The law requires you to submit samples of your breath for the purpose of testing to determine alcohol content. A record of the taking of the breath samples, including the test results, will be made. Upon your request, a copy of that record will be made available to you. After you have provided samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or urine for independent testing. If you refuse to provide samples of your breath, you'll be issued a separate summon for refusal. A court can find you guilty of both refusal and driving while intolerable. If a court finds you guilty of a refusal, you'll be subject to various penalties, including license revocation of up to 20 years, or fine of up to $2,000, installation of an ignition interlock, and referral to the intoxicated driver resource center. These penalties may be in addition to penalties imposed by the court for any other offense of which you're found guilty. You have no legal right to have an attorney, physician, or anyone else present for the purpose of taking breath samples. You have no legal right to refuse to give or delay giving samples of your breath. Okay? So, any response from you that's ambiguous or conditional in any respect to my request that you provide breast samples will be treated as a refusal to submit the breath test. My response is just yes sir. >> Um, hi Howie. >> Hi Harry. >> Even if you agree to take the test but then do not follow my instructions, do not properly perform the test and do not provide sufficient breath samples, I will charge you with refusal to submit the breath testing. >> I repeat, the law requires you submit samples of your breath for testing. Will you submit the samples of your breath? >> I just want to be as compliant as possible. >> I just need you to say yes, sir. >> Yes, sir. >> Yes, sir. Um, I just did the backhanded cut down. Do you mind just doing >> She just has to give you the >> Put gloves on. Yes. >> Yeah. Yeah. >> She just has to actually Sorry. You sir? Okay. She's a major. So, >> thank you real quick. >> I'm sorry. >> No, no, it's not your fault. >> I was trying to make it the easiest decision for you as I could. >> You're good. You're being very cooperative. We appreciate that. All right. So, just stand up for her. >> You want me to? >> Yep. Okay. >> Just turn that way first. Do you want me to take this off? Fine. >> Okay. That takes 10 minutes and then see what it says. And I think your ride's actually doing great. It's not that. So, you don't have to worry just yet. All right. So, it's mine. Your mom. >> Is it okay? >> We can't do that just yet. As soon as we do this, we're just going to have to finish some paperwork and you'll be out of it. >> Okay. Like I said, there's no tricks. >> It's completely my [ __ ] fault. Like, I >> just remember you have the right to remain silent, okay? So, don't go don't go saying too much, okay? So, >> can I can I just ask from like a criminal justice perspective? Why does it reset when you burp? >> Because some lawyer at some point said that their client burping could have affected the test results. >> Wait, really? >> Yeah. So now we wait 20 minutes so that any alcohol like if you would have had a beer right when you left thatchers. >> Got you. >> Um it just takes away the opportunity for any basically to make the test more fair. >> So >> to take any alcohol out of your mouth that might still be there that could maybe li raise the uh the number. >> Kind of make me think of like a defense.
