digging in the water at a documented archaeological site the site is known to be a prehistoric shell mid containing Lilith artifacts from the archaic era and disturbing or removing anything from this area is a de felony good I'm Lieutenant Jones of fishing Wildlife you got any probes in the water you got any bags or any anything else that contain anything in the water just okay no do you have any artifacts fossils or anything like that in the water no okay you have any in the boat no okay did you say did you say fossils fossils are artifacts heree and I few days ago okay are they in the boat no okay we're going to pull up alongside you and do a a Boer safety check and we're also going to check um for resource stuff as well says we're in you just digging by hand you got do you have a site and he had multiple pieces in his boat well you've got some in your boat it's in my boat now but you had some in your boat yeah but why'd you leave it there it don't matter it don't matter that's all still archaeological items yeah and so was the stuff in your boat it's a documented archaeological side I believe yep we can look yeah we're fixing to look it up but you've got pieces of artifacts in here as well so that came out of your boat so just stand by shards yep if there's more than five pieces in a certain radius that's a that's an artifact um that's basically a documented site because of the existence of the prehistoric people so you're not allowed to be digging in it and you're not allowed to be keeping it yeah I I understand that it doesn't matter if it's a valuable Arrowhead like people normally keep or if it's just other pieces valuable Airhead what's the valuable Airhead dude it depends you talking Museum quality swanie or a big bull Simpson are we talking about a nan or we talking about a swanie a Santa Fe the 90s yeah yeah it depends on what you consider easy to sell versus what is uh valuable information for the archaeologist that would uh one day excavate the site which now is not in situ it's not how it was left because somebody's been digging big holes and only taking certain things out of certain layers so that's that's the difference I totally agree with what you just said yeah I mean like I said man I was I found stuff here in the '90s and it was few or far between then and that's how I know to come here and find sharks teeth and bones you know I guess it's in it's in their in part of their mid did you do something under the archaeological isolated finds act never did cuz that's what that was the only reason people could in the 90s and it had to be uh isol ated sites that weren't part of a documented site even then okay which yeah this is this is a big site not bad you're getting upset but I'm just asking [Music] anywhere get it ain't placed outside of the site along with these items back here yes are going to be seiz as evidence for uh the charg is on there but it's removal alteration of an archeological site by moving altering those archaological items okay it's a misdemeanor it's not the felony for excavation okay now with the digging tools lost me this is this is this this is no trespasses we're not supposed to be fossil hunting you're not supposed to be removing altering artifacts from a site containing artifacts that's that's man-made stuff there that stuff right there is man altered stuff and it's it's where it it should stay where it's supposed to be okay whether it's uh and it's all going to be uh archaeologist is going to go through all of it as well yes okay um also we're going to get statements from everybody that witnessed you placing that stuff up there yeah um we also uh are going to be seizing the tools that you were using today while belt yes sir oh man come on it's called Uh instrumentalities of a crime so that's an instrument Pap man um and you're going to receive a citation for possession of marijuana under 20 gr if you would have been able to provide uh proof that you had a prescription for it um that's also going to be a break because uh there's some agencies that are it's going to be I'm actually they're charging a felony for uh prescription with or for having a control substance without a prescription so you can actually be charged with a felony for that because you don't have your prescription and that's something you'd have to figure out with with the court but you're just going to get a Mis meter if you can provide that it'll it'll help you your court date can you provide proof and I've asked you twice but I'll give you another chance I can't provide proof today um but um and we're going to be seizing the marijuana as the evidence of that crime okay this amateur archaeologist was charged with removing an artifact from an archaeological
