Officers with Florida Fish and Wildlife were on patrol when they noticed a private property entrance with an open gate. The property had 6-foot fencing around it with no trespassing signs. They observed approximately 1,000 semi-tractor trailer tires on the property. A couple weeks later, after seeing a vehicle enter the property, they set up a concealed location to observe. As they watched the vehicle, they observed the suspect aiming a rifle out of his driver's side window at a nearby alligator. He fired a few shots at the alligator before exiting the vehicle and continuing to fire. Get down. Yeah. Now he just pulled another gun. I'm sorry. >> Go go go go go go. Go haul ass to him. Keep going. All right. Don't let him out. HEY, STAY. PLEASE. STOP. [screaming] >> STOP. >> GET OUT OF THE CAR WITH YOUR HANDS UP. >> Get out of the CAR WITH YOUR HANDS UP. STEP OUT OF THE CAR. He's trying to point to something. >> Power, man. Power here. I have a problem. >> Okay. Oh, slow, man. I have a problem. >> All right. >> No. >> No. >> Uh, >> man. No. >> Go ahead and pat him all the way down. Make sure he doesn't have any weapons and deal with the >> rest. Good. Send that one up. >> I don't speak a little bit. What is the problem? >> The tires. >> Okay. >> Tires. >> Tires. M. Okay, we'll talk to you in a minute. Let's go this way. >> Come. Don't. >> Hey, I need call me. My friend is coming back. I need a phone for me. >> Okay, we'll let you make a phone call in a minute. Okay, >> scoot in. >> Okay, >> so you're shooting at the alligator. >> Yeah, >> that's what he was shooting at. Where did the gun go? Here it is. All right. >> [sighs and gasps] >> Make sure you might have to fire it to for it to unload. So, I wouldn't >> Well, I'm not leaving it freaking loaded. >> Yeah. >> Safety. >> No, it's safety forward on this. I think it's a gamma. No, >> no, it's some B. I don't know what the B is. >> It's a Benjamin. >> Okay. >> How does it Is there a release? I don't know. It's not loaded. All right. All right. We need to work on getting a translator. >> Yep. >> Um, we need to work on I'm going to call Did you call that St. Francis guy >> with DP? >> No. >> Okay. I'll work on figuring out a phone number for him. >> Identification. >> Yeah. >> ID. >> In my car. >> In the car? >> Yeah. >> Can I get it? >> In a shirt. Shirt. >> In a shirt. >> Yeah. I'll get it. >> How's homeboy doing? >> Here's alligator. >> Fine. He was just opening his mouth like he was uh hurting. >> First thing you need to do cuz he's custodial interrogation. >> Mhm. >> You need to mirandize him in Spanish through the translator. >> Okay, >> that's step number one. We watched him roll tires out of the car. So, it's like we watched him shoot the So, it's like whatever. But >> it'll be helpful >> to the subject real quick. I'll read it and then if you could translate Of course. May I introduce myself to gentlemen or lady first? Uh, >> it's a gentleman. >> You have the right to remain silent. >> Having these rights in mind, do you wish to talk to us now? >> All right. >> Yes, I do. >> Awesome. All righty. um if you could ask him if he knows what's going on and why we had stopped him. >> If I am to be honest, I'm not entirely certain. >> So, we stopped to stopped him because he rolled the tire out. We watched him try and shoot the alligator with the BB gun from the car. >> Yeah, because I wasn't on the shore and he was trying to attack me. >> All right, you can tell him to just hang tight one second. All right. So, if you could go ahead and ask him where he's getting the tires from. >> I picked them up here, sir, to sell them to the recap. And the ones that I I can't use or not use, I return. >> Okay. Where is he returning them to? Is he returning them here? >> Then I pick them up. I go sell them. And if they don't, they're of no use, I'll bring them back to the same place. >> Okay. So, I guess I need to specify. Or is he getting the tires from this lot, taking them somewhere to sell them, and if they don't take them, bringing them back to this lot? >> I never take the ones that are deep in the slum, sir. I only take those who are in the shore, sir. >> Okay. Does he know where the tires came from that are on the shore? >> Well, not really, sir. You see what one day when I was on a fishing trip because I have a license fishing gear. I noticed there were like, you know, tires on the swamp and I I heard that someone would purchase the the tires if they would be good and I decided to actually get them. >> If you could ask him where he got the tire that he rolled out today. >> I picked him up at night and I brought him in morning. >> From where specifically? Well, sir, basically I come in and I picked up everything on the right side until I reached the end. Then I turn around again on the right side. I notice because I I see everything. I'm trying to classify which one will be abused, which one it will not, and the one that that it won't be abused. I just drop them off again. >> Tell him that the alligator was uh we saw him start shooting at the alligator before the alligator approached him. The alligator was never near him. I mean, if you if you were actually there and you actually saw it, you would notice that the alligator was on my way to me. It was coming my way and >> and I can't let them approach me because they swim very fast and they're fast in the shore, too. >> All right. You can tell him that we just approached the alligator at the shoreline and it swam away from us. Why would it be different for him? Oh, actually, sir, because he saw that I had a gun and he I was trying to shoot it, but I I couldn't shoot to kill him, you know, because my my shotgun is actually on the line, so I'm not really able to kill anything with it. >> You have him clarify what he means by it's online. >> Uh the the side is misaligned, sir. It was not zero. >> Is somebody paying him to drop these tires off? Well, if there is one that actually works, they do purchase it from me by 20 bucks. 20 bucks. >> Does somebody pay you? Nope. Turn to turn and face inside. >> Ah, sir. >> Thank you. >> Can you ask him what he's complaining about? The one I have in my right hand is squeezing too much, sir. I have five fractures in that hand. >> Okay. All right. We're going to pull them out and readjust the C real quick. >> Hey, you have water? >> Aqua? >> Yeah. >> Yeah. >> Hey, where where do you work? >> My work. >> Work at hotel. >> I need my phone. >> I don't remember exactly. What's the name of the place? >> Hotel. >> Yeah, the dishwasher over >> dishwasher. >> Dishwasher. >> Yeah. Lavand plot >> from 9 to 5:00 a.m. Yes. 9:00 p.m. to 5:00 a.m. So, yes. >> Okay. And on weekends, where do you work? >> I repair the trailers from trucks as well as helping a friend of mine to fix up cars. >> Okay. Who Who is the friend? >> Well, he's a Mexican. I only know him as Tono. >> And where does uh Tonio live >> or where does he do the work? >> I know how to get there, but I'm afraid not knowing the proper address. >> If I show him on a map, would he be able to show me where it is? >> I actually need to call him so he can pick up the truck so he can take it home. >> Is it his vehicle? The van? >> No. >> It's under my friend. Would you be so kind as to talk to Let me talk to my friend. I talk call him. He could come here. He speaks both Spanish and English. Help us, too. >> Okay. Yeah, we can call him in a minute. That's not an issue. But I need to get some more information first. >> Okay. Uh, which direction would you go to get to his place from here? >> Uh, I'm homeless, sir. I use the address in front of the workshop, but I'm actually homeless. I don't have a place of my own for speaking. I don't think the gentleman is understanding what we're asking in regards. We're asking for Tony's address. Correct, sir. >> Correct. Yes. >> Okay. >> Phone. Hold up. >> Okay. So, where where is he picking up the tires from? >> From here. >> I'm sorry. I missed what what you said what the translation was on that. >> From here, sir. Uh from here and from the streets. You know, people throw them away and I pick them up. Okay. >> So, where did he get all the tires today? >> I worked yesterday, right? Uh the whole night I picked them up and I brought them to the entrance to the entrance because I couldn't find a lot of >> I picked them up on Friday like late at night to pick them up, you know, get them to the, you know, Saturdays very early because they actually closed early on Saturdays there in the evenings. And where exactly did he pick them up on Friday night? >> A part of them I picked them up in the streets. Another one I picked them up here. >> Okay. I don't understand why you would pick up tires from here and bring them back here. >> And besides you you didn't come here yesterday. >> So where did he get the tires yesterday? Because he did not come here. We have surveillance that's watching every movement in here and he did not come yesterday. So if you want to cooperate, we can work something out. But if you're going to continue to tell lies about what's going on, we can go down that road. >> No, no, this is true. This true. I I was lying to you, sir. I apologize. I didn't remember. It's true. I didn't came here yesterday. This these ones I I I came here uh and I picked them up, you know, a couple days ago. I don't remember the exact date that I I picked them up. >> And the other ones I picked them up from the streets. >> Okay. Well, if he's not willing to cooperate, we'll go down that road. That's fine. >> Okay. >> No, no, no. You're right. You're right. Yeah. You see, I'm sorry, sir. I'm lying to you. I'm sorry, but I've been drinking, you know. I kind of forget things. It wasn't here, you know. You're right. There's like a lot of places look like this place. So this one this one's I I didn't pick them up. You know, I came here a couple days ago. I don't remember the exact day that I came here, but I I didn't came here. You're right. I I came fishing, right? I came fishing. So I said, you know what? I'm going to leave them here. I'm going to leave them here. That That's the reason, sir. >> Where did he get the tires from? >> On the street, sir. There's plenty of tires in the streets, sir. Everywhere. >> That doesn't make any sense. What shop is he bringing them from? No, no street at all, sir. Like I'm saying, it's it's from the street, sir. No store at all. No store at all. I like I said, I'm picking them up from the street. >> No, my name is >> Westchester >> tractor. Okay. >> Hey, >> no. >> All right, I'm done with the interview. It's not going anywhere. I appreciate your help. All right, that one's mine. Is that one his? >> Yep. >> All right. Is it powered on? >> Yep. >> Perfect. We're going to seize it. >> Awesome. >> All right. Um, in the end, the suspect was charged with two felonies, one for littering for commercial purposes and another for attempted alligator poaching. He pled no contest and was adjudicated guilty on both charges. He was sentenced to 50 days in jail with credit for time served.
