Police say the driver later agreed to provide a breath sample during the observation period. >> [music] >> And one of the samples registered a 0.142 alcohol level nearly twice the legal limit. But when officers requested additional samples, they say she repeatedly gave short shallow breaths and did not complete the required sample. So it was treated as a refusal. According to court records, the original charges included DUI, refusal to submit to testing, refusal to sign citations and several traffic related violations connected to her driving behavior. [music] As the case moved through court, prosecutors later dropped the refusal related charges while the DUI itself remained active. Court records also show the defendant entered a not guilty plea, waived speedy trial, and was later accepted into a DUI diversion program. Officers also discussed the suspected unidentified medication found inside the vehicle during the incident, but based on the public court records currently available, there does not appear to be any confirmed drug possession charge or publicly filed lab result at this time.
