If you like fish and wildlife content, be sure to subscribe so you don't miss out on future videos. Officers with Florida Fish and Wildlife were on patrol in federal waters when they observed a commercial shrimping vessel with crew members actively fishing with rods and reels. They made contact to conduct a resource inspection. >> Oh, just threw something in. Fish. Yellow tail. Looks like yellow. >> Yeah. You got ice all over your head. >> Yeah. >> Yeah. We can close it for now. >> How many snapper are in there? Guan Quanto snapper. Snapper. >> How many? You got a bag of them? >> No, the bag. >> The bag? >> Yeah. >> How many? >> 200. >> 200. >> Cam said a couple hundred. >> Couple hundred. What? >> Couple hundred bags and there's only shrimp down there is what he said. >> There's a sack snapper. I just can't get it out. >> He his permits are expired as of 20 days. >> Okay. >> He's trying to call the captain right now. My phone is dead. That's why I brought all that out. >> Is the boat registered? >> It is, but that was that was expired too as of like 21. >> Really? >> I don't know what the paper >> Yeah, the paper was. I didn't look at the sticker yet. They have a ton of lane snapper. He just told me maybe 200. There's lane snapper hidden behind this box. Behind the box? >> Yeah. Go look. Why did they say why they're behind there? They don't know English too. Well, well, the captain said the only the fish on the boat are on the deck. He said everything else in here is shrimp is what the captain said. Do we just like overlook the stuff that that's on the deck over there? Yeah, this is their call. >> Huh? >> Can I give this back right now or I'll hold on? >> You can give it back. So, your hands are free cuz I'm going to I don't know if one of you guys want to go down there with me. >> I'll go down there with you. Let me Yeah, let me come back. I'm going to give you this stuff back. Do you mind coming out to the deck with me? >> Okay. >> And uh they're just going to go down and check the ice. Okay. >> Okay. >> There's all your stuff back. I'll follow you. >> Okay. They have a ton of lanes, [snorts] like a whole sack of them that's frozen and quite a few on the deck. The permits he has are expired, though, so we're going to have to get a hold of somebody to run them. I'll get the stick later. He's going to call about that permit. >> All right. >> Oh, is she going to stay up here? Yeah, here. >> Just be careful, John. That ladder has a lot of ice. >> Slick, slick, >> slick. And it is freezing. Oh, they have a lobster tail, too, by the way. At least one that I found. Hey Cap, do you just mind just standing back this way while they're down here? Can you stand over here? >> What do you say? >> Just stand over here. >> Yeah. >> Yeah. Good. It is cold down here. >> Yeah. >> See them? >> Yeah. >> So, we got to get these sacks out of the way. Just be careful. They're heavy can be. Watch your foot. >> This has got fish in it right here. >> Yeah, I saw that. Yeah. And there's a lobster tail. But there there's other stuff here. I didn't even see more snapper. Some kind of What is this? A fililet? Some kind of filt >> want to answer. >> I do. Go ahead. >> For what? >> 20 per person. 8 in for lanes. >> We didn't even look in there. >> Yeah, I need to look. He said it was shrimp, but I didn't look. So, we definitely need to here. >> Those are all blue crabs. But look, egg bearing. >> Oh, yeah. >> No bueno. >> Yeah. No, no bueno. >> There's no other fish down here. >> Um I don't think so. >> I know a whiting. Little bit whiting. >> Whiting. >> Yeah. But this is a I don't know if you legal or Get rid of >> whiting's okay. >> Yeah. >> Go ahead. Watch your foot. They have egg bearing blue crab in here, too. Bunch of lanes. At least one lobster. There's another egg bearing in here. I'm going to put this one in. Clipper lobster. We're going to have to count all these. They're going to be over the limit for sure. Recreational to find out. I don't think they do. But if they have a golf refisher, do you want me to start taking these up? >> Yeah. Should probably keep looking too cuz >> Oh, for sure. >> These bags are awesome. >> Did you even go back here? >> Yeah, just briefly though. That's where I found the lottery tail. Might be about to hand them to Alex. >> Where you at? >> Right here. Where you at? >> Oh, wow. John. >> Yeah. >> Behind this wall is more snapper hidden. >> Okay, >> we got a bunch. I mean, like a lot. I need some gloves. This is going to be difficult for us to get. >> It's going to take a while. >> We just found more. >> Bunch of tuna. >> Tuna. >> Looks like just one bag of uh lang. Bunch of black fins though. Try and grab it. John, just tell me when you're coming up with them. I'll grab them. I'm just watching right now. >> They are not happy. My hands are frozen. Oh, you want me to come back up there? >> I got to come up. Let's just come up for a minute. He said they're not happy. Let's just come back up. Yeah, calm, calm. >> I'm sorry, sir. >> It's okay. >> Be tired and sleepy because every night working. I told I told him no putting nothing in the freezer. Nothing. They cost what I three four time in in Tampa. Never never have my in my freezer. Now I told him that him and him no putting nothing nothing because I know my problem. Me never have problem. Never never. Four time he coming here because he told me I need to eat fish because nothing. Yeah. >> Nothing. So you can look everything for me. We don't have nothing problem. I I told him no putting nothing in the freezer. I don't want nothing in here. Huh? glove. Did >> you look in that brine tank? I have not. No. Okay. >> I haven't looked in the galley either. Is there anything in the brine tank? >> Fish and shrimp. >> Just shrimp. No fish. >> No. No. No. Nothing in my tank here. Huh? >> I need a shovel or something. I'm lucky. >> Okay. Just >> Yeah. >> Do Do you have a shovel? >> Yeah. >> Okay. >> Okay. Let me see. Let me see. >> Okay. >> There's just four to five bags of shrimp in there. >> Did he go back down? >> He did. Yeah. You're welcome to go back. You could. >> Yeah. Yeah. Let me know when you're halfway. I'll grab them from you. >> Okay. >> That one's going up. >> Yeah. Just trying to see what's in it. Got it. Got it. >> Yeah, >> Alex, this one's heavy. >> Got it. Yeah. >> I mean, this one too, right, Jeremy? This has got a few short lanes in it. >> Yeah. Whatever you see. >> What kind of tuna is it? >> Huh? >> What kind of tuna is it? >> Bunch of black fins. A cobia. >> You want to pull? You want me to pull some of the shrimp out? >> No, that's the last of that. There's another bag right here of something. >> Okay, >> I am freezing. >> Holy crap. What are these short cobia fillets or something? >> Here, grab this. I don't know what this is. Short coal flies or something. >> Hey Cap, listen. You can keep talking to him, but I need you to just stand over here. Okay? You can yell at him, but stand over here. >> This fish is sorry for eat. >> That's okay. >> Yeah. Before this one, if this one you look, you know, have cook here. This one for heat one time coming. You you can go inside put the everything that oxide. No one more. This one. >> Okay. >> In my four time this one coming in. My nose is going to freeze. It is cold as I got to check behind these walls. These walls are full of tuna. >> Is it really? >> Yeah. I I got to go up. I got to go up. >> Yeah. Yeah, me too. >> All right, let's open them up. Yeah, this is going to fall out. Another lobster tail. A blue runner and a porgi coy. >> Yeah. >> Oh, there's mangroves, too. There's yellow tail back here and everything, too. So, they still count towards the snapper aggregate, though. >> Yeah. >> Golf. I mean, we're going to have to lay them out at some point so we can get pictures of them all. So, I'm not sure how. Like, do we want to just count them then? Put them in rows of 10 or 20? >> Probably. You want to just let them thaw out? >> Yeah, that's why I'm dumping them here. >> Those are frozen solid. >> They can have 20 per person recreationally. They didn't have a golf refish permit, right? >> You didn't hand me one. >> I did not see one. He handed me a book and I pulled the two shrimp permits out. >> Do you have a golf refish permit? >> I know that permit. >> Golf reish. >> What you say? >> Ree fish? >> I did not see it in his book. >> Golf reish permit. >> Um the the paper >> or just shrimp? >> That's shrimp. Yeah. Yeah. >> I didn't see a golf reish in there. No, I I can look again, but no, I only >> I know last time. >> That's okay. >> Permit for fish. No have >> no permit for fish. >> No, sir. I know the answer. >> Okay. I might go back down. I'm not convinced there's not more fish somewhere. So, we kind of have to decide cuz we got a we got federal violations and we have state violations. Does he have shrimp permits >> or do we not know yet? >> We're trying away from Noah. >> All right, I I might go back down for a minute. They have a lot of black fins, but >> more than 10. >> Hard to say. It's It would be so difficult to get them out. They're wedged behind these boards. Would >> it be easy to grab them with a gap? >> No, it wouldn't be easy to grab them with anything. How many are back there? Quite a few. Like 20. I don't know. They're under a milk crate. more on this side. >> Hey, Captain. Yes. >> Is there any seafood in the fridge or freezer up front? >> Okay. Okay. >> Can we see? >> Okay. It's all I have lot of problems for my team. My situation that's bad. >> Now is any problem? He never >> nothing in here. >> No, nothing. >> Okay. >> Okay. >> Yeah. >> Okay. >> Thank you. >> I guess we're going to These are going to cover the whole deck. Are we going to do it all here? >> Yeah, I would say so. >> Easier to put them up here. They're not going to fit there. Well, you want me to start organizing it? Yep. Um, your counts don't matter in the baskets, right? I didn't count those. This is still 92. Uh, >> what are we thinking? Like >> rows of 10. >> We'll start with rows of 10 and see how big it gets. Where you starting? Over there. Yes. The more we're thinking about it, >> we could do no do the lanes federal and do the rest state >> cuz there are two different violations. Like one is a bag limit, the other is, you know, blue crabs, lobster. >> Yeah. >> Other stuff. >> What did Jason say about the tuna? >> Well, if we write them stay, we got to get the tuna out. I don't It's going to be physically like it's going to be hard to get that those tuna out. They're behind all those walls. But there's probably three or four all huge. >> Yeah. >> Black pins. They're over 10. They're They have more than 10. >> Oh, I'm sure we can find a find a way to get them out. >> Okay. I'm gonna start scooting these closer, Alex. I think. How many? How many tuna? >> Um, >> I think so. Six. >> Six. >> Yeah. >> I saw more than six. >> More. I don't know. So, I thought >> Ask them how many. We're going to find out. >> 10. >> Pompo. Don't matter. >> No. Are you counting your rows right now? >> No. >> Okay. Me neither. I'm just >> I'm trying to organize them and then I was going to count them. >> If you can maybe make them like the same number. >> No, we will. I'm just stacking them right now. >> Yeah. >> I kind of need them to be over there. >> The mates. >> Yeah. Or all three of them over here. They can sit or whatever. >> Sit over here. Stand there. You too. >> No. Maybe over here. So, we're not coming all the way down because this is going to be a hard picture to get. So, stop here. I would We'll start another row over here. There's 30 in this row minus this one. >> So, to not mess you up, I'm going to let you do your 30. I'll come back and do my 30. >> Yep. Did >> you hear that about the black fence? >> I could I could hear that. >> The temper bur's only for recreational. >> Okay. >> So, they're good cuz they have an SPL and an RS. Yeah. >> So, the fillets, they're going to be fine cuz Golf Federal, you can have a pound and a half of fillets per person. So, get them out of here. >> Yep. I'm going to I'm going to let them know they can put those fish back on ice. >> Yeah, >> if you want. Those these are okay. Bueno, you can put them back. >> No, it's okay. >> They're okay though. Keep them. Eat them. That's okay. >> You told me I can get it to get it, you know. But I told you it's a new one. I >> Okay, but those are good. >> Put them in a bag. Put them down below. It's okay. >> Thank you, sir. >> Yeah. So, one way you might want to do it, >> what are these in rows of? >> 30s. >> Okay. So, two rows is their limit. >> Yeah. >> So, the first two rows are limit. >> The rest is over. >> You want to add these to this? >> Yeah. I'm just waiting. He's going to count this last row and then I add those. >> And then maybe these snapp are in the bottom there or something. >> Yeah. 40. >> I'm I got to write this down. I can write it. Okay. 300 322 lane snapper. All right. And you still got snapper behind you. Yeah, there's still random snapper behind too. >> Yeah, 322 lane snapper. You want to put them over here or down low? >> Over there's fine. I'll put the lobster down here. That's nothing. It's just those two. Stone crab doesn't matter. So, the tails are wrong and out of season. And how many >> That one might be undersized, but I was waiting till it fall. >> Yeah, but I have a gauge. All right. How many? 2 4 6 8 10 12 14 16 18 20 22 egg bearings. >> That's what I got. >> Yep. We're going to have to somehow get pictures of all this. >> I could if you stand up there, I bet you can get the whole thing. You just got shadows. Feel pretty confident about the freezer. >> Yeah. Yeah. There's no more fish. Like I don't know. I wouldn't know. I'll go crawl down there. No, he said he's good. Get our state salad for evidence picture of all three of us. Oh, did you do you want that pork fish in there? What do you think? >> I don't think I would worry about it. Put it to the side. Okay. Because we're doing federal and state, I wouldn't seize any of it. >> But we'll make it clear that this is all illegal. If they're if they're caught again, checked again in 5 minutes, they could be written again. They could go to jail for >> I already told them that that was all good, but they don't I don't even think they want that. >> Okay. Um, let me work on >> We're throwing these back though, right? >> No, >> I wouldn't. >> Okay. >> I wouldn't I wouldn't mix it up. >> Are all all three of them getting charged? >> For the state, you guys. I mean, >> state you could federal or you really just documenting everybody. So, it's up to you on state. >> Well, how I mean, would you just write all three or Kevin said he wasn't fishing? They're all in possession of it. He's the operator of the vessel. >> Yeah. >> Well, the operator. Yeah. >> And those two were actively fishing when we pulled out. >> Actively fishing when we pulled >> and Okay. >> That's up to you, though. Um, >> hey, Captain, what's your phone number? >> These fish. >> Yes. >> Are are no bueno. Snapper over the limit. >> Yes. >> Okay. Oh, what do I meant though? So, you could have 20 snapper per person. So, 60 total. You have 322 lane snapper, six yellowtail snapper, and six mangrove snapper. Okay, so you are way over the limit. Okay, the lobster, the tails, it's out of season and they're rung. They need to be in whole condition when it's in season. It's out of season. >> I told him I'm sorry. I told him not putting nothing inside. But me I it's a lot about working. I not me it's only here. He don't me not coming. I told him. >> Well, I'm just telling you. I'm just telling you. >> And then the blue crab. You see the eggs? >> Yes. >> Yeah. So any crabs or lobster, if they have eggs, you need to immediately put them back in the water. >> I told him, but this is new one. He knew one to die. Okay. Yeah. You know, on that time >> now it's my >> But you're the captain. You're the >> captain. I Yeah. Yes. Yes. >> So the the snapper is a federal violation. >> Yeah. >> The the crabs and the lobster is a state violation. Okay. So give us a few minutes. Okay. We could we could take you all three to jail. We're not doing that. Okay. You're you're going to get citations. Okay. So, just give us a few minutes. We're not going to take these fish. So, it's up to you what you do with them. >> No. >> Okay. Good. >> Okay. So, we're done with the fish. So, just give us a few minutes. Okay. Whoa. John, be careful. There's a fish right there. >> Let's see. >> Sorry, he's sleeping. >> Oh, it's okay. We're going to explain everything to you. Okay. >> Okay. >> All All three of you there's there's there's separate charges here. Okay. But all three of you are getting charged for the blue crab that have eggs on them and the rung and out of season lobster tails. The two. Okay. That's what I'm I'm having you sign right now. Can you explain that to them? them. Do they understand? >> You okay? >> Yeah. The blue crabs that have eggs on them, there's 22. You got All three of you are getting charged for that. Okay. >> Along with the two lobster tails that have been rung and that they're out of season. All three of you are getting charged with that. >> Do they understand? >> Yeah. Yeah. >> Okay. So, who? Elvis. Okay. that. Hey sir, so signing this is not an admission of guilt. You have a court date. Okay. You have to show up for your court date. It's on May 3rd. >> Okay. May third. >> Yes. All three of you. May 3rd. >> I go >> Ernesto. So this is what he just signed. Okay. It's for the blue crab and the out of season run lobster. >> Okay. >> Yeah. charge for the fish. >> We We'll get to the fish. I'll explain those in a second. You are Ernesto, right? >> Yeah. >> Okay. >> Like I said, signing is not an admission of guilt. It's saying you're going to show up on May 3rd for your court date. >> Oh, hey. >> One citation for you, only you. The registration for the boat is expired. It's no good. and Florida >> I think so that but the problem is today is Saturday not um early the boat working so >> it's not though we looked it up we called our dispatch the boat is not registered in Florida anymore it's expired more than 6 months okay this one you have 30 days Trento Diaz to pay the fine or contested in court okay you don't have to go to court for this but you can if you wish >> uh but what did this one >> expired registration for the boat. >> Wow. >> You're the captain. >> Yeah, but >> you can contest this in court. You can request a court date. >> But that's something you have to talk to the owner about. Be like that cuz >> I know if you I can >> you can you can call him after. You can request a court date and we can go to court about it. >> Thank you for everything. I'm sorry. I'm sorry. >> I understand. It's it's it's unfortunate. So, this is a copy of that citation, okay? What you just signed and three warnings. Okay, warnings. Warning is for um you didn't remove the expired decal. The sticker, you have to take it off the boat. Okay. Along with the saltwater products license sticker, that sticker removed from the boat. Take it off the window, the old ones. Um, and you also had what's called a pork fish on board. It's marine life. They have to be landed uh uh alive. They have to be kept in in water alive for like an aquarium. That's these are just warnings. Three warnings. You don't have to do anything with these. Nothing. They're just warnings. >> Okay. It's only warnings. >> These are warnings. >> Okay. I need to pay this >> that you need to pay or contest in court. Yeah. >> And the other ones are court dates where you have to be there. >> This one I can't pay before going >> these you can't pay. No, you have to go to court. All three of you have to go to court. >> I need to go in the court for >> Yep. >> Okay. >> Okay. >> Yep. And as far as all the fish, okay, it's a separate violation. It they're federally regulated. Okay. So, you can each have 20 a piece, but you're over that bag limit. So, Officer Sturgeon is is taking all of this into account. He's writing down names, numbers, blah blah blah, what you had, and he sends it off to Noah, the federal organization Noah. So, he takes the report, types up the report what he found, and they assess a fine. Um, so they will be in contact with you. Okay? You don't have any paperwork on that or anything, but but they will be in contact with you. >> Okay? But if you the problem if you keep call me we can be working every time in the in the ocean it >> they'll they'll find a way to get a hold of you. >> Yeah because every time it work >> either by mail or phone or they'll they'll get a hold of you. >> Okay. The problem about the fish mean never because put the attention but you know when you working is hard they sit on here every night. Yes. >> Don't put the attention here. But this is my problem. I don't have my >> And just just keep in mind if you keep the any of these on the boat, you're you could still someone could still stop you and you're going to be in violation. Okay. >> You understand? >> You're allowed you're you're allowed 60 >> 60. >> Yeah. You have three people on board, right? So 60 snapper. >> The lobster and the and the crab are a different story. You all right? Those those I'm going to have you throw back right now. >> The love drop overboard. >> Yeah. So, you speak English? >> Yeah. >> Okay. >> Okay. I can put in the water. >> These have to go in the water. The fish you can do what you want with. But you can be charged again with them if you keep them. >> Okay. Whatever you >> questions nothing >> no >> no >> I'm sorry it's it's only I'm sorry >> Alex you good >> the person the person think you know if you this a lot of fish too much too much a person hungry the duck you know the person think he happy if he getting >> oh You're you're really hungry. >> Yeah. No, no. That person think it's good. Yeah. Okay. You get a little big here. You can eat fish. But we coming in the net. Okay. I think no problem because trip him. We told him no putting nothing. But he know that I I know. >> Okay. >> But that's correct. >> Okay. Here. You want to throw those in the clipboard so they don't fall. >> All right. We'll be safe out here. Okay. >> Thank you. >> We're good. In total, FWC officers counted 322 lane snapper, six yellowtail snapper, six mangrove snapper, two rung lobster tails, and 22 egg bearing blue crab. This put them 274 snapper over their combined snapper aggregate bag limit of 60. The three individuals received various state and federal charges. Regarding the state charges, Ernesto the captain and his deckhand Elvis were both charged with being in possession of rung lobster tail, being in possession of outofse lobster, and possession of 10 gallons of whole blue crabs. However, the charges were later dropped. The main legal argument made by the defense attorney hinges on the fact that the vessel was not registered in the state of Florida as it was over 6 months expired. In federal waters, FWC can only enforce vessels registered in Florida. On the other hand, Mangalo was charged with being in possession of undersized lobster, being in possession of out of season lobster, and possession of egg bearing blue crab. He failed to appear to his court appearance that a warrant has been issued for his arrest. We cannot confirm the outcome of the Noah case, but they were facing up to $7,600 in fines.
