[Music] welcome back to the Donnie Rapture Channel today's body cam video takes place on July 6th 2024 FWC officers on water Patrol observe the vessel traveling without navigational lights and the video picks up as officers initiate a stop in the vessel all right evening guys fishing Wildlife hey so the reason for the stop at night once it's Sunset you all have to have nav light and what that means is you have to have a red port side light left side light a green right side light and an all around white light all I saw from you guys was the white lights in the front which technically has nothing to do with navigation lights okay so that's the reason for the Stop um do you have your driver's license registration for the boat or an ID and registration for the boat my house is right here down down the next I got you yeah all right right while we're here um let me make sure you have your safety equipment so you should show me life jackets for each person a throwable life ring fire it it came up as a battery and a robbery charge so robbery doesn't necessarily require that you go and kick down a door into a store and stick a gun in somebody's face robbery is just theft plus Force so if you grab somebody and grab their arm and said give me my money that could be considered robbery yeah there was there was never any theft or anything I I literally just confronted him and I told him and I said you have to pay me back for the money I got you and for the for the rent that I paid for you cuz it's been you know over five or 6 months and uh yeah he didn't and I mean you know I didn't like didn't put your hands on him no I I I I I pushed him okay but I mean nothing not like I didn't like punch him or beat him up or anything I got you I did I did push him though a p a push could be construed as battery because you're putting your hands on someone really yeah if somebody if somebody pushes me as an officer as battery somebody pushes your mom I'm Define it for you in state of Florida battery is an unlawful touch or strike so it's basically just going like boom like walking on a hallway and someone like bumps you on the shoulder that's like unintentional but if it's like if you actually meant to touch somebody like that it's battery it's battery like if you were to take if you were like not you're going to do that I I don't think you will but if you like kick me in the shin right now it's battery loo it's a felony it's crazy like you just wanted to touch me or something like that that's how it is so so are these felonies uh simple battery would be a misdemeanor a robber a robbery charge typically is a felony Joy when we get there you want to continue with the signal one or you want me to do it or what I I'll take care of the signal one just because I I initially asked you about it and starting to look that way yeah that's fine what's the signal on so he he was asking if you've been drinking right cuz like we could smell the alcohol on sobriety tasks you probably seen them on TV and stuff like that make sure that you're not impair okay and then um we'll go from there go to the jail get you booked in and and see um when Orange County were glass I and smell a strong odor um I'll explain it to you in in-depth but uh ultimately you are taking the ride for the warrant but at this time I've noticed signs of impairment so I I think that I don't I think you're being truth about having one beer today I I really am okay well your performance on the task does not indicate no I'm man that's why I was telling you guys like I have horrible memory like four steps like I literally only remember two so okay you'll have an opportunity to provide a breath sample we're going to have you blow so we we'll confirm that and stuff like that obviously you know you're under arrest primarily for the warrant but this officer notic signs of impairment like I said um you wreak of it you have a lot of kind of little clues that we look for one beer how long ago uh it was right before we just stopped okay I got you we're going to put you back in in cuffs okay it's either way man you you know we told you that you're going to jail because of the warrant but I don't think that you were necessarily sober today and from what I've seen I think your normal faculties are impaired based on your performance in the tasks and was it Reax your hands was can I can I ask you which one it was was it like the the eyes there's stuff with the eyes there's stuff with all the other tasks that you did and I can explain that fully fully for you and I'll write a report on it okay but at this time um you're under arrest for the warrant and voting on influence you know that I was cooperative yes sir oh dude on the bottom I report I will write that you're a respectful and Cooperative that's a part of we're stopping you for nav lights and voting safety right and then now now and then I run your ID I run your DL it's like hey this guy's got a warrant and I have to I have no choice but to arrest you and then and then with with fwc's cooperation and this case and all that you are a great as far as being well with us you're doing a great job like you're being cooperative however you did show signs of impairment which is why I'm going to ask you Prov a breast stand point a sec okay I justed toera absolutely whatever else on our end with FWC you're Cooperative with the the courthouse in Orange County that's a different deal that's that's you I'm going to be cooperative over here as well but just making sure is that ID and registration
