An officer with Florida Fish and Wildlife responded to a call at Phil Foster Park in Riviera Beach after a concerned fisherman reported two subjects keeping multiple undersized and illegal fish. >> Don't throw the fish. Don't throw them. All right, you're going to get a misdemeanor now. It's fine. I'm not stupid. Go ahead. Throw him. You're going to get a misdemeanor anyway. Failure to allow inspection. Go ahead. Go ahead. >> What's up? You know throwing the fish don't work, right? >> You got a fishing license? >> No. >> Got an ID on you? >> Yeah. >> Let me get that. >> What'd you throw over? It's >> all right. All right. It doesn't really matter what you threw over cuz I'm going to I'm going to write you for it anyway, so it doesn't matter. You know what it was? >> You seem to throw something on. >> Yeah. I watched you reach in the bucket and throw something over the freaking bridge. >> All right. Who caught the fish? >> Huh? >> Did you catch the fish? >> No. >> Did he catch the fish? >> I thought it was somebody that was here first. >> Okay. >> So, that is that illegal though, huh? Is >> that illegal? That fish? >> This right here is illegal. >> Yeah. And then it's also legal to not allow inspection and start throwing fish off the bridge. Isn't that funny how people call in and tell you? >> So, let me explain something to you. You've been getting watched for the last hour, hour and a half or so. So, you can play this game, but >> watch. >> You see all these fish that you put in the McDonald's bag or you put in the McDonald's bag? >> Yeah. >> Okay. So, I'm going to make this real easy for you. Okay. Okay. >> You're going to provide me with the ID and you're going to tell me who caught the fish. You're going to provide me with your ID and you're going to you're going to tell me who caught the fish. If you don't do that, I'm going to take you to jail. Okay. So, it's it's one of the two. It's a misdemeanor in the state of Florida to keep fish that you're not supposed to be keeping. That means that it's an arrestable offense. That means I can take you to jail if I want to take you to jail. If you cooperate cooperate with me, I'll give you a citation and you and move on with your life. >> Okay. >> Here. >> That's my face, right? >> Yes. >> Okay. >> You have your ID? ID. Driver's license. Thank you. Do you have a fishing license? >> Do you have a fishing license? >> I do have a fishing license, but I think it's expired. >> It's expired. Okay. Do you have one at all? >> No. Okay. This is his face. So, give me your face. You mind your face though? >> Are you good? >> Not yet. No, this one's coming with me. Okay. >> Oh, that that's our name. >> Did you measure it? >> Okay. >> All right. All right. What about all these parrot fish? You know the regulation on parrot fish? No. >> Okay. So, you can't have them at all for food. It's a marine life species. You want to see something else funny, too? This this area right here, there's probably a sign somewhere somewhere around here, but this is actually a marine life sanctuary. So, what that means is it's actually an enhanced penalty to kill marine life in a marine life sanctuary. So, It's a marine life sanctuary, this area. >> Yeah. >> So, when you kill parrot fish like these, >> it's a no-go. It's It's extra It's It's an extra penalty. >> It's an enhanced area. >> So, what is it? What is that you could fish to? >> Can you 652 42 27s? >> Huh? >> I'm talking to my radio. >> Oh, you got you got to you got to think to me, right? >> Yeah. >> Zero supposed to be seven caps. almost 8 in. >> Hold on a second. Okay. Yeah. So, did you if you you need to measure, make sure it's 8 inches. >> Eight. Eight and a half. >> What is it? >> Eight and a half. >> Eight and a half. Okay. Then throw it in your bucket. >> These How much do these need to be? >> Yeah. >> They need to be alive. So, it's a marine life species. So, the only way you can keep these is if you're going to put them in an aquarium. You can't kill them for food. Can't kill them and put them in a McDonald's bag. Can't do that. Okay? So, you understand? You understand what I'm saying? Okay. All right. >> You guys hang out here. I'm gonna go back to my truck. I'm gonna type a citation. I'm gonna bring it back to you. Okay. >> So, you got like a fishing book that we could use. >> Yeah. >> Yeah. But if if you if you weren't sure if you could keep them, why would you keep them? You know what I'm saying? And then also, why would you hide them in a McDonald's bag and then think that nobody's going to know? >> I mean, we never know. >> Give up. Jim, stop talking. Just give up what you're giving us, >> okay? Sounds good. Hey, I'll be right back. >> You must get a list where we could. >> Okay. >> Come over here, man. >> Yep. >> It's your ID. It's >> your citations. I'll explain them in a second. And then here's your citations right here. Okay. So, first one is going to be for both of you. It's going to be for possession of the marine life species harvested for food. It's not only is it not allowed at all, it's definitely not allowed here at Phil Foster Park because it's a marine life sanctuary. Okay? So, you're both receiving a citation for that for the parrot fish that were in the McDonald's bag. Okay? So, that's for that. You're both going to receive a a ticket for not having a fishing license. Okay? And then you are also going to receive a charge for interference obstruction of an FWC officer for throwing that fish over when I walked up. Okay, understood? All right. So, the the fish violations are sec are written as second degree misdemeanor in the state of Florida. What that means is you both have a court date. On your citation, you will see a court date that's set 30 days out from today. It is a mandatory court date and you must appear. Okay? Otherwise, it's treated just like any other failure to appear and you can get a warrant if you don't show up. Okay? So that's for the fish case. The the fishing license ticket, you can pay it. You just have 30 days to pay it. Give it about 5 days to get into the system. Then you can pay it online, over the phone, or through the mail. If you choose to fight it, you can do that as well. Just you have to elect to do that by calling the same number. Okay. All right. So, first things first is Jamie or Jamon, I'm sorry. Just need you to sign right here. >> Not admission guilt. Just saying you receive the citation. So also, yeah, you got sign right here. Okay, there's that. And then here is take this >> citation >> in a and a court date as well. So this is for the fishing license ticket. Okay, so you're getting one for the fishing license ticket and then one for the fish. The fish is the one that has a court date. this one. You have 30 days to pay it online, over the phone, or through the mail with this information that's on here. >> What the charge is like for >> I'll I'll explain in a second. I just So, just need you to sign there. Like I said, not admission of guilt. Just saying you received the citation from me. So, it's right here. >> This is for the This is This is for the fishing license. This is for you, right, Damian? >> What's it cost? >> $55 >> for the fishing license. for the fishing license. For the for the citation. Okay. So, let me see your copy of the citations real quick. So, I wrote on there 30 days. You have 30 days to pay it. So, that's yours. And then for you, >> same thing. It's not admission of guilt. Just saying you received a citation from me. Okay. This is for the obstruction of an FWC officer. This is for the marine life species and this is for not having a fishing license. Okay, questions. You guys have questions? >> Uh the um what the charge be like for the um obstruction? >> So same way as as uh the fish case. So, it's it's written as a second degree misdemeanor along with the same thing as a fish case. So, basically, you're going to have to appear, explain to them why you did what you did and the and you know, depending on your priors and stuff, you know, usually it pays based on past experiences, you know, the the court the judge will look at your your prior history and then go off of there. Usually, it ends up being fines. I can't speak for the judge. Okay. Um, >> yeah. >> So, so you're saying this over here is is a marine >> it's a marine life sanctuary zone. Okay. this this whole area, Phil Foster Park as a whole, it's it's a >> You got a sign somewhere here. >> Yeah, there there are signs. There used to be one on this bridge filing, but however, that's besides the point, just simply because the fact is the marine life, even if it wasn't a marine life sanctuary zone. You you can't harvest them for food. You can't you can't kill them. If you're going to keep them, you you have to keep them as an aquarium fish, like you're going to put them in an aquarium. You need to keep them alive. So, you can't you can't harvest them for food at all. Okay. Um, if you want to download something that has the regulations just for the future, if you decide to start fishing again, if you want to download uh fish rules, okay, it's on the app store called fish rules and it's a little blue icon. You download that has any any of the fish that you can find the land or anything like that, anything you're not sure of, you could you can type it in and it'll tell you what the regulations are for it. Okay, that's the quickest, easiest way to do it and it syncs to your location. So, you you could put set it for here and you'll be good. Okay. All right. The biggest thing for me is the throwing the fish and the hiding the fish. Okay, those things are a no-go. If you were honest with me straight up and you're just like, "Yeah, you know, I had these fish." I might have wrote you a warning. Okay, I can't We can't be can't be doing that. All right. Any other questions? You guys understand what you got to do? >> Yeah, good. >> Okay. All right. Information's on the ticket. In the end, both suspects were charged with failing to keep tropical ornamental marine life species alive, and they were cited for fishing without a license. A Kion was charged with interfering or obstructing an FWC officer. Both individuals entered a pre-trial diversion program. They were each ordered to pay $350 in cost and fees for the criminal charges. The fees were later paid and the charges were dropped. As of the time of making this video, the court record show at Kion has not yet paid his $55 fine for fishing without a license.
