You even ring the doorbell. Mhm. Pretending like you're going to go walk right inside. >> Mhm. And then what do you do? You start resisting. You're not giving me your hands. >> I ain't resisting, sir. I I said I'm going to my house. I ain't resisting. Okay. Okay. What is this? That's my cooler. I'll be with you in a second. Yes. No, it's his. I guess. Okay. I'm going to read you your rights, okay? You have the right to remain silent. Anything you say can and will be used against you in the court of law. You have the right to talk to a lawyer and have him or her present with you while you're being questioned. If you cannot afford to hire a lawyer, one will be appointed to represent you before any questioning if you wish. You can decide at anytime to exercise these rights and not answer any questions or make any statements. Do you understand each of these rights I've explained to you? Having these rights in mind, do you wish to talk to me? No. Okay. You don't want to talk to me? No. Can I ask you No. what the heck just happened now? Why you were walking away from me after I told you to stop? >> to my son's house. You're going to your son's house? >> Yeah. Okay. How come you kept walking when I told you to stop? I know. Cuz I was going to my house. Okay. I'm going to be honest with you. Mhm. I smell alcohol. Your eyes are really watery, glossy. Nah. You're speeding through this neighborhood. I saw it myself. I was I wasn't able to properly pace you, but I saw you were hauling through this neighborhood. Blasting loud music. How much have you had to drink tonight? I could say. What does that mean? I'm giving you a chance to be honest with me, man. You come out of the car. You reek of alcohol. You're swaying as I'm talking to you. Okay. So, do you want to be honest with me and tell me how much you've had to drink tonight? I was just going to my house after that. Okay, where are you coming from? Mhm. Going to my house. But, from where? From where? Yeah. Where were you at? >> To the store. The store? Coming to my house. What store? What store were you at? In Stuart? Yeah, of course. Okay. Mhm. I want glasses. [ __ ] I don't know. >> [snorts] >> Okay. All right. I'm going to give you another chance here. Okay? Mhm. I have reason to believe that were driving while impaired. Okay. >> [snorts] >> You smell like alcohol. Every time I talk to you, I still smell it. You have watery, glassy eyes. You're wobbling as I was talking to you. Okay. Where were you coming from? Be honest with me. Were you coming from a friend's house? Store? Or it's like You said a store. What store? There's many stores in Stuart. So many stores in the state of Florida. Of course. Okay. Are you willing to do field sobriety tests? I need a yes or no on this. Are you willing to do field sobriety tests? Cuz right now I have the reason to believe you're under the impair- are you under the influence of alcohol while driving? Will you do field sobriety tests? Yes or no? I'm going to take your silence as a no if you remain silent. Refusal to do the field sobriety tests, I'll have to base my investigation off of what I have right now. Do you understand that? And just as I told you, I smell alcohol on you. You have watery, glassy eyes, slurred speech when I'm talking to you. You'll be charged with DUI if you refuse to do field sobriety tests. I didn't say so. I mean Is it yes or no? Are you going to do them or not? You're not going to do them? Okay. All right, I'm now requesting that you submit to a lawful test of your breath for the purpose of determining its alcohol content. Will Will the test? No. Okay. Okay, so I'm going to take you to the Martin County Jail, all right? I'm charging you with resisting without violence. I'm charging you with DUI and DUI refusal, okay? DUI? Why? Why? Because you're not doing field sobriety tests, and I'm basing my investigation off of what I had. Exactly what I just explained to you. Do you have any questions? Any questions, comments? Okay. Mr. Fernando. Yes, sir. I'm going to ask you again Mhm. if you've thought about it a little, decided you want to change your mind. We're at the jail right now. Again, I have reason to believe you're under the influence of alcohol based off of what I observed when I spoke to you, when I initially got out of your GMC. I told you I smelled alcohol. I told you your your eyes were watery, glossy. Immediately picked up on these things. I immediately picked up on these things. Again, I have reason to believe you're under the you're under the influence of alcohol while driving. Will you do field sobriety tests? If you refuse to do field sobriety tests, I have to base my investigation off of what I have right now. If you do the field sobriety tests and everything looks good, I can dispel this, okay? Who would you say >> But if you refuse to do the field sobriety tests, I'm going to have to base my investigation off of what I have, which is you have watery, glossy eyes, smell of alcohol every time you talk. You were swaying as I was speaking to you right next to your car. Do what you got to do. I need a yes or no. Do what you got to do. I need a yes or no. No. You're not going to do field sobriety tests? Okay, so I'm charging you with DUI now. Okay. And I have to read you this. I'm now requesting that you submit to a lawful test of your breath for the purpose of determining its alcohol content. Will you take the test? I need a yes or no. Do you want me to read you what happens when you refuse to take the breath test? So, refusal to take the test I requested of you, your driving privilege will be suspended for a period of 1 year for your first refusal. Additionally, if you refuse to take the test I requested of you, you'll be committing a misdemeanor of the second degree if this is your first refusal in addition to any other penalties which can be imposed by law. If you refuse to take the test I requested of you and if your driving privilege has previously been suspended or if you've been previously been fined for refusal to submit to a lawful test of your breath, your driving privilege will be suspended for a period of 18 months. Additionally, you'll be committing a misdemeanor of the first degree in addition to any other penalties which can be imposed by law. Refusal to submit to the test I requested is admissible in the evidence in any criminal proceeding. Do you still refuse to submit to the test? Yes. So, you still refuse? Do you need me to to explain it a little bit more? No. You understand that refusing to submit to a lawful test of your breath means not only will your license be suspended for a year, you'll also be charged with second degree misdemeanor refusal to refusal to uh to [snorts] blow. So, if this is your first refusal, I'm going to check if you've been charged with DUI before in the past and you've refused, that'll be a first degree misdemeanor on top of DUI, on top of resisting without. I didn't I didn't resist. You pulled me down. That's Yes, that was because you were resisting and I told you to give me your hands and you didn't give me your hands. You locked your hands in front of your in front of your body like this and you said we ended up like this. You didn't give me your arms so I had to take you to the ground. Was my camera on or was it off? Yes, body cam was rolling the entire time. And you were also walking away from me as you acknowledged. I didn't say anything. You know. So you refuse to submit to the to the breath test? Okay, so your license will be suspended. I'm taking your license. Um you cannot drive for the next year. If you're caught driving, you'll end up right back here. Okay? All right. Okay. And then like I said, you're also being charged with resisting without violence, DUI, DUI refusal. So three charges you're being charged with. Okay? I want to see that camera. What's up? I want to see that camera. You can see it once you get out of jail. And it'll show you walking away from me after I told you multiple times to stop and you also locking your arms when I told you to give me your hands and you didn't. My initial reaction to you when you got out of the car was that you're under the influence of alcohol because of how strong the odor of alcohol was when you got out of that car. As I'm speaking to you now, I still smell it. Do you have any questions about anything I read you read you I told you? No. No questions? Okay. You refuse to do field sobriety tests? You refuse to do the breath test? Of course, yeah. All right. Do you have any questions about refuse the the refusing the um the misdemeanor charge, the Do you have any questions about that? About refusing to the breath test, what I read you? You're good? You understand everything? Of course. Okay. He was charged with DUI, refusing to submit to testing, and resisting an officer without violence. Court records show the case was formally filed a few days later. He did not remain in jail long and was released on bond. The case is still open with misdemeanor charges pending, [music] and court proceedings are ongoing, including scheduled hearings as the case moves forward. Behind the lens, [music] the sirens call. Through every frame, we stand tall. Shadows fade where truth ignites. We are the voice that breaks the night. Behind [music] these eyes, the stories [singing] live. Echoes of courage
