It's a misdemeanor to be in the water trying to harvest lobster without a lobster without the measuring device. I did have one like 2 minutes ago. Yeah, I don't know how you used it cuz that one was like way undersized. >> I dropped it when I was grabbing it as a guy. Okay. >> I went bare out there and then I lost it but All right. So, you got one grossly undersized uh lobster. I If you can't measure it, you you shouldn't even be out here. It's wrong wrong time of wrong time of the year. So, um It's an arrestable offense. That's the crappy part about it. Do you have the registration for your boat? >> Yeah, it's in there. So, you When did you lose the measuring device? >> When I was catching that lobster. Um I should have told you not to get him. And you but you So, you never were able to measure that guy. I did on the side. I had a big red tape right here. All right, here's what's going to happen. Yeah. Rather than take you to jail, I'm going to give you a court date. You're going to have to return for court. Um it's kind of negligent for you to to still try to measure lobster when obviously it was grossly undersized. There's a measuring device for a reason. Right. So, um You've never been in trouble before? Okay. So, more than likely what they're going to do is they're probably going to give you an FWC course. They'll call, you know, the the state will ask me for my recommendation, which um you know, given the situation, I'll probably tell them, you know, they were polite. They just did something dumb. Uh but uh they'll probably give you a pre-trial intervention. I can't guarantee that but So, um I I can most certainly recommend that. I can't guarantee that it'll happen but most of the time you've never been in trouble, you did something stupid. It's not, you know. Um so, uh but yes, you'll just have to remember you got to come back to court. Yeah. Just here. Here? Yeah, Plantation Key. There's a bunch of boats still like all sideways on the ramp. Oh, yeah. Yeah, I can't believe they haven't They They They have taken a bunch of this stuff though, right? >> Yeah, they took a lot of it down but I guess some people just don't care. Cop or firefighter? Yeah, after football this I took a year and I'm figuring it out. I'm pretty much chose about every profession in my head. It is very different. It is you know, the things that suck is writing a couple of good guys a ticket, you know. Those are the bad sides of it. Um you know, there's a lot of good stuff about it, too. So, um making a difference is obviously a good thing. No. You know, I even on my days off I love to go out in the boat. Yeah, I love the water so um I love the water so I don't You know, and also it's different when I go out on the boat, I'm with my wife. It's you know, you can go jump in the water. The times I got to jump in the water here is because somebody dumps a bunch of stuff on. So, at least I get to enjoy the boat when I go out on it. All right, Shane. Yours is printing out. This is not an admission of guilt. It's just stating that you promised to appear in court that you got the ticket for the possession of undersized. I gave you some lobster gauges so this way make sure everybody in the water has a lobster gauge, okay? And you know how to measure them now. Okay. Um sign right here. All right. And like I said, I I will, you know, I'll give them my recommendation. I can't say that it's going to be a guaranteed thing but obviously you've never been in trouble. You you know, you did something stupid. And it was alive so that's good. So, hopefully they just give you pre-trial. Pre-trial intervention, what that is is basically um it is it's that one chance that everyone gets so that you don't have a record, basically. So, um as long as you comply with all the stuff they tell you to do um FWC course and all of that stuff. Um that's normally what I see from from um from the cases that I write, okay? So, here's your copy and here is the court date. 7:31 at 8:45. It'll be in front Yeah, yeah, yeah, it's a hell of a ride, man. So, if you got a friend down here, try to stay there. He later pled guilty to the charge and was sentenced to 6 months of probation with the possibility of early termination. He was ordered to complete 36 hours of community service with the option to buy out at $10 per hour, complete a Florida Fish and Wildlife course, and pay $378 in costs and fines.
