STOP. STOP. STOP. STOP. >> [laughter] >> WHAT? >> STOP. >> NO. >> STOP. STOP. STOP. >> I'M GOING TO TELL MY DADDY KILL YOU, BRO. >> MAN, DON'T SAY THAT. >> ALL RIGHT, STOP IT. TURN AROUND. TURN AROUND. THIS IS >> [screaming] >> MY BABY IS RIGHT THERE, BRO. >> ON July 12th, 2025, in Charlotte County, Florida, officers responded to a domestic disturbance at a short-term rental. And what they captured on body camera raises legal questions every person in a relationship should understand before they ever need to. Florida is a mandatory arrest state. Under Florida Statute Section 741.2901, subsection 2, once officers establish probable cause for domestic violence battery, the arrest is required by law. The victim's preference does not change that outcome. The phrase "I don't want to press charges" has no legal effect in Florida domestic violence cases. The state presses charges. That is not a choice any party in the room gets to override. And understanding that before a dispute reaches physical contact is the entire point. >> I'll be out with multiple subjects. Hey, what's going on? Sure. Yeah, absolutely. What happened, guys? >> Nothing. This is my daughter. She's on her way home. >> Okay, what what happened? Why was there a lot of yelling and stuff? >> They just had a little argument, so I'm sending her home. >> Okay. >> That's my grandbaby in there, and then I'm going to have to take my car. >> Is that your That's your daughter? You got You guys had the argument? >> Yeah, but we okay. >> Okay, it's not a big deal. I'll >> I'm sending them home now. >> Okay. anything got physical? >> No, we're good. >> Okay, sounds good. What are you guys yelling about? We got multiple calls, so >> They just got caught cheating. That's That's what it was. And it >> Okay. All right, hey, that's not a big deal. I'll just take your info, write quick statement, and I'll get you guys on the way. Sounds good? >> All right, thank you. >> All right, yeah. >> I got it. Thanks for >> You got it. Hey, can I have your ID, please? How can I address you? >> Aliyah. >> Aliyah? Aliyah, can I have your ID, please? >> It's hot, baby. >> Where'd you get the marks from? >> Scratches. >> Huh? >> They were just just hustling out there. >> You got any marks on you? >> Not that I know of. >> No? >> You see some? >> No, I don't see any. That's why I'm asking you. >> we're good. >> Okay. Yeah. We show up as in teams, right? >> I'm so sorry. >> We show up in teams. Can I have your ID? >> I don't have it. I got it at home. >> Sounds good. Can I have your name? >> Yeah, E I L Y A H A. >> E I L Y >> Y A H A. I know it's cuz I was >> What's your last name? >> Adderley, A D D E R L Y. >> Hello. >> I'm sorry, you're talking too fast. >> E R L E Y. >> E R L E Y? Any middle? >> Genise. >> You You mind coming over here and talking to me? Is this your baby? >> Yeah. >> Yeah? Who's this lady? Hey, you want to give me the baby so I can talk to him? What uh You want to sit in the grass so you're not >> She just like just take it too far like I caught her cheating. You know how girls are when they caught cheating. So, I tried to leave not leave but like I was trying to get my stuff so I can make her leave so we can leave and stuff but she not she wouldn't leave she wouldn't leave home so >> You guys live here? >> No, we got a B&B here. So, I can't I don't have no car so I got to leave when she leave or leave when her mom leave. So, I don't I don't have no car she my transportation out here. So, I was trying to leave when she leave she didn't want to leave. I just want to leave go home and be by myself. You see what I'm saying how to be here. You know what I'm saying but she >> Well, so what happened? >> Nothing like we just literally just arguing over it like she just scratched me just stuff like that. Just arguing over like nothing cuz she got caught cheating. She get mad. >> Were you physical with her at all? >> No, sir. I'm literally trying to move her away from me. You can ask her mother anything. I didn't touch her nothing. >> Listen, you're not under arrest right now. I'm just going to read you your Miranda rights that way you know your your rights before we talk any further. Just because I seen bruises on you I seen bruises on her. There's two sides to every story so I just want you to know you're guys okay. Like I said you're not under arrest. I just have to read you your Miranda rights, okay? >> Can't even call my mom my phone broke. >> How old are you? >> I'm 18. >> You're 18 okay. Like I said I'm just getting a statement from you that's all, all right? Just can you put the phone down so I can talk to you? >> Yeah, my phone is dead. >> Yeah, the right to remain silent. With these rights in mind are you willing to talk to us? >> Yes, sir. >> Okay. So, this is who is this to you? How long have you guys been together? >> Since ninth grade. >> Since ninth grade? >> Yeah. >> And that's the your child do you guys have a child? Okay. Um we had a we had a mini altercation but like not like not like It's about to be about this. >> All right, so you guys were here today. >> Yeah. >> All right. What happened? >> Literally okay, I woke up. I checked the time on her phone cuz my phone dead. >> Okay. >> And I see a dude text her. I just asked her I'm like so we cheating? You know how girls do they get defensive like blah blah blah blah blah blah all this and this and that. don't try to talk to her like boom. Can you just take me home cuz I have no transportation. I want to go home. >> What's wrong, man? >> We live in the same house. >> Where? >> Fort Myers. >> Okay. Why you guys have even been here? >> Oh, because her mom's birthday. >> Okay. >> We stayed the night. Same stuff here. Come over here. >> Okay. >> And then I woke up like you text anybody? She's like, yeah. >> How did you see the text? >> Oh, cuz my phone's there and I like I had used her phone to see what time it was. >> And you went to her messages? >> No, I didn't I I just turned the phone on literally and then it said she was texting somebody. So, boom. I'm like, can you take me home? She's like, no. She's getting mad. I keep asking her can you take me home? Can you take me home? She's like, no. No. No. That's really what happened that led up to it cuz I kept asking can you take me home? I don't want to be here. I got no transportation. She brought me here in her mom's car. I have no other way home. >> Sure. >> I called my people. They couldn't come get me. So, I just I needed somebody to take me home. I didn't want to be here at all. >> Okay. So, what led up to the >> this in front of my baby either. >> What led up to the physical aspect of everything? >> Cuz I cuz I wanted to go. I kept asking Can you Can you take me home? Can you take me home? I don't want to be here cuz she obviously I talked to her and I don't want to be here. So, I just want to go. I don't want to be here. Yeah. She got mad, threw the phone. >> She threw the phone or you threw the phone? >> She threw the phone. >> So, the phone is broken. Okay. So, she she throws her phone. Were you guys inside or outside? >> We was inside. >> Inside? >> Yes. >> All right. So, you said you tried to like leave. >> She just Yeah, she just she was just grabbing me. She was just scratching me and stuff but I was just trying to get her off. I didn't touch her none of that. >> Okay. So, you're walking away. How did she grab you? Like how? >> She just she just grabbed me like she was >> And you were >> Don't call me out my name. Don't call me out my name. I'm like, bro, I just want to go home. I don't want to be here. I told you this. >> Okay. So, then how did you end up with the scratches on your back and on your stomach? >> She I'm telling you she was just like grabbing me. Like I'm I I I'm telling you I'm trying to push her off me cuz I don't want to touch a female. >> Were you walking away? Were you >> I was trying to. I'm telling you I do not want to touch a female. >> Yeah, I'm asking these questions. I'm trying to be as descriptive as possible just because I wasn't I just needed like >> It's just crazy cuz all of this is in front of my baby. It's just like >> Where was your child when this was happening? >> My child was in here with her mother. But her mother was trying to control her too, but >> Uh-huh. >> we just too much to one on one. >> So you trying to walk away and she's grabbing you, trying to force you not to leave? >> her mother got the baby, so she can't control her like >> And you're doing >> I'm trying to go >> evasive maneuvers, trying to get out out of it? >> I'm just trying to go to sleep. >> Okay. Did you hit her at all? >> No, sir. I did not hit her. >> And how did she obtain those injuries? >> I don't know, sir. I'm trying to pull her off of me. So like when I mean she on me, she on me. So I'm trying to pull her off of me. I don't want I don't want these on me. I don't want that, sir. I'm trying to pull her off of me. Like it did hurt my baby's hurt. Here what I said is like >> Yeah. Have you guys been physical in the past? >> Uh-uh. Not like this. We just argue, but we've never been physical like this. I just wanted to go home. That's it, bro. >> Okay. You said you don't want EMS? They come check you out? All right. So the argument started about cheating? >> I guess he woke up and saw somebody in my phone. We were both cheating. You know how to do that. >> Okay. >> Um Um I guess he I was already disrespected cuz he already kept coming by and saying slick stuff. Like after he found out I already told him in a message I said I take the blame. After that, he just kept coming in and out making slick remarks and I'm just trying to ignore him. I'm on I'm on the phone with my sister trying to ignore this man. So after that, it just take place like he wanted he wanted to go home. Like he wanted me to drive him home. We already came out here for the Airbnb. But he wanted me to take him home, but I already said like we just woke up at 12. It's already hitting 1:00 at the time. >> Um Fort Myers. I said I don't feel like going to >> Is that on your ID? >> Um it probably is it's probably Lehigh cuz my ID's old, but it should be Fort Myers up there now. >> Okay. >> Um He's saying no, you ain't taking me home. Telling him call his sister take him home. But it's still just back and forth like that, but not touching yet. So I come out the living room. I'm sitting there putting on my baby clothes cuz she just got out of pulling my mom. We sitting on the couch. Mind you, he's drinking liquor already. >> Okay. >> tell the bring that out the truth in people. He's drinking liquor cuz he can't smoke, so he had to do something else to cope his pain, I guess. >> Okay. >> So, um he's sitting there and he was like, "That's why you taste like that. That's why you've been tasting so weird." Just basically like calling me out my names, calling me out saying I'm ran through, saying I'm that, just making me feel bad about myself. So, of course the words touched me and I threw my hand on him. >> Right. >> So, my mom was trying to stop us, but I was still throwing my hands out. I am so he he didn't touch me at all. He was just trying to like jack me up, push me off of him type, but he didn't put his hands on me. >> Okay. When you say push push you off of him, did you come on to him? >> Did I come on to him? >> Yeah. >> We was already like this, like this. >> Okay. Oh, you don't have to do that. >> Well, that's how he was, so I'm trying to give you the picture. >> Okay. >> So, we was like that, so I already threw my punch, but he already he grabbed and pulled my braid out my head. My scalp already know. Um so, that's when I was punching him cuz he pulled my braid out my head. So, of course I'm going to throw a punch and I was continuing throwing punches at him. So, he has a knot on his head, so that's why he just yanked me by my shirt and grabbed me like this. That's why my shirt is ripped. >> Okay. >> And then yeah, so my mom put us in the car and it was just time to go home. And then that's when you guys came. >> Okay. You obviously have marks all over you. >> Me? >> Right. Yeah. And so does he, so >> Probably cuz my junk is fine. Sensitive, but you could >> Can you go ahead and yeah. Keep I mean, I don't want you pulling down your shirt too much, but you got a couple scratch marks there. If you could just hold that. >> He got that well. >> Yep. You have anything on your hands? Can Can you go ahead and put your hands together for me? Like this. Turn them around. Together. Okay. What you got on your legs? >> Just that well. >> This? >> Yeah, I don't know. >> How did you get that? >> I don't know. >> Can I get your other foot, please? So, you approached him and he started hitting you, swinging, or >> When I approached him, we was already arguing. I guess when I got >> hey, at what point did it get physical? >> When he just kept calling me out my name. >> He was saying that he was saying nasty stuff. He was saying nasty stuff like it's very personal and probably brings somebody's >> Right. >> gratitude down. And I mean as a female, you know, I love been together for a long time. And I told him like even her dad did stuff like that. I don't like that as a female. Don't say stuff like that. This >> Who's this? >> Oh, that's my boyfriend. >> Okay. >> You have got another baby just >> No, he just got here. You don't even know if >> Okay. >> He hasn't even this is the first time he's been >> Okay. >> So, >> So, did did he just kind of piss you off enough until you came over and hit him? Where'd you hit him first? >> Uh his eye. >> Right in his eye? Okay, go ahead and tell me on. >> got him on the eye. That's when he pulled my braid >> After you hit him? >> more cuz he pulled my braid out. >> After [clears throat] you hit him? >> Yeah. >> Okay. All right. >> Not going to lie, officer. I don't know if I do have anger problems, but I really try my best cuz I'm trying to change for my daughter, but >> Right. >> he already know what type of buttons to push. >> Right. >> And I literally was trying to hold my I I kid you not. I was trying to hold my composure until I couldn't no more. I couldn't. >> I understand, right? Words have gotten >> I didn't mean to hit him. Like I've been together for 5 >> long have you guys been together for? >> We've been together 5 years. >> Okay. >> Since freshman. >> No. All right. Well, just like our policy, right? The primary aggressor call was made using factors under Florida statute section 741.2901, comparative injury severity, history of prior abuse, and evidence of self-defense. Both parties gave consistent accounts. The physical evidence matched. The determination was legally sound. On Miranda, the Supreme Court held in Miranda versus Arizona, 384 US 436, 1966, that custodial interrogation requires a full rights advisement before substantive questioning begins. One officer delivered a partial advisement, interrupted it, and continued into the interview. That is a procedural gap with real consequences. The non-custodial exception from Berkemer versus McCarty, 468 US 420, 1984, could apply since the male subject was not formally under arrest. But with multiple officers present and no communication that he was free to leave, that exception is not clean. Complete the advisement every time without exception. Use of force is measured under Graham versus Connor, 490 US 386, 1989. Three factors: severity of the offense, whether the subject posed an immediate threat, and whether the subject was actively resisting. No credible threat was present. But active documented resistance justified the takedown. No taser was deployed. A verbal warning was issued first. That sequence, warning before escalation, is consistent with trained use of force continuums and is exactly what holds up in after-action reviews. The restraint shown against sustained resistance reflects measured, documentable decision-making. Resistance during arrest does not cancel the original charge. It adds to it. Florida Statutes, Section 843.02, makes resisting an officer without violence a first-degree misdemeanor, up to 1 year in jail. Kicking a patrol vehicle adds a potential disorderly conduct charge under section 877.03. Two charges. One bad decision. >> Because it's an investigation. >> What? >> We're going to have to read this to you. You have the right to remain silent. Anything you say will be used against >> No, no. Before we ask her any questionings, is any of you here? We have to ask her. She's not under arrest or she'll be handcuffed right now. >> You have the right to talk to an attorney you have >> If you want me to. Wait, what's what's going on? >> Just just hold on. Just a second. All right. So, she said that we could we can talk. Just uh just ask her Uh you're going to have to get a picture somewhere. I have to get a picture. All right. I just sent a picture. >> Yeah. Can you go ahead and put your phone down for me? Okay. Put your hands behind your back. >> No. >> Easy. STOP. STOP. STOP. STOP. >> WHY? >> [laughter] >> WHY? >> STOP. >> NO. >> STOP. STOP. STOP. >> I'M GOING TO TELL MY DADDY KILL YOU. DAMN. DON'T SAY THAT. WOAH. >> PUT HER IN >> WOAH. >> PUT HER IN THE ALL RIGHT. STOP IT. TURN AROUND. TURN AROUND. THIS IS >> [screaming] >> MY BABY SHE'S RIGHT HERE. BRO, I >> I'll get it. You're going to get tased. You're going TO GET TASED. YOU'RE GOING TO GET TASED. PUT YOUR HANDS >> I CAN'T GET MY OTHER ARM. I CAN'T. >> TAKE YOUR OTHER ARM OUT. TAKE YOUR OTHER ARM OUT. SHE IS. Go ahead. Here. Here. >> Please don't >> Do not resist. I'm going to tase you. Do you understand? >> Please don't tase her. >> I'm not going to. Can you go over there so we can do our job, please? Thank you. I don't care. >> You guys >> Couldn't fix them up. them. You got to take them off anyways. Fix She's not going to do nothing. >> So, is he What's happening with him? >> Listen, ma'am, I told you to go over there, all right? I will arrest you for obstruction if you don't get away from me. >> What you told him? Now you quiet? I got 5 minutes and we both going to be there, right? Watch out. >> All right. Remember what I said, now. All right. Hold on. Just stand up. Get up. Stand up. I will drag you to the car. Stop it. Stand up. >> I'm sorry. I have my regular job. >> Why, bro? >> You have to go. >> Officer, please help my >> I have my regular job. Get in the car. >> I can put my hand in the car. Shut up. >> Get in the car. >> Nobody got busted though. You probably messed it up by yourself. >> Yep. >> Move. We're already here. You about to kill my >> Get up. >> I have my regular job. Sorry mom. >> You're going to get another charge. >> Why? >> Listen. Stop that or you're going to get tased. Do you understand me? Stop that. >> Stop doing that for no reason though. >> Stop that. You're going to get another charge. Listen to me. You're going to get another charge, okay? Stop it. Just go down now. Uh I'll do the rest. Let him know she's uh probably going to be disorderly so they know. On the way there. Yes, I'll explain that to you. GIVE ME 1 SECOND. >> [screaming] >> NO, WE'RE STRAPPING HER IN. YOU GOT YOU GOT THE HOT GUYS? NO. NO. STOP. Stop it. Stop it. All right, stop, please. I'm asking you to just stop. You did this. We didn't do it. Okay? Hey, I got them I think I got some on my seat. Just hold her here. Just watch her. Come back over here. Come back over here. Come back over here, woman. I understand. I'm going to tie your feet because you can't act like an adult and you keep kicking my car. Come over here. You still have to be in a in a car seat. Come over here. I'm going to drag I don't want to keep hurting you. I don't want to keep touching you. Come over here. Listen to me. I don't want to keep forcing you, all right? I don't want to keep holding you. Just come over here so I can put a I got to put your your car I have to put the seatbelt Come on, dude. Let's go. Stop it. Come over here. She's free. >> Can I get my other shirt? I'm calling my dad. MOMMY, CAN YOU CALL MY DAD? I WANT MY DADDY. >> LET ME SEE LET ME SEE YOUR FEET. >> I WANT my dad. Call my dad. I can't bring it here. No, BRING IT HERE. BRING it here. Don't listen to them. Bring it here. Tell daddy come. Let's see though. >> Just go to Just go to the jail. If she stops Let the jail know she's going to be disorderly. Yeah, she's 10-15. I'll let him know. She's going to go disorderly so he might have to run code over there. White T-central. I'm going to take some pictures of you, okay? You just put your arms out like this. >> Don't you want to press charges on her? >> Okay, I'm trying to >> No, I don't know the status. >> Why? I got to let them know they got to >> It's domestic violence, brother. Hands out like this. Come into the light, please. Turn this way. >> You know what I'm saying? I'm going to be in some paperwork. >> What? >> I don't think I'm going to be in paperwork. >> What's going to be what? >> I'm going to be in paperwork, like >> Yeah. >> For what, though? >> If you choose not to not to not to be a cooperative witness >> No, I'm saying I don't want charges. >> That's fine. Now, listen to me. It's domestic violence, okay? You got to listen to me. You asked me a question. I'm going to explain it to you, bro. >> I'm just saying I got a baby, so >> Listen, you asked me a question. I'm trying to explain it to you. All right? In the state of Florida, all right? We have no choice but to prosecute for domestic violence. You guys been together 5 years. You have a child to come and you currently live together. Those are all the criteria that means for domestic violence, okay? Whether you choose to cooperate or not right now, we have no choice but to sit to separate you guys from the situation. So, she's going to be under arrest that. At a At a date, if you go to court and you don't choose to cooperate, that's on you. If you want to drop charges, that's on you. But, for right now, yeah, she's going to go to jail. >> can see her drop charges on general. >> Yes. >> Okay, that's fine. >> do whatever you want later on, but not right now, okay? Lift your uh your hair up so I can get to your forehead. Yeah. You understand? I'm going to give you some paperwork, whether you want to take it or not, I still have to give it to you, okay? It's your victim rights. It just has stuff for you as a victim, things you're entitled to, uh resources you can use, and numbers you can call, all right? Give me a second. I'm going to grab that paperwork for you, and I'll give it to you. Do you have a ride? Is your phone working now? >> No, my phone is dead. >> No, uh uh uh do you know a number by heart? >> What? My mom's number is there. >> Yeah? >> Yeah. >> Okay, so when we're done with that, I'll get I'll let you use the phone so you can make a phone call. >> get my shoes and >> get picked up. Yeah, that's fine. You can go inside or whatever. Just give me one second. Stay out here for now. Okay, so what was your question? >> I just want to know where you're keeping her. >> Okay, so she's under arrest for domestic violence battery, okay? He didn't want to press charges. We had no choice but to press charges in the state of Florida. We got a statement from him. We got a statement from her. Her statement and his statement coincided. The primary aggressor is her, okay? We have to decide establish who was the primary aggressor, okay? And for base off what she said, and base off what he said, we decided she was a primary aggressor. So, us as law enforcement officers have no choice but to remove one or the other from the situation, okay? So, that's why we're going to take her into custody. The reason we went hands-on with her and took her to the ground and we almost tased her was because she was being combative and she was resistant, okay? We don't want to do that. I don't want to put my hands on a girl. I don't I you know I understand the situation is already harder than it is. >> I was just It's I understand. >> Yeah. So, she's going to be held at the Charlotte County jail, okay? >> Charlotte County? >> Yes. She's going to be there till first appearance. They don't do first appearance on Sundays, so she's going to be there on Monday. Uh until Monday, okay? Uh Monday she'll see the judge. The judge will decide, you know, what's what's what's going on, she'll be she's going to get post bond or not, bail. They'll call you, she'll call you from there, and then uh I think Charlotte County allows unlimited phone calls. So, she'll get a she'll get a phone call. >> Can I Is I'm sorry. Can I give you her dad's number because my phone service is going to be off. >> I don't I I mean I you'll have to call the jail. Just cuz yeah, cuz I I have no way of giving her any I can't give her anything. She is whatever is on her phone or whatever I can actually but you can always call the jail and say I have an inmate there this name I need her this number call me and then they'll they'll do that for you, okay? >> Okay. >> All right. Um any other questions? No? Sorry, I know it was your birthday. Uh I'm sorry we're in we're in this situation, okay? All right. >> Officers receive a B. The primary aggressor determination was legally supported and clearly documented. De-escalation throughout both interviews was professional and consistent. Victim services were handled correctly including rights paperwork and access to a department phone. The one mark against them, the partial interrupted Miranda delivery to the male subject before substantive questioning. The female subject receives a C+. Her candor with officers reflects character but she initiated the physical violence, admitted it on camera, and then resisted arrest in a way that layered additional charges on top of the original. Candor does not undo conduct and every decision she made after the argument escalated carried a legal price tag. The male subject receives a B+. He cooperated, kept his account consistent, and did not retaliate despite being struck. His one vulnerability, answering substantive questions before his Miranda advisement was complete. Asking, "Am I free to leave?" before responding would have been the legally correct move. This footage contains five lessons that go beyond this one encounter. Each one is worth carrying with you because the law does not wait for you to learn it before it applies. Lesson one, mandatory arrest laws take the decision out of everyone's hands. In Florida, once probable cause for domestic battery exists, the officer has no legal authority to leave without making an arrest. The legislature made that call. It applies regardless of what anyone in that driveway wants. Lesson two. An interrupted Miranda advisement is not a completed one. Officers must finish the full reading before substantive questioning begins. Anything less creates a procedural gap that can emerge in suppression hearings later. Even if the underlying arrest was entirely lawful. Lesson three. Resisting a lawful arrest is a separate criminal offense under section 843.02. It does not matter whether the original charge seems fair. Resistance is prosecuted independently. Comply with the arrest. Challenge it in court afterward through proper legal channels. Lesson four. Injury documentation by officers is independent evidence. It does not require a cooperative victim to sustain a prosecution. Physical evidence combined with consistent accounts from both parties can carry a case to trial on its own, regardless of what anyone later decides they want to say. Lesson five. If you are being questioned and your legal status in the encounter is unclear, ask directly, "Am I free to leave?" That single question determines whether Miranda applies. Do not answer substantive questions while that status is still ambiguous. The answer to that question is information you are entitled to. Two 18-year-olds, a child, a birthday weekend, and one state statute that left the room with no options. Understanding how the law actually operates before the moment it applies to you is the only protection that matters when things move this fast. If this breakdown gave you a clearer picture of how domestic violence law works in practice. Share it with someone who needs to hear it.
