An officer with the Washington Department of Fish and Wildlife was conducting resource inspections at a boat ramp on the opening day of recreational spot prawn season. He contacted three individuals returning on a vessel. >> Morning. >> Hey, how are you? >> Good. How are you? >> Good. And uh what time did you uh set your first spot? >> Thank you. You mind if I take a peek at your catch over there? Sure. >> Okay. I mean, you can go get your truck. I don't want to slow you up because the ramp's a big mess. >> Okay. >> Um just just three limits on the boat, right? Yeah. >> Okay. Yeah. >> They all in separate containers. >> They are. Yes. Red bucket. And then there's one in my That's >> Thank you, sir. How's it going? >> How are you? >> Good. Good. >> How are you, sir? >> Hi. Where do you guys got all your shrimpies at? >> Right here. >> Red bucket. >> Red bucket. >> Right behind this. Okay. >> And uh besides those shrimp, are they any other shrimp or fish in the boat? Okay. Let's see. Um, so did you get how many how many shrimp did you guys catch? [music] >> Just those two bags. >> Each bag is 80. >> Okay. And this one there's another >> another 80. >> Okay. Another 80 in here. >> Okay. Look at these. Heat. Heat. Come on. Heat. Heat. Heat. Heat. Heat. Hey, sir. Besides these extra shrimp, is there any other shrimp on board? >> So, the ones up in the bow and the ones right here, there's no other shrimp. that one. These ones. What What about all these ones that are up in the bow? >> Okay. So, no other shrimp on board. >> Okay. Um, do you have your license and your driver's license? >> How old are you, sir? >> Do you have your license and driver's license? >> Right where this right. >> Okay. All three of them right there. And do you have your driver's license? Yeah. >> And can you Does your granddad have his driver's license? All right. Driver license. Thank you, sir. Thank you, sir. >> How do you like to be called? >> Raiden. >> Raiden. >> Yeah. >> Austo. >> Mhm. >> Okay. Do you guys still get mail at uh drive? >> Yeah. >> Okay. And you get mail there, too? At 16? >> You do? >> Yeah. >> Okay. Thank you. >> All right, guys. So, here's where we're at. You said >> those are your limits. >> Yeah. >> What happened? You got anything to say? >> No. >> No. >> Okay. You knew so you knew the limit was 80 and this appears to be more than 80. How many you got total? >> Okay. >> Did you just keep everything you guys caught? >> Yeah. And this is your dad? You got your uh driver's license? >> Yeah. >> Okay. >> So, I'll fill you in. I found the shrimp you had up in the front of the boat. >> All right. >> After you guys told me that you only had your limits. >> All right. >> So, now you guys are being detained. You're not free to go. >> Okay. >> And uh what I need you to do is I need you to pull your boat. pull her there. Stop. I'm gonna go to my truck and do some paperwork. >> Okay. >> I got to do some shrimp counting and then we're going to do some paperwork. >> Okay. >> Cuz what you guys have is you have a failed smith, you have an over limit, and you're potentially into Well, that is a mystery. >> Okay. >> Okay. >> So, honesty is typically the best way to go. >> Yeah. Does my daughter's license count? >> Is your daughter with you? >> No, it doesn't. >> Okay. >> It only happens if she's with you. >> Gotcha. Now, um, >> I have two licenses for that. >> I asked him, he wasn't sure. How many shrimp do you guys have? >> Uh, those on the in the bucket for sure, 80 each. >> Okay. >> Um, he said the one in the cooler is uh a limit. >> Okay. >> And then those three was that three bag, four bags, five These >> three big ones and two small ones. >> Yeah, these these are the these these ones are the ones that you have in front. >> Yeah. >> Okay. Are they each 80 or are they just everything extra? >> It is should be roughly 80. I don't know about the small bags. >> Okay. Do you guys have another bucket on your boat? >> No. >> Okay. >> Well, there is. >> Okay, that's fine. And then do you have a vessel registration? That's current. >> Okay. So, like I said, I'm going to take these. I got to go do some counting and paperwork. >> Pull over there. >> Just someplace park where you're not in the way cuz it's clearly a mess. >> Okay. >> And um come over and see me. I'm parked over there in that truck >> once you're done. Okay. >> I'll be right there. >> All right. Thank you, sir. How you doing, sir? >> Great. How are you? >> Good. Are these boats going to move anytime soon, you think? couldn't tell you. [laughter] I'm I'm not not part of the organization party. >> Are you uh >> I'm making sure everybody has the the limits that they're allowed to have. >> Somebody didn't. Huh? >> Somebody didn't. >> Yeah, that won't be it. >> 80 80 per person. >> Yeah. >> Whichever comes first. But the shrimp it's 80. >> Yeah. 80 per person, guys. >> Oh, yeah. >> 80 per person. >> Yeah. >> Yes, sir. >> I'll grab that one. What's that? >> Uh, it was those guys right there. The ones that uh you talked to while I was standing there. They had a bunch stuffed up in the bow. >> Okay, I'm going to finish counting. So, just stand by and please don't interrupt so I don't misount your shrimp. >> It's fine. I'm just letting you know so that way I don't >> I don't get the number wrong because it matters to you. >> So, you guys are allowed to keep your limits. And for the counting, I'm going to combine them all into here. So, you have one limit in here already. >> It's okay. Just stand by, sir. Heat. Heat. 42 43 donating two. Okay. 54 7 8 There's two limits. Two 6 10 7 14 80 Okay, that is three limits there. Okay. So, these are the portion you're not allowed to keep. 13 51 4 80 There's another limit. Okay. 2 3 4 5 6 7 8 52. So you got three limits plus 52 over what you guys are legally allowed to have. three. So, here's what's going to happen. You can't have these shrimp. You're not allowed to have those shrimp. You can have those shrimp right there. I've got some paperwork to do now that I've counted them. Um, where did you guys park at? >> Okay. You're not holding up traffic, are you? >> Uh, yeah. >> Yeah. So, here's what's going to happen. I've got to do some computer work now. It's going to take a few more minutes. Go find a better parking spot so you're not holding up the traffic. And then um come back and see me. This is going to take a few more minutes. >> Few minutes in like 30 >> possibly. >> Like I said, at this point I've got to do paperwork now. I got to count it. This all takes time. It's a lot easier if you just follow the rules >> and then you're not on my time and you on your time. >> Okay. So yeah, please go deal with that and then come back. >> Okay. If you don't mind, don't lean on my truck. Here's what's going to happen. I'm referring charges to the Island County Prosecutor and they're going to reach out to you guys in the mail and then they're going to give you directions on how to proceed with this. You understand? Okay. Did you hear what I said? So, you're going to get something in the mail and it's going to tell you what to do, okay? >> And how to comply with this. You guys can't um can't take more than your legal limit. And when I ask you if you have any other shrimp on board, what do you think the correct answer is? >> It should be no because there's no shouldn't be other shrimp on board. But you can't fail to submit because if I've activated anything else, it's a whole another charge. So uh Raiden, here's your I'll give you your dad's and then here's all those licenses that were in the front. Okay. Do you guys have any questions for me? >> How much going to be judge for this? >> Since I'm referring it to the court, they're going to decide. Okay. >> This isn't This isn't just a ticket. This is a criminal charge. >> Criminal charge. >> Criminal like a misdemeanor. >> Yeah. >> Like you have to go to court. >> Yeah. >> And potentially jail time. >> Jail time. >> Yeah. Anything a misdemeanor technically by law you can serve up to 365 days in jail. >> So that's the seriousness of this. It's not as simple as a traffic ticket. You can't have more shrimp and you can't fail to submit. Okay. So, your dad's back there in line? >> Yeah. >> Okay. You guys can take your bucket and your can cooler. I'm confiscating the shrimp and your Ziploc bags. >> Okay. >> All right. You guys are free to go. >> And if your dad wants to come talk to me, I'll be over here. >> All right. >> Okay. >> Thank you. >> You're welcome. Have a good day. You, too. Okay, audio video is back on. >> Okay. I just want to make sure. >> Okay. So, you didn't get a chance because I, you know, I understand there's a cluster here in the parking and stuff. >> So, uh, what happened is you guys overlimited and you failed the Smith because when I walked down the ramp, I said, "Do you have how'd you do and what did you say?" >> Three limits. I talked to your son. He said, "Three limits are right there." I talked to your father and I looked law >> and he said, "Hey, you know, there's three limits." I said, "Is there any other shrimp on board?" "No, no, no." I used my inspection authority. >> Sure. >> What did I find up in the bow? The shrimp that you guys hit. So, that's what we call a fail to submit, which is a criminal charge. Um over limiting is another criminal charge. These are both misdemeanors. What I'm doing today is I'm not writing you a ticket, but that's why I verified that your address is correct on your um >> on your uh uh >> license and that way. >> Yeah, I gave it to your son. >> Oh, okay. >> Yeah. And so he he has your license and your fishing license. I made to give this back to your dad. >> Okay. >> Um so what I'm doing is I'm referring charges to the county prosecutor. They are a little under manned right now because as you're in the Navy, most of the people that work there are also Navy spouses and they transfer all the time. So, it's going to be a bit of time before they reach out to you and what's going to happen is they're going to give you directions on how to proceed with this and you can explain your part to the court. Um, I don't know what the cost is going to be because it's imposed by the court. >> Okay? And that's the battle I got for you. >> Okay? >> You know, but just next time >> Yeah. >> follow the rules and then it won't be a negative experience cuz >> you know I I want you there shrimp. >> Something you're legally allowed to do, but you just got to follow the rules. >> Yeah. And plus turn can't have you got the the people that own the license has got to be on on board as well. >> Correct. If they're not there >> can't have it not allowed more than 80. And >> like I said the inspection authority it's on the license. I'm allowed to inspect your boat. So if you're hiding it >> and I find it that's a bigger deal. >> So you know. >> Okay. >> You're still in the Navy. >> Yeah. >> Integrity. Honesty. >> I hear you. >> Anyways, have a good day, sir. Thank you. Appreciate you. >> You, too. >> Sorry about the count. >> No, that's okay. My hands are only a little short. >> In total, the individuals had 532 spot prawns, 292 over the legal limit. Unfortunately, we do not have the court records for this case, but based on the interaction, it's likely that all three individuals were charged for harvesting over the legal limit and failing to present their catch.
