On September 7th, 2026, officers were dispatched after reports of a road rage incident involving a van driver who followed an electric scooter rider, swerved toward him, and displayed what appeared to be a handgun. After gathering information, officers arrived at the suspect's home. >> US police. How you doing, ma'am? Step outside, please. Is your husband here? >> Yeah. >> Okay. Hey, wait. I need you to step outside, please. Ma'am, step out here with this officer. Come to the door, please, with your hands up. Need you to come to the door, please. And let me see your hands, please. Hands up. How you doing? Don't reach for anything. All right. Come on, step out here. All right, put your hands up for me, and I'm just going to pat you down for weapons. >> Okay. I don't have anything on me. >> All right. Ma'am, do you mind I see that you have a rifle right there. Okay, so let's just going to close this door. Okay. So, let's step out over here. Let's go talk over here. You want >> Yeah, yeah. Then when I hear then we would have collaborated our stories. >> All right. So, do you know why I'm here? >> Nope. >> So, we got a call about traffic incident at the triangle. Do you know anything about that? >> A kid A kid was blocking traffic with his two two-wheel scooter, yeah. >> Okay. Why don't you tell me what happened? >> He was blocking traffic with his two-wheel scooter in the fast lane, and it was making cars go around him and all that stuff. I got upset at him, and I told him, "Get out of the fast lane, go into the slow lane." >> Okay. >> He got mad at me, called me some names. >> Okay. >> We got around the corner, he continued to follow me. I was going to go to this hotel, he followed me down to Flagler, and I made a right cuz I didn't want to turn in there cuz I knew he was right on my butt, and he continued to follow me down through all these little streets, and he finally pulled over, and I'm like, "I'm not going to pull over." So, I turned around, and kept going through all the other streets, he kept following me, and finally he turned off, and that was the last time I saw him. >> That was it. That's all that happened. You didn't do anything, you didn't say anything to him? >> I got to call him a I said, "You you stupid [ __ ] quit having your your your two-wheeler in the middle of of the of the of the of the passing lane. >> Okay. >> Get on get into the get into the uh the bike lane. That's basically it. >> All right. All right. So, I'm going to read something to you. >> Okay. I'm going to ask you questions. All right? >> Officer Andrade with the Key West Police. So, listen. The reason that we're here is there was um an incident uh traffic incident >> Okay. So, then yes. Do you want to tell me what happened? >> Do we have to have it on my neighbors? >> We we do. We do. >> Can we go up in my my garage area? >> Um do you mind? >> No. >> Yeah. Go for it. >> Um we were driving down the road. Um the guy is on a scooter driving in the fast lane. >> Mhm. >> Um slowing up all the traffic. He yelled at him on your Yeah. And I I yelled at him for yelling at him. >> Oh, yeah. Okay. Got you. >> that he's a flipping [ __ ] for driving. And then there was all kinds of obscenity. Yeah. Yeah. >> Between the two? >> Yeah. Yeah. Between the two. But yeah, he he was one of those motorized scooter driving in the second lane. He split lanes, I guess, to pass him and screamed and yelled at him, which I yelled at him about that. >> With these rights having these rights in mind, do you wish to speak with me? >> Well, I I just told you what I've told you. >> I know, but if I'm asking you questions, will you speak with me? >> go so far, and then if I think it's I'm being coerced, then I will stop. >> Okay. >> Okay. >> We happened to turn down the same road he did. He was pulled over. So, and he swerved to hit him, which is not cool for him. >> Your husband swerved to hit him? >> Yeah. He swerved not to hit him, but swerved to say >> So, you pissed me off, so I'm not going to swerve at you. You got you. >> And then we turned, and then the guy followed us for blocks and blocks and blocks and blocks and blocks. >> And then what and then what happened? >> Then we went to the bar, had a couple drinks. >> There was no altercation when he got to you or anything. So, he just saw where you were, and then he took off? >> I don't know where he saw where he was. >> Well, you said he followed you all the way to the hotel? >> He followed us around and around and round and finally that's when we went to the hotel when we couldn't find him or when he wasn't following us anymore. >> Did you in any point show a weapon? >> No. >> To this to this gentleman? >> No. >> Um and then he followed you, you didn't follow him? >> chasing me. He kept chasing me. He pulled over to the side, waiting for me to stop. >> Where did he pull over on the side? >> I'm thinking on 20th. >> Near 20th and like dog or >> He would have been ahead of me. So somewhere along the line he got ahead of me. >> Okay. So where where he was ahead of you and he stopped did and you were coming up to him at any point did you swerve your vehicle towards him? >> I I I moved over into the right hand lane and then got back into the well there there's only two lanes. I moved over a little bit and I got back into the left my lane and then I went to turn on next street he kept following me following me following me. The guy was just being arrogant and mean. >> And so when when you swerved over towards him and you came up >> I didn't come anywhere near him. >> Okay. Did you stop at that stop sign? That said that >> I think so yeah. >> Okay. So you stopped there. Um and then what did you do when he was following you and he finally gave up? Where did you go? >> I just kept turning up different streets and then I went back on the Flagler Avenue and he was no no longer there. >> And where'd you go from there? >> I went to the hotel where my friend works. >> Okay. Um but at no point you don't have a Do you own a handgun at all? >> I have a handgun. >> Um where do you normally keep that? >> the center console of my of my of my truck. >> Okay. And >> I did not pull that out. >> And at no point you show that to him or anything like that. Cuz he's he's telling us that you pointed a gun at him then rolled down your window put the gun away and then you guys had verbal you know whatever verbal went on between you two. >> We had verbal when when I said to him get out of the center of the road and get over to where the bike lane is. >> Mhm. >> That was our verbal discussion. >> Yes. He did he did say that. He did mention that. He mentioned then he made a left onto South Roosevelt and a right onto Duck Ave and that you followed him >> was Duck Ave. That wasn't planned. It was Duck Ave. >> And you followed him and he said he stopped near the corner of Duck >> me. I didn't follow him. >> Victor did pull out his taser. >> His taser? >> And pointed it at him. >> What did this taser look like? >> It does look like a gun, but it is a taser and he carries it with him. I mean, he has it in his vehicle at all times. He's 75 years old, so we he's had young people try to >> Do you know why he pulled his taser then and what then he pointed it at him, you said? >> He yelled and screamed at the kid, the kid started yelling at him. The kid came up beside him, so he pulled his taser. Did he shoot it? No. >> Why would I chase him? >> So, that's why we're here. Okay. >> I as soon as I found out it was a gun >> Yeah, and the reason we had our guns was because he said it was a gun, so we just used precautions. So, I thank you guys for being smart and not, you know, trying to do anything or make any sudden >> Two guns that I believe he carries with him. One's a taser, one's one of those non-lethal things. >> Okay. >> I don't even remember exactly where he stopped. He was egging me on. He wanted to have a brawl. So, what he wanted to have a do. >> Okay. >> to fight a 75-year-old man. >> Yeah. >> He's probably what? 30, maybe? >> I'm not sure. But, I mean, he's younger than >> Irregardless, you know, it's a five-year felony to be assaulting an old But, irregardless of that, before I got to him, yeah, went over and then I came back again. >> He said that you aggressively swerved at him like you were trying to hit him with your car. >> You know what? Everybody was basically in He was basically in everybody's way on that side of the road, on the passing lane. >> Mhm. But, that was in those back lanes. So, >> lane. >> So, just for clarification, any any bike, scooter, vehicle that goes over 15, they can't be on the sidewalk. They have to be in the road. And they have >> of the the >> They have a full use of the lane. >> Yeah, >> thought they had to be on that road where it says there's a bicycle lane. >> Yes, but there's signs that clearly state and there's other, you know, literature that says they have full use of the lane. A bicycle has the full use of the lane if they want to ride on the road. As frustrating as that sometimes can be. Okay, so >> Well, you know what's frustrating is probably every day now around here. >> Yeah, there's lots of people on electric bikes, scooters, bicycles, all of it. And tourists and residents alike. What he what he's stating that happened is pretty serious, right? You know, he's stating that someone pointed a pistol at him and then someone tried to hit them with his with their vehicle. >> I went like this and then I went back in my lane. I didn't come close to him. Otherwise he'd have been >> When you motion like this you mean you turned left? >> No, I went like this and then I went back into my lane. >> Swerved a little to >> Swerved a little so you you can see that I'm not going to be pushed around by him, but I didn't even come close to him. Otherwise he would have kept chasing me. He kept chasing me. If anybody was the aggressor it was him. >> Okay. I understand you said you were going to dash him earlier. >> Do you look at that with your phone or is it like a SD card in the dash camera? >> How do you access that video? >> Oh, well I don't do it. I'm my kid does that stuff. I don't I hardly even know where my phone's at half the time. >> Okay, but is that is that how you would access the video from your dash video? Um and then for for the video >> Actually, he started this whole thing at the moment I said to him when I pulled up beside him when he was in that lane I said, "Dude, get over in the bike lane." He fell [snorts] out of nasty things to me. >> Okay. And that's kind of what And that kind of what kicked everything off? >> That's exactly what started the whole thing. >> So from those two you can you tell which one it was that he pulled out? You think it was the >> It was the the taser cuz he even says I'll taser his ass if he gets too close. >> From his statements he was he was trying to he was following you to try to get your license plate. So just hang here, okay? Just hang with him. Okay, so another question. No, no, no, you're good. You're good for now. For now. >> I'm just going to figure the worst. >> Um, when you were at the light, did you point You said you didn't point at the the triangle there. >> Yeah. >> You You said you didn't point a pistol at him. Did you point anything at him? >> No. >> Nothing? >> No. >> Nothing that would hurt >> What? I I said, "Get over in that stupid lane over there, the the bike lane." >> You didn't point any like any other type of weapon at him. >> No. No. >> Do you have any other types of weapons in your vehicle? >> I have a a non-lethal. >> Okay, did you point that at him? >> Yeah, I did point that at him. You said weapon. >> So, that non-lethal is still a weapon. It's a non-lethal weapon. >> pointed it like this. And he said, "Come on." >> So, you just held it up. You just showed it to him. >> Yeah, I showed him I have this gun cuz I'm 75 freaking years old. >> What kind of gun is it? >> go get it for you. >> No, no, no, just what what what is it? >> It's a Byrna. >> What's that? >> You don't know what a Byrna is? >> Well, I'm I'm trying I want you to tell me what it is. >> It's a pure gas non-kinetic or anti-kinetic. >> Okay, so like a like a pepper ball gun. >> Yeah. >> Okay. >> Yeah, for people my age who get attacked by guys like him. >> Nothing wrong with having it. I'm just but when I ask you a weapon any weapon >> It's not a weapon. >> It's a self-defense weapon. >> But it's not going to kill anybody. >> No, that that's I understand that. It's a non-lethal I get that. It's a non-lethal. >> It's not It's not going to kill you. It will make you pay attention to the next time you try to assault a 75-year-old man or woman. >> No, I understand I understand where you're coming from. >> where I'm coming from. >> Okay, now next question is can we watch your dash cam footage? >> No. No. I want you to after I talk to an attorney. If you're going to arrest me, just arrest me. >> And this I mean this isn't the first time we've came across the >> Yeah. >> Um, excuse me for just one second, okay? >> No problem. >> Got to have this guy. I've been I've been speaking with him. I've explained, you know, and he's told me, you know, basically what his side of it. And you know, I got your side of it. Um, Here's the Here's kind of what I'm what I'm leading at. So, he told me about the weapon. It wasn't a an actual pistol. It was a pepper ball gun, a non-lethal. He carries it because he's got a bad back. He's obviously advanced in years. He, you know, just felt a little bit disrespected, I guess, cuz you guys had words. >> my lane. I I understand I was I wasn't in his lane. I didn't approach him. >> No, I get it, but you were in a in the left lane, which you're really not supposed to be in the left lane. >> but you still shouldn't pull a weapon on me, period. >> No, understood. >> He pursued me. >> Understood. He said he did kind of swerve in your direction. >> No, he [ __ ] turned the corner to follow me in Florida. I feel like it's cuz it's and he's a good big name in this town. >> Oh, I've I've never heard of him, to be honest with you. >> Well, I've looked him up and I'm found everything about him. I mean, I think he approached me screaming out of his window. Whether it's a pepper ball gun, that's what he tells you. Sure didn't look like a pepper ball gun to me. >> Cuz his wife his wife's the one that told us about it and she said it was a pepper ball gun. So, >> Maybe we should look at his registered weapons. >> He does have other weapons, you know what I mean? Like >> this wasn't a pepper ball gun. I mean, I was a gun owner before I was a felon. I know guns. >> I know, I get it. I I I fully I fully get it. So, I'm just the reason I'm calling is is >> Yeah, what what what if it was a kid he'd done that to? >> Well, that's kind of like what I've been going over with him and talking to him about is like, you know, >> And I mean, he followed me around a corner, floored it, and was inches from me, drove through the bike lane and was inches from me. I mean, I want to file charges. >> You do? >> I do want to file charges, absolutely. >> All right. I just I just wanted to talk to you. Also, I'm going to have to collect the taser and the uh >> Well, that's fine. >> and the kinetic weapons and you mind if I take your 380 just for safekeeping so the other ones are evidence but that one just for safekeeping. That way she >> it's going to be. >> Mhm. >> I know where >> Well, I'm just saying so that way she's in the vehicle cuz she's a felon she can't have weapons so >> so that's fine but yeah, go ahead. >> So, go ahead. Okay. >> Yeah, yeah. >> Thank you. All right, go ahead. So, go ahead and just uh you can keep those on if you want. If you want to bring them, do you want them? >> Well, my glasses? Yeah, well, I can't see without them. >> All right, so go ahead and stand up. Just put your hands behind you. >> or one of the other ones? I can't believe you got to handcuff me. I haven't done anything. >> So, that's how it works. So, you get arrested, you get handcuffed. >> Harm you in one of the way or capable. >> It's not about harming us. It's just when you get arrested, you get handcuffed. Well, it's just against her we search everybody. >> Yeah, I'm just saying. >> Not because we think you're >> For safety. >> No, you're good. That it happens all the time. >> The man was charged with aggravated assault with a deadly weapon, improper exhibition of a dangerous weapon, and reckless driving. Video from his van showed him following the scooter rider and swerving onto the shoulder toward him. The assault charge was based on the van being driven toward the rider while the weapon he displayed was determined to be a Byrna pepper ball pistol, not the .380 handgun also found inside the van. No weapon was fired. He pleaded not guilty, posted a total bond of $17,500, and the case remains pending.
