on July 11th 2022 a police officer observed a vehicle driving recklessly on the freeway the driver a woman was weaving between lanes without maintaining proper lane discipline this erratic driving behavior prompted the officer to pull her over I had one beer okay what's one beer to you one beer 12 O 24 o was a 12 oz are we talking IPA are we talking a dois dois and where' you have that beer at storming crab storming crab when the officer began investigating the woman's driving behavior they noticed a strong odor of alcohol emanating from the vehicle this smell suggested that the driver might be under the influence how's it going good how are you good what's going on tonight nothing not a whole lot hey I'm off please reason I'm stopping you is you're weaving in and out of your lane of traffic okay any reason for that no I think he was just talking to me I just got distracted you have your driver's license yeah it's the envelope no not it says Insurance on where you guys coming from tonight uh nowhere she just uh Dro me off home she Dro me off okay is the vehicle insured yeah it it's up to date and everything when the female stepped onto the road the officer inquired whether she had been drinking in response she denied it despite her claim the officer continued with the investigation likely conducting sobriety tests to determine her level of impairment is it is it your car yeah it's in your name it's in my mom's name your mom's name mhm okay I'm going to give these two back okay and then will you step out for me so I can speak with you back here yeah do you have any hang out right there right where that arrow is poed although she confirmed that she was medically fit the officer proceeded with the horizontal gaze nagas hgn test after conducting the hgn test the officer decided to administer a full standardized series of sobriety tests including the walk and turn test and the one leg stand test you so one beer right yes sir just one yes sir any shots no will you take the hair and brush it out of your eyes do you we contacts I do not any recent head trauma traumatic brain injuries no sir nothing at all I'm going to have you stand with your feet together toes touching Arms by your side I want you to focus on the tip of my finger okay sounds good for the sake of this test the tip of my finger is going to be where my fingerprint would be I'm going to be going back and forth I don't want you to move your head at all your middle finger right this one right here sounds good don't move your head at all okay okay do you understand what I want you to do yes sir okay so be honest with me how much have you had to drink tonight one beer sir one beer okay you see where my light is pointed yep I'm going to have you stand right there facing my car okay so step you'll plant that lead foot and with the foot behind it you'll do a series of small turns keeping this lead foot planted the entire time okay you'll continue down that line nine heel to toast UPS so nine and then nine back nine plant your lead foot with the foot behind it you'll do those small turns and then nine all the way back okay two three for the demonstration I did three you're going to do nine okay when I instruct you to start you'll focus on your feet counting each step out loud you keep your arms by your side and you won't stop this test until you're completely finished do you understand what I want you to do any questions no sir go ahead and begin one 2 3 4 5 6 7 8 9 arms turn one 2 4 5 7 8 9 perfect ma'am face me after failing the walk and turn test the police officer asked the female to perform the oneel leg stand test which requires balancing on one leg for a set period She also failed this test as she struggled to maintain her balance the inability to pass both tests provided strong evidence of impairment you can come back to right here where I had you the first time face me next test I'm going to ask you to pick your left or your right foot whichever foot you choose you'll raise it above the ground about 6 in off the ground okay your foot will be parallel with the ground okay you're going to keep your arms by your side you're going to focus on the tip of your toe counting in 1000s just like this 1,001 1,002 1,003 this leg will be straight that foot will be parallel with the ground you'll focus on the tip of your toe counting in 1000s okay you'll boots back on okay the officer took immediate action by arresting the female and placing her into custody ultimately the officer transported the female to the police station for further investigation this step involved more detailed questioning and processing including completing formal paperwork and potentially conducting additional tests just some tall boots I know they're so hard to put on to intoxicating alcohol and/ or drugs the New Mexico implied consent act requires you to submit to a breath test to determine the alcohol content of your blood after you take our test you have the right to choose an additional independent test if you choose to take this additional independent test you have the right to a reasonable opportunity to arrange for a physician a licensed nurse or laboratory technician or technologist who is employed by a hospital or physician of your own choice to perform an additional chemical test the cost of this additional test will be paid for by the law enforcement agency do you agree to take our test no thank you I cannot force you to take our test but if you refuse you will lose your New Mexico driver's license or non-resident operating privilege for one year if you are convicted in court of driving while under the influence you may also receive a greater sentence because you refuse to be tested do you understand that your right to speak to an attorney or
