Welcome back everyone. Today's video comes to us from New Mexico where similar to the rest of the United States, it's illegal to threaten people with a firearm. The suspect in today's video owns a piece of property along the Pecos River and while he likes the river, he really does not like people fishing on the river. According to the criminal complaint, the suspect is accused of threatening fishermen fishing along the river between April of 2023 and March of 2026. Apparently threatening people isn't enough and he decided to be a little more proactive in his efforts and put up barricades and hired an excavator to dig holes to make it more difficult for anglers to walk up and down the river. Before the criminal warrant was issued for the suspect in today's video, there was a civil case between the New Mexico [music] Department of Justice and this individual. In that civil case, the state argued and won litigation affirming that the public may lawfully recreate the river even where those waters run by private property. Now, the state didn't stop there. After the civil case, they decided to pursue criminal charges thanks in part to some cell phone footage that they received from an angler. In this video, you can see what is apparently the suspect with a shotgun saying things to anglers alongside the river. Let's check that out now. >> Actually, we were staying right here. >> Oh boys, it gets hella deep. >> It's my land. I've got a right to target practice. I'm going to start shooting right across there. Cuz I respect target practice right here on my land. >> All right, it's okay. We'll go. We'll go down. >> I'll go back to my camper. Stay off my property. >> He should be here in like 5 minutes, 10 minutes. >> Perfect. Get the [ __ ] off my property. You're such an [ __ ] You know what's so hard and I respect your property? >> We respect your property. We don't go on your property. We don't damage the fish. We catch and release. We do it like that. >> Thanks in part to the pixelated cell phone footage along with other available evidence, the state secured a warrant for the arrest of the suspect. The New Mexico Department of Justice intercepted the individual as he was beginning to pull into his driveway at another residence. So, this is not the residence where these crimes allegedly took place. >> All right. >> You going to grab him at the gate? >> We're trying to. Hit your lights. Mr. Mr. Can you step out? I can speak to you really quick. >> Why? >> I'm with the New Mexico Department of Justice. >> Okay. >> So, can you please step out of the vehicle, sir? >> What's the problem? >> It's a problem? >> Yeah. >> Can you please step out and we'll speak. >> problem? >> The problem is? >> Yeah. >> So, right now, sir, we have a warrant for your arrest, okay? For aggravated assault with a deadly weapon. When? For many multiple times, okay? So, can you please step out of the car? >> No, I'm going to go in and talk to my wife. >> I would please advise you if you don't do that, please. You're on another charge, sir. >> what's going on here. >> I'm trying to be very, very cordial with you, sir. Can you just please cooperate with us? >> I got these guys here that want to arrest me for aggravated assault with a deadly weapon. When? >> So, multiple times throughout the years. >> Sir, >> I'll sir, I'll show you the arrest warrant if you want to see it. >> But, sir, I I have gone to trial. >> Okay, but >> court. We did this. I got to check my date. I went to court. We had a understanding from the judge and and she said I had to fix the rest I had to fix >> Okay. >> the >> So, sir, I what I'm going to do is I'm going to go ahead and show you the arrest warrant, so if you don't mind, just shut the vehicle off and can you just please step out? >> so I'm not in the way here. >> Okay, sir, and I will show that to you, okay? >> Okay. >> But, please don't go in cuz I don't you to elude, okay? >> I'm totally confused. >> Okay, now I'll show you I'll show you the paperwork, okay? >> When was this When was this issued? >> So it is issued today and it's actually signed by judge, okay? >> But why? I haven't been I haven't been I haven't been to the cabin in 2 weeks. >> Okay. Well, sir, just go ahead and if you if you need to go and pull the four the four forward and then you can come out, okay? Cuz I I don't I don't I don't want to make this a bigger deal than what it is, okay? >> You're going to try to arrest me? Like take me to jail? >> It's it's going to happen, sir. >> But I don't understand why. >> Okay, well, we're If you can just shut the vehicle off, okay? Okay. Just park it right up here. Okay, go and pull forward a little bit. And I'll we'll we'll show you the paperwork, okay? >> Okay, I did When did the judge sign this? >> Today. Yesterday, I'm sorry. >> But why? >> Sir, I'm I'm going to show you the paperwork, okay? >> Okay, okay. I'm going to pull up here. >> Okay. >> Is he going all the way to his house? Are we pulling Are we walking in with him? >> No. >> Are we walking in? >> I told him just to pull up right here. Lita, I'm going to get the paperwork real quick so we can show him. Come on, Bass. >> Yeah, I'm totally confused, man. >> Okay. And you know, sir, I I don't want I don't want to make this a bigger deal than what it is. >> Well, I want to see that. >> But you can come over here. It's signed. >> I'm in it. >> I do not know. >> Can you tell me what's going on, sir? >> He's going to I'll I'll talk I'll talk to him now. Yeah. And if you want to come over here Mr. I'll explain. Okay, so >> I said we have an arrest warrant for your arrest, okay? >> I don't understand why though. >> Well, before we start talking about anything you know what I mean? You I'm going to have to read you your rights, okay? >> Okay. >> So >> Does anyone have a Miranda card on handy? >> So um there was a arrest warrant issued for Mr. >> For what? >> For aggravated assault with a deadly weapon. So we're we're here to contact him about that. That's what we're here for this morning. >> Uh we had a hearing a couple weeks ago with a judge and the judge you can look at the statement says he needed to clean up the river or needed to fill in the river where it was dug out and that's what the only thing that the that she put on there. We haven't been to our cabin in two or three weeks so I don't know what's going on here. >> Okay, so it it is a warrant that was that was put into the system today so I don't know if it's from stuff that happened in the past it just got filed now. >> Well, everything was thrown out. If you want to I mean I was current at the hearing sitting listening to the judge. >> but I as as I believe that was a civil hearing this is a criminal matter I believe. >> But how does like how would how would we not know about this? He didn't That's this isn't this isn't I mean I don't know who did this but we haven't been there in month in in weeks. >> Right. And that may be the case but I don't that doesn't mean that >> Well, I have >> that these things happened during that time. It might have been something that happened before and just got filed now. >> the judge or somebody tell us about this because >> Not in a civil hearing cuz this is it's a criminal matter so it would be something completely separate. It would be a >> So we wouldn't have any I mean it's been I mean this matter happened months ago. >> Mhm. >> So, you're saying that just out of the blue somebody filed >> I don't know if out of the blue, but that's but somebody it it just was filed. >> Okay, so what are we supposed to do here? Because this sounds crazy to me. >> So, the judge did did sign and and put a hold on the warrant. So, I mean, he has to he has to be booked on it and see the judge and then it would be a criminal proceeding from there. >> Okay, so I don't understand what that means. >> So, he would have to go to jail, see the judge for release, and then uh then it would be a criminal proceeding from there. He go to court and deal with it in court. >> Well, I need to be over there with him. >> Huh? >> I need to be over there with him. >> Well, that's fine. We just ask that you don't interfere in any way, you know what I mean? >> Okay, cuz there's some hard evidence. >> I'd love to see it. Especially with multiple guns, I'd love to see that cuz it's only happened once. >> That was in That was in '23. >> Okay. Well, I'm just letting you know we do have the arrest that's signed by the judge. So, you're under arrest. I just want to place you under arrest right now, sir. >> Do I really have to be handcuffed? >> That's that's kind of part of the protocol for the time being. It's not not saying you're in danger or anything like that. Just we have to do that, right? >> Where Where are we going? >> You're going to jail. >> No, no. Where are we going? >> So, right now, sir, uh probably we're going to get you transported by Santa Fe County. >> Can we fix that one? >> Yeah, absolutely. And then we'll go from there and You got my keys? My keys? >> We have the warrant here. >> I need to talk to a lawyer before you take him away. >> That's that's not an option, but >> But you can call um John You turn it that way. >> Yeah, let me You can call whoever you need, ma'am. That's that's fine. >> know what to do here. This is ridiculous. >> I mean, this is ridiculous. I don't understand. I'd love to see evidence because we >> The judge told us what we needed to do and we did it. >> Within 3 days >> Do you have no weapons on you or anything, sir? >> No. I'm just going to >> I'm just going to check your pockets real quick, okay? >> Oh, wait. Hang on. Let me get my Hang on. Can you come get my um keys out of my pocket there? That's my wallet. >> You want me to take it? >> It That's up to you. Completely up to you. >> If you wanted to take it, then that that's fine. >> If you want it in your possession, it'll go into property as you get booked. If not, she can hold on to it. It's up to you. >> hang on to it. >> Do you have any important numbers you need to write down? >> I have them right here. >> Do you Do you know your wife's number by by >> Can you read this to me? >> This is You guys This is [clears throat] ridiculous. I'm going to check your waistband as well. >> Thank you. >> Like I said, I don't want to make this a bigger deal than it is. I'm trying to be really cordial, you know what I mean? I don't >> I know, I appreciate that, and I am, too. But we had a we had a hearing. >> Okay, well, before we talk, okay? >> Just so you know, we are recording. >> Okay, great. You have the right to remain silent. Under Understanding these rights and having them in mind, do you still wish to talk to us? >> Uh I don't know. I I'm going to hear what you have to say. >> Well, I have I just advised you of your rights, sir. It Like I can't >> Okay, yeah, I wish to still talk to you. >> Okay. So, we have this warrant for arrest, okay? >> Okay. >> This is for several incidents that happened on your property ranging from 2023 to 2026, okay? That Do you Do you want to explain your side of story? That had that involved multiple firearms. >> That That's just not true. She'll be proof of that. There was one incident where I was walking around on my property with a shotgun cuz these guys were trespassing. One. And we went to court about that and they I never pointed the gun. It's my property. I'm allowed to have a gun on my property in the county. I'm allowed to do that. I never pointed at anybody. They have video. There's never I never pointed a gun. It's a cross here, right? How can I be arrested for that? >> Okay, did you say anything to them? >> Nope. I told them to get off I told them to stay in the river and not to trespass. >> Okay. >> Right? That's what I told them. We went through this with the judge. >> Okay, cuz there's some hard evidence, sir. >> I'd love to see it. >> Okay. >> Especially with multiple guns, I'd love to see that cuz it's only happened once. That was That was in '23. >> Okay. Well, I'm just letting you know we do have the arrest that's signed by the judge. So. You're under arrest right now for >> You're under arrest right now, sir. >> Do I really have to be >> handcuffed? >> That's That's kind of part of the protocol. >> For the time being, it's not I'm not saying you're in danger or anything like that. Just we have to do that, right? >> Where Where are we going? >> You're going to jail, sir. >> No, no. Where are we going? >> So, right now, sir, probably we're going to get you transported by Santa Fe County. >> Can we fix that one? >> Yeah, absolutely. >> Yeah. Just follow the officer. >> We're just going to sit you in the front seat here and then uh >> Can we put this in front of me? >> Yeah, put that in front of you. >> Yeah, I don't I don't see a problem with that. If you just turn around here, I'll I'll snap you in. >> Oh, thanks. >> And so, just so you know, when we transfer you over, their policy is usually has to be hands behind the back even for the ride over there, just so you know, okay? I don't mind it, but >> If you'd like to look this over, you can. >> Uh Can I >> No, we have to have to take that with us. >> No, no, I understand. Huh? You already did. >> I'm I'm going to do it again just so you're we know that you're clearly familiar with them. You have the right to remain silent. Having that in mind, do you want to speak with us right now? >> No. >> Okay. Let me uh I'm going to get is that your >> wife >> wife? Okay. Um I'm going to get her >> contact I can call my >> Here, let me put the window down. Yeah, that's fine. >> What's that? I I I I I I like to speak to her. >> Yeah, I >> I have the right to do that. >> I don't think so. >> Well, I am. >> No, no, for sure. Hey sir, just so you know, she has medical needs. I've I've offered a medical or other people to come. Um so Ma'am, are you feeling okay now? Do you need any kind of medical or anything? >> No, I'm not feeling okay. >> Okay, do you need medical or rescue or anything right now? >> I can call 911 myself. >> Okay. >> Honey Honey >> Now, we're still going to be here for a little bit. I'm going to I'm going to back out of the driveway itself though, okay? What? Because I don't want to be parked here anymore. >> Well, I'd rather you be inside with >> park inside? >> people than out on the street. >> Well, that's not where I'd rather be. >> Okay, well, I don't feel safe and comfortable. >> Okay. >> But you don't really get to >> No. I just don't know who's in your house or what weapons are in there and stuff. I I I can't take anybody's word for that, you know? It's nothing against you guys. We're going to probably go to the the post office. That's where they're going to take you to from, I think. >> Oh, is that where you're going to go? >> Yeah. That way that way we're not from the house. >> I appreciate that. >> Yeah. >> So, where's this all going to go? I mean like what's happening? Like what what's what's the what happens after this? >> So, what happens is you'll be booked. You'll see a judge um that'll talk about conditions of release and stuff like that. Um and then or whether there's a bond or I don't I don't know. That's that's kind of out of our hands, but that'll be you'll see a judge and then once you're released um then it'll be a criminal proceeding. You'll go to you'll have a court date to uh do an arraignment where you'll, you know, plead make your plea and then it'll go to from there. >> But, I won't see a judge today. >> Um I would think that's probably unlikely just being that the time of day it is. Um I'm not sure uh if the if they do um Saturday arraignments or not. Um >> Will they set a bond? I mean like can I get out on a bond tonight? >> Maybe. Uh so, there isn't a bond as of now. Um but they they may change that. That's that's something that again is out of our >> Who who who does that? >> It's a a judge a judge does all of that. >> But, when? I mean like Is like a Is there a judge on standby for this? For, you know, not just this, but other stuff? >> I honestly do not know. Like if they do cuz they they would have to do what what is called an arraignment. I don't know if they do weekend arraignments. Um you're probably not going to get an arraignment at night. Just so you know. Um but you know, I don't know if they do them on the weekend or not. >> So, where do they put me? >> At the jail? >> Yeah. >> Like the specific area? >> Yeah. >> I I don't That that would be a on the decision of jail staff. We have no say or knowledge of that. >> What are we doing here? >> We're waiting for the Santa Fe County deputy to come and take you to be your your transport. You guys as you can see we're not really set up for for transports. >> Okay. I'm going to let you say goodbye to her. >> I just want to be honest. >> So I'll give you a call later. I hope. Right. Love you. Okay, babe. All right, bye-bye. Okay. >> All right, miss >> Can you reach across and get your seatbelt >> Seatbelt, got it. >> Don't drop your glasses when you get out. >> All right. So what's the story? >> What are we doing? What's the plan? >> Uh you're going to be transported to Santa Fe County Adult Detention Center. >> And then will I stay there the weekend or are they going to Will I be somewhere else? >> No, it just depends on when you see the judge. >> And is that judge available like the weekend? >> Usually no. I've seen it happen sometimes the judge goes in on a Saturday. But usually no. >> How do we find that out? >> You would have to ask when you get there. >> Okay. So what are we doing? Going in the back of your car? >> Yeah. >> All right. I'm trying to make a minimal impact out here cuz I live out here. >> Okay. >> Yeah. We just do it as quietly as we can, sir. Okay? Without jeopardizing officer safety, of course. >> Okay. Do you want me to hold on to those while the handcuffs get to you? You got to change out the handcuffs for you. >> Sure, yeah. >> And then I'll give them right back, okay? Okay. Oh. >> That's okay. So I'm just going to have you Do you want to come back here? >> Sure. >> So I'm going to take it off and then you're going to put one hand on top of your head and then the other one, all right? Here, put your hands on top of your head. And just keep them there, all right? Go ahead, turn around and face the car. Thank you. Use your other hand, ma'am. >> Can you just rub my nose? I'm allergic to that cop. >> Yeah, you got you. >> My left side. >> put my forearm there. >> I have a long sleeve. >> Yeah, I don't worry. >> Awesome. Thank you. >> You got it. >> No, he left that all with his wife. >> Okay. I'll just take this stuff here. >> Yeah, that's all he had. It's real easy. >> Okay. >> Thank you. >> Appreciate it. >> Yeah, I really do. >> All right. So, in the end, the individual was ultimately charged with five counts of aggravated assault with a deadly weapon and one count of public nuisance. Of those charges, three of the aggravated assault with a deadly weapon charges were deferred and the other three remaining charges were dropped. Now, on the court's website, there is very little information about the actual sentencing, but it does look like he received some form of probation for the three aggravated assault with a deadly weapon charges that were deferred. Anyways, that's it for today's video, but we love to hear what you think. Do you think the officer should have let him drive down the driveway knowing that the arrest warrant is for aggravated assault with a deadly weapons charges? Do you think that the suspect was simply playing dumb, acting like he had no idea what was going on? Let us know down in the comments below.
