So, you come off 81, then then what happened? How'd you get right here? There's a a trail right here. Okay. Trail goes through some posted signs. Yes, sir. Yeah. This property is well posted. Yellow signs said no trespassing. You had to walk right past them. You understand that? I understand it, yes, sir. Okay. So, we got a couple problems. Number one, you hunt over bait. Really number one, you're trespassing. Then we then we got hunt over bait, so we got some issues. So, go ahead and stand up. >> [clears throat] [sighs] >> I'm going to hand you your phone back. And that knife, go ahead and give it hand me that, please. And what's that? Is that your decoy bag? >> It is. Okay. Go ahead and pull your shirt up. Let me just make sure you don't have a pistol on you somewhere. Turn around. Okay. Anything on your ankles? No, sir. All right. >> [clears throat] >> So, I'm going to get a map out real quick and you're going to show me where you came in at. Terrible. Who dropped Who'd you say dropped you off? I did. Huh? I did. Oh, who did that? Um I can't incriminate anybody else for anything. >> [snorts and clears throat] [sighs] >> All right, man. So, what I'm going to have you do is go ahead >> I'm going to lose my hunting license. Huh? I'm not going to lose my hunting Lose your hunting license? I mean, not. Have you been in trouble with us before? No, sir. You probably won't lose your hunting license. Let's go get that camera down, okay? I'm going to get you to take down that one, and I know you got one more hit somewhere else, too. >> [clears throat] >> I'm going to get you to get that one, also. Do you have any more out here, or is it just two? No, sir. Just two. Did you get a picture of a truck on one of them? I did. I really didn't think you'd show up after that. What's that? I'm surprised you showed up after that. >> That's called that's a 43 43. How many times have you put corn out here? Cuz, man, they have tore this up. Yeah, lots. Yeah. Have you done Is it been like since deer season, or you just started doing it in like >> Just me. Like a couple weeks ago, or I think so. >> I mean, it really doesn't matter at this point. I mean, you're not going to be in any more trouble for that. I'm just asking. I'm just curious, cuz, man, it looks like somebody dissed that up. I It looked like that already pretty good, honestly. >> Something was already bringing them here, huh? Yeah. Can you go ahead and >> There's a little spot over there. >> Go ahead and get that. All right. Let's head to that uh that other camera. Yeah, let's go to get that other camera. Have you seen on those cameras any good gobblers? Yeah. How many are in here? Cuz, I heard two. I know I heard two this morning, and I scared I'll be honest with you. I came in right here, and I heard some fly down. They were up in that tree line back behind me. I didn't know they were there until I heard them flush out. But, Two or three. It sounded like two or three birds up there. But, there was one over there somewhere way out here. And then I heard them back further. >> [clears throat] >> All right. Got to go in that way. Did you turn it off or is it still on? Can you not turn it off without the key? No. Oh. See, there's a yellow sign right over there. See the back of it? Right there. All right. This whole This whole place is posted. They don't play around with their posted signs. They put up a lot of them. Huh? What is this place? It's a giant preserve. Acoustic plantation. It's all up 81 and you see the signs everywhere. They're yellow and they say no trespassing. So, they got a lot of cameras here. That's a preserve. They don't It's a management It's a private management land. Conservation easements and things like that. They do a lot of gopher tort- gopher tortoise restoration, black bear habitat. >> [clears throat] >> Do you hunt the river sometimes? Is that how you found this? No, I've never hunted the river. Do you mean do you hunt off 81 like the water management? Did you ever hunt that or like Tilly and all that? You ever hunt that or Do you kill a lot of turkeys every year or you get one or >> No, I'm lucky to get one. Yeah. I mean, take off that bag, set it on the hood. Just stand by for a second. All right. This is custodial at this point. >> being arrested? Well, you're not free to leave. So, question when I'm asking you questions and you're >> this on? Put it on what? Put this mask >> For the mosquitoes? Sure, go ahead. Custodial means you're not free to leave. I'm asking you questions. I need to I need to read you your rights. Do me a favor and get your hands out of your pockets. You have the right to remain silent and refuse to answer questions. I'm going to ask you some questions. Um, I mean, yeah, I'll go ahead. Okay. They have a lot of cameras out here. Told you that. Have you been out here before? Answer. It's not going to be much worse if you say yes. I just need to figure some stuff out. Have you been out here on another area? I've only been out here maybe two other times within the past week. You've been out here maybe two times within the past week? Are you familiar with Highway 81? Not really. Is that you? No, sir. Is that you? That looks kind of similar to your build and shape. No, sir. Do you know where that would have been taken? No, sir. Okay. Did you steal a camera? No, sir. We had an incident in the last week. Last week somebody came over and was trying to hunt the sod field. Do you know where the sod field is? I have seen the sod field. There was somebody over there trying to hunt turkeys in that out of season. It was youth weekend and then they but got caught on camera, saw the camera, and destroyed it, took it off the tree. That was not you? >> No, sir. Okay. What all areas have you been on out here? Just this. And how And you always come in off 81? What's this road? Highway 81? This highway right here? >> Yeah. Yes, sir. Okay, let's look at the map. I just want you to point out where you came in at. >> [snorts] >> 44 45 Okay. You were here this morning. About right here. I'll get you a 27 here in a second. Roughly, in those pines. We just walked like this. And we left, we went like that. And then we kind of made a hook, and went north. We're here. Okay. Zooming out, that's 81. Runs north and south, roughly. Mhm. This is water management. There's a gate here that's gone, and a road that kind of goes right along it. Mhm. I came off off that. Okay. Did you go all the way 44 38 tall down here, and then hit this little area and cross a creek, a small creek? There was a creek there. Okay. And you just went in there like that, or >> Som- something like that, yeah. Did you go across this area to get to where you were? Did you cross that little open field? Or go along the edge of it? A little bit, yeah. >> Okay. All right. That's how you came in. So, [snorts] you when you cross that creek, or right around that creek, there's posted signs along that line, every 100 ft or so. You would have had to walk right past them at some point. And setting all this up, too. So. I got to call the land manager and talk to them. All right? >> [clears throat] >> With this being private property, and you trespassing, that's a That's considered a property crime. It's like if, you know, we're we're kind of out of the loop [clears throat] on that. It's up to the landowner what we do. They can charge you simple trespass. You're armed, they can go armed trespass. There's There's different options. It's up to the landowner. Okay, we don't make that decision. The landowner does. But I talked to them. Huh? Sounds like they made a not good decision for me. >> Yeah, so you're going to be good placed under arrest for trespass for trespassing while armed cuz you had a gun on you, okay? Mhm. Um It's your first time ever getting charged with anything like that? It is. Okay. Well, from experience, I'm not giving you legal advice. I'm just telling you what I've experienced as an officer. It usually gets pled down pretty easily, okay? If you're cooperative with the state attorney's office and everything, usually they'll plea it down to a lesser so you won't become a felon. You might get you get It may look like you're getting charged with a felony today, but it's a common practice to get reduced after you go to jail and you handle the stuff with the court, okay? I'm just explaining that. That's I'm not telling you that's necessarily a given, but I'm telling you that's how it's went in what I've seen. Um So, go ahead and put your hands against the truck. I'm going to do a quick search. A- Or go ahead and get anything out of your pockets. Do you have anything else in your pockets? >> [clears throat] >> And anything down here? I'm going to go and pat you down. What's that? Is that part of your pants? Okay, go ahead and turn around. I'm going to go ahead and put your hands on your back. All right, man. Come on around over here. It gets you out of these mosquitoes. Yep, little buckley, man. Yes. Thank you. You get some air going in here. Did you plead the fifth already? Huh? Okay, I'm not going to ask you any more questions then. >> [clears throat] >> In the end, the suspect was charged with attempting to take wild turkeys within 100 yards of a feeding station, armed trespassing, and hunting without a turkey stamp. Through a negotiated plea deal, he pled no contest to trespassing while armed, and his adjudication was withheld. He was sentenced to 3 years of probation with the option of early termination. Approximately 3 months later, the court terminated his probation after meeting all set terms. He was also ordered to pay $1,125 in cost and fines, which currently show unpaid.
