for texting and driving both hands on the phone doing this no seat belt and looking down at the same time it's it's dangerous driving it's distracted driving distracted driving leads to accidents so we're going to check out his license um he's definitely going to be getting a ticket today uh distracted driving hurts people and we're trying to reduce people getting hurt by enforcing these types of laws so in some states outside of Florida like for example Ohio seat belts there's a something called the secondary offense where if you're just driving in Ohio with no seat belt you can't get pulled over for just the seat belt violation alone it's a secondary offense meaning that you have to be doing something else in order to get pulled over and cited for the seat belt however in Florida the secondary offense for seat belt there's no such thing so just not wearing your seat belt or just texting and driving in Florida it's a primary fence meaning that you can just get pulled over for that reason all right insurance is good you got to carry the registration on you it's actually state law you could get cited for that as far as everything goes I'm giving you two citations one's for the texting and driving violation the other one's for the seat belt okay you have uh the options are on the pink paper um you just got to choose an option within 30 days or photo will suspend your driving privilege all right please be safe so for this episode uh I just wanted to get back into an unmarked while my Dodge is still being worked on um and my Ford Explorer the Mark car that I'm usually in that's also being serviced right now we're just using this more so to see if we can catch aggressive drivers because with the marked carts it's a lot harder to do that so we're just going to drive around this episode see if we can find uh any careless aggressive drivers or reckless drivers we'll go from there um just so that you guys are aware every six months a company comes with a dyo machine that's on a trailer and they calibrate our cars using the dyno and they calibrate it making it so that we can run moving radar and that we could also pace cars pacing cars means that you're driving the same speed as the person in front of you and you're measuring the speed off of the speedometer on your car and it's calibrated because of the dyo machine and all the paperwork that comes with it moving radar you're supposed to have that calibration paperwork because you're going off of your radar system that's integrated with the vehicle's calibration as well so when you submit your radar log your radar paperwork you want to submit the speedometer calibration as well because all that paperwork if they want to go to court it'll show that everything's how it should be and the case won't get dismissed because all the proper paperwork is with with the uh speeding ticket this car right now is not calibrated so I can't do moving radar and I can't do uh I can't Pace clock other vehicles Pace clocking is the term that we use for pacing a vehicle and measuring the speed off of our speedometer now because the car is not calibrated that doesn't mean I can't run stationary radar which means that I'm going 0 miles an hour I'm parked uh I could do it in my car or I can get out of my car and I could run radar outside of my vehicle and and uh still do traffic enforcement that way with speed up to the car I see two little people in the rear 9-year-old 5-year-old there's a car seat cover for the leather seats in the back like for his dog so there was no way for them to wear their seat belts that's why they weren't belted in now for the 5-year-old you need to have a car seat that's front-facing or you can have a booster seat but until she's 6 years old she has to be properly secured in a booster or car seat because you're still too tiny at that age and the law says that 5-year-olds need to be properly seated in a booster or car seat the nine-year-old's good to use the seat Bel in the rear um so that's why I told him to call the wife have the wife come with a car seat because he really shouldn't be driving without the car seat and he really shouldn't be driving the way he was with two kids in the car it's not fair to them because if something happens to his kids it could have all been avoided if he was just driving safer so it's not fair to them if something goes wrong she so that means if you were driving the vehicle Florida is ordering me to seize your license plate and tow your vehicle and it looks like it's possibly because there's no car insurance on this vehicle yeah so um you're going to have to contact the State and see exactly why your licensed is suspended it just says it's a non-judgment suspension which means that uh it could be a variety of things most of the time it has to do with insurance the other things it could be uh you not paying your tolls on the interstate it could be um you not paying child support if you currently pay child support if you have unpaid parking tickets they could do that too it could be a variety of admin related things you're going to have to call the state and see essentially I can see the cover of the book but I'm not allowed to open up the the book and read it and tell you what's wrong only the state can I only have limited access yeah so just uh are you currently paying your insurance right now yeah cuz when I run your tag to it shows that there's no insurance on file which it doesn't mean 100% there's not an insurance policy with a car but most of the time it'll at least show me if there's a policy when I run your tag it shows no policy right now so that's why I'm asking this yeah all right is there any way you can show your daughter proof of insurance or no don't I don't all right well I wouldn't recommend driving this car until you confirm that there's insurance on it for obvious reasons um this guy's trying get out of here do you want to just uh push up a little bit so we can leave the spot open for cars leaving and entering yeah and then I'll talk to you once can we can um have a to or something you're not going to to it no because if anything there's a parking spot right here you could just pull off and and then you can park and then get insurance if you don't have insurance all right all right yeah just pull up like right here if you want to park like half on the sideway I'm sorry half on the sidewalk and half in the bike lane just so you're off the road that's fine okay after looking at the driver's license for the driver it's valid everything's fine with it there's no suspensions she's not wanted however the registered owner the vehicle her license is no good now she's the registered owner is not here she's not in the car but there's a seiz tag order for this vehicle meaning that like I said to her the State of Florida wants that license plate back usually 90% of the time it has to do with insurance car insurance you're not paying your insurance insurance lapsed things like that there's problems with the insurance so the way the insurance company and the state combats uninsured drivers is by putting a c tag order out me taking the order I'm sorry me taking the license plate seizing it and then the car gets towed and then it would be required to get a new license plate for the entire vehicle because the registered owner is not the driver I can't take the license plate instead I could issue a citation for no proof of insurance and um theoretically if drove off technically I could tow her vehicle I'm trying to work with her however uninsured motorist in Florida it's a huge problem right now so for me it's a zero tolerance thing you're getting a no proof of insurance citation now if she purchases the insurance or fixes whatever problem is going on with the insurance she can show the clerk of courts that the insurance is now taken care of and that insurance ticket that she's going to be getting will be dismissed instead of paying the $116 insurance citation it will be just a $10 Court fee and that's it if it doesn't get taken care of it'll stay at $116 and she'll have that plus the school bus violation which is a moving violation which is $166 plus points so if you're curious passing a school bus on the left side opposite of where people get on and off the bus that's a moving violation so it's just the $166 plus the points now if somebody passes the the school bus on the right side where the kids enter and get off the bus it's a mandatory court appearance similar to the 30 mil over the speed limit so it's not criminal it's just mandatory meaning that you have to go in front of a judge and the judge is going to set the points the fine they're going to ask you why you did what you did and depending on the circumstances if you're passing a school bus on the right side where people get on and off it most likely could be reckless driving which now is an arrestable offence so it'll depends on the situation uh the totality of the circumstances that's what the officer Witnesses if they're flying by the school bus at excessive speeds and they almost hit somebody now you got reckless driving all day but if it was like one of those things where the person passes the school bus at like 2 miles an hour on the right side it's a mandatory court appearance and they're going to ask why you decided to pass a school bus where kids were getting on or off a bus so like I said I couldn't find your insurance um so here's what I'm doing I'm issuing two Sid ations one's for passing the school bus on the left the other one's for the no proof of insurance now if you find proof of insurance and you have the card that ticket will be dismissed as long as you show the clerk of courts that and then it's just a $10 Court fee that's all you got to pay um the speed I'm sorry the school bus violation that's a moving violation so it's 166 plus points so your options are on that pink mailer but essentially it's paying it driving school which is online or traffic court But whichever say that I can't hear you how does the points work I've never had points before uh so if you're paying it you're accepting points on your license just that's it driving school you do the online course you have 90 days to complete a 4 to eight hour online course and then 104 you get a certificate of completion you show that to the cler of Courts and then there's no points involved with the with the violation you just have to pay it you pay accept points go to school avoid the avoid the points or if you want you can always go to court and then it's up to the judge but you know I mean I don't think most is online the driver school is online yes it's all online yeah and that would take off correct if you finish the course within 90 days yeah and then you just show the uh Clerk of Courts the completion like the certification and that's how you avoid the points points you want to avoid points because the more points you have it makes your insurance go up if you have a lot of points the state can suspend your license so that's why it's kind of like a big deal and I'm trying to go into criminal justice skill so I don't need no points see what I'm saying yeah you don't so all right um do you have any questions or no and obviously I wouldn't drive this car until you confirm that it's properly insured because you risk getting the vehicle towed and it goes into an impound lot basically and then for your mom tell her to get her license renewed or uh fixed because right now it's suspended the C tag if she were driving right now that tag would be take that tag would be taken off the car and that custom tag it would go away forever like nobody would she would never get that tag back no nobody else would get that tag they'd destroy it and she'd have to get a brand new tag so her custom tag would be forever gone so just tell her to make sure that she gets everything fixed all right it probably has something to do with the insurance
