Just before 11:00 p.m., officers rushed to an apartment in Lake Township, Ohio, following reports that someone has been shot. >> Police. >> Hi. Hi. So, um the body is upstairs. Um and >> Okay, Mom, I'm going to let you go. >> Okay. So, it's upstairs and then um to the right. >> Gun switch, sir. It's on the dresser. >> Where's it at? >> It's over there. I cleared it. >> Oh my god. >> No, it's up there. It's on by my TV. No, sir. Other TV behind me. 10 mm. >> All right. >> Inside an upstairs bedroom, officers discover 15-year-old Symone Moore with a gunshot wound to the head. While one man performs CPR, police secure the suspected weapon. As a police body cam show, plays on the television. >> Any other guns? >> No, sir. >> The officer collects the firearm, which is later entered into evidence before returning [music] upstairs. According to the incident report, Symone was pronounced dead at the scene shortly afterward. As more officers arrive, the investigation begins. >> And then I didn't know, but there was blood on my prom shoes. So, I touched her blood and I was And then I washed it off in the sink. >> Did the box come from upstairs? >> Yeah, it was It was right next to her. >> Where's the gun at? >> Upstairs, straight from my right. >> Is that the gun? >> Yes. >> Is it clear up there? Can they get >> Yeah, it's it's what I >> What's up? The officer collects the firearm, which is later entered into evidence before returning upstairs. According to the incident report, [music] Simony was pronounced dead at the scene shortly afterward. As more officers arrive, the investigation begins. >> Who am I talking to? >> Okay, go ahead. >> Just just just come downstairs. I was cleaning my gun. Um It was jammed. I couldn't figure out what was wrong with it. I took the mag out. I cleared it. There's nothing in there. I cleaned it again. I put the slide off. I put it back on. As I go to like reinsert the back onto the clip itself, it went off. There was There was just like that. First thing I did was call 911. And she said CPR. I told you guys that's exactly what I did. I've done that a thousand times. It's never happened had it happen like that. I don't know what's going on and why it did that, but it never happened. >> Yakub insists the weapon accidentally discharged while he was cleaning it, but investigators aren't ready to accept his [music] explanation without asking more questions. >> He's still in there. And so I have What's up? >> I don't know what the [ __ ] is it. >> What? >> I don't know. >> I don't know what the [ __ ] is going on. >> That's not true. I'm sorry. I didn't know there was a .22 upstairs in that room where that was fired. Is there anything I can do? >> All right now, just hang tight. >> I called my mom. >> Can you hear me? All right. >> I don't know how to say this, but the gun went off. Yeah. >> So, she's dead? >> Um This is right back here, and I'm pretty sure she's dead. There was a bullet jammed. There was a bullet jammed in the chamber. I was cleaning it out. Um there were two that were actually jammed. I cleared the first one out, and then I put the second one back on. The hammer re-engaged, and it went off. Everybody in this house is great. I got a problem with my gun. It's never happened. I'm not here hurting anybody. >> What's that? >> I don't know what I could have done different. I've done that a thousand times in the summer. This jammed before, but it's never launched the bullets. Cuz before you guys got here, before I started CPR, I cleared it just to make sure I got it cleared twice. And two of the the one round that was still fully intact came out, and I set that next to the gun with the dis-chambered Um and they were both It's they're both gone. And ever since then, it's I've been on edge. I've never had this happen before. I sleep with my cleared out gun on my safety at night. I don't know almost 24/7. I'm not home with it. It's just like go take your biggest [ __ ] war. I don't know what I was thinking. It's because of what I saw. But I'm going to go up and tell them what I think. She's not >> And she's what? >> I'm going to tell I'm going to say that she's not breathing. >> With the weapon in her hand. >> I don't know how to >> I'm not Yeah, I'm not up there now. I didn't >> Well, from what I saw, it looked like it hit her right back here. >> What? >> There was no exit wound, so it wasn't a clean shot. I tried CPR. I checked for a pulse two or three different times. There was no pulse. Unfortunately, or fortunately I should say, I've never had anything happen like this. All this stuff that I worry about when all of this is done, and through about getting my sales firearm back in my possession? >> Well, it's going to be a while. >> I figured. Cuz it's going to have >> It's not going to happen until we have this open and until >> It's 5 days. >> Everything's done. >> Yeah, I figured it would be something along the lines of that. I just wanted to know. >> Jacob then asks when [music] he might get the gun back before making another unusual request. >> May I go home with my girlfriend cuz I'm going to be I can show you my phone. >> Proba- probably not. >> Well, there was an accident because she's never done anything like this before. >> And with the >> Another excuse. >> The medics don't want to give it to him right now. >> Jacob then asks [music] when he might get the gun back before making another unusual request. >> Howdy. How you doing? >> I want to get back to my appointment this >> What's that? >> I want to get back to my appointment this >> Military? >> Two years. >> What branch? >> Marine Corps. >> Okay. What's your name? >> Jacob. >> Jacob, what's your last name, Jacob? >> Eisner. >> Eisner. What happened tonight? >> Um my gun's been having a problem the last few days, but yeah. So the girls were talking to me. >> What kind of gun? >> Uh 10 mm. >> Okay. >> I I can probably bring it to you in a minute. I was sitting But I was sitting on my floor and it pointed this way. I guess it was something having a problem with the jam the last few days. So I was there twice before I opened it and I had to try to go everything out of that. So they might have been here twice. Um I took everything off. I tried so I couldn't I couldn't find a problem with it. I you know, I I I didn't know what the problem was with doing it. Um as soon as I split the slide back on and it engaged the the end of the pin, there were two rounds that were stuck simultaneously with this that I didn't see. And as soon as it did, it pushed the other one off. >> All right, who are >> Who are you in the office? >> Um I'm sitting in >> There's no time? >> I'm not calling you. >> Okay, you're not calling me. Okay. What are you going to do? >> I'm sitting >> I'm She said are you guys going to want to talk to the other Nobody else is here except for me on the sofa. Was he here tonight? >> Yeah. >> Did he want to happen? >> Yeah. He left probably the reason he why he left is because it took back way too much. So, he was like I I >> Yeah, he's going to need to come back. >> You guys want him to meet at the station or back here on the sofa? >> Station's probably fine. >> Yakub continues repeating the same story, [music] but reveals that two other people were inside the room when the shooting happened. According to the incident report, one witness later admitted the group had been drinking and claimed Yakub was playing with the gun moments before it fired. >> That doesn't look suspicious or anything. >> Really? I tried not to, but I was more focused on that. >> Defense? What's your situation? >> Well, as I told the other guy, told me my deployment is not something I ever wanted to see again. >> Your deployment days? Expound on that. >> Uh I was in the court for 2 years. >> You were in the Marine Corps for 2 years or What What unit were you with? >> Like my MOS or >> Are you unit? You assigned to a unit after training? >> Yeah. So, I went through my MOS with my 2336 Delta. I went in for EOD. Um I've been out for 3 and 1/2 4 months. I'll be honest with you, everything's a little fuzzy right now. >> Okay. So, >> Yeah. >> Um are you going to take his gift shoes? >> I told him I said if I'm assuming you guys want to take me down, then I would have to go upstairs, grab my shoes and socks real quick, and so I should like it, but otherwise yeah, I'll be out of here. >> You said in that room Okay. I'll grab that for you. >> So, he just informed me there was somebody here that left prior to our arrival. >> There was so we were three people here. It was me, her, and then there was my other buddy he served with me. He left so we got to you know we saw the same he couldn't handle the sleep offensively. He's going to meet us. Yeah, he was sitting right next to us. So I was sitting my bed was here. I was sitting here. My friend sitting over here and then Three of us were sitting on the >> Okay. >> Do I need to take a phone charger with me or can I charge it on my own? >> What kind do you have? >> C. >> No, we got C's. >> Still okay if you have the case in the truck if you know she'll be right next to the other round ones. >> The female upstairs what's her name? >> Uh Simony. >> Simony? >> Simony. >> How do you know her? >> Perfect. So she was having problems at her friend's tonight I asked her if we could figure it out. I said yeah that's what we were okay. Um >> So she came in to >> to just hang out. >> Yeah, I don't know what her number is or Um they were leaving actually shortly. Um I got a love letter and we agreed to go back to my place. >> Okay. Okay. >> I just don't understand how I feel like I have every night in the same bed. I wake up and I feel I go to bed every morning and I go to bed I can't go to >> They said she was just asleep. >> Mhm. They did? >> Is there any other information I can give you while it's still fresh in my mind? >> What's that? >> Is there any other information I can give you while it's still fresh in my head? Thank you, sir. I got work. >> What's that? >> Okay. >> Was there a pair of socks in that top dresser? >> Uh I don't know if there was any in the top dresser. >> Yeah, I got you. Whatever works for you guys. >> You embraced it a little bit. >> Yeah, not the first time I've had to do it. >> Um You don't have to ask me what is that like the hands and the firearm. >> Cover all our bases. I mean, it's just >> I I mean, if something like this happens, I just got to cover you know, that's everything and anything, you know. Is there any anywhere blood anywhere else on you at all? >> Uh there was some on my foot, but that got cleaned off. That was it. >> You cleaned that off on your foot? Which foot was it? >> My right foot. >> Right foot. Okay. >> There were like literally three small dots on it because when I went over there, I pulled her off the bed cuz that's what she asked me to do to give her CPR. Um and then when I pulled her off, I just slipped over her. >> Okay. >> I don't know if it was We we've been having a problem so like if you look on this frame under this shelf, there's either like rust or some sort of like orange paint or something on the top of the frame towards the where the actual tip of the barrel is. That was the problem. I don't know if it was just sticky and it got lodged in there. >> Grab photos >> [snorts] >> of >> Cuz my buddy who's like who's registered on it was like >> Yeah, you can make them up. >> chamber one before. >> [music] >> a thousand bucks. >> Oh, yeah. I mean, you know you're a teacher. Like I said, you've been in a brain course, so you know, you you should know first thing about firearm safety and handling. >> You would think I would know damn near everything about it, but they still surprise >> It happens. >> for photos. >> That's That's what's better. >> Okay. >> Was that down here when >> No, she put it back. >> by the bed and I grabbed it because it was underneath or like my purse was on top of it. So, I grabbed both of them because it's my prom shoes. >> Okay. All right. You got it. Plus, I it is my car should be toasty from sitting here for a while. I wonder if they make lights that being colder than the Polar Express itself. Not Not a lot of room, so >> Like I said, grandma's cabin used to be in the back. >> I didn't know it would get that bad. >> [music] >> Can I I've never made a mistake with a weapon. I was raised so heavily on gun safety. And what I don't understand is because when I cleared it, I had it on the floor. And as soon as I turned it around, I heard click boom. [music] It was that simple. My hand wasn't even on the trigger. I had it on the side of the Like Never put my hand on the trigger. Just in case. I just I'm just I'm I'm not even like I'm still grasping the fact that she got shot. Yeah, but I'm grasping the fact of how because I have never less than trigger. I think I have once or twice, but I have never seen, you know, a a pistol like that chamber two rounds. Now, between the blood on the floor and my sheets and everything, how is that going to work? Like, do I get to go back home? Do they clean that out? How does that work? >> They're probably going to be processing that, I would imagine, until tomorrow. So. Well, very likely, I don't know what it would be, but you're going to catch some kind of charge because somebody died. So. >> Do you know roughly what it would be? Or do you have any idea? >> I have no idea. >> I'll I'll tell you what though, the one thing that hurts worse about this case is the fact that she was so young. That's what hurts. >> How old was she? 17? >> 18. >> But I'm trying to make some sort of light of this situation. >> We uh >> This metro is like, "Do you know how to do CPR?" And was like, "Well, ma'am, I was a lifeguard for 7 years. I would hope so." She was like, "Okay, do you need me to count for you?" And I'm like, "No, no, I'm okay. I promise you I I have more than enough extensive training on how to do CPR." >> Yeah, I know. >> like, "Man, that's all you." And I was like, "Yeah, I couldn't do anything better than what you were doing, so." That was definitely something I'll think about for a hot minute. So, yeah. >> The fact that I put him in your case is top three worst cases. >> Mine. >> Always yours. >> She was like, "Yeah, just went out the uh went out the officer that stayed in there with me for like 6 hours." >> [laughter] >> Top three worst cases. Really something to be proud of. Go Jake. >> At Lake. >> [laughter] >> Go Jake. >> I don't know what hurts more, the fact that she was so young and the accident happened, seeing it and reliving it, or the fact of how her parents are going to react. And my uh her her best friend made a joke and she was like, "I really don't want to do CPR. I'm just going to use your eyes and light." >> [music] >> She was like, "Well, as strange as that is, thank you." But yeah, she was not the driver of that shift. She didn't want to go to it. I'm just like, That's really too soon. [music] Too way too soon. >> Yeah, that that's somewhere you learn in your basic training. >> [laughter] >> See, as much as about the situation that I want to laugh just because I use laughter to cope, you know, hear that. That's just what I do. Like, humor is my way to solve a lot of my problems. But just kind of like on this situation, I don't want I want to because I know it'll make me feel a little better, but at the same time I don't because I'm just like, that's not something I really want to think about. So, there's like one specific part that's continuously replayed. >> Mhm. >> It feels like the only part which is the fact that like, you know, as soon as I put the slide cuz like the way it is, you have to like hold the slide back and then lock it to then, you know, flip the switch back up to where it would close it. And it was as soon as I pulled it back because the way that it is because it likes to get stuck right before you can like truly lock it. So, I like like threw it back into it, and as soon as it just >> [music] >> hit. It was just enough pressure. I don't understand how. But, I was sitting kind of like this, right? And she was laying on my bed. She was kind of laying like if you were to lay like that, it was pointed towards me cuz she was like laying on the side of my bed watching TV. We all were. Actually, we were watching Pit Bosses. And um you know, I'm clearly going to go to the gun, and I like threw it back into it. And as soon as I did, my the my my hand pushed it up, and as soon as it did, it just was enough to discharge it. And I immediately heard it, and I looked over cuz I thought, you know, I broke the bottom of my bed. I was like, okay. Scary, terrifying, but it rolled off the wall, it rolled off the bed. Nobody gets hurt. I would rather that happen. Small accident. Big deal. And then the moment I look over, it's just I'm just like, Go around, get everybody out, call the cops. That's where we ended. And uh my friend was like, call the cops, call the cops, call the cops. And I'm just like I can't find my phone. I have to find my phone to call the cops. >> Yeah. >> And um my girlfriend, she was just like, um um um I was like, you you need to get up. She was like, why? And I was like, because this will literally drop dead. She was like, what about you? And I said, I've seen worse. Literally. I I promise you I've seen worse. This as much as it hurts to do, as much as this is going to hurt to do, like to do this here, everything to her, I said, I I have to do this because he can't, you won't, and I'm not waiting for the paramedics to get here. So, it was just That's that's the part that's replaying in my head. That's like the only part that has me like continuously shaking my leg cuz if I was sitting here like, you know, if I would have held it all straight here, and pointed it at the floor, and like, you know, maybe like tried to like pull it down into the floor or something, or, you know, if I would have cleaned it like 30 minutes later, or [ __ ] 30 [music] seconds, or >> Yeah, anywhere in a million. >> Like if they would have gotten ready to get up, and you know, nobody was in the room, you know, something. Like every I'm thinking of every little detail that could have, you know, could have been changed. >> Yeah. >> You're a little played. Um I remember telling one of you guys it was like, you know, like where was everybody? I was like, well, I was on the floor. I was still laying down. I was on the other side of the wall. She was upstairs. Like I remember how she was laying. I remember how her hair was. Like I remember where my girlfriend was how she was standing, cuz she had literally just walked back in the room. I remember that for a fact. >> So you >> She did. I swear I could like sit here for hours and just be like, what about this? What about this, you know? Cuz my buddy was like, well, hey, you want to go do something? I was like, no, no, I just want to stay home. I was like, what if I said yes, you know? Or or something, or what if I would have said yes to picking her up, or, you know, I think one of the things that hurts me the most was that I told her she was going to be safe in my house. I said, nothing's going to happen. You're safe in my house. >> That's one of those things that will be stuck in your head for a bit. >> I don't think I'm going to have people over for a while now. >> [snorts] >> Damn. I might have to go in at 30. Very likely. That's fine. >> What was your idea? >> No. I was going to do some, you know, targets, but that probably is going to be a minute before I lay my hands on a firearm again. Maybe give me a week. >> All right. Fish more. >> What's up, man? >> Put your hands behind your back. Hands behind your back. >> I am. >> Put you put your palms >> Palms together. >> Can you tell me what that means, please? >> No, that's fine. >> All right, not too tight. >> I understand. Do you know if my phone is still on there? >> Yep, you can transport it with your hands though. >> What? >> That's not good. You'll find out that I was not privy to the information. I'm just a driver. >> Okay, that's fine. >> All right. >> Appreciate you. Am I not allowed to call my mom? Am I not allowed to call my mom? >> what we're going to do. We're going to take a seat, okay? We're not going to talk the whole way down, okay? Take a seat for me. >> Sir, I am I'm ready to call my mom. >> You can get one when you get to the jail. >> Yes, sir. Sir, do I have one quick question? Yes. Um the guy said that if anything were to happen, I just have my two babes on me. >> They said they would take a video. >> Okay. >> Um they said that before they took me, um I would be able to get a list of uh a few phone numbers from my cell phone so I can call call somebody. How does that work? >> Who has your cell phone right now? >> Uh that gentleman has it in there. >> Oh, then no. If it's already seized and booked, we can we can't take it out of booking. >> No, no, that's [snorts] fine. >> [clears throat] >> Um he said that if I left or anything that I would be able to get a or a cell phone like a number out of it. >> Yeah, I I got no way to do that, man. >> Can you ask him? Cuz that was the gentleman who [clears throat] I talked to. >> Yeah, I mean, you can talk to who? >> That gentleman that just walked out the that door right before I walked out. That's the man that I need to talk to real quick. He was the one who said I could. >> Okay. I'm going to go ask, but I'm assuming the answer's going to be no, but worth a shot. >> Thank you, sir. >> As the investigation continued, prosecutors filed several additional charges against the 18-year-old, including improperly handling a firearm inside a vehicle, carrying a concealed weapon, and violating underage alcohol laws. Authorities alleged that earlier that day, Jacob had driven around with a fully loaded gun. [music] In a separate discovery, investigators searching his phone reportedly uncovered illegal material involving a minor, leading to another serious charge unrelated to Simini's death.
