at approximately 10 43 pm on the night of February 11 2023 Palm Bay Florida city council member Peter Filiberto was observed riding his motorcycle above the posted speed limit running multiple stop signs and fleeing from a police officer officer Morris pursued the councilman with a squad car he attempted to make a U-turn to flee the scene however laid his bike down in the process it was at this point that officer Morris knew the councilman was endangered to Civil Society okay yeah I got my altitude what the hell you doing man enjoying your night trying to take off on me man you or not no sir [Music] [Applause] [Music] [Applause] same right there [Applause] you have anything on you that's gonna poke or stick me um why are you running man you're not running when I let you up over there okay but then but then you just try to turn around and you fell off your motorcycle and that's why I was trying to play kickstand Fox rod 416. 674 while you're running but foreign foreign [Music] basically I'm turning around on a pickup truck I seen him coming out of crystal um so the pickup truck's coming off of the pirate outside go to turn around to be on the pickup so the pickup turns into whatever that first street is here okay well here he is hiding in the woods I'm like what the heck it comes out of the woods so I'm like okay now that's weird weird right so he gets back on the lips when it shoots southbound and lifts them and then turns out to Airsoft so that's when I finally caught up to him started on the tag light them up as we're taking a turn off to here so he gasses it hey chief just great super busy sirens he gashes it so and then all of a sudden like kind of looks back lets off of it starts with her off to the right um okay so that's why I was calling out you know whatever my sirens on that I jump out and as I'm trying to jump out he's trying to turn around but yeah so I'm dumping the motorcycle over and then so I get my Taser Point get off the bike my gravel pull them out like kind of do a transport no no like use of force or anything like that but I mean I come on second one wait with him up here at earthsound right yeah and that's when you rubbed off when you started the Rev off so I hit my sirens to alert him but he's I mean he was driving so I don't know if you knew I was behind him or not everybody he was I mean he's weaving in and out so I'm like okay this guy is like something's up with him I I couldn't even affect the traffic stop on him until I got to Big Cypress correct and I let him out like right right before the intersection like in between six hours I just picked it up I just picked it up and but he was basically trying to do he tried to turn around and dump the bike as I was getting out so I just picked it up because it was laying down that motorcycle's register you sir yes sir okay the uh the tax problem so you know no it's about before that I drove a hole in there uh wash the bike overhaul it was dangling gotcha okay [Applause] the last is the [ __ ] side of the city is falling apart okay Insurance unbelievable foreign [Applause] foreign PTA or full ride stop that so she's got an investigation to she she's going to speak to you because we got an odor of alcohol um so she's mirandizing you so that she can ask you questions about what happened to me that's that's why that's fine okay so I already have probable cause for for reckless driving yeah okay um but the odor of alcoholic beverage is a concern to me so we're going to conduct to make sure that you're not compared Beyond just so these are if you are then we have to do is that a yes or no no no oh the response sorry no said no no further conversation he doesn't have to answer any questions still have the right to ask please yeah yeah yep would you like to perform fields or any exercises no thank you okay do you understand not not doing food sobriety exercises we still have to take the Battalion circumstances and still be charging without the internet you don't have to do the exercises you can't force somebody to do them but we do have to say they can use against the important not doing it you don't want also yeah all right so we're gonna for the first proposal for 18 months if your driving privilege has been previously suspended or if you've been previously fined under Florida State Statute from 27.35215 urine or blood additionally penalties compose my mom refusal to submit to the test on the question you would miss everyone to the evidence essentially have you heard used to say for a breakfast there okay so if this is your second refusal em your driver's license is September 13th or 18 months and you get another listing their charge thank you so with that in mind you still refuse foreign [Music] [Music] [Music] around make a U-turn yeah when he did so he just fell over so the bike just fell over he just fell over and then he got up let me I have some property equipment you want to do a money count real quick 20 40 45 46 47 47 yeah is that a DUI citation or a separate sighting okay so I'm just gonna do reckless um since you did he he was gonna he was trying to turn around and flea on me yeah like when we stopped here yeah he was trying to turn around and he dumped the motorcycle he's gonna do it no thank you um so reckless driving DUI refusal to submit and then all right we'll see if that indoors yeah councilman Filiberto who was elected to office in March of 2022 had himself a night to remember or forget if he wasn't too blacked out he racked up six charges in total including cocaine possession reckless driving driving while Under the Influence no motorcycle endorsement refusal to submit to a blood or breath test with a prior refusal to submit to a blood or breath test the first one being in 2008. and driving with a suspended license with knowledge in a plea offer he was sentenced to two years of supervised probation due to his DUI charge and felony possession of over 10 grams of cocaine found all over his body including his shoes and socks he was also ordered to pay over fifteen hundred dollars in court costs and fees his driver's license has been revoked for a period of six months and he was ordered to perform 50 hours of community service he resigned from his Council seat following his arrest on February 17 2023 thank you for watching cop cam Nation be sure to like And
