Seven. >> They're doing it wrong. >> Six. Five. Four. Three. I believe this is the last warning, ma'am. >> They're doing it wrong. >> Two. >> They're doing it wrong. >> One. Okay, don't drop your cell phone. You don't want to hurt yourself. >> What's up, everybody? So, this woman, Nisbeth, can see her child once a week, 2 hours, supervised by DCF, at a location approved by the court. That's it. That's the deal. But, she's shown up unsupervised three times. She canceled a DCF appointment and told them, "I'm going to see my kids on Friday without you." She sat outside this house for an hour and a half on camera waiting for them to come home. And today, after being warned she was coming, she showed up again. The officer gave her a countdown, but she didn't leave. Now, I already know where this is going, so let's just get into it. >> You think he's here? No. I was reading that the kids yesterday are really again. No. Out here. >> They told us to do an injunction. >> I think this. It's a shelter. She said that it's a dependency shelter order. There we go. >> Mother supervised visitation >> Mhm. Has to be supervised. >> But, she doesn't want to be supervised. She said that DCF doesn't tell her. >> Well, that's not up to her. >> She wants her son to have >> supervised uh visits. But, she doesn't want them supervised. She wants to see them whenever she wants. >> Okay, so supervised supervised visitations at all times by DCF or adult third party approved by the department. >> Mhm. >> Yeah. >> Okay, has her getting a third party approved by the department not supervised. So, is it just DCF? >> It's only DCF. >> Okay, it's mandatory. But, she showed up at her department's office center, or place agreed upon by parties at a minimum of one time per week for 2 hours. Okay. Has there been any sort of visitation uh prior to today or is this the first time? >> I don't know. She just shows up here. >> This is the third time she shows up. >> Okay. And the other times has she had supervision with DCF or she just come? >> I I didn't want to call the police. I just told you, you know, that you shouldn't be supposed to be here. Can you please go? >> Last time was last Friday. She was here for an hour and a half. >> We believe that she was waiting for me in the school, which is not supposed to >> Her brother just called me. She called him. She was at school waiting for the kids. That's the what I don't like. >> She cannot do that. >> And then she saw you and then she was following you. Because that's the police right behind our house. >> I'm not following her. Yeah. I feel like she's stalking. She was stalking. She's >> I don't want to see the kids seeing the police cuz they're going to get all go haywire. >> But see, this is the third time that we have to have the police. >> The first time that I called the police. And they told me yesterday to see if I can go tomorrow to the court and file an injunction. >> Yeah. Okay. So, she's violating the court order. >> Yep. >> Yeah. >> And she she doesn't She doesn't want DCF doing the visits with them. She wants to see the kids without the visitation. That's a big, you know, problem here. >> What's the context behind behind this? Was there abuse involved? >> So, the grandfather is talking to the officers and what he's describing is not a mother desperately trying to see her children, he's describing a pattern. Yes. Now, this is not a mother who cannot wait to see her children through the proper channels. That's someone who has decided the rules don't apply to her and that decision made three times now is the whole story. >> She's mentally unstable. Um so, that's why they tried to get her in like a mental institution, but she's not She doesn't >> want to They don't They don't want to get her bail bail granted, right? Which is fine. So, I'm going to go try to explain this to her. I'm going to She Does she have her own copy of this? >> Yes. >> Okay. >> That was the first time that she showed up when they gave her the copy. Kind of arguing with me that, you know, "What's this? Why are you doing this to me?" I thought that she You cannot be here. Talk to the court. We just have the kids now. Just talk to the park, please. And then she showed up last Friday because she canceled the appointment on Wednesday because it was with DCF, and she told DCF, "No, I'm going to go see them on Friday without you." And she came in Thankfully, we were not here, but I can see her through the camera. She sat here for like an hour and a half waiting for us to come back. And today DCF called us yesterday. She just texted us that she's going to show up at the house tomorrow because she doesn't want DCF to have the visit. It has to be on her own terms. So, they told us, "Be ready. She must have said she's going to show up today." And she >> This visitation on her own terms stuff is not up to her. >> No. >> There's a court order with the certain restrictions on the families when and if she can see her children. She has to abide by that. If not, you guys have to I'm going to give you an event number. It's going to document why we were out here today. You guys need to Whenever your next visitation to to child court is, you need to provide them with this. If not, she's violating the court order. They'll judge the take that into consideration with the court case. As of today, um, we're going to We can trespass her and he's already filled out a trespass form. >> Okay. >> Uh, that'll be the first step towards having her stop coming here. If she comes back here, she's going to get arrested for trespassing. >> Just for the income. >> Just for the >> Just for the line. >> Because there's This This is pretty set in stone. This is a court order. She can only be here supervised with DCF or a person that DCF chooses to have supervision with. And she cannot come here by herself. And she's been doing that. document is today. All this is on the camera. >> Okay. >> So, this is going to be a documentation that this happened. We're going to explain that to her. We'll try our best to explain that to her. She's going to get trespassed. If she comes back here, she'll get arrested on site. >> And you may want to do the visits at some place other than here because she's associated >> They're not supposed to be here. It's just that this CAF usually comes here. >> I would be very scared if I were this dude. This woman is going to do something horrible. Like you can see it. Do you Like do you want to see how she's more interested in making the kids' father mad than actually following the law? Like she doesn't give a damn about her kids. It's ridiculous. I must say grandparents and dad must report her every single time. But they didn't do it the first two times, which is why this one occurred. Like never give people like her the benefit of the doubt. Like all she'll do is escalate. >> But she does want that. She wants to see them on her own terms. >> Just associate seeing the kids with some other location. >> All right. Let's see. Nesmith, what's your phone number? Okay. This is Nesmith. Have you gotten a copy of this document right here? That's your court order from the Department of Children and Families. >> Let me see. >> I'm not going to let you see it. Just have you gotten a copy of this? >> cuz I have three different copies. >> The question is have you gotten a copy of this court order? >> I'm not sure. Let me see which one. >> Okay. This court order says that this court order is dated February 6th, 2024. >> Do you have that court order I sent to you the other day? >> This is between you, your child's father, and this house right here regarding your children. >> Regarding what? >> This court order right here says supervised visitation shall be supervised at all times by the department. >> It doesn't matter what you think. This is what the court order is. >> is matter what I think. >> Okay. This is the court order. So, you have to abide by this court order. If you do not abide by this court order, it's going to make things more difficult for you to see your children. Do you understand that? >> Mhm. The the needs to go check in for my cousin's kids. >> Okay, whatever grievance you have needs to be taken up with the court, okay? >> No, I want to see my kids. >> Okay, supervised visitation shall occur at the department's office, a visitation center, or a place agreed upon by the parties one time per week for 2 hours, okay? >> want to see my kids. >> Okay, you can say you can say what you want, but this court order is standing. Meaning if you violate this court order there's consequences, okay? >> There's no consequences. >> Consequences is going to be making it difficult for you to see your children, okay? What you're doing right now is just making things a lot more difficult for you, okay? There is a court so you can still see your children, but it's at the direction of the Department of Children and Families when when and where they said that could happen at, not here, okay? You can't just come here, you can't just come where the order said you can't go, okay? Okay, this house right here I understand that. This house right here is not somewhere that you can be, okay? You can't just come here whenever you want without supervision. Okay. I understand that. I'm going to tell you Listen, listen, I'm going to tell you what's going to happen if you keep coming here. You're being trespassed from this property today. >> Honestly, the real tragedy is that every single time she does this, she just makes it harder to see those children through the legal process. Yeah, I must say she's actively destroying her own case and the cherry on the top, she just refused to sign the trespass warning. Wow. >> Like I said, it doesn't matter which day what's going on is what's happening, okay? You're being warned to not come back here today, okay? If you come back here today, you're going to get yourself arrested. Or any day from now on. Do you understand that? >> Sir, can you let her know that she's trespassing on the property? >> Okay, go ahead. >> How long has she trespassed? >> They got 290, you need to tell her how long it's been. >> Okay, let her know that >> You are permanently trespassed from this house. If you return here, you will be arrested on sight. Ma'am, I see you're going to get arrested. You're not supposed to be here. You can not trespass this You can not trespass ever ever again. You want to sign your warning or not? >> No, I'm not going to sign nothing. >> have a copy of your warning. You will still be able to This lady is good. You still be able to see your children, just not here. >> But no supervising. I don't need no supervising. >> Okay, that is not up to you. >> Yes, it is. >> That is up to the state. >> See, yes, it is. I don't need no supervising. >> Okay, you need to leave. >> I don't need no supervising. I want to see my kids, no. I want to see my kids. >> You need to leave. >> I want to see I want to see my kids, no. >> Okay, you've been permanently trespassed in this place. You need to leave immediately. >> I want to see my kids. >> If you do not leave, I will pull you out of the car and put you in handcuffs and take you to jail. You need to leave right now. >> I want to see my kids, no. I want to see my kids. >> You have 15 seconds to leave. If you do not, I will pull you out of the car and put you in handcuffs. >> They know what they did. >> 15 >> No, I want to see my kids. >> 14 >> I want to see my kids. >> 13 >> I want to see my kids. >> 12 11, you leave now. >> I want to see my kids, no. >> 9 8 >> They're doing it wrong. >> 7 >> They're doing it wrong. >> 6 5 4 3 You leave, this is the last warning, ma'am. >> They're doing it wrong. >> 2 >> They're doing it wrong. >> 1 >> She didn't want to see her kids. She wanted to prove that she's still in control and they proved her very wrong. Wait, like what did she just say? You cannot trespass on me. Like seriously, she doesn't even care at all about the law right now. And now why is she crying when the handcuffs go on? Like she was told exactly what was going to happen. At this point she just chose to go to jail by herself. >> Fine. Get out of the car, please. Out of the car. Get out of the car, ma'am. Stand up, please. >> They're all lying. They're all lying. >> Give me your cell phone. >> Hold on. I want TO SEE MY >> PUT YOUR hands behind your back, ma'am. >> Put your hands behind your back, please. Ma'am, hold your hands. Okay. >> Hold on. I want to see my kids. They're all [ __ ] lying. >> Okay, ma'am. Stop fighting me. >> No. No. No. >> Stop resisting. Okay, ma'am. >> They're all [ __ ] lying. >> Ma'am, your wrists are small. So watch out. >> They're all [ __ ] lying. They're all [ __ ] lying. >> Okay, don't drop your cell phone. You don't want to hurt yourself. >> They're lying. >> Get your hands out of your pockets. >> I NEED MY MY MY MY MY ARM. MY ARM. MY ARM. MY ARM. OKAY, my arm. My arm. I want to see my kids. They're all [ __ ] lying. They're all lying. >> Okay. >> They're all lying. I want to see my kids. My my arm. >> Okay, go in that way. >> I want to see my >> Go in that way. >> For what? >> Go in that way. >> Well, I ain't getting in your >> to leave. >> Give me my my my car. >> Yep. Get out of the car, please. >> Why? Why? Why? They're all lying. >> I'm going to search you real quick, ma'am. Do you have anything on you? >> I know. >> Do you have any drugs on you? >> No. >> any weapons? >> No. >> The officer's going to check you real quick, all right? >> I They're all lying. Everybody >> Yeah, go ahead. >> Oh god, how stupid is she acting? Her voice is triggering something in my brain that gives me unnecessary rage. Honestly, this woman is a danger to her children and society. And I hope the dad gets full custody with no contact with her children. Like she obviously lost her children for some reason and now she's playing stupid games and she's winning stupid prizes. >> What we're going to do is we're going to end up parking your car in the street. So when you're released from jail, you can get you can come uh pick it up, okay? >> They'll be lying. >> Okay, there was no need to have this happen. >> They all be lying, everybody. >> you need to talk to the court in order to have contact with your children. It sounds like you >> They'll be lying. And they know that. I Can you Can you put her Can you untie? >> Yeah, see she's got two fingers there >> No. >> and two fingers there. >> I can you Can you >> Okay, check your pockets for weapons. >> I'll write down Mommy. And my teddy bear. I >> Back of my hands. The back of my hands. >> down my teddy bear. >> So I'm just going to stop right there. I understand that but you got to follow the officer's orders. >> no because everybody have been lying. >> Okay. >> And they don't want to accept it. >> Every time you come back here, this is going to continue to happen if you want to not follow directions. >> No, everybody have been lying. I >> You're just making things a lot harder for yourself, ma'am. >> No, I'm just defending. >> Okay, okay. Step into the car, please. >> I'm hurting my arm. >> I'll go leave it I'll park it out there on private property, sir. Okay, she was arrested for refusing to our orders to leave. So she's going to Pinal County Jail right now. She's only trespassed from the actual physical property, so she's allowed to be in the street. So she can come back when she's released from jail and pick up her car. And we're just going to make it really clear to her that when she comes back that she can't come on the property. If she does come on the property, go ahead and take a photograph or a video of it, so that >> Yeah, I got her photograph already. >> Yeah, so then we have the officer can have proof if if if it becomes a problem. Does that make sense? And she'll just get arrested again. Uh and then um you know, it does vary the number of times that people need to be arrested to follow this law, but eventually everybody does. Does that make sense? Sometimes some people are hardheaded and it takes a couple of arrests. Some people it's one arrest, right? Uh I don't know her history or how many arrests she has or whatever. So, usually the more arrests they have in their history, the more it takes. Usually the fewer arrests they have, uh one usually does the trick, right? So, okay guys, you guys have a good night, okay? >> Thank you. So, how long will she be arrested? >> Well, it's uh considered the lowest crime level, so she'll be able to bond out right away. So, she'll be back tonight. If they don't come Hopefully she'll come pick it up or smarter would be for her to have a family member come pick it up, right? Or a friend. Does that make sense? Anyway, she's going with the keys. The car's legally parked. Um she has all her stuff. She has the ability to come get it or have a friend or family member pick it up, okay? Thanks guys, have a good night. Thank you. See you. >> I don't need no trespassing order. I need to see my kids. I'm I'm not the problem. They are the problem. >> Nesbitt was charged with trespassing and resisting an officer without violence. She pleaded no contest, was adjudicated guilty, and sentenced to 73 days with credit for time served. Also, ordered to pay $1,288 and $0.76 in fines. The fines went unpaid. The balance is still due. And when she was released from jail, she went back to the property and was arrested again. And now the car that the officer carefully parked legally on the street so she could pick it up. That was the excuse. That was the reason to come back to a property where she was permanently trespassed from where children she cannot see unsupervised live. She clearly does not care at all about her kids. She cares about control. And they proved her very wrong. The court did not take those children away for no reason, right? The supervision requirement did not appear out of nowhere. DCF does not get involved in families because everything's fine. I really hope those kids are okay. Like that's only thing that matters right now. Drop a comment below at what point during this countdown did you know that she was not going to leave? Because I knew at 14. The second she said that I want to see my kids during the countdown. I knew it, right? Tell me when you got to know.
