from a frantic high-speed Pursuit that leaves an officer pinned to a 17-year-old who thinks she can overpower her own mother to a chaotic dispute sparked by an insult over a deceased parent and finally aent standoff between a university student and a boulder officer each of these cases unfolds in a blink exposing raw emotions in legal gray [Music] [Music] [Music] areas while on routine Patrol with his K9 partner Joo an officer spotted a black vehicle in manona Wisconsin driving without a license plate a tactic often used by car thieves operating a vehicle without a license plate or a proper temporary registration can justify a traffic stop however for the driver later identified as 20-year-old jaquin this was not a new instance and passing John no uh no plates going to be watch out Eugene get out the ground I'll CH you get on the ground watch out Eugene jao here 32 in his head 32 selling him jao selling him the officer announced multiple times that if Jaquan attempted to flee on foot the K9 would be deployed legally that's crucial courts generally require officers to give a suspect fair warning before releasing a police dog when feasible get drop drop drop the drop offenses with two active warrants he was also a fugitive from the Wisconsin DOC for a prior gun conviction ultimately jaquan's cash Bond was set at $60,000 hey Bianca you mind talking with me what is to talk about I yeah I don't know I mean you my hand can't even move my hand no more that hurt like a what you do to your hand I don't even know you see the vein though it like popped up and it's a little swollen oh yeah yeah I don't know so did you grab your hand she hit me first she slapped me first so I pushed her we just fought like normal we it's not the first time we fought before I got you but I told her cuz she's always trying to like I don't know she's always trying to control my like I can't have anything before she takes it away well mean you're 17 right so you're almost 18 yeah but like still like yeah I don't know it's just been rough this not the first time she's called the police on my so okay so I mean I don't know because she hits me first cuz she's like she be telling me like oh I'm going to do this to you and I'm tell her like I'm going to do it back to you you know I will and she like oh yeah I want to see I want to see I want to see and so she does it to see if I do it back yeah how how'd she hit you she like TR slapping me in my face so she pushes me that's how she starts and then she like threw me in I don't even know did she grab your hand or she does everything bro she's Mexican I know I'm I'm asking cuz you know we have to I know I just I didn't even feel it till after yeah do you want uh EMS to come out and look to see if it's injured or anything I don't know but this hurt I can't like I can't move my pinky back I don't know we can get them out here if you want no cost to you I don't know I don't know cuz if it can go away then it's fine but so you can't go like this too much pain it does look swollen I'm not going to lie my finger yeah okay it's shaking but I can't feel it yeah let me see your other hand for comparison yeah you can tell if you look here I'll hold your phone that way you can see the comparison too but yeah you can see like right here it's a lot more swollen yeah and right there so you definitely got some sort of injury right there I don't know if I fa or like I don't really know I just realized like afterward okay in Athens Georgia officers arrived to find Bianca all of 17 years old and brimming with teenage bravado standing off to the side nursing her swollen hand while venting her frustrations about her strict mother it's the classic domestic scenario where teenage angst collides with parental Authority and it's never as simple as she started it so your mom got into you for some some reason and she's like I'm going to hit you or whatever and you just you know go ahead and do it so she she comes at you first you push her back and then we start like fighting you start fighting is it just like hands and feet I mean hands yeah just hands she started pulling my hair you know just casual yeah yeah okay and then she took like my earbuds like this is my stuff like she she had to doesn't buy my she took it and she started being like trying to whoop me with my earbuds so I tried to get my earbuds but she I was like you're going to break them and they're like they're mine you know and then then like after that she like she kep pick me she grab my phone this isn't my phone my friend is letting me borrow it so I was like give me my phone back because it's not it's not mine she's letting me Bor and she like grabbed my stuff and she just like threw it and she like cracked it like you see like she cracked my okay so she threw the phone and and cck she threw my phone like after she was trying to like beat me and I just left after that and she started crying like she always does yeah and so she called us I was going to call the police and I'm like you call I don't care it's not the first time this happened and it's not going to be the last either so so we were called out here before then I mean yeah probably I mean probably the time I snuck out but I don't care about that well but I'm pretty sure y have been called about her from a policing standpoint the first task is to separate and interview everyone involved domestic disputes are emotionally charged so that quiet chat with each side is crucial but I can't I don't want to stay here no more because I'm fine with my dad is here but like when I'll by myself with her yeah does your dad live in Athens yeah he lives here with us he's at work right now though mom's story however is that she was simply exercising her parental right to limit Bianca's phone use especially if it isn't the daughter's property tempers flared words were exchanged and before anyone knew it fists and hair pulling entered the mix M okay okay okay okay what's going on buddy did you see anything you see what happened yeah what happened can you tell me just just like I we came from home from church M and then there my mom she got mad at her cuz she got the car on like for 40 minutes or something and then she she she was mad at her and then and then um we we came home and then my mom I don't know what happened but I they got mad at each other and then they just started fighting okay do you know where yeah where the porch the porch they started fighting you know who hit who first uh what do you no you're not sure okay thank you man all right I know you already talked to this officer but I just spoke to your mom and I wasn't here so can you tell me what happened yeah yeah he's going to take the lead she back it's been crack but where was the phone at when she grabbed it on the chair she it was on the chair she grabbed it and threw on the on the floor that's when I had when to go put my Stu down when she pulled my hair and I had put it on the chair did she pull your hair or did she pull your ear earphones she did both okay she pull my hair first and then like after that when we started fighting she grabbed my earphon and she was trying she she she pushed you as you were walking out of the house yeah like okay I was walking out the house like you know how my house is right you been there a couple times so I was walking cuz that's when we were like arguing and she like basically walked behind me and she like I turned around cuz I felt like she was going to hit me already and that's where she kind of pushed me and then she tried to slap me and then after that it's like when I turned around to put myself down cuz I knew that we were going to start so she just pushed you and and out don't nowhere just just because cuz we we were already arguing yeah but just because you were arguing and she just decided to push you that's it cuz she was I'm telling you she told me um well you know I don't know if you know but instead of Georgia uh corporate punishment is Le it's still legal so you're 17 right so you still live under her roof until you're 18 you still got to do what they say if they decide to punish you maybe hit you a little bit that's that's that that's within the rights and there we don't I mean as long as it's reasonable so you can't just just my point is you can hit them back just because they hitting you I'm not going to let my hair well it's not the first time I already told have you have you seen your mom she's got all scratches over here she got she's the typ scratch herself man she didn't scratch herself I know her I know Scrat I know her so you think she scratched herself she used to do with my dad well I don't know your dad I don't know you uh get back in the car I'm going to talk to your mom one more time the officers comment that corporal punishment is still legal in Georgia references statute number 16320 among other statutes which generally allows parents to administer reasonable physical discipline but once a child actively Fights Back Landing punches causing injuries or damaging property it can escalate into criminal conduct in domestic battery contexts the relevant charges might involve simple battery particularly Under the Umbrella of the Georgia Family Violence act if the incident involves people living in the same household go put the phone in my car the phone yeah both of them yes I both yes put in there I'm going take a jail for batter can my brother put my stuff in my room sure yeah hand probably just sold up because of you hitting your mom sorry well I'm not sorry I'm not going to lie you should be though that's your mom I know they're strict and everything but just looking out for your best interest okay once you get older you're going to think about this and you're going to appreciate it more hey I'm telling you better be the last time all right Bianca was taken into custody and charged with battery and Family Violence I want out of my house the last time I asked kick her out she going to get her the money back get her money back he in the process kicking her out he's talking my dam Mom I'm not put this crap hey Josh He my dam Mom where's your brother at he's in the houseu my dead Mom okay things it physical between y'all yes call okay she my hand right there it's grabb me around the neck what she do with your hand let me see what hand right there and CH neck what this about you pushing the table sheing talk to my mom that's I push table you push it to hurt her no to get away from her okay she neck got to get table get away from her yeah last time we were out with you what it was about like a month ago same thing she h a baseball back last time for no apparent reason I'm trying to that's not what she told me last time she the basball I I went to house and show right there had evidence the baseball backat you been taking your medicine yeah I take my medication this did you go and take your shot yeah I did I want practice doing that this month I want out of my house she talking about Mom and stuff in there and she dis my family on the phone all the time I'm tired of my family but nothing but nice to her we ain't done nothing to her at all she's always disrespecting me in my own house and a man got right defend himself in his own house he grabb my neck the problem is she lives there just as much as you live my neck she don't live here hold your hands hold your hands out like this hold your hands out like that my brother at least hold her hand let me look at the the other one what's going with the other one you got blood you need EMS check you out hey how's it going I'm doing what's going on tonight they looking for a place to stay and I've been trying to help her out a little bit and he gets violent because he can use some of it as part of his disorder but a lot of it he knows what he's doing because the moment they got here he just immediately gets fired up and he pushed her and was trying to flip the table over that has all the stuff on the table and I told him you know when you act like this we're going to have to call the police and this is the third time that he's done that and he's being the aggressor he's he's starting stuff to try to I don't know if he's I think his plan is to provoke her thinking he can get her thrown in jail kicked out of the apartment she has you know made some decisions to come back and forth she brushed my hand over right there you need EMS check you out no I'm fine let let me see that knuckle again she did that right there you said she bit you or cut me with something I'm not sure she did how are you not sure if she did it to you cuz she did it to me she did something that Cor in that corner between here and she went and stayed at a motel and she was she can't go back where she was cuz it's it was a violent situation okay I know plans on moving out she doesn't plan on staying here that's my brother that's your brother and I've been taking care of him pretty much my whole life okay so he's been staying here with you he's been staying here I'm the Le holder okay he's saying that he was that they made the dog B him and all this stuff which nobody was here when he got bit by the dog he was the one aggravating the dog nobody was here but him and I don't know if he was playing with the dog the dog's not aggressive I mean she's never Liv and the only reason why she bit him is cuz he was poking at her whatever he was sometimes all it takes is one incendiary comment to transform a tense house into a battlefield that's exactly what happened one January evening in Clark County Georgia two brothers and their guest crammed into a small space already simmering with resentments by the time officers arrived the situation was teetering on the edge but then the guest makes a crack about their late mother and the result is fireworks okay you're walking off but you're the victim here hey Josh don't walk away she got up and I'm thinking she probably called y' as well as he went up there and called to try to divert what was going on she called cuz he put his hands on it okay and like I said he's done this this is the third time that he's done this okay he's the aggressor he's the one that's doing it provoking it and he's the first one putting on somebody hey do we got a crime officer's come out he probably familiar I'm trying to figure that out Josh come back here do you want to do you want to press charges on him pushing you I don't really he just he he keeps doing it and and it's a lot I mean we've had this we had happen last time and there's a difference between being mental health and what he's doing he's very aware of what he's doing Josh is good is when he's good I don't see why he would have done that tonight of course I did say you know he's disrespectful to his brother he's disrespectful to everybody take a seat Josh I a going I my property I live here that doesn't mean Hey listen to me that doesn't mean you can walk off you're not free to leave you hear me walk I the victim here walk off we're trying to determine if you're the victim if you walk I'm going to explain something to you Josh you walk off again you going to jail I go to jail I found Su too buddy that's fine false accusations against me Josh you're not free to leave you hear me he pushes over he gets Violet and what started it is I'm St right here okay sit down the bumper man I'm stay right here just take a breath she me this this why trying be she trying to do B get you locked at now I'm get you locked at I ja she with a car last time right there across there yeah I remember you tell me that last time y'all ain't done nothing about that so I'm going to do something about CU everybody else said it didn't happen it didn't happen I got video recording and everything okay can you show me the video recording video can you show me the video record nothing we we've been gone all day we just came in from skating and we' got guest I know he can't handle she was crying cuz she saw adults and kids around me that's why I've encouraged they don't really see that make it a longterm thing and so but I told him last time if you put your hands on me or the children you know I'm going to defend myself okay so I mean do do you want to press charges on it or up I'm just him I'm talking to you got you said you had the video I I this [ __ ] well see it's hard to prove something like that I can to come this about you hey don't go down there I mean ultimately ultimately it's up to you I mean he pushed you do you want to just I'm tired of him hitting his brother I'm tired of him hitting us and I just wanted to cool off and cuz last time they brought him back he did it again after y'all left he knocked over everything Frank me face I know he'll calm down as soon as they decided to detain Joshua he tried to Dart away the standard response when someone actively resists or fleas is to escalate Force hopefully just enough to gain control in this case the officer deployed his taser and Joshua took a tumble down the hill that might sound comedic but any use of force must be legally Justified and objectively reasonable under Graham V Connor here because Joshua was running from a lawful arrest simple battery plus resisting deploying the taser likely Falls within accepted guidelines think I WR you yeah he might have broke his arm yeah he might have broke his [Applause] all arrest her too she children shot get out I'll get a evidence bag I don't know what's going oning um you advis for EMS already I did I'm break personed to what's your name what's your name I can see you what's your name Pilon 2278 y I'm you it all to me in my hand what's officer name I'll wrap it up what's that officer name it's Roger Rogers 2268 okay give me the other one at the bottom of that Hill Joshua complained of arm injuries so EMS was called to check him out though he was cleared on scene the jail staff wouldn't accept him prompting trip to the hospital what we did was we affected an arrest and it was accomplished I was trying to do tell last my ass was trying to do okay and y'all basically B hurt my arm I'm suing y'all I'm talking to Big Chief in the morning that's what I'm going to do sit out his office Big Chief ain't goingon to be there in the morning it's going to be Saturday whatever day comes y talking to I Don't Give a dam what day come I'm talk to soon y'all okay he come in on the weekend and talk to me okay I'm getting out this weekend okay my family will B me out okay out of my house so it sound like d child himself that what you heard sounds like somebody did y'all basically hurt me hurt a black man what you hurt I'm I got RAC anyways rest that white person rest me and where the hell is are you in mess at I got a good feeling like they're probably going to divert I'm pressing charge buddy I do against you and him okay yeah I had no reason to do that I talk to my brother I basically do i r to get a hug for left is that why you're running towards him yeah give him a hug okay I hit him nothing okay cut all me c [ __ ] you rolled down the hill man no he hit me T for no apparent reason I going get my brother a hug he fell down this hill me got T he roll down the hill they they oh you remember me huh I got back okay I was just thinking press get too he said his arm's broken it doesn't look great but I don't know if it's broken or not on it motion you still got a radio bols can you Mo your fingers no I can you can't can you feel me squeezing them okay okay I got to push on it I'm so sorry yeah it just kind of feels like a swollen like a knot I don't really feel any bones moving inside this side too okay you know the jail never yeah yeah I mean it's just a kind of like like he's got a good size on that do I think that they should no they refuse people for a bloody nose so one moral of the story is that once officers have probable cause for an arrest fleeing can compound the legal troubles with additional charges that almost always overshadow the original offense whatever the trigger disrespect a dog dispute or a push the real deciding factor in these incidents is how people respond when emot run hot that goes for everyone including the suspect and the officers who have to keep a lid on chaos come over here and sit down man my bad brother it looks pretty bad I ain't going to lie to you I'm press to get her this crap happen all right you can do that I press going on buddy he's not in custody or anything right now I'm releasing him if I were you after you get checked out and everything you ain't got to do it tomorrow okay maybe Monday or Tuesday or if you want to wait after the game that's cool make sure you turn yourself in okay I don't want to have to come find you okay cuz I am signing those warrants all right buddy all right all right man have a good night you too huh oh yeah your P You're I got you man turn yourself in Monday okay all right make sure you get that arm checked out Bubba the suspect was booked almost a month later on January 30th for simple battery and obstruction of law enforcement I couldn't help I noticed you just sitting on the patio out there I couldn't help but notice you're sitting on the patio behind this building yeah yeah I just and there's signs for no trespassing private property that kind of thing yeah I wasn't sure what you're were doing if you lived here or you worked here it looks like you're working doing something picking stuff up okay gotcha what's the actual address then3 rapo okay what unit are you in I don't think I have to actually tell you that well I'm just checking to make sure that you have a right to beard that's all I just told you I lived here okay I told you that I'm working as well okay shouldn't that be enough for you well I I got to verify it just so I know that that you do in fact live here kiding me what do you what do you need from me if you have an ID with your address on it that'd be great simply being on a property labeled no trespassing doesn't prove he's violating the law he's quite adamant that it's literally his residence once he says hey I live here I'm a student that might resolve the suspicion unless the officer has some concrete reason to believe he's lying so the tense question is did Officer Smiley have enough cause to keep pushing well we've had some stuff going on in this area I'm just doing my job just making sure you belong here and if you do then great and I'll be on my way okay is z do you have anything with your address on it yo look man here follow why don't you why don't you follow me and I'll just [ __ ] beep the building dude just chill out man dude this is ridiculous I'm just asking you if you have something with your address on it then that that would help me no I don't how am I supposed to have something with my address on well a lot of people have a driver car they just carry something with their address on it yeah an ID it's ridiculous bro yeah so this can I get your date of birth please why I just need to verify who you are that you belong here that you have a right to be here okay are you kidding me man can you have a seat please no no Mr ainson no no I'm not I'm not 290 cook CL can you please have a seat no put that down stop Mr ainson right now you're instructing a police officer which is a jailable offense I'm asking you one more time to sit down I'm not doing anything wrong and you're not going to arrest me you're not going to do anything cuz I live here and I didn't do anything wrong last chance sir for what have a seat for what what you're going to arrest right now I'm detaining you and investigating you for a trespass that's not what you're doing officer better thing cuz I got dude I could get lawyers and you have a camera on you it's filming right now an idiot have a seat pleas why would you think that you could tase me I'm freaking picking up trash on my property I need to confirm it which is where I live there's a sign I'm not doing anything illegal it starts off with what might look like a routine check a Boulder police officer spots someone behind a building posted with no trespassing signs it's not unusual for an officer to at least ask a few questions except this time the person behind the building 26-year-old Zade Atkinson actually lives there sit down and drop that object I don't have to sit down and drop it doing my work in my job and this officer comes over here drop the object relax are you serious just relax look at that no I'm not doing anything have a seat drop it drop it drop it why do you all four of them look all the police are telling you to do something do it you have a your yes weapon away he refuses to put his weapon away which is the first thing I asked for and you want my name yep I'm offer and you have weapons drawn you guys look like you're ready to go you're ready to go right just talk to him I'm not why why I got to talk to him cuz you can't well you you don't seem to want to talk to me from a tactical standpoint the encounter goes sideways the moment the officer demands Atkinson sit down that is a strong step once you start giving commands sit or you'll be tased you're escalating add in the fact that Atkinson is holding what looks like a tool for picking up trash which smiley calls a blunt object in Atkinson's eyes it's just a piece of plastic he's using for his job but from the officer's vantage point it might be a potential weapon if the suspect chooses to swing it dude you called the you called the whole Calvary you're not listening for what you're not listening favor just don't get any closer okay can I step in and talk what weapons drawn put your gun put that down I'm not putting my gun away you going to shoot me there's cameras everywhere dude are you going to shoot me my plan is not to shoot you you you said this is a weapon it can be used as a weapon you feel like this is threatening yeah can you put it away can you just drop it on the ground I'll put on my property set it down if you put that down I'll put my why I told you started taking down my information telling me this that and the other thing and then I walk away and he pulls his out so Zade I'm listening to you and I just appreciate it you do the same so Zade you were doing to sit down this would bring everything down a little bit and we could start I do not feel comfortable sitting down around a bunch of murderers okay so Zade this guy was ready to me sir okay so Zade um once again I'm off oh you're just going to ignore what I just said though no I'm just trying to communicate okay as adult men right okay so I think you can hear the fact that I'm just trying to be professional with you here and get some communication going so where we can get dis resolve because I now found out who you are I found out you're a resident here I don't know what you right now is I want my identification I'm not [ __ ] sitting down here's what we can do realize that sir I'm not sitting down here's what we can do we can stand here all day all right and you can waste our resources when there's people out there committing crimes right I can get your right criminals right I can get your name your date of birth you have all my find out I don't have your date of birth yeah there's why do you need my information why are you coming on to my property asking me for my information this is where I live I don't need to give you I didn't do I live here do we just want to stand here though I live here go get the go get everybody call everybody that's not how it works call everybody then we'll have a standof dude are you kidding me this is stupid I live here came on my property and you took my identification dude I live here not you you need to tell me who you are so I saw him sitting here you need to tell me ultimately the Boulder Police Department faced strong criticism over this stop Smiley later resigned after the incident triggered an internal investigation and Community backlash alleging racial profiling when we look at how this might resolve legally Atkinson wasn't charged with anything he was was not trespassing he lived there yet the entire experience became an ordeal that fueled a broader conversation about police stops implicit bias and how in everyday activity picking up trash spiraled into a near use of force scenario [Music]
