He punched me in the right here and then I think my hand might be broke. He picked up the drawer out of the RV camper and he slammed it down on me. He broke my phone. >> Okay. And you don't want to be seen by an ambulance or anything like that? >> No. >> Okay. So, what's what's going on as far as from from before all that happened to now? >> This morning, he accused me of taking his phone and I promise you I didn't take his phone. I couldn't get in it if I wanted to. I don't know his passcodes. He's bad about to get put in stuff I'm not knowing you know where he puts it. >> Mhm. >> So, he broke my government issued tablet. He broke my phone. Destroyed the room I sleep in. I don't know what his deal is. >> Okay. So, he >> He burned my home down because he laughs about it behind everybody's back in December. Killed my three dogs and laughs behind everybody's back. that they love I'm afraid he's going to really hurt me. >> That's what I >> I don't have nowhere to go. >> Okay. Um has So, from our call history we've been called in a couple times. Has this this happened before? >> Yes, he hit me before. Blacked my eye really bad. >> Have we tried petitioning for a temporary protection or anything like that? >> So, listen to this. He caught my trailer on fire while I was in there asleep the first time and I it really scared me. So, I went and put a they gave me a temporary the judge gave me a temporary 30-day restraining order. We went back to court. She said that there's no proof of of abuse and that she dropped it. Four months later my my burned my trailer down and I had 12-foot flames coming at my face. No one got charged with it. He gets nobody knows how he started the fire, nothing. I'm and yeah, I've had three restraining orders orders on him. >> Okay. >> Yeah. He's a good guy most of the time. I I just don't know what his deal is. >> Okay. >> I'm not there. This kid came out and yelled at me. I know I never got to [ __ ] strip and deal with them. Never touched the real woman. >> County, I'm here in the lobby with a temp to me, bud. What's going on? >> I have some trouble crazy ass woman, man. This woman keep putting me through hell, buddy. >> Okay. >> Back in April 17th of 2020, man, they didn't even want to black her old 9. I go to jail, cost me $3,500. Never touched the lady. Today >> Okay. All right, relax. Relax. Have a seat. >> I'm sorry. You got me all turned around, you got me crazy. >> I >> I haven't No, I'm not scared. I'm scared to go to the office. I go to jail for this all right. >> Well, so tell me what happened today. >> Yes, sir. >> [snorts] >> Told me to call the county at 9:30. It was They never came. I'm going to bring you to the police station. Thought I had to go to the county. Back home, that woman has been hammering me, man. Trying to get me to put my things out. Never touched my wife. Never hit her. A while ago, she throwed water out the stove in my face with a ladle. Caused me to get an ambulance. When she do that, threw it in my face, I'm going out the door cuz I know what she's doing. Trying to get me to put my hands up or have to leave my property. So, when I went out that door, there was a bunch of blankets by the door that had me. I slid out, hit them blankets. Yeah, I'm I'm getting out of there cuz I'm trying to keep them at escalated, all right? That's why I laid down and the cop knocked on the door, turned the radio He hit me. He hit me. He hit me. He hit me. >> Okay. All right, Harland. >> You need to go see these men. Can you get help you, man? Can you I can't kick you. relax just a little bit. What What What have What have you What have you drank or taken today? >> Nothing, sir. >> Nothing? >> No, sir. >> Okay. >> So, I haven't taken anything. I'm sick of it. This fool put me through hell. I filed for divorce twice. >> Why haven't you followed through with it? >> My home burned down second time. And December 16th, two hours three days after I'm not two days after that Friday Saturday morning my home burned down. I feel I was devastated. >> Okay. >> Now in July, I go back down there and I get my protection payment tomorrow. Following year. >> Okay. Well, so what happened on the protection order last year? >> I don't know, sir. Sir? >> Did she dismiss it or did the judge throw it out? >> know, sir. >> Okay. >> I went to work on a Wednesday morning. And my wife called her that morning for what I had filed for divorce. She didn't meet me at the flea market. She said it's not working between me and her. Sir, when I got home that evening she served me protection order. I told her I filed for divorce. >> Okay. >> That is you got to tell the truth. >> And then so did you see him drive past and leave or >> Uh I just heard his vehicle go up. >> Okay. >> It's [snorts] expired tags. >> About how long ago do you know? >> 15 20 minutes maybe. >> Okay. So, well, for one, we we we've established that this this shouldn't happen. All right. Um but as far as we can do, we can take the the the legal side of it and we can handle that, right? Um and go find him and and and deal with him accordingly. Uh but we need to do we need to to to file for civil protection. I don't know when the last time you did it was, but anytime he messages you or talks to you or anything like that that's a that's a violation. And that 30 days is set there so that you it gives you enough time to to separate yourself from this cuz if if this how he's going to act it it we shouldn't be with him. >> No, I love him but he can't hurt me no more. He can't >> but >> to lose my toe my diabetic real bad and I've been sick a lot. And he just doesn't care about me anymore I don't think. I don't know. I don't know. >> I understand and then he cut your hand how did he how did he cut your hand? >> picked a drawer up that we live in we bought a new trailer house down we we bought a little 28 foot camper and he drawer one of drawers was out of the kitchen >> Mhm. >> and it was full of stuff and he after he got me down and was punching me he punched me like twice. He picked that thing up and I put my hand up like this instead of hitting my face it it hit my hands and the it's with the drawer that he hit me with when he hit me with the drawer. >> Okay. And then and and during this physical altercation did he say anything at all or anything that >> He didn't no. No, I told him you hurt me. You really hurt me. I think you broke my hand. >> Mhm. >> And I told him I was going to walk to the neighbors and call the cops and I guess it scared him and he left. I I don't know. >> Um are you right handed or >> Yes. >> Okay. Will you be able to fill out a written statement or anything like that? >> Okay. Yeah, it just as as best you can. Um and as far as if you don't mind me looking at your pinky is >> Uh And this is kind of deep too right here. It's starting to I mean >> So do you have any plans as far as seeking medical attention cuz this needs to be looked at. This can't just >> I'm my I'm going to get a hold of my son >> Mhm. >> and I'm have my son come and take me to the urgent care. >> Have you called him yet? >> No. >> You you can call him right now if if if >> I don't know the phone number it's in my daughter-in-law's and I don't know anybody's phone numbers they're all in my phone. >> Okay. Where's your >> He's it's shattered it's broken it's shattered. >> Okay. >> And my tablet I mean I I don't have no way to get a hold of anybody. >> Okay. Um I can see in house if we have anything as far as we might have their phone numbers. Um if you have their names and addresses and stuff like that, I might be able to look at it and and see. Um, are they are they Who's your mercy contact that's uh that's attached to your driver's license? Who did you give >> have a driver's license. They took it in for me to take it to my insurance. Okay. I can't even drive out of here. >> Uh, what You're not going to get any trouble driving out here today, okay? Who's your phone number? >> CAN I DRIVE TO MY SON'S THEN? >> NO, YEAH, YEAH, YEAH. You won't You won't get absolutely You'll get absolutely zero criminal charges trying to get away from a domestic relationship. If they have any problem with it, anybody anywhere can talk to Washington County Sheriff's Office because right now I'm giving you permission to do that. Does that make sense? We will document this, figure out what's going on over there, and I will follow you out and make sure that that you you leave this area safely. Is there anything that we need to get from the house that that you would like to grab for a couple days? >> No, if he goes to jail, can I not come home? >> Yeah, I mean, we'll we'll We're going to go do everything we can to locate him, right? Um, but I mean, we were you're more we're more than happy to You just got to call up here and let us know. I don't want to lie to you and say, "Oh, I'm going to call you." and then I get I get very, very distracted or or have to go to another call and we arrest him and just get the time to call you. But yes, so when he broke your phone, why why did he break your phone? >> Cuz he thought I took his phone. I really didn't I really didn't take his phone. I didn't. >> I got you. Uh, did he at at any point in time find his phone? >> I don't know. I Most of the day I would either walk up top the hill just to keep from confrontation, you know, or I'd come and sit in my car and Finally, I just got thirsty and I walked back down there to get something to drink and >> Okay. So, I'm going to do I'm going to go ahead and take some photos of you. Um, I'll get you a written statement to the best of your ability to fill that out. I'll get you some paperwork that we can that we can explain to you. Um, and if you're not wanting to go, uh, I'm still going to have to go up there and make sure that see if he's up there or not. Um, and you're more welcome to just wait here or go up there with me. >> He's destroyed. He usually sleeps in the bedroom and when I'm here and not at my son's house, I sleep in the living room part. He's totally destroyed it. >> Okay. So, let me get let me go ahead and snap this. Stand just normal and like you are. >> No, it's not right for nobody to be beating on a man. Woman beating on a man or man beating is not right either way. >> So, at the point where we cannot communicate properly with our words, then we need to separate, right? And and you and I can agree on that. And and no No way should a an adult have to use violence to get a point. Does that make sense? And that's what we That's These are the resources that we're going to provide to you to to try to get get that going um as far as >> So, you guys have given me a temporary one, but do I need to go see the judge at the court? >> So, you'll have to You'll have to petition for the temporary one. >> Okay. >> I can't I can't petition it for you, okay? Cuz you have to You have to take that initiative to do it. Um but, we need to. I'm going to provide you I'm going to provide you a bunch of resources of temporary housing and some people that uh the women's shelter they outsource for a lot of stuff too that uh if you're needing help to get away from this toxic relationship, we get you up on your feet. >> It's just a shame it comes to this because we've been together almost 15 years. I mean, I'm 60 years old. I don't need to I don't need a man anymore. I don't care. >> All right. And then nothing else as far as the cuts and scrapes. All right. Well, we let's walk over there. Let's go uh get you a You don't need anything from the house? >> I don't know. But, I want everything I'm doing to check my phone. >> Of course. >> I wish he wouldn't have smashed my phone so you could see the video of him telling me that he He burnt my trailer with He hoped it would have been me in there than not my dog. And my dog's 15 years. I had a brand new trailer that I had >> So, you should be able to take the the the the the memory card that's in that phone and put it in another phone and still have some of the some of that data saved. I'm not going to be the >> I don't want to I can't I can't I can't prove it. >> expert. >> I can't prove >> And he probably just says that to me maybe cuz he's mad at me or something to hurt my feelings. I'm not sure. Uh that's the story he hit me with. >> Okay. >> Here's my phone. >> Okay, was all this in the camp in the in the the residence? >> Yes, you can come here. I mean, this was I mean we never fully got it cleaned up yet, but yeah, this is what he's done to it. Right here's where he had me down. Where he hit me. Yeah, this is It was I mean, it's so disgusting. >> Okay. I got you. And you don't need anything out here, correct? >> No. >> So, let me get you that paperwork. Um and then we'll try to get you that statement of fill it out as best you can. Um and then if you have any questions, I can answer those as we go, okay? Well, Harlan, I I I I've listened to what you said. >> Yes, sir. >> Now, I haven't talked to her, but the other deputies out there have talked to her and he did say that he has PC for your arrest for domestic battery in the second degree. >> Here we go again, man. I keep telling you that. >> Hey, I I don't I don't know what's going on. I didn't have anything to do with the investigation, okay? But, what we're going we're going to need to follow follow the rules and do what we got to do, okay? >> I'm going to arrest you again. >> So, I need you to stand up, turn around, put your hands behind your back for me. All right. No, just put your hands behind your back. Harlan, put your hands behind your back for me, buddy. Let go of your arm. >> I'm >> going to like turn this off and >> Do Do absolutely whatever you need to do. >> the ice that he can go ahead to keep the fish he catches cold. So, you can take this >> That's where he's sleeping. >> Okay. >> I'm going to start this cuz we have There's red kings out here. Big big red kings. >> Okay. Yeah. >> Yeah, I had She had had to get me a phone. Let me fill it out up here? >> Yeah, we can fill it out up there. All right, that's where all my paperwork's at. So, for future information All right, I want this to be the very last time you and you and it's Harlan, correct? Is that how you pronounce it? >> Harlan. >> Harlan. So, you and Mr. Harlan never have these kind of issues, right? In a perfect world, we'd never have any kind of domestic violence. But you can't get in trouble for like traffic charges if you're trying to leave a an a incident where you're in physical danger. No No cop is going to try to give you a ticket for no license or no insurance if you're trying to leave something or if you're even drinking and this happens and you're trying to leave the the situation and you're you're you're you know, too impaired to be operating a motor vehicle, but you're trying to get away from an you know, a situation where you're in physical harm, we're going to deal with that. That's the that's the more of the two evils as far as you know, if one crime's being committed, I'm worried about that crime, the physical domestic that's harming you versus the traffic charges. Does that make sense? >> Yes. >> Do what you got to do to get away. >> So, you told me if I took off and moved my car, they was going to call cops cuz I just got my very first ticket for no insurance. You know, we were at your gun farm and then they took my license over and never even had a ticket for my life. And >> [clears throat] >> so yeah, I paid $1,500 and then I got my license back. >> Okay. >> But I'm waiting on my disability cuz I'm I'm type 1 diabetic and and a bad diabetic and >> So, if you want to if you want to jump in the car to to you can do whatever you need if you need to start it to get the air cool air going. I'm going to Okay, well, I'm going to grab Well, I can open up the back of my car if you want to sit in the back of that to just leave that that back door open for you. All right. So, I'm going to explain a little bit of information for you. This is going to be your copy for the orders card. So, this is just some of the resources that are available available for you in situations like this, okay? So, a lot of it's going to be all of the the numbers important numbers for you to to try to hold on to and and and get a hold of. So, one of the two things that we we recommend is the Peace at Home Family Shelter and the Northwest Arkansas Women's Shelter. Like I said, they help with temporary housing. Let's say that cousin or or son that you know, they're either out of town or something where you need, you know, somewhere to stay for a little bit. They those they they outsource, too. So, like they need to get a hold of a motel that hey, can you can you hold on, you know, give her a room for a couple days that she can get on her feet, she can get away from this this situation. Those are good people that to to get a hold of. Um as far as over here, the temporary protection, I did you go to the courthouse the last time? You know how long ago it was? >> Um let's see. My it was like my place he the place burned December 26th of this year. >> Okay. >> And um it's she turned I asked for a 10-year one uh >> Mhm. >> 4 months before that. >> Mhm. >> I don't know the date cuz it was 4 months be- before December 26th. >> So, it'll be at the Washington County Courthouse. It's off College. So, here's going to be the address right here. So, what you're going to do is this case number, they can you can already uh provide them this case number. We already are going to have a report on it. Right now, uh my one of my partners is already got him down the road and he's in he's in handcuffs and going to jail, okay? So, right now he's >> him. >> Yes, he's he's already going to get booked into jail. Um and he'll get a no contact order that's issued by the judge so they shouldn't contact you before the arraignment date. That is different than this temporary protection. You have to fill this out. So, if he contacts you with the no contact order, the most we usually can do is give you a ticket. And that's not going to stop it. Worse the temporary tech protection, you have a a whole hearing on it so that it can become permanent for the next 10 years. So, that's information that we need to to think about, pray about, sit on, just to to to to soak it in, okay? Um as far as this Laura's card, do you have any questions at all or anything I can answer for you? This is your copy here. Like I said, I'm Charles Graham. It's going to have the case number. So, you can hold on to that. You can fold it up and >> Can you all please don't oh or him out? >> So, no. That is That's not how that works for the for the domestics, especially in this situation. So, they will they will not be able to just let him go. Okay? >> If there's nothing else, I mean, I'll stay gone tonight, but I'd like a little time to at least come and get my stuff because I have to leave here. >> And that So, that um especially that So, they're open Monday through Friday, the courthouse is. The faster we get that TPO, if he's still in our jail, we can go serve him. Therefore, this would be a restricted address and he's not allowed to be down here. So, if he shows up down here, it's an arrestable offense. >> Okay. >> Make sense? >> Yes. So, I can go first thing in the morning. I can have my Somebody's going to take me. >> Mhm. >> Okay. >> Yeah. Absolutely. Um so, I'm going to go through and I'm going to ask you a bunch of questions. How long How long have you two been together? >> Almost 15 years. >> 15 Almost 15 years. Okay. Are you guys married? Okay. All right. Well, >> Never. >> That That That'll be the op- You'll get that opportunity when you go to court, Harley. >> He said I didn't hit her, man. >> I >> He said I didn't hit her, man. I didn't hit her, man. >> Who are you living with down there, Harley? >> Gina Gibbons just nuts, man. This woman has put me through hell. >> Well, y'all been having problems, ain't you? >> Hell, yeah. I come down here to get help. You got to go to court. You know he's going to be waiting on you. Well, I got to Thank you, man. But I'm all right. Every time I come to the cop, I mean, I get arrested. >> Well, it's not you coming to us. It's you not staying there and giving your side of the story when you get >> my statement to the officer. I never touched her. >> But what what why didn't you stay there at the house? >> Uh cuz she has destroyed my phone. >> Okay, how did you get here? >> I drove my car right there. That drove me here. >> Okay. >> For help. >> Okay. Har- Harland not there. Just have a seat in that chair, brother. >> Can you tell me how I'm supposed to take my stuff? >> Well, >> [snorts] >> Okay. So, what I'm going to do after they after you go in here, if you give me permission to, I'm going to go out to your car, >> The key would be fine. >> Okay. Hang on. Hang on. Well, I'll Listen to me. Lis- Listen to me. Listen to me. I'll go out, roll your windows up, and bring your keys in and then put them in your property. That way when you get out, you'll have your keys to your car. Do you give me permission to do that? >> No, sir. I don't. >> Okay. Then I'll leave it sitting there. If it's not there If it's not there tomorrow morning, that's on you. I gave you the opportunity. Well, I'm just saying when you get out, if it ain't there, if your car's not there when you get out, that's on you. >> Thanks. >> Hello. >> How's it going? >> Wonderful. That is Mr. Harland >> Have you been sick? COVID anything like that? >> No, ma'am. I swear I didn't know that. I'm very upset. >> Why are you upset? >> My wife broke through my baby in the restaurant. here. trying to get help from these people. >> Okay, do you have any injuries for me to be aware of? >> No, ma'am. I got food in my damn face. >> Okay, do you know where you are? >> Huh? >> Do you know where you are? >> Yeah, I came here for help and I'm being arrested, boy. >> What's your date of birth? Okay, have you been here before? >> Oh, no. >> No? Okay. >> Yeah. >> I'll be a couple of minutes. >> Okay. All right, let's go. Come on. >> All right, I'm just waiting. >> Come on. >> All right, show me your hands, please. Open up your mouth so I can get your tongue. Close your teeth, keep them in your mouth, show me your gum line. Go down. Go up. All right, show me your hands one more time. Lift up your feet, wiggle your toes. I need to take some pictures of Harlan, do me a favor and stand up, sir. You stand up straight right there, hands down to your side. Okay. Hold your arms out and hold your hand flat like that. Okay. Just flip them over. All right. All right, I'm done. >> Yeah. What were you doing here? You were being obnoxious a while ago. >> Huh? >> What were you doing being obnoxious a while ago? Why don't I just bring you back? >> Is it this way or this way? Hands up. >> Go with that gentleman right there.
