If you like fish and wildlife content, be sure to subscribe so you don't miss out on future videos. An officer with Florida Fish and Wildlife was on patrol when he contacted three individuals at a boat ramp. >> How's it going, guys? How was uh how was fishing for y'all tonight? >> What? >> How was fishing for you guys tonight? >> How? >> Yeah. Did you guys end up catching anything? Yeah, I'm catching. >> Do you uh you guys have fish on the boat? >> Yeah. Yeah. >> Can I just take a look at them real quick? Yes, sir. Sure. >> Did you guys go over by the skyway or did you go offshore? >> No, sure. >> How far? >> Uh like Yeah. How deep was the water you guys were in? >> What? >> How deep was the water you guys were spear fishing? Yeah. >> Yeah. >> Was the visibility okay? >> No. No. >> [snorts] >> How much? >> Just one. >> At least one be good. >> Good. Stop looking at >> from what we saw so far. They have enough fish for one license. >> Oh, I know. You're the suitcase scuba diver. I've check I've talked to you before. You guys hiding fish in there, man. >> What >> said you guys are hiding fish in there? Don't move too much. >> Oh, look at that. >> You also have a trigger fish that's too small, too. So, but you guys didn't hide that one. Okay. You have a a license on you? You have a license? >> They have the driver license. >> Yeah. And then you have a license on you and you have a license. Okay. Okay. So, I've I've talked I I believe I've talked to you before and I know I've talked to you before because he's got the uh he's got the suitcase that he dives out of. Well, that grouper's speared and I'm pretty certain you're the only one that dives. The hogfish isn't speared. The trigger fish isn't speared either. Do you English? >> Little bit. What's that? >> You're the only one that speaks English. >> Okay. So, here's the here's the issue with the fish. Obviously, you guys know that those you can't have since it's hidden in the bow of the boat. Uh the trigger fish is too small. >> That one? >> Yeah. That's too small, which was in the cooler back here. So, as the operator of the boat, you're responsible for all the fish on the boat. It's written in the law that doesn't matter if somebody else did it. You're responsible. >> All right. >> The thing is though is that guy grouper shot and he's the guy that that spear fishes because I've talked to him a bunch. You know what I'm saying? >> Yeah. I'm I'm sure that >> What's that? >> That's my fish. >> You speared it? >> Yeah. >> Okay. All right. How many guns do you guys have? >> Uh two. >> Okay. inside the boat. Maybe >> one three. Three. >> Okay. >> All right. So, so [snorts] the trigger fish is too small. Yeah. The hogfish, I haven't measured it, but it looks small. And then the gag grouper is big, but it's out of season. Okay. Which I'm sure you guys knew it was closed cuz you wouldn't hide it up there if you didn't know. >> Uh, you can go ahead and load the boat on the trailer. >> All right. >> And I'll get all the information I need from you guys, >> but just don't go anywhere. Okay. All right. >> Yeah. >> Yeah. Well, that's the thing when it comes to spear fishing, like technically if you shoot something that's too small, it's it's a violation. However, nobody would know if you just let it go. >> You know what I'm saying? But if you guys if you guys retain it then and we're waiting for you at the dock and we check you, it's a violation. You know, >> is at this point like I I know that mistakes happen under the water, but at this point, we don't. It doesn't matter. You know, you guys have a group ride throughout a season. All right, buddy. Here's all your stuff back. There's you. Here's you. Here's you. Okay, so let me tell you what happened. All right, so obviously with the fish being in the boat, you're the one responsible for it all. >> 104. Um, I have a feeling that he probably shot the gag grouper since he's the one that's usually in the water, but we're not going to go down that road because you said you did. You've been in jail before >> for the deer. You were arrested for deer. >> Him? Yeah. >> Yeah. >> With me. >> Were you in jail, too? >> No, I'm not going to jail. But >> yeah, I'm telling you, if you would have went to jail with him, I would have taken into jail tonight for the fish. >> It's the same thing. And normally I don't take people to jail for fish, but when you hide it in the bow of the boat, that shows intent. That means you knew that you weren't supposed to have it. And if you would have been arrested with him with the deer thing, I would have taken you to jail tonight, too, because obviously you didn't learn your lesson. You still haven't learned your lesson. What happened in Pole County? >> Yeah. Yeah, I know. >> What' you end up getting? Did you get a fine or something? >> What? >> When you went to You went to court in P County, right? >> Me? No. >> You never went to court? >> Uh, >> it said that you were >> Yeah. >> Yeah. One for one sheep, right? >> One sheep said. >> No. >> No. You were on the deer thing, too, with him. >> He went to jail, but you were part of it. Were you a witness? Were you with him? >> Yeah. >> Okay. All right. Well, you've had other you've had other citations from us before. So, I put down on here that you're a repeat violator because you've had other citations from us for fish and no fishing licenses and things like that. You were part of that deer that deer poaching thing. So, um, you're probably looking at about a $500 fine, but it's the other the other thing would have been taking you to jail and a $500 fine. >> So, I'm not taking you to jail. I'm giving you a citation. >> That's fine. >> But, you got to you got to you just got to do better, man. Um, this is your copy right here. Okay. Um, down at the bottom is your court appearance stuff. It's May 20th at 8:30 in the morning at the Penllis County Courthouse. But you got to make sure you go because if you don't go, you'll get a warrant for your arrest. All right. And this is the court copy I just need you to sign here by the X. It's not an admission of guilt. It's just a promise that you'll show up for court. Okay. All right, man. I know it's just fish at the end of the day, but uh when you're hiding stuff or you've you've had multiple tickets and that's usually when because they're all they're all criminal misdemeanor. So, >> yeah, I know. >> All right, man. Do you have any questions for me? >> No, sir. >> All right, man. Well, be safe getting back home and try to try try to keep legal fish next time. >> All right. Thank you. >> All right, man. Have a good night. >> All right. Thank you, man. >> Take it easy. >> In the end, the suspect was charged with possessing an outofse gag grouper, harvesting or possessing an undersized hogfish, and possessing an undersized trigger fish. He plead guilty to all three charges and was ordered to pay $50 in fines and cost. This is by far the lowest fine we've seen for similar violations and we hope that Penllis County increases accountability in the future.
