I want to go back in the back room with him. >> Why is that? >> I think he's pretty tough. I want to see how tough I am. I'm 60 years old. I'm not. Jesus Christ, dude. >> This thing is not >> I know they're My hands are blue. >> No, they're not blue yet. >> Yes, sir. >> Hey everyone, it's Trent, prior deputy sheriff, patrol sergeant, and canine handler. I've said this in prior videos, but domestic violence calls are some of the most dangerous calls that you can respond to as a law enforcement officer for a wide variety of reasons. And when you have a situation like this, which I've had to deal with myself, where you have a belligerent, angry suspect that exits a home and wants to yell and scream, clearly there's no reasoning with them. There's really only one way to deal with somebody like that, and that is to immediately grab them once they once you see that they are not going to cooperate in any regard. put them in handcuffs and put them in the back of your patrol car as safely as possible and then try to finalize your investigation because the last thing you want to do is have them go back inside the house where they could potentially access firearms or other dangerous weapons, come back out and use them on you as a law enforcement officer or themselves. Sometimes you'd have to end up getting a search warrant if they barricade themselves and refuse to come out. It can get very messy very quick. So, since he already came outside, sometimes that's just the best route. Plus, this suspect had just committed a violent felony where he had punched his wife in the face and she has visible injury. But obviously, this officer wanted to go a different route. And I have no clue why he did this, but he decided to provide this suspect his supervisor or sergeant's desk phone number. There's only two reasons I could come up with. A, this officer and his supervisor are buddies and he thought this would just be a hilarious prank situation. or B, he hates his supervisor and doesn't really care about his career, what happens to him, because that is a huge no no and he can get in big-time trouble for that for sure. And I've said this in prior videos as well, just because somebody demands to talk to your supervisor or wants to see him, there is no law or policy that mandates that you have to oblige them as a law enforcement officer. You do not have to do that whatsoever. That is going to be up to you if you decide to call your supervisor to a scene. But you definitely are not handing out their phone number. And then the officer obviously pushes this guy back away from him to try to create distance because he perceived that this suspect was trying to hit him on his head with his cell phone. And that's what's articulated in the report. So for use of force, we're going to go to the Supreme Court case Graham versus Connor, which dictates that the reasonleness of a particular use of force is going to be judged by the perspective of a reasonable officer on scene given that exact set of circumstances and they are not going to be burdened by 2020 hindsight. So that's how he articulated it. And yes, if a suspect is going to be hitting you, striking you, that is going to be battery or made that attempt, then yeah, you are justified in pushing them back away from you to create that distance. And if they trip and fall, then so be it. That happens sometimes. And the suspect gets humbled right away and comes down several notches in terms of how up he was and how angry he was and his yelling and his screaming. But then later we see he gets handcuffed, put in the back of a patrol car, and then he wants to become a handcuff hero again at that point and starts to yell at these cops to beat him up once he gets to jail or whatever. But really, he's just incredibly intoxicated and probably not too bright. That's going to be it for this one. See you guys in the next one. >> He was charged with domestic battery and aggravated assault on a peace officer, but remains innocent until proven guilty. [Music]
