All right. So, my main concern is >> my main concern is where my parents live now. I don't live here. >> Well, I think that's due to the reason that you took off from a crash. Um, so my main concern is you're based on what I've observed, I smell a bit of alcohol coming from your breath. >> I'm telling you, >> um, I observe slur speech. I just want to make sure that you're all right to operate a motor vehicle. Would you be willing to do some field exercises? >> No. >> No. >> No. >> Okay. Why? Why is that? >> Because I know I don't need to. Actually, let's let's step out of the vehicle just cuz I I don't I'd feel safer if you weren't behind the wheel. Turn it off. >> Okay. All right. I'm telling you to step out of the vehicle. >> Okay, that's fine. >> All right, >> that's completely fine. >> So, you're Why Why aren't you willing to do field exercises? >> Because I know I've had one beer and I told you that. >> Okay. If if you don't or if you're not willing to submit the field sobriety exercises, I will have to base my arrest decision off of everything that we've observed so far. >> Okay. Which is what? >> Which is you taking off from a crash. You're >> I do not take off from Okay. >> Your the odor of alcohol coming from your breath. And also I see you're you're kind of swaying while standing. All right. So I'm going to ask you again. >> Are you willing to submit the field soiety exercises? No. >> No. All right. >> Chris, >> 10:15. >> Okay. >> Ma'am, turn around. >> No. >> Put your hands behind your back. >> Thank you, sir. 99. >> Are these comfortable? >> No. Don't know. >> Well, I mean, is there enough room for your Is it >> Yes, but will you at least It's very tight. >> Okay, I can loosen them up. >> Yes, please. Thank you. >> This is your grandparent house. Whose house is it? >> Can we call them? >> We can call them. Do you want me to leave the car here >> and secure it >> or I have to tow it to two? No, you're not toying my car. >> It's a simple yes or no. I don't need your language. I don't need your attitude. >> Sorry. >> So, you want me to secure your vehicle on your parents property here? >> Yeah. Will you close the mic? >> Absolutely. >> Thank you. >> Sorry. I'm not It's all the way deep down. >> I'm not I'm not >> Thank you. >> You have anything on you though? Sticker. >> Who's your mom? Samantha. >> No, that's my sister. Will you call her? Will you answer it? I will answer that. You just worry about this. >> Well, can you answer it because >> not right now? >> Well, I don't want my dad to have a heart attack. So, can you >> We'll deal with that in a second. >> All right. >> All right. That's as loos as I can make it. The other one's just fine. >> No, I'm I'm fine. >> Okay. There you go. >> But I'm not leaving with you guys until at least someone. >> No, you don't have that option. Do you need anything like your wallet or phone? >> I mean, yeah, but you're not going to be in there that often. >> Well, we'll be able to get it from the car. >> Nothing in your pockets or anything? >> Just hang tight. Sweet. >> So box in there. See? >> Oh, it's reeks in here. It's probably in her cup. I don't know if you want to smell it. Oh, definitely. But you just note it. Hey, unlock your car. She's on the other side, ain't she? >> So, what's your password so I can call? >> Can you go Samantha for me? Yep. >> And tell her to meet us at the police station. >> No, you're going to jail. She can't meet you at the jail. >> Well, can I at least have shoes? >> Are your shoes in the car? >> Yeah. >> Okay. >> Thank you. Will you tell her to meet us there? >> She won't. She can't meet you. I'm going to fill her in though. >> Okay. Thanks. >> Hello. No, this is officer Hyel with City Store Police Department. Hi, just update. She's going to be under arrest for leaving the scene of a crash and DUI. Um, Mar County Jail, but um you're not going to be able to pick her up. She's going to be in there probably all night um based on her alcohol level. um once it comes to a safe and normal alcohol level then they will release her medically but until then she has to stay in there. So usually I tell people probably 8 to 10 hours >> yeah is a is a ballpark. I don't know what her alcohol limit is. So, I don't know what that is, but um 8 to 10 hours is a normal time frame. Um, as of me guessing right now, then she'll have a bond. Yep. Yep. Yep. She'll have a bond and you can get all that at the jail. Um, obviously we're not there yet to even give it. Give us probably like a few hours and you can call there and get the exact bond amount, everything they'll tell you. Um, is her your parents coming home here anytime soon? Okay. Okay. All right. Um, fill them in cuz her car is here. It's either going to I'm securing it here instead of Yeah. at the house here. Right. Um, so I got the keys. Instead of towing it, I'm going to secure it and lock it up. So, I don't know if I'm giving the keys to them if they get here before the officer leaves or the keys are going to go with her. Perfect. Start heading this way then. I'll give you the keys. All right. Now you smell. >> Yeah. Spray it all over. >> The other one one that I put here could probably It looks like shotgun. [Music] >> All right. I did not give you guys permission to go through my car. >> Where's the cuffs? >> They're right here. >> Okay. Why'd you take them off? >> Because you guys made them so loose. >> Step out. >> Put it back on. >> But I did not give you guys permission to go out. I did not step out. >> Okay, that's fine. >> Turn around. >> I did not give Put on tighter. I did not give you permission to go to my car. >> You don't have to me. Oh, that's fine. I'm just telling you I did not give you permission to go through my trunk, any of that. My wallet is open. I didn't give you permission for any of that. I gave you my password. That was it. See, you went through my car, my phone, my wallet. I get back in the car. I'm I'm perfectly happy sitting here. >> You have a 1070 coming? >> No. >> Okay, >> does that make sense? Yeah. >> This is your phone. >> Is it? >> Yes. >> If not, I won't take it. >> It is, sir. I'm sorry. >> I did not give you Yes, it is. But I did not give you guys your keys. >> I asked for my shoes. >> Is this your keys? >> Yes, it is. But I asked for my shoes at the jail. Sierra condominium 1041theast [Music] within the last few hours on fire. >> What was that? >> Oh, your car's getting towed. It's not getting towed from my parents. >> 109, sir. >> 109. >> 1012 adult female 51 CJ 65 starting >> 4887. >> Drive safe cuz I'm not buckled in. So, what are you arresting me for? >> Hello. What are you arresting me for? >> Do you want >> Okay. Did you pull me over when I was driving? What are you looking for? Cuz I asked for my shoes. I did not give you permission to go through my car. You did not give me my shoes and you just went through my car. [Music] >> What did the lady say? She was hurt. Hello. [Music] Can you hear me? You're going to ignore it. That the fact that you did not have a right to search my car and that I never gave you permission for that. and we're gonna recap that and then you'll take me in and then my parents will show up and we'll go from there. But I just want to confirm that I gave you no permission to go through my car. You didn't have a right to pull out my cup, anything like that. You're not going to respond. How can you give me a DUI if I didn't blow or do anything for you? I'm just curious. No response. So, I ask and you don't respond. [Music] >> Okay. >> All right. >> I would choose. I'm not sending. I'm now requesting that you submit to a lawful test of your breath for the purpose of determining its alcohol content. Will you take the test? >> I want my lawyer. >> What was that? >> I want my lawyer. >> So, that's a no. >> All right. If you refuse to take the test I have requested of you, your driving privilege will be suspended for a period of 1 year for a first refusal or 18 months if your driving privilege has been previously suspended or if you've been previously fined under statute 32735215 for refusing to submit to a lawful test of your breath, urine, or blood. Additionally, if you refuse to take the test or blood, you just ask me. >> Additionally, if you refuse to take the test I have requested of you and if your driving privilege has been previously suspended or if you've been previously fined under statute 32735215 for a refusal to submit to lawful test of your breath, urine or blood, you'll be committing a misdemeanor in addition to any other penalties which can be imposed by law. Refusal to submit to a breath test I requested is admissible on evidence in any criminal proceeding. Do you still refuse to submit to this test? >> Yes. Okay. >> But I don't understand everything that you said. >> So, would you like me to reread it? >> Yeah. >> I don't understand because you didn't breathalyze me from the beginning. You're not breathalyzing me now. Like, I'm >> That's what I'm asking for. >> But I don't understand the consequences of it. I don't understand that at all. Okay. Thank you. >> So, I am now requesting that you submit to a lawful test of your breath for the purpose of determining its alcohol content. Will you take the test? >> Continue. >> It's a yes or no question. >> Okay, I'm going to say no again, but continue. >> If you refuse to take the test I have requested of you, your driving privilege will be suspended for a period of 1 year for a first refusal 18 months if your driving privilege has been previously suspended or if you've been previously fined under stat statute 32735215 for refusing to submit to a lawful test your breath, urine or blood.
