Yeah. This isn't the best uh location here. Tell me what we can do. Okay. So, I'm just going to uh check your eyes real quick. We got all these rear lights. Okay. So, I'll just have you stand with your feet together and arms at your sides. I just need to check your eyes, make sure you're good to drive. So, I'll just have you look at the silver top of the pin there. You'll hold your head still and just follow that with just your eyes. You understand that? Yes, I do. All right. So, don't turn your head or anything. Okay. Cuz I'm going to move it. Okay. Go ahead. Oh, so you got to keep following this here. Do you want me to follow it or you want me to look at you? I want you to follow just this. Just focus on the the top of the pin and just don't turn your head. Okay. So, don't turn your head. So, you'll just you'll just move your eyes. Okay. Got it. Make sense? Okay. Okay. So, just you got to stay focused on that the entire time. Understand? Understand? Okay. So, you you kind of anticipated went back to the center. Just consistently focus on it. Okay. Can you see it? Okay. In the in the lighting. Okay. Great. Yes, I can. So you you'll have to stay focused on it. Okay. I So because you came back to the middle. So if you could just try to stay focused on it, that'd be great. I think I see what you're trying I'm I'm trying to understand what you're trying to Yeah. So you'll just you'll just look at this the whole time. Don't look at anything else. You're doing good. I see it. Yeah. Yeah. You're doing good. Okay. Thank you. I'm a little nervous. Oh, you're fine. There's nothing to worry about. We're just We're just doing our job and we're being thorough here. Understood. Yeah. Okay. Almost done. Yeah. It's kind of You're You can blink if you need to. No, I'm I'm trying not to blink. I'm trying to be really good about this. No, you you can totally blink. That's fine. Uh Okay, we'll go up with this one. All right. So and that So we got a solid guy. I'm a good guy here. Okay, fair enough. Why don't we have you stand right right in this area on that tire track where it's nice and flat. Uhhuh. All right. And uh you'll face towards this way. Go ahead and take your right foot, put it in front of your left foot, touching heel to toe together like this. So you'll be like right foot in front of left or right in front of left. Yep. And they'll touch just in a line just like this. Okay. So you walk I just want you to just put your feet like this for now. Okay. And then just have your arms at your sides like loosely. So you'll just be just like I am right here. Okay. Yes sir. Okay. Um just stay in that position until I tell you to start the test. Do you understand? Yes sir. Okay. And you'll do it in one continuous motion. So once you start the test, don't stop at any point until you've completed the whole thing. I think I understand. Okay. So Okay. I'm going to demonstrate. It's going to look like this. One, two, three, out to nine. If that's your ninth step, leave your front foot on the line. Turn around it in a series of small steps. Come back. One, two. So, you want me to go three out and then turn back and do it again? Yeah. So, did you see that turn? You want me? Okay. Do you understand all the instructions? I think I did. Oh, you think you do? Okay. What do you have questions about? No, I'll I'll Okay. I'll just reiterate just to be sure. So, you'll look at your feet. You'll count every step out loud. You'll keep your arms at your sides. One, two, to nine. Yeah. Out to nine. Turn. Come back nine. You'll turn exactly like I showed you. I'll I'll do that. So, a series of small steps and then uh make sure you do it all in one continuous motion. Yes, I will. Okay. Do you understand all the instructions? I do. Okay. So, make sure that your foot's all the way in front like this. Go ahead and do that for me. Okay. Okay. Then arms loosely at your sides like this. Just just right. Yep. Go ahead and begin. 1 2 3 4 5 6 7 8 9. Turn around. Just how I instructed. Just do it how I instructed. You said nine. I'll just do it how I instructed. Yeah. Okay. One, two, three, four, five, six, seven. Okay. And then uh the other I told you said nine. I did. Yeah. Okay. The other one we're going to do is a time test. Uh one second here. I'm tell you like I'll do it. All right. Fair enough. So you'll have It is snowing and it is snowing. Yeah. Okay. Okay. So, you'll have What's that? I'm sorry. No, what were you saying? No, I said it is snowing and we were kind of driving kind of funny. Sorry. Okay, fair enough. So, you'll have your feet together, arms at your sides. Yes. Uh, stay like that till I tell you to start the test. You understand? Okay. So, when I tell you to start, you're going to pick a leg. I don't care which one. You're going to lift it up off the ground about 6 in, keeping the bottom of your foot parallel with the ground. Legs straight, arms at your sides. You'll look at your foot and count out loud in 10,00 1 10002 1003 until I tell you to stop. Keep my leg up. Yes. Okay. Do you understand those instructions? I do. Okay. Do you need it? Uh tell me tell me again. Okay. I guess I I guess. All right. So, you'll pick a foot. I don't care which foot you pick. You lift it up off the ground so it's parallel with the ground about 6 in up off the ground. Legs uh straight, arms at your foot, your your sides. Look at your foot. Count out loud. 1000 thousands 1001 10002 1003 and so on till I tell you to stop. Okay. Do you understand? Hold on. Do you understand all that? I think I do. Yeah. What do you not understand? I think I understand. Okay. Any questions? No. Okay. So So you think you understand what what would what can I help you with? Nothing. Nothing. Okay. So you understand the instructions. So again, you need to have your feet together to start and then arms at your sides the whole time. Okay. Do you understand? Yes. Okay. You want to step on that side? Yeah. Well, I don't want I'd rather get hit than him. All right. So, I'm sorry if we were driving a little funny. Okay. Um are So, you're ready? I am. Okay. Go ahead and begin. So, you want me to say 100,002? Yep. And while you're looking at your foot, 100,00 1,002 100,004 1005 1006 100 foot off the ground. 1008 1009 100 It's kind of hard to one two three four I mean what one two three four five six Okay, you you could stop. You could stop. It's a 30 second test. I mean did the best you could. Yeah. Yeah. Okay. U So, right now you're you're under arrest for DUI. Okay. I'm What do I do with my family? Uh, we'll figure that out. Relax. Relax. I'm completely relaxed. Okay. I'm just trying to make sure these don't get too tight on you. I'm not going to do anything. No. Yeah, you were just kind of tensing up and so I wasn't able to make the proper adjustments here. Uh, has anybody else in the car have a valid driver license that can uh drive that hasn't? Um, hopefully. Okay. What do you got in your pockets here? A bunch of stuff. Um, where are you guys staying? Uh, we have a condo up in Sun Valley. There's nothing in there. All right, fair enough. You okay? I'm about right. Okay. So, uh we'll have you have a seat in there. Let's watch those running boards. They kind of rip you up. Okay. All right. Give me one second. I'll be right back. Um yeah, he was like he blew both stop signs was in the oncoming lane. Like it was like just I got you. What do we got going on them? Cuz she's drunker. Yeah. She said she wasn't drinking and I was like, "Well, I'll check. You make sure." But I said, "He blows under. He gets to go right now. We'll wait and figure that out." Cuz you're going to do right here. Are you taking the back? Yeah, I got a lifeline. All right. So, how this works is I have a portable breath test instrument. Um, but I have to play you a recording of your right so you know what's going on. Um, I also have to make sure there's nothing in your mouth like chewing tobacco gum, nothing like that. Okay. So, I have to look in there just make sure you're good. You can open your mouth for me under your tongue. this. I need to see under your tongue. Okay. I appreciate it. Thank you, sir. Okay. Um, so I need you to not burp or vomit or anything like that uh for the next 15 minutes. Um, because if you do, it makes the reading higher on the test. And so we it'd be good for you to not do that. You know, you know, you want a lower reading. So Okay. Okay. So, uh, can you do that for me then? Just make sure you don't burp. I promise I won't. Okay. All right. And uh I'm going to play you this recording. Just listen and then we'll talk about it if you have questions. Okay. This is an audio recording that complies with the advisory requirements for the consequences. Where's my family and responsibility? Oh, just listen to recording and we'll talk. They're just in the car there 18-8002. You are required by law to take one or more evidentiary tests to determine the concentration of alcohol or the presence of drugs or other intoxicating substances in your body. You are subject to mandatory installation of a state approved ignition interlock system at your expense on all motor vehicles you operate for a period to end one year following the end of the suspension period. Your driver's license will be suspended for 90 days if this is your first failure of an evidentary testing in 5 years. Where do I where do I go from here? You will not be able to just keep listening. I have to have you listened license over. Okay. Do you want to hear that again or you understand it? I think I understand. Okay. Um All right. Yeah. Your family's just right here in the car in front of us. So they're all good. They're warm. Everything's good. We're we're normal people. We're not Yeah. Yeah. I didn't I didn't do anything crazy. I know. I know. All right. What do you do down in Salt Lake? I'm actually the mayor of our town. Are you? Okay, cool. Own a restaurant in the hotel and Oh, awesome. I'm I'm a pretty normal person. Yeah. Just came up here to hang out for the holiday. Come up every year. We've been coming here for 35 years. Oh, awesome. This may be my last trip, but yeah, we're leaving the state tomorrow. Yeah. Okay. Not my normal Yeah. night. Okay. Anywhere. So, what what happens with me? Um, so, uh, like I said, I have a portable breath testing instrument. We'll see what it says and then we go from there. I'm I'm assuming I'm probably over the limit. Okay. But if you're if you're under, uh, we let you go and if you're over, um, you have to go to jail. So, that's kind of where we're at. I go to jail. Yeah. So, that Yeah. So, so that that's only if you're over, though. So, I always like to give people the benefit of the doubt. So, we'll see what it says. Um, and then uh and if I go to jail, what happens? Uh, then you'll be able to bond out and figure it out. When does that happen? Uh, I it all depends on if a number of variables. It could be immediately. So, okay. Um, I mean, if you haven't gotten in trouble like this before, I'm pretty normal. I'm a pretty You gotten in trouble like this before, they'll ever I can guarantee you I've never been in trouble like Okay. Then then probably you'll be able to get right out and uh move on. So, Okay. [snorts] I'm actually on the board of our police in Salt Lake. Oh, are you? Yes, I am. So, yeah, you you're used to working with policemen and stuff like that. I I know how it works. Yeah. Okay. It's nice they'll do all this stuff here, not have to go somewhere else, you know, figure it all out. I'll take it as it comes. It's my own fault. I just I was just driving like a freaking like I always [snorts] drive. I mean, I'm I'm not an idiot. I'm not I never said that. I I know. I know. Okay. So, you So, you'll take a real deep breath, put your lips on there, and then blow out till it beeps. You'll kind of hear the air rushing through it if you're blowing hard enough. Um like going like air going through a tube, you know? Uh see, there we go. Okay. So, real deep breath. So, put your lips around it. Are you sucking in in? Okay. You can't. No, you have to blow out. So, really deep breath and blow out till it beeps. Yeah. Just like that. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Almost there. Almost there. Keep going. Okay. So, now we have to wait 2 minutes and then we do it again so that it's within a certain range and then we'll look at it. See what it says. I may or may not. I mean, we, you know, we had blind at dinner. We Yeah. Yeah. It's We're on vacation. You have a farm or something? No. No. We have We just have a restaurant and Oh, that's right. Yeah. I'm the mayor and I So, you have to plow around your restaurant and stuff. Yeah. Yeah. Awesome. Must be like a nice little town. It's a good little town. Yeah. Awesome. Probably in trouble right now, but we'll take it to Wisconsin. Okay. So, we'll do the same thing just like you did. So, real deep breath and blow out till it beeps. Yep. Just keep going till it beeps. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Okay. All right, let's we'll see if that uh it has to be in a certain range with each other. They have to match. So So here's here's what the test says there. You can't see it. Okay. Tell me what it says. Uh says uh 0.207. So almost three times the legal limit. You're kidding. No. No. So uh three times the legal limit. Uh not quite, but it's it's more than twice. So Okay. So I'm So you're going to jail? Yeah. So I'm going to jail. Uh yeah. So that's kind of part of the deal. So, I have to put this uh I have to put this uh seat belt on yet. Pretty much in right now. Now, now what can I get for you out of your car? Can I can I get a phone or a wallet? But you'll need to call them, right? So, um you tell me. Um I'm guessing I'm guessing you're going to want to call them right when you get down there to get you out. Oh, they'll we've just got to get them home and then what what what happens with me? Um, so you'll be able to bond out when we get down there. So, I'm going to jail, right? Yes. Yes, sir. So, all right. Hang on a second for me. No, it's not. He wants to talk to you. He wants to talk to you. Yeah, your husband wants to talk to you. Oh, you I wouldn't want to walk in the snow with those either. No, I'm I'm going to jail for DUI. They're going to take you back to the condo. You're not allowed to drive because I know you you've you've been drinking. So, so I'll be home when I get home. Okay. But let them take you home. Can I get his phone so he can call you when he gets there? Do you have your phone? I'm sorry. Do you have your phone? I don't have my phone, but don't worry. I'll Is it in the car? Can I Can I go see where his phone is? Yeah. And And I would uh I would probably just hang out in the car where it's warm. Don't go in the driver's seat. Let's go back to the passenger seat. No, he was driving. That's where I car I don't want you in the driver's seat. So, why don't you go? I'm just going to get his phone for him. Um we Okay, we'll take a look. Yes. But is that his phone right there? Is this one his? Is that his or is that yours? That's his. That's his. All right, I'm gonna let this officer have it then. Okay. And then he doesn't need his wallet, right? He's fine. I got his wallet. Okay. So, I just have his ID and his phone and that'll be fine. Um, I'll let you jump back in the passenger side. All right. Cuz I don't want you in the driver's seat if you have Okay. So, I'm Well, I kind of haven't, but I No, you're intoxicated. You You can't drive. So, I I need you to get passenger side. You blow the machine to prove that you haven't done that. We're not going to allow you to drive. No, I'm not. Okay. So, just get in the passenger side, please. No. So, I'll have you walk back around the car and then I'll talk with you all. Can I get in this way? They're not. They're so I don't have to go around. It's like really No, no, you need to go around there. Just go around. Go around and get in. Can I just get in this way? I'll walk with you around and I'll follow. All right. So, we'll walk around right now. Okay. Okay. Okay. I'm going to walk with you. Go ahead. Go that way. I I go ahead. I just have like the wrong shoes on. Okay. You hold down. inhale till somebody comes and gets me or I mean I'm just trying to figure out how it works. Uh yeah, till someone comes and get you. There's really not somebody to come and get me. My wife couldn't come and get me because she's been drinking obviously. So you may have to just sleep it off and then figure it out in the morning. So I'm there for the night. Uh unless someone can come get you. I'll I'll sort it out then. I was just going to say we'll see him tomorrow. Um yeah, you can come down and bond them out. Okay. Um I don't know how because you have don't have another car, right? No, I do have a car here. Oh, you do? Okay. Yeah. So, when you're when nobody's drinking, you can go down and bond him out. Yeah. Tomorrow morning. Yeah. Yeah. He'll just uh have to hang out down there. He won't go in the general population or nothing. They just put him in a a holding cell with a bed and he can sleep and they'll give him a blanket and some food. We'll see you tomorrow morning then. Thanks. Okay. Who was drinking the drinks in here? Can you ask them? Copy. I'll just talk with him. Mayor Knight might have believed he was above the law, but was nonetheless arrested and cited for excessive driving while under the influence. In Idaho, excessive DUI means blood alcohol concentration of.20 or higher, while a standard DUI is lower than that. He was also issued warnings for having obstructed windshield or windows, failure to stop at stop signs, improper unsafe lane change, driving on the wrong side of the highway, and driving too fast given the conditions. He blew a.207 blood alcohol content, [music] which is above the excessive DUI threshold. His bond amount was set at $3,000, which he paid to bail out of jail. In a hearing on March 13th, 2023, he was found guilty of standard DUI despite the fact that his blood alcohol content was above the excessive DUI threshold. His sentence included credit for 2 days of time served in county jail and 40 hours of community service. His license was suspended for a total of 120 days and he was ordered to have a mandatory ignition interlock device in any motor vehicle that he operates for a period of 1 year. He was also placed on 18 months of supervised probation. He racked up a total of nearly $1,300 in court fees and penalties, not including his likely very expensive attorney's fees. The three passengers were escorted to their vacation home by a police officer because none of them were sober enough to drive. The two open containers in the back seat were poured out and nobody was charged with this crime. The vehicle was towed that night. According to the town of Brighton, Utah's government website and April 2023 council meeting minutes, Mr. Knob is still the mayor and one of five elected council members.
