I got the patient on board. We'll be going in to go uh harbor. Oh. iPhone. >> What was that? >> No iPhone. >> I'm measuring. We're trying the iPhone thing. Uh app. >> Gotcha. >> Who caught the fish? >> I caught the fish. >> Caught all three of them. >> Yeah. >> Do you have an ID? >> And your and your license. Fish license. >> Sure. What's going on? >> All three of these are on their size. >> All three fish are on their size. I got um >> my ID >> my ID is in my bag and then I'll show you my fishing license. >> Hey, let me get the ID. I'll get my ID. >> They're my fish. >> I tried measuring them on the thing. Uh m it said was 16, Lane 8, and then those were 12 if I'm not mistaken. Uh, so mud and cyber is going to be 18. >> Men's 18. >> Uh, >> here's Oh, this is a transaction. And then this is >> Look, I was searching up >> fuel. I don't know if this was like the right site, I guess. If >> I'm mistaken, they had all the things from Snappy. >> So that's that's old right there. Okay. So for the mud and snapper, they used to be 60. >> Uh and they changed they changed the regulations a few years ago. >> Long time. Yeah, it's been a long time. Yeah, I think >> three or four years ago. Do you hear as well? I just got >> All right. >> It's okay. Before I ask you any questions, right, can you advise FWC because well, this is most likely a crash that occurred. >> I'm saying before I start asking any questions, right? So, here it goes. Before we ask any questions, we must receive your rights. You have the right to remain silent. Any safe against you? Do you understand each of these rights I explained to you? >> With these rights of mind, do you wish to talk to me now? >> Okay, young man. >> Yes. >> Do you understand each of these rights I've explained to you? >> Yeah, I do. >> Okay. With these rights mind, you should talk to me now. >> Yeah. >> Got it. Okay. So, first things first, I you know, uh it's a question, you know, you guys want to answer one at a time. Uh, pop fish on my I pulled all three fish out there. >> Okay. So, have you tell you >> he's my father. So, >> they were my fish. My I pulled him out. >> Okay. >> I understand. Um, at any you were showing me that app uh that you had a picture of the thing. Okay. I could I could show you your name. It was the site was called outdoors featured >> whatever. Uh >> from >> I searched up the regulation for snapper. He had told me that they were some kind of snapper. I looked >> and then I clicked everybody. >> Sorry, I have a privacy screen. >> No, you're good. >> Do you mind if I look at that real quick? I just want to see what's on it. Okay. >> Let me see. 10 minimum size limit bra mangrove eight size limit for lane 16 minimum size mutton 15 minimum size golf side at 20 in minimum size limit red 12 yellow tail subjects okay >> 41 your subject Florida. >> So that uh what what app what website is that again? >> Uh it's called snapp. >> All right. So, do you have measuring device? >> Yeah, we were using the iPhone. >> Got it. >> So, okay. >> So, over here is just >> Yeah, I know what app that is. So, uh, these apps sometimes and I wouldn't really technic questions answered off of it, >> but when it comes to measuring, that's one thing that, you know, especially like I wouldn't trust uh uh phone. Okay, it's just >> as perfect as technology can be, it's bound to make mistakes. Okay, so we have an undersized butted snapper, undersized yellow tail, and we have also an undersized master snapper. Master snapper has 10 in and it's around like eight. You have the yellow tail that's close. That's around like 11. I'll measure in front of me. And then that mud snapper is also size 18 in. It's 18. It's supposed to be 18 in >> and it's around like 14. Okay. So, it's it's really off. Um you guys have to have measuring fun. Uh so just hey right now >> what do you want to say? >> When are you clear? Can you copy disable phone calls? >> Copy. So just so you're clear, you have three size fish. That's those are misdemeanor charges. Three charges. That is an arrest. That is an arrestable offense. I can take you to jail right now for that. Okay? Just so you're so you understand that. Okay? So here's what's going to happen. Okay? I'm not taking you to jail tonight. Okay? >> So I am issuing you about citation require. Okay? So like I said it's you know you can't be relying off that man it's this you know that's why we want to avoid this but at the same time you know I also have my job this enforcing the regulations of the water. Okay. So you guys have your fishing licenses that's a good thing. Okay have your fishing lices. >> So uh if you want if you guys want to do something just uh uh sir if you want to just pack up the truck and stuff. You're just going to go to the car. Just going to lean up against right there. That's it. You're just going to hang out there, type up some paperwork, and I'm going to send you on your way. Okay. >> Deal. >> Okay. >> Um, >> yeah. >> Then those. So, what >> the measuring device that you have. Can I see it? Um, >> sure. I'll show you exactly. So, how how we're doing this? Okay. So, >> you have >> Okay. You got your your snapper. So, snapper is total length. Are you familiar with total length and hold and uh head fork? >> Okay. So, uh snapper, we measure them to the total length. So, you're going to put the tip. You're going to close your mouth is what we do. And then you're going to pinch the tail. And that's total length. So, total length is 15 15 in. Now, when we're looking at fork, sometimes some fish are measured at the fork, which means you know the tails are open and you're measuring right here. Okay. at least 50. >> And then this you said that's not a lane sniper. >> This is not a lane snapper. This is a school master snapper. Okay. School master sn have to be 10 in. So we'll measure this one as well. This is also going to be total length. Close the mouth right there. The tail. So he's about 8 and 12 8 and 12 inches. Okay. Then we'll get the yellow tail as well and put it here at the tip. neutrals peach tail. So it's 11 and like 11 shy of 11 and a half. Okay. So just so you know a lot of people get mudded snapper for lane snapper. They kind of look like not at this size but small lane snapper like when they're like sorry button snapper when they're about this size they look almost identical to them. They got that little dot that the same shape the same almost the same face. Okay. >> Uh but once they get big you really can't mistake them. And this is this friend. Uh so yeah, school master mud and snapper and yell. Okay. So >> go over there. I'll type it up quick and I'm going to send you guys on your way. Okay. >> How do I pronounce your name? How do I pronounce your name? >> Daniel. >> Hey Daniel. I don't I don't like butchering names. All right. So, this is going to be your copy. Okay. You and I both have the same copies and I'm going to explain to you why. Okay. Um so, uh before we get into that, um just so you know, uh right here is going to be the charges. The undersized uh mutton snapper, the school master snapper, and also the yellow tail snapper. Okay, just letting you know right here you're going to see on mutton snapper charge is showing 16 in. For some reason, they still have not updated that on our system. But if you go on fwc.com, you're going to see that the legal size for mud and snapper is going to be 18 in. Okay. Just letting you know that >> that's where all the >> Yeah. Everything you go So all uh the plethora you can get a plethora of knowledge off of FWC. >> Yeah. FWC. Everything you want to know about fish, whether the prohibited species, fed federally protected ones, >> everything. Everything. Limits, >> right? >> Seasons, it's all there. uh including uh the licenses that you want to get if you want to catch. Okay. So, um yeah, these are the charges and then uh right over here it's going to be and I have the same exact copy. Okay. It's going to be on the 2nd of December 2024. You have port at 9:00 a.m. for Honorable Judge Morgan at this address 3117 Overseas Highway in Marathon. So, it's just a little bit further south. Okay. Um if you miss your report data, a warrant will be read. So I >> it is imperative that you do not you know you show up. Okay. >> Uh so the only thing that I need from you, okay, is a signature on my copy. Your signature is not an admission of guilt. Okay? It only means that you understand everything that I've explained to you. Okay? Court date on the 2nd of December, 9:00 a.m. Judge Morgan, the address, the number if you have any questions, and your charges. Okay. Do you have any questions, comments, or concerns? Reference point um >> can be appeared whatever the case may be. >> Um disabled if you have them, you know, can this be through Zoom? I have cases. >> Uh that's a great question and I know said like postcoid a lot of like court dates and things like that have been you know zoom. I don't know. I'm not sure exactly. I don't want to give you an answer. So, just give them a call then maybe, you know, they they might uh but for the most part, yeah, I can't I don't want to give you an answer and then, you know, it's not the correct answer. >> Um, so yeah, that's Any other questions? >> Okay. Will you sign me a copy? >> Okay. >> Here we go. And you sign right you want my print name. >> Oh yeah. Right next to a little pile of so the the fish just letting you know I'm not keeping them. We don't freeze them or anything like that. So you saw me get out cuz I took pictures of it and we just use evidence. We don't I don't think we ever kept fish before. All right. Just letting you know. Okay. It's all going to be on my body cam footage. They dump it right back into the water. Okay. >> Okay. >> All right. Any other questions? >> That'll be all. Appreciate it, >> sir. Do you have any other questions? Right. >> Okay. >> Hang on. >> Uh, I say FWC, it's you got go on there on the website. There's yours. This >> is ready. fwc.com telling you you'll learn everything you need to learn. >> Um, you know, it's up to the judge what it is, what the verd, you know, it's going to end. Uh is this your first time >> violation? So first time you know that's in trouble. It's you know obviously we you are in this is serious right now. You know it's a violation that's been committed. Uh but normally they uh they'll send you to like uh they'll let you elect like a school like you know like you go to uh you get pulled over. You guys speak Spanishita. So they send you to a traffic school. I mean, it's like a fish school basically, you know. So, you go and I don't know if I not sure if it's online or in person, but you know, they sometimes they'll tell you, hey, it's uh you go 6 months, you can't fish in the Florida, you know, they'll put you on probation, but then they'll tell you maybe or maybe sometimes it's a year, depends on depends on the severity of the violation and how many times you violated it as well. >> Uh but they can make sometimes, you know, they'll cut it in half. Maybe it's like three months instead if you do that. So, >> so >> that's like typical session. All right. >> Yeah. typically. So once you start getting into like second, third, fourth violations, now we're talking about, you know, that you're just not learning and then that's it's a different uh story we're writing there. Okay. >> So, all right guys, get home safe. All right. >> Bye. Take care. >> Yeah. >> Thank you. In the end, the suspect was charged with possession of undersized mutton snapper, possession of undersized school master snapper, and possession of undersized yellowtail snapper. Through a negotiated plea deal, he pled no contest to the possession of undersized mutton snapper charge, and the other two charges were dropped. His adjudication was withheld and he was sentenced to 6 months of probation with the possibility of early termination. He was ordered to complete a Florida fishing regulations course, pay $250 in fines, and pay $38 in fees. Approximately 5 months later, his probation was terminated after satisfying the conditions.
