kid that didn't have the seat belt on is the one that flew out the car and hit the road right he said there was probably a joint left right there I'm not mistaken I think he has multiple suspensions all right ma'am I'm going have to talk to you for a little bit now okay you might come over here with me we're going to go back to the beginning of what happened so where were you guys coming from coming from Miami Florida I was coming to South Carolina for him to see his dad and I was sleeping in the car what woke me up was when my daughter said where is um Chris juice they thought that he got out of the gas station and went into the bathroom without us without my brother knowing but that's not what happened he didn't even noticed that my son fell out the car right here like I didn't even know like and then that's when I went crazy and I and we was like right there on the eway so we had to hurry up and turn around to get off and come back to the same gas station that he said he my brother said he was at all right and the hills I found in the glove box the Xanax bars Xanax yeah those are my anxiety pills okay are those do you have a prescription I don't have it in my um bottle no I don't have my prescription you have a prescription for Xanax in particular um they give me um some type of pills like that's for like that has a doctor prescribed Xanax far to you that's what we're asking um we we can check that we can go on the record we check see so he has prescribed you any Z they they prescribe me with pills that are like in the Xanax family in the Xanax family but he hasn't prescribed you those those pills you get those I have bad anxiety pills I mean anxiety problem where did you get those pills from my friend gave them to me your friend gave you those pills yeah like my anxieties that I have does your friend have a prescription for the pills is it his is it his prescription probably probably you have a prescription of a okay I've been trying to go to the doctor the the secondary concern that I have is when you guys left Miami okay you got four four children in the back seat um their ages are on the back seat right now is at 5 or 9 5 4 and three that's that's our ages in the back seat that's that's the concern that I have the secondary concern is um who was the male that was driving the car my little brother were you awake when your brother was smoking marijuana in the car no no you weren't awake when he was sleeping okay you were sleeping when he was smoking marijuana did you know that he had marijuana on him I'm not no I was know where they had no one now he is driving under the influence of a narcotic with four juveniles one of them obviously not in the seat I can't I can't say that they all weren't in seat bels I know that when we came up to the car they weren't in their seat belts but uh two of them were supposed to be in car seats which one said they said four supposed to be in a car seat so anybody under the age of five needs to be in a car seat under five and under five and under has to be in the car seat so then that basically that means that I can't drive my car at all because I have six kids yes this would not be a vehicle that would be suitable for you to drive I know that I just got this car for now to get around you would have to have a vehicle that with seat set sto M yeah I know I always used to have Vans and stuff like big car my I lost my car and this is the only option that I had to have a car for now I understand so like I said there's other options that you as a mom have to take for the safety of your children a better option would be finding somebody to watch your juveniles so that you can fit up there that would be stuff that I would expect a parent to do do you have any family that's in the area here where is your family at far away we don't live here at all I understand you don't live here but where would your family be at where would the nearest relative BS very far Miami Florida and nobody have a car and nobody has a car down in Miami they don't know anybody that could no and this car is not even under my name I I was going to do all the registration and everything so your younger brother does he have a license he never had a license before did you know he didn't have the license um I think yeah yeah he didn't I don't think yeah he didn't have you're putting your children on the back of the car who don't have seat bels on a non-licensed driver listen I love all of my kids I understand what I'm saying this isn't a question if you love your kids or not okay I know what happened was a mistake I understand I don't know what you want me to do there's there's a lot I want you to do as a mom to to for the safety for your children I can I can go bu it first at this time we're going to detain you all right over here no do this walk with us walk to the back just walk walk to that car I don't want to do it in front of your kids you go and put your hands on your back I was sleeping cuz there's many things going on here many things not just one many things that put these kids lives in danger today not just one thing between too many kids in without seat belts without the without the car seat no one realized that kid fell out the drugs in the car there's a lot of things going on right now okay discuss that investigation so we're still doing an investigation into it okay all right if you were to go to jail today your charges would be driving with no driver's license okay um I don't know how suspensions you've had possibly driving under the influence of Narcotics and also child neglect for having narcotics in the vehicle with the children on there and then also failure to for due cause to make sure those children since you're the driver you're responsible to make sure that they're in car seats and they're in seat belts and you basically drove off and let one fall out of the car so you be you'd be charged with child neglects going to do it like I said we we're still doing an investigation that's why we wanted to talk to you so we've got to see if this ta comes back to this car you guys are doing okay in there got your puppy all right Des have a few more questions for you okay do you have like a NEX of kid so to speak for that you'd want contact for your kids someone that you'd want contacted for them what uh just for DCF because DCF has to be notified because your child fly out of the car the father is the father local or is that's the one that's in South South Carolina South this point your brother's being placed under arrest for driving with spend driver's license felony possession of marijuana and the child neglect we're also being placed under arrest for child neglect and possession of the Xanax pills if they turn not the Xanax okay the two of you had every reason or right to either one put those kids in a car seat or make sure they're properly buckled in with the two of you failed I mean you put your children's life in danger by letting them smoke marijuana and driving like that know okay well all right let me call somebody so they can come get my kids all right give well here's the right now I can't sit with your kids while someone comes from Miami so I did call Department of Children and Families they are on their way to take possession of your kids if you give me that name I will give that name to them I'm going to take your oldest child put him in one of these cars then I'm going to drive the car literally from here to the parking lot and get him off the roadway um did the kids eat this morning or anything man did the kids eat breakfast if I was go to McDonald's and get them some do anybody have any allergies or anything that they can't eat all right so I'll go to McDonald's get them some food and the investigator should be here the next half hour 45 minutes okay so step on out and they're going to walk you over to the other car sense and then there's a puppy in the car too correct yeah those are my puppies all right puppies there's more than one in there all right they're going to go to we're going to turn them over to I can't to our um animal control and can I pick them up yeah I'll give them your name you'll be pick them up my car it's not under my name well here that's the problem the car is going to get towed it's going to go to the local tow pound you won't be able to get it out until you bring a valid registration insurance for the car cuz the car is not registered the car is not insured so you shouldn't be driving this on the road okay okay all right it's all right I see everything you guys are doing not everything that we're doing it's everything that you the choices that we select to do today everybody got a seat belt on back there can you guys scoot over here and put your seat put your seat belt on mom's in jail oh no she uh going to go try to find some car seats okay everybody has their have anything active things a little bit differently when you're arrested for child neglect that's why the Department of Children and Families I neglect my children it's not what it's not what we think it's the evidence that shows you we're neglecting your children additionally you're also being charged with possession of a schedule for Narcotics this pair was charged with a whole lot more more than just drugs on this family trip to the Carolinas Desiree Rodriguez was charged with felony child neglect and Xanax possession 18-year-old Jacob Santos was charged with felony child neglect operating without a driver's license no motor vehicle registration attaching a license plate not assigned to the vehicle and knowingly driving with a suspended license Desiree bonded out 4 days later and Jacob bonded out 8 days after the incident they were both ordered to have no contact with any of the children who were in the vehicle Desiree eventually pled no contest to both of her felonies and was sentenced to 2 years of community control probation followed by two more years of standard probation a six-month driver's license suspension and she was ordered to comply with the Department of Children and fam's case plan Jacob's attorney suggested that Jacob was mentally incompetent to stand trial because he quote does not appreciate the nature of the charges against him or the range and the nature of possible penalties as if that wasn't obvious the second officers made contact with him you were get in the car with them in the back had window down he missed multiple appointments for this mental examination so he finally pled no contest and was sentenced to 180 days in jail 36 months of probation a drug and alcohol evaluation and an advanced driver improvement course so how
