on December 8th 2024 at approximately 11:18 p.m. deputies responded to a residence regarding a domestic dispute here's what unfolded no I have no idea who you are my name is Deputy Murphy I'm with the flag of County Sheriff's Office okay fine stay back there don't don't come any closer I got a card in there to show you what do you have to show me FL Sheriff card okay what is that what is that what's that what does the Flagler Sheriff's card have to do with it you wait for the Flagler company there you I do okay fine just wanted to know so what what went on tonight nothing did you get into an argument with who with your wife or could have been my wife it could have been could have been yeah okay so when you say it could have been you want to make contact with her when you say it could have been what happened nothing we just had a disagreement that's all what were you guys you want to talk to her what were you guys disagreement about he's going to speak with her what were you guys disagree about personal matters and you will not know my personal matters I'm not asking you okay fine so it's personal matters okay you call my lawyer he'll tell you so you guys got into a disagreement on a personal matter on a personal matter call my lawyer and he'll tell you I don't need to know your personal matter okay fine what happened my lawyer's name no I don't care about your lawyer what what happened during your uh disagreement what about was it just verbal was it physical was it verbal did you touch her it was verbal okay I pushed her you pushed her yeah I pushed her out of the way okay cuz she was standing in front of me so it wasn't just trying to slap me so it wasn't just she was trying to slap me I pushed her out of the way would you do that okay would you do that second no so you hit you in the side of the ear the right side and the side do you have any bruising here or anything no does it sore do you need any medical assistant no I'm good okay so you hit you how many times about four and then I ducked okay and that was it and yeah but he kept swinging you know even after I talked he was like want more and I was what did you do after that came here so you left here and went to next door and did he leave and just get back cuz he was coming or no he was getting ready to leave or get the soda out the car one the two yeah I think he was getting ready I to stop on okay all right all right so I we're going to have some paperwork for you to fill out right now um yeah but you'll be able to go back inside so you don't get cold um are you going to wait for the paper to be filled out yeah we we'll wait for you it's no rush so we just need you to fill out the paperwork um it's a we need you to do a statement it's voluntary you don't have to yeah um write a statement out for us if not you you don't have to again it's voluntary we have your statement on video but we have some other paperwork that we need to give you all right okay um you just if you in my life never okay no I'm 80 years old and never been arrested well today is the first day you can't hit people I didn't hit her I shoved her that's that's that's hitting that's that's battery that's unwanted touching okay well tell my attorney well you can tell your attorney not me I'm just I will you just you deal with that part and yeah no problem it's her her word against mine she has nowhere to go I will inform you that you you'll see a judge in the morning no problem um I it's up to the judge what they do with release usually you'll be released probably but you will not be allowed to go back to that house okay you'll have to go there'll be like a no contact order for her until you and the courts figure out and when do I go to court do you have any idea you will see a judge in the morning in the morning okay thank you by Florida law you have to see one within 24 hours but you'll see one in the morning okay more than likely you know you'll be released on your own um with stipulations which means you probably won't be a lot back you will be able to contact her to you guys work things out um that's between you and your lawyer and the courts in her and all that stuff okay no I have no problem uh doing that I have a friend of mine then on the street he' be cleared to put me up well you'll have to be so far away from her so no it's a it's a mile away okay you should be okay there just let the judge know that well they're going to want to know anyways what what caused you guys to get in such an argument today I mean you I don't want to know your personal no that's all right was it over TV was it over TV not it was uh yeah believe it or not it was over Spectrum okay right one TV in the living room works fine but the other one doesn't and the bedroom so I called spectrum and I told him i' like to have a representative sent out tomorrow so we can check this out and find out if it's the TV or if it's a spectrum system MH so he says all right yeah we'll work on that we'll take care of that tomorrow and uh that was and then I don't know what happened after that but we got a a pushing match and uh something about a phone call or something that I was supposed to make and I called them oh I called my daughter that's what it was she said your daughter call call her back I said I will so then I started doing something else she saids I'll call her back I says I will when when I get finished done here she wouldn't let me get done she got the phone and told me to call Natalie so I don't know one thing led to another and then before you know it we're yelling at each other and then uh shoving each other around she showed me too you'll be able to tell that all you to tell your story thank you yeah it's a shame we've been together for 30 years never had a problem before you have been arrested before hm you've been arrested before oh yeah when here's your mug shot right here oh yeah how long ago um you were arrested 8:30 20 2020 2020 that looks like what the hell was that for the last time you were [Music] arrested it's not let me click on driver under an influence probably no domestic violence what was that dri under Charlie 221 and Charlie 222 adult charging affidavit violation of contact original charge so you had domestic violence and then you must have contacted her again and you got you got a violation of no contact which will happen again if you do it and you arrested here for commit domestic battery by strangulation strangulation yeah you gotta be kidding was in 2020 so that was the same charge you got arrest it twice because you got arrested for DV and then you got arrested for violating the the the the injunction and that so you've been arrested twice once for domestic violence arrested now I don't know if you were charged with it youed I understand it could have been pled down to something different but you were arrested for violating a no contact order so this time when you get out don't contact her because you'll get arrested again okay so thank you tell you can't contact her you can't have any of your kids or friends contact her for you just nothing nothing right just fine with me you're going to go to jail I'm just no no I appreciate that you I appreciate you telling me that you don't the judge is going to say it again is going to tell you too but now does she have to stay there or can she leave she can go wherever she wants to go she's not going to have any no I can't go back I got to stay away from her right you've got to stay away from her so okay in other words all my clothes and everything somebody else has to pick up no you'll be able to the judge will tell you you'll be able to one time be able to call us okay to go there it's called a civil standby right have like 15 20 minutes to go into the house and get what you need out oh good but you have to call us right to meet you there you don't go there unless we're there you'll meet us down the road we'll go there with you we'll explain to you what happens we'll explain to her what happen and then yeah I have a friend of mine he's only four houses away that you know I can depend on him he'll I can make calls and everything else on there and he told me any time I wanted to stay over because I used to stay there and watch ball games and it was late when I left so he says he can stay over anytime you want so leftand following the investigation and the statements gathered the deputy determined Jon to be the primary aggressor in the situation he was transported to the Flagler County Jail without incident and charged with obstructing without violence and Battery against a person over 65 it was noted that John had a previous arrest on August 30th 2020 for domestic battery and another on August 31st 2020 for violating a no contact order both of which had been dismissed by the courts all right sir go ahead and step on out I'll try that's going to be easy there you go what's your thoughts let us know
