911. What's the address of your emergency? It's okay. Tell me exactly what happened. So, my mom had texted me asking me to come home that she needs witnesses. And as soon as we started walking up, she started yelling, "Stop. Don't hit me. Stop it. Don't touch me." She said he choked her. She said she choked her out. He took her phone. Is it now in her room yelling at her? Who is it that doing that to your mom? Um, he is my littlest brother's dad. Okay. Hey, Bloomington Police Department. Hey, what's going on? Hey, man. Are you Reginald? Yes, I am, sir. Hey, sir. I got a body came on. How we doing today? Doing pretty good. Okay. I just got called for an argument. We are arguing. Yes, we are. Okay. Everybody okay? No. Okay. Uh, my partner's coming. He's going to talk to you, ma'am. Reginal, would you mind stepping out and talking to me real quick? Thank you, sir. I got my cigarettes real quick. You don't mind? Oh, you got them right there. Perfect. All right, sir. I'm officer call. Like I said, I got a body cam on. Um, we got called out here for a fight. Just yelling and screaming, stuff like that. Who call? I can't give out that. Okay. If no one calls you, if no one calls you, there's not an argument. She's not an argument. That's not an argument. You still We were called. I didn't you came the door. Yep. I showed up to 516. You've already told me that there's a little bit of an argument. That's okay. That's the less of this the law. She's okay. I'm okay. There's not a problem. Okay. Well, when I asked if you guys were okay, you shook your head and said, "No, I'm not." She shook her head, too. Okay. I'm upset. But she didn't say, "Hey, we need the police. Police come in." Yep. Sir, come here. Sir, come here. Touch me. Okay. I'm going to You're not going to go back inside the house. Okay, because she didn't call right now based on based on what the callers told me, you are detained right now and you cannot leave. You understand that? Did you want to uh do you want her to detain? Sir, listen to me. I just don't listen to You're not going to talk to me. I can talk to her once cuz I'm under arrest. I did nothing wrong. Okay. At this point, you're trying to interfere with the investigation. Investigation. I'm telling you, come talk to me. What's going on? He's going to talk to you to her. They can talk to her. She didn't call the police. She said the police. She's not going to tell me by law. I can't talk to her. You know what I'm saying? Until she calls the police. Take a deep breath. There's no need to take a deep breath. You guys come here every week for the same. I haven't. I'm just saying in general, we're have a conversation. I'm allowed to have a conversation with my son's mom. She didn't call you. So, there's not a problem. Okay. When he came in, if there's a problem, yeah, we're arguing. That's the only problem. That's why we're here, man. She didn't say, "Hey, leave my premises or go home or none of that." So, there's no need for you guys to be here. Am I wrong, my right? Don't call my parole officer and we can go discuss the laws, however you guys want to do it. But, I've done nothing wrong. You see what I'm saying? So, can I finish my conversation with my son's mom? No. What is the reason? So, we're investigating a domestic dispute. We we're going to separate the parties. There's no parties. She So, you're you're invol you guys got to be separated. I speak to your your ship supervisor then. No, it doesn't work like that, sir. So, tell me. It doesn't work like that. Nope. We're on duty. You're on duty. I can speak to your shift commander. You're telling me no. Okay. Um Okay. Say less. So, can you tell me what's going on? No. You are refusing to provide a statement. You won't tell me what's going on. And I told you your supervisor and you deny me that too. You're not allowed to speak your supervisor. We don't have a policy. What happened? Don't ask him the same question. You just ask anything I want to ask him. Go ahead and ask him. He's going to tell you the same question. But he has the right to answer for himself. He has a voice. Speak. Ask him. I don't need to ask him. Okay. So, you just told me though. Am I being detained? Yeah. Okay. For what? Uh, we're investigating a domestic. Okay. You're investigating a domestic. There's no domestic here. So, you can't detain me if there's no law or no crime being committed. You're not free to leave? No. Why you're not free to leave? Cuz we're investigating a domestic. We're investig. I told you no already. Okay. Do you want to, sir? I'm not going nowhere. I'm not. You are not allowed to go back in. Go back where? I'm not going nowhere. I'm standing. You're going to stand right here. I'm staying where I want. You don't have to provide a statement, but until you've arrested me or detained me, I'm not under arrest. That is the law. I just told you you're detained. Okay. For what? You're not free to move. What am I detained for? We're investigating a domestic. You're investigating. Where's the domestic? We are under the impression you might have committed a crime. Since she says I beat her or put hands on her, there's no domestic. Okay? You understand what I'm saying? There's no there's an argument between me and my son's mom and that's okay. Tom 12, we'll take one more. No rush. Okay, sounds good. Sounds good. Would you like to tell me what's going on other than yell at me? No. So, you're refusing. You're not listening. So, I'm telling you, we're investigating a domestic. So, what happened today? Nothing. Me and my son's mom are having an argument. That's it. Okay, cool. So, until my partner is done talking to the people inside, we're going to hang out with you. That's what we're doing. But then you're detaining me. I just told you I'm detained. You're not I had no crime. I had no charges against me. We have reasonable suspicion that you might reasonable suspicion suspicion. I just told you reasonable suspicion. Okay, you can say it, but like that's where we're at. All right. Can I speak to your supervisor? No, I'm not. I mean, you you have a phone. You can do whatever you want with it, but I will not be calling anybody. That's where we're at, right? So, you don't want to talk, then we we got to talk. She'll be out and say there's no message and you guys can do what you do. Okay, cool, man. The victim's video and statement are redacted, but the incident report states that the victim and suspect shared an 11-year-old son, but were no longer together. He remained jealous and controlling, and after finding out she was seeing someone else, he snapped. Fearing him, she texted her daughter and friends. As they arrived, they saw him speeding through the complex. Inside, he shoved and choked her five times, causing her neck to pop and making it hard to breathe. When she said he heard her, he replied, "I don't care." Crying and shaken, she refused medical help, afraid of getting him in trouble since he was on federal parole. She told officers he had stalked her, sent hundreds of texts from prison, and threatened to kill her. "If he gets out, he'll kill me," she said. She had recorded part of the assault, but he took her phone. The video captured threats, insults, and the moment her neck was injured. Witnesses confirmed her story. Her daughter heard her begging him to stop and a friend saw him grab her through a window. I'm not denying you to talk to my supervisor. I asked you several times, can I speak to your supervisor? You said no. I'm not going to provide a That's your job. You have radio. You have a radio to provide a a conversation between him and your supervisor. Hey, can I get a super supervisor, please? I'm going to drop down because I'm not sitting in a hot car until about and I'll pick you up. That's fine. Are you going to act like a child? If you make me act like a child, I will. But it's in that car, bro. I'm not trying to sit that high car, man. I'm not. You're going to sit in the car. It's time to sit. As soon as it's time to leave, I will get in the car. I promise you that. We're about to leave. So, let's sit in the car. You said we're about to leave. We're not leaving. We're leaving. I mean, what do you want me to do here, buddy? I want you to I want I want to know what's going on so I can make my bond or do whatever I got to do. So there I'm trying to treat you like a man. I understand that, man. And I'm I'm trying to I got But you're throwing a tantrum. I I am. You're going to sit in the car. I can tell you to sit in the car. I can ask you to sit in the car. Eventually, I'm just going to pick you up and put you in the car. That's fine. That's fine with it, man. But I'm saying when we about to leave, I'll sit in the car, but I'm telling you, it's 100 something degrees. No, we're not. You're going to wait for the offic. Just uh brace his head. Brace his head. You know what I mean? Good. You're good. No, I'm not good because I don't know what's going on. No, because you're not going. No, do not. Cuz this is not what's this is not what's right. No, you got to see a judge. Uh, bro, I'm going to ask you guys what's going on, bro. I ain't I a I ain't done asking asking you still it's domestic. I ain't done. You see what I'm saying? The the person in the premises didn't say, "Hey, man, you need to leave or none of that." You didn't call the cops or none of that. I don't like I don't care. I'm right. I have a lot. [Applause] You hit a button. Let someone know I'm locked up, please. I can Huh? Can you hit a button? Let someone know I'm locked up so I can take everything, please. You get three phone calls once you get over there. Yeah, but I I can't use those ones over there. I ain't got no money in my books or nothing. Yeah. Yeah, I can ask you what's going on several times, man. So, I ask you what's going on and you're like, "Hey, man. You I ain't got to tell you nothing." I said, "Hey, man." That's basically what you said. You said tell me no one no one called for domestic, but you're here to arrest me and there was messy two people go to jail. Not just one person. You still working at Bridgestone. What's up? What they got you for? Man, I just missed a coordinate. Yeah, you can get out to Monday. Got you. They said judge prison. He was charged with aggravated domestic battery, strangulation, and resisting a peace officer. According to the report, jail calls revealed he tried to pressure the victim by asking others to get her to drop the charges. He also talked about involving DCFS, claiming both sides should be arrested in a domestic case. Hey everyone, it's Trent, prior deputy sheriff, patrol sergeant, and K-9 handler. It is always going to be funny to me to see suspects in these videos, and I've talked about this in other videos, where they will demand to see a supervisor. They believe it is their right to have a supervisor brought to scene. It's just funny to me. And like this officer said, and he is 100% correct. This is not McDonald's. This is not your traditional customer service job where this officer is going to be mandated by law or policy to get a supervisor to the scene just because this guy is demanding to see one. It doesn't work that way. It's never going to work that way. First of all, getting a supervisor to the scene, that is not going to help this suspect's situation in the least bit because that supervisor is going to be siding with his officer. The officer didn't violate policy or a law. He is not violating this guy's rights. Everything he's doing, he is justified in doing in my opinion, and there is no reason to do that. But also, this suspect saying that I've been doing this longer than you've been on the street. Well, he needs to be making better life choices. But also, that tells me that he should know better. He's been in and out of the system. he's currently on parole or probation, some sort of supervision. And if he has a fourth amendment waiver because of that supervision, then he is automatically detained no matter what. He is not free to leave. But he wants to continuously keep asking that question as well. Am I being detained? Why am I being detained? I'm not being charged with anything. Why am I being detained? So again, he should know better. But just to clear this up for everyone. So you do not need to have charges brought on you to be detained in these situations. Everybody is detained. If you're going to be an involved party in like a domestic violence incident like this one as the potential suspect, you're detained no matter what because these officers need to conduct their investigation to find out if a crime occurred and if he is going to be the guilty party. So, he's not free to leave in the situation no matter what. But he wants to argue that fact and act like he doesn't know any better when of course he does. He's just trying to do whatever he can to get out of the situation. in the female victims portion of this video is redacted and it will be in the report as well to protect her rights because she does have rights as a victim of domestic violence. So that's why that was done. Additionally, this suspect yelling at her and saying it's going to mess up my parole if I get arrested for this. That is technically another crime that is called dissuading a witness or trying to dissuade a witness. prevent them from cooperating with law enforcement because you're instilling some sort of fear element into them or trying to guilt trip them, make them feel bad to get them to change their statement. And I've charged a lot of people with that myself. And another thing, this officer at the end where this suspect still wants to argue and says that she didn't press charges or both people both of us should be going to jail for this domestic incident and this cop says, "Well, in the state of Illinois, she doesn't need to press charges." So, a lot of states are different when it comes to domestic violence cases. The area that I worked, it was a mandatory arrest no matter what. If I was able to establish PC like this officer says or probable cause that this crime occurred and that this is going to be the suspect, we didn't need a cooperative victim or a victim to press charges against the suspect in order to still make that arrest. However, there are some states where it's not like that and they will need a cooperative victim to press charges or in some circumstances it is still going to be at the officer's discretion. Every area is different. Policies differ. It just kind of depends on where you're at. And that is going to be for this one. See you guys in the next one. [Music]
