An officer was on patrol when he spotted an angller spear fishing in the upper keys, a restricted area. >> How you doing? >> Good. >> Hey, how you doing, officer? >> Good. You got anything on you? Any fish? >> Yeah. Mangroves. All right. Whiskey at >> Okay. Um, >> I got my trolling motor on. You want to off? >> Yeah. Yeah. Uh, let me see which way the current's going. >> All right. >> You You just spear them here. >> Uh, most of them were caught in line, actually. >> All right. Well, I see a couple speared. >> Yeah, there's a couple. >> All right. >> The last couple since the bite stopped. >> It's right here. >> Yeah. >> Okay. >> So, I need your ID. I need all your IDs. Where you guys from? >> Jupiter. Okay. There's no spear fishing within the upper keys. >> Oh, really? >> Yeah. Do me a favor. Put that thing Well, sir, it's up to you. Just around >> the I thought the bridges the >> other boat. >> Do me a favor. Put it around the T-top. Just around those. Yep. Maybe bring it back to me. >> Spears are just >> Yes, sir. Yep. the harvesting of any lot any fish with uh using a spearing device while in the water. >> Yep. >> Yeah. >> Well, I mean that's I know that's >> I read that branches. I'm sorry, man. I >> start pulling all your your uh How many mangroves do you have? Okay, go ahead and pull them out, please. And do you have a registration for the boat? >> I do. >> Can I see that? Please. >> We weren't the only ones spearing. That's that's the only reason we went was there was other guys that that got spear. We weren't good to spear. We were We were taking these to go to the past. >> All right. >> I'm not You're not here. >> I'm not saying you're By no means. >> You didn't know. I'm sorry. >> Honest honest mistake. >> It was an honest mistake. I swear on my life. I would swear on that. I know you guys. I swear on my life. >> That's all right. >> Go ahead and pull your snappers out. 6114 stop. All right. >> No other fish in there. >> Tight. What's that? >> Okay. Pull that cuda out. All right. All right. What's that? Uh >> okay. All right. Pull that guy out. >> Injuries at 99. >> All right. Else in the >> So, what's the limit on Cuda? >> All right. Let me have uh Did you measure that one? Okay. You may have that speared one. Go ahead. That one. Yep. Put it right here. Uhhuh. >> That one. Yeah. And that one right there. The hole. Okay. All right. Let me have uh my other phone that's in the place. >> Just get a quick picture of him. >> We got uh Do you have fish rules app? >> My friend made that app. >> Yeah, >> you should read it then. >> I I didn't I see that the pulse All right, you may put back in. Get the fish back and wait. Not again. >> I'm sorry. >> Yeah, there's a overlot regulation. >> 1767. >> You're allowed one over slot. >> Look it up. >> That I know. I got a couple of mistakes. >> What's that? >> Uh, Barracuda. >> Barracuda over slot. See where it says limit uh size. >> Says minimum 15 in. >> Uh-huh. And then >> says memorable one greater than 36. >> Right. >> So, if that other one's less than 36 in, good to go. >> Is it 36? >> I don't know. The head on it is like 20 something. >> The the big the big one. Yeah. The little one. >> Yeah. Look at the other one. Measure the other one. >> Go straight in there. >> Yeah. >> Yeah. He's He's bigger. >> Oh, he's big. I'm sorry. >> Uh they add regulations on barracuda. >> What's that? >> When did they add regulations on barracuda? >> Uh I want to say two years or three years ago. >> Yeah. Would have never thought a bear would do you, right? >> Well, it's hard to get over fish. >> You're Casey, right? >> Yeah. >> All right. >> Yeah, they get overfished. >> So, listen. I'm not going to I'm not going to hit you for the the barracuda. I'm going to write you an infraction for the spearing in the upper keys. >> Well, we'll never do that again. I hope not. >> Now, I will I will tell you >> I don't either. Don't worry. >> People that destroyed after we've all we've all been there. >> Well, listen. Yeah. >> Here's the deal. It is a misdemeanor. All right? So, it's an arrestable offense. I'm not taking you to jail. I'm giving you a notice to appear. Means you have to come back for court. Tell the judge I didn't know. Whatever. All right? Most of the time, what happens? I'm not going to tell you that it is your case. I'm just going to tell you that most of the time it uh you get, you know, if you've never been in trouble or any of that, I have no objection to um withholding your adjudication. So, it's not going to stay on your record. None of that. And >> are you just having you charging me with spearing? >> That's the only one I physically saw in the water with a spear gun or a spearing device. >> I didn't actually. >> Well, and I will tell you this much. >> Okay. it. The law says that all you have to do is be in the water with the sphere with the spear and device. >> Yeah. >> Exactly. So again, I'm going to uh it's not going to be uh you know, I'm not going to look for jail sentence or any of that, but I do have to do my job cuz they they look at us like, hey, you guys got to be out there protecting the resources. Imagine driving around this nice boat and going, "Hey, it's okay. Hey, it's okay." [laughter] >> What's that? >> Follow you guys on Facebook. I know you got to do your job. >> Yeah. So, >> so >> um thought it was now I know that all upper teeth period. I just >> No. So, you got to be outside state waters, which >> patchies >> you would be. No, most of the patriies are in state waters. You got to be three miles out uh out of state and you'll see a line on there that says prohibited area. >> You got to be outside that. And then on this side, you got to be nine miles out on this side. So that'll be state waters is 9 miles. Now once you get past and the reason being is all uh Upper Keys National Marine Sanctuary once you pass channel uh Long Key Bridge, which is not this one, but the very next one that's like three miles long. If you're on the south end of that, then you don't have to be three miles out. >> Gotcha. >> Then you could be within state waters. All right. >> Is this your copy? All right. This is your copy. And here's the court date. August 7th at 8:45. And there's the address. You got to come. Okay. >> All right. Let me get you to sign my copy. Again, it's not stating that you're guilty. It's not stating that you know that you agree to any of this. It's just stating that you know what you're getting the the um the notice to appear for and that you promise to appear. >> Gotcha. >> All right. You got to make sure you appear otherwise you don't want a warrant out for you not coming to court. >> All right. So sign right here is just stating again it's your copy. It's the same thing. is just stating that you promised to appear and that you're being charged with u uh spear fishing upper keys. Like I said, I my recommendation, you know, listen, the truth of the matter is I'm supposed to dump out all the fish. I'm supposed to get that big barracuda. I'm supposed to do a lot. The truth of the matter is, you know, >> it'll probably be gone up tonight. >> Yeah. >> We got 400 now. Thanks for coming. Whatever. We appreciate it. >> All right. Thanks for being there. Yeah, man. So, sorry to do it, but you know, >> everything. >> Thank you. Thank you very much. And when they come in, y'all got the deal. >> Well, good luck to you, man. >> Knock the out. >> All right. >> Bella and I set them on their way. >> Where you guys staying? >> Uh Airbnb. >> Where at? >> Um the way actually >> Antigua or I've never where the lobster traps are. The big lobster sign. >> Yeah. Okay. those beach parts. >> Yeah. Right. >> Okay. Right in that neighborhood. All right. Cool. All right, guys. Well, good luck tomorrow, too. You guys know about the 300 ft rule for all the rules. >> Yeah. So, tomorrow lobster you got a lobster gauge? >> Yes. >> Everyone in the water that's actually uh trying to harvest lobster has to have a lobster gauge on them. Okay. That's a misdemeanor if they don't have one, >> right? That's fine. And then the other thing that's very important is you got to be outside 300 feet from any residential or commercial shoreline. So you saw those cylindrical buoys that are where you got to anchor outside. That's 300 ft. So you got to make sure you're outside that to snorkel or dive during mini season. >> So if you're out here, I don't know if you're going to plan on doing any lobster in here, but uh it's tough cuz it's the current's ripping. Yeah. >> Try to stay away from that center of the channel. >> What's the rule with bridges and channels? >> You're allowed to snorkel however and dive however you can't interfere with navigation. So, you got to keep in mind when that flag goes up, everyone's got to try to go around you. So, we try to steer people away from the bridges. And the reason being some of the bridges are so small and narrow, >> they don't have a choice but to come to the bridge, >> right? And so, you got one guy here and then the other guy's like, "Man, I wanted to hit this." Well, go over here and go over here and go over here and there's no room for anyone to go by. And then when they're disoriented down in the bottoms trying to lobster, they're scuba diving and they're doing all of this nonsense and before you know it, there is flags all over the place. >> I got you. >> So, just keep that in mind. >> And and they took a big hit during that one Sunday that everyone was allowed to catch lobster. >> And we were we were very worried about that. >> Yeah. I've been stopping a bunch of people earlier. noticed. I mean, it was like 3 weeks. Like, >> yeah, >> I know some people plan that these days. >> Uh, we've stopped a bunch of people today and they're like, "Ah, we don't see any." And I'm like, "That's the problem." So, >> better off going to Publix. >> Yeah. Well, good luck. Hopefully, it's calm. >> Yeah. No, no, none at all. None at all. Right. >> Yeah. I would stay away from it because there'll be people there yelling at you. >> If somebody yells at you and says to get away, they're probably right. >> Gotcha. Thank you. Thank you guys for your service. >> All right, guys. Have a good one. In the end, Casey was charged with spear fishing in a restricted area. He pled no contest and his adjudication was withheld. He was ordered to complete a Florida fish and wildlife regulations course and pay $328 in cost and fees. If you like this video and want to see more like it, subscribe to Arrest Cam.
