And there reason I mean this is I mean why would I think it would be okay to do this and do put my I mean my my >> Well, let me ask you this. What can you do about it though? you know, um I I have a saying that I always that I always tell myself whenever I get worked up and it's no amount of anxiety can predict the future and no amount of regret can change a past. You know, you can be ashamed of yourself and you can hate yourself for what you did. But the thing is though, you cannot go back and you cannot change your actions. You did what you did and it's unfortunate. It's unfortunate for numerous reasons. One of them being is that you put your kid in a bad spot. But the thing is though, you cannot do anything about that right now. All you can do now is move forward and work on improving things, bettering yourself as a person, not just for your sake, but also for your children's sake. So to be put in a situation for yourself, you know, it's people make mistakes. No one's perfect. It's all about whenever you make mistakes, are you going to keep making mistakes or are you going to learn your lesson better yourself? So, I know right now you're really really down and you're really really beating yourself up about it, but I encourage you to try Oh, wait. Hold on. Step out. So, you're going to go right there between those two red poles. >> The mother could face charges of shoplifting and child. Under current Georgia law, she could face a maximum penalty of 2 years. Children learn from the behavior of the adults around them. Decisions like these may give the child a misleading sense of right and wrong and subtly influence their choices in the future. You know, just chilling, whatever. My mom was over the summer like I can at least like July 12th. Yeah. Over the summer came over. Mom was at work. I have a younger cousin. He's 15 times 16. And they was playing a game. He came in my room watch YouTube. My mom is not here in my phone. He seen she seen that he was in my house with my phone cuz I took a picture of him being at my house. When she seen that, she was just like, "Why did you invite somebody at my house and stuff like that?" So, you know, I'm sleep. I wake up light on and she just instantly start hitting on me. So, I'm just like why are you hitting on me? Show me the picture talking about some why is he like why did he come to my house and the screen he looked at the screenshot or the picture said August 8th. I took the screenshot of it cuz I sent it to someone. He seen it. She seen the date. It said August 8th but he didn't come over August 8th. do over summer. She still didn't care and she just she just kept hitting me and stuff like that. I was trying to explain myself and she was like my ass trespassing because like I'm not there. She told me like what if I >> She wasn't there. She couldn't him anyway. So he came over July when >> like around July 12th and he's like down the hall from his class. So I'm just like why would you say that about somebody I met since fourth grade over the summer? Me and my cousin Township. I'm pretty sure you know what I used to walk. I used to stay in that houses over there. We used to always go to his house. Um I come over his house cuz like he do music. He'll like roll up or I don't know. >> So how did you get all your marks? What did What time did this happen? >> Like going on to >> this morning. All right. So she saw the phone picture. She confronted you. >> Feel like I was behind. I mean I ain't got to lie about somebody to come to my house because I go over his house. That's the only reason I go to that neighbor to go to his house. She know I be over there. So it's like why would you flip cuz he's at my house and that's not my boyfriend. I ain't having did nothing with that boy. So no. I don't know why she flipped that down like that. It kind of scared me. So, >> you know, and she took my phone. So, >> so how did you get the marks? I need you to explain. >> She hit She did me with a Gucci like at least more than 15 times. She mess >> where she hit you with a on your arms. That's how you got the arm or she you on the butt or what? >> Okay. Okay. It's not sound weird cuz you're a man. So, >> I'm here. >> When I go to sleep, I like kind of free ball. I sleep in my underwear. I woke up. I'm like, why is she hitting me? I ain't got no clothes on, just my underbarrings. And she dragged me out the bed like by my hair. I'm just like, "Bro, it's a photo." Like, I would not dare do nothing with this man. Like, my friendship came so far with this man. I would not do nothing with it. I ain't never trying to. >> So, after she confronted you about the phone, you went back to bed. You were in the bed whenever she confronted you. >> Just busting my room, told me the photo and she's like, "What the you let somebody hit my house going off and just hit me in my face." So, you know, she been doing that. So, >> how'd you get the marks on your arm? All these marks on your arm are fresh. >> Fresh from in the morning. >> She just grabbed you or what? >> Punched me so hard. I had to put my nose back in. No start. >> Can you look up for me? I'm not going to shine soon. Can you look up to the ceiling? >> Yeah, she hit me with the belt. She hit me in my face. I don't really her fist in the face. >> That's my That's when my nose start. >> Where's your dad at? >> My dad? >> She not in the picture? >> He was a felony, but like I don't have a picture, but I know what he looked like. I don't I can't stay with him. >> He's not at the house. >> No. >> Nobody else was around when this happened. You got brothers or sisters or whatever? >> My sister was in the other room. So she woke my sister like why did you not sneak a girl? Not a girl but a boy in the house. She seen like the screenshot said August 8th but that's not when he came over. It was over the summer. My sister looking at her crazy what you talking about. She was like I feel like you and my mom was the type if don't make sense. Of course she's going to put her her hands on you. >> So she started with the where she with the >> it's like stuff like this on her back. I don't know if you can show that but she like my face. >> She hit you in the face with the >> Yes. Is that where this mark on your neck is you? >> You just take a just take a like a Gucci blue leather belt and just somebody with that like dead in the face. I can see I got lit up at least 20 times before she was just overweight. She just >> And all the stuff on your arms is from the too or did she grab you and was pulling you around? >> She with that [ __ ] Like my sister is way more light than me. My sister don't go over here. But >> officials documented the [music] marks and contacted DCF to ensure the student's wellbeing. >> Some go all the way to my back and stuff. Is this from the or is this this is where she you know you can see look this is from the my >> all this is from strikes with the >> you 17 right and we have somebody else that you can go stay with >> heard that already. >> Okay. >> Do you feel like this is your mom justing you? Is this the first time she's ever hit you like this? No. Do you feel like this is normal? >> I mean I didn't do anything like I don't know how to explain that. Like >> you just had a friend over at the house when your mom wasn't there. >> That's about it. I mean, I went >> I don't have smoke, nothing like that. >> I don't do that. >> Do you want me to have medical come out and check you out? Do you feel like you need medical attention? >> My arm stated, but I don't need no >> When did you get spanked? >> When did I get this? >> In the morning, like 1:00 in the morning. Like, it was going on 2:00 >> last night or this morning. Did you have a boy in the room at that time? >> No, it was over the summer. That's the thing. >> So, mom found the picture in her phone. So, you just took like a selfie of him in your house. >> Yeah. I had a girlfriend while she was over there. She didn't tweet me. I ain't lying. It's not about like all just because she wasn't there. >> Yes. >> And that student has a sibling across the street at Bear Creek. >> We see I was going to actually I meant to go back and ask her, but I wanted to talk to mom. Is there any way we can get both of them together to that to like leave with the aunt? >> Yeah. >> Cuz I don't know the defects, they'll probably not want to take cuz if we do end up taking mom into custody, we need to already have something for the sister. >> Okay. Okay. I just wanted to touch bases with you guys because I'm going to call Bear Creek and I don't want um you know mom to pick this up. >> Yes, absolutely. Can we stop that from happening? Do you guys feel it's best to get them together to cuz I think the aunt is that's the plan is the aunt's going to come get them at least her and I would like for them to stay together cuz we don't want to se separate the siblings. >> When meeting with the student at school, the mother denied the concerns [music] suggesting the situation had been exaggerated. >> What happened this morning with you and your daughter? >> Nothing happened this morning. This took place last night. What time last happened? >> So, you know what I'm speaking about. >> I know exactly what you talking about. >> What happened? >> Took place like 10:30, maybe 11:00. That's what time I got home. >> What happened? >> I asked my little girl about a little boy that she had in my house. She like she know what I was talking about. Went to go get my belt and I my child and she was moving in the midst of me with her. I don't know my kids. I have another little girl. She's in the ninth grade, eighth grade. I barely put my hands on my kids. This is our first time ever going through this. How many times did you your daughter? >> About five times with the I never physically put my hand on my channel. >> What were you with? >> Like what kind of belt? >> It's a Gucci blue. >> How did she get marks on her face? >> That's what I just said. When I wasing her, she was moving. I guess the had face, but I never physically none of my kids. Like I said, they barely get a This was my first time. >> You didn't have to You didn't have to the metal end, did you? >> No. No, not at all. >> Did you see your daughter when she left for school this morning? No, because she walked out so fast when I got out. It's like she had an attitude from what happened last night. She left. >> So, she told us this happened around 2 this morning. Anything happened about 2 this morning? >> No, she's lying to you guys. You can't believe everything a child say. >> That's why we're talking to you. >> I'm not one of them parent. We can call my other little my other little girl. We can call my sister. We can call anybody in my family. I do not my kid at all because I used to get and stuff like that. So, I'm not too fun in that. But for her to bring a little boy in my house, I was mad and I did get a her. But me physically her and trying to hit her with the pl the metal part of the side. No, not at all. I'm a hardworking mother and I take care of my kids. >> She claims that you her in the face and she does have to face >> and also on her. She also has marks on her neck. >> I never once hit my child with my hands. I never physically my child and if she told you that, she told you a lie. Some of the marks are obvious. Nail mark, but not mark on the on the face. >> Nail mark. She must have did that when she left this morning. When my child went to bed last night, she did not have no nail marks in her face. How she got those? I could not tell you guys. When she went to bed last night, my child did not have no nail marks. Cuz if I'm her with a Where the hell would my nails come in? >> I agree. >> Like, let's be clear here. Like, I'm in my cuz you're a little distance. I'm right here. Oh, you my How do my hands touches your face? >> That's why we're talking to you. >> Okay. >> We didn't get into no fight. We didn't get into no argument, sir. I went and got my and I start with her. >> What did she do to get you so upset? >> She brought a little BOY IN MY HOUSE WHILE I WAS AT WORK. >> WHEN WAS THIS? >> A couple days ago, but I'm just now founding out about it yesterday. >> Cuz she had a boy in your house while you were there. So, where were you? That's what made me mad cuz you had a little boy in my house without me even knowing it >> and she was in her room. You came in and confronted her. >> Yes, sir. >> And then you came in with your >> Yes, sir. I did. >> You didn't grab her by her hair? >> I did not touch her physically with my my hands touch my child. And if my child was sitting right here with me sitting right here, she would be looking at y'all like I'm I'm literally lying because I did not physically put my hands on my child. That's not in my character to do. But she don't have nowhere else to go. She got to go home cuz she have to go to work tomorrow. Like she's on a schedule. >> What is she working? >> Freddy's. >> Does she drive? >> No. As much as I try to get her to. So she could cuz she has done it before. What happened is she has or something big or whatever the case might be. She probably this morning got a little angry of what happened and did that to herself. He physically no. However, with visible marks on the face and neck, authorities reminded the mother that Georgia law requires intervention whenever there is a concern for [music] a child's safety rather than dismissing it as ordinary discipline. >> She was like, you know, I came in confronting, I'm trying to her, and then she just like starts moving around. I know when I was getting I was moving around, but you you just keep whailing on your freaking job like that. That's different. My mom was saying, I don't know how she got marked. She probably did it to herself. And that's always a go-to for people. >> Okay. >> What time does your mom get home to? >> She got home at like around 12 something. So, I don't even know if she went through my phone. Like, usually she'll she'll go through my phone because like she got blocked by somebody on Instagram, right? I only think she go through my camera cuz she never do stuff like that on my messages. When I go home, she's she do this thing where she just take my phone till like the sunset go down and give it back before 10:30 cuz that's when I supposedly supposed to be sleep. So she did that and then like I can remember just waking up again. >> Is it fair to say you've been busted before? That's why she does this. >> Yes. >> Yeah. In this case, there has to be a physical separation. >> Oh, 100%. >> So we got to find a place. >> What it got to be a separation for? Just cuz she It's domestic violence at this point. >> How is it domestic? >> Because she's your daughter. >> Nobody called and said this was a domestic. We're not still fighting. It's not an ongoing fight. >> It's not. But mother and daughter, son, >> and we're not fighting right now, >> but you're two people that are related to each other as domestic. >> And an incident occurred at your house, which is why we're here, cuz you live in Pharaoh. It was discovered by the school police, which is why we're involved. >> But it's a whole new thing. How long do we supposed to be separated domestic? >> Well, somebody not saying this happened if somebody >> case before with my husband. >> So, and they let us be separated for like a couple hours. So I'm just trying to say how long do she need to be separated because this is going to mess up her going to school which is tomorrow and she have to go to work tomorrow. So if she don't go to work tomorrow, she get fired then what? Like there's a lot there's a lot at stake here for >> Janala. We have to we her safety is our paramount main concern. >> But ain't nothing going to happen to Janala at home. Nothing's going to happen. >> We can't chance that. Does that make sense? >> Okay. She don't go home tomorrow. She go home the next day. That's a chance. So what do >> you also have another entity involved? the other state of Georgia which is a Tax that's here. >> Yeah, >> correct. >> They they place ch children. >> Okay, I understand what you're saying. So, what makes day difference from tomorrow? Cuz if she get placed somewhere today and she got to come home tomorrow, what makes it a big difference? >> They can help with transportations. We're not too much worried about that. >> That's fine. >> No, what I'm saying is I'm about to give you a different circumstance. So, say a woman and a man are arguing. >> Okay. >> One of them the other one, right? They're both going to have different sides of the story. So then we have to determine based on the evidence that we can prove which is somebody is going to have physical marks. Okay. Which your daughter has. And then we have to determine who is telling the truth what makes more sense. And her marks do not look like mark. And she is saying that she >> Yeah. She told us exactly what you said. >> Okay. >> But she also said that you her in the face. >> Now that's a lie. If I in the face my hands be >> not necessarily. They skinny enough to be I got into enough fights to know if I somebody in the face my hands would be >> not necessarily if you hit it once and it wouldn't necessarily mean if I hit if I somebody in the face something to be wrong or my hands will be somewhere something will be fragile on my >> nefortunately we are not done with you they're done with you no we're not done you have everything you need >> yes I'll be back >> officers reassured her that they understood her intentions [music] and were not judging her as a parent nevertheless the mother faced follow-up from authorities to ensure the child's care and safety. >> You don't seem like a bad mom. Okay. >> Okay. >> This got out of hand. >> It did. >> What we're going to do is we're going to put this to a judge. Okay. At this time, I'm going to take you into custody and we're going to take you out of here. We're going to go back to the PD. I got some paperwork I got to do. >> I got a little work. So, how y'all going to take me to custody? I just sat up there and told y we'll deal with work later. Okay. If I got a phone, we can make a phone call and you can let them know that you're not going to make it today. >> No. But why y'all taking me again? For right now, it's it's battery. Okay. It's a family. >> Basically, we have what's called probable cause. Okay. Me and him think I me and you just had a good conversation, right? We don't think you're a bad I don't think you're a bad person. Seems like I said I think you're trying to be a good mom and you care about your child. We don't think anything bad about you, but it's called protocol. We have >> Okay, but I can't go with y'all because I have to get my child from school. Like this is inconvenient my whole never just took me to jail. law when it comes to family, we have to we have probable cause. We are required by the state of Georgia make an arrest >> or citation >> not a citation. >> We can't do that. >> Not in this not in this incident. >> Not in this case. >> We are duty bound to make an arrest that we can establish. >> This is not us saying we want to do it. We have to do it. >> They're making arrangements. They've already contacted your sister. Your sister's coming to get the both children. She'll be here. She said fiveish. >> How has this became battery? >> The visible mark. the visible marks battery in the state of Georgia by law. Like I said, it's family under the family. >> This past just parental discipline. >> We don't determine guilt. We just have to have probable cause for >> Okay. So, I'm going to switch with y'all. I'm going to >> county jail is where you're going to go. So, I got to do some paperwork. We'll get you down there and get you out of there as fast as we can. We'll get you to the jail. We're going to try to get you out of here as discreetly as possible. >> So, I'm going to jail. >> Whatever y'all need to do or if I lose my job, then what? >> This is what I'll say to you. You'll be given a card when you go to Fulton County Jail. I would advise you just to make >> Fton County. Okay. >> Yes. Fton County Jail. I'll advise you to make best use of that car. >> You don't got to put them home. >> I have to. Nobody's outside. You're going to be discreet taking out the door so you nobody else see you. >> You know where I'm parked? I do have to hold. We're in a school. >> I can't run with handcuffs on. >> Yes, you can. >> No, I can't. >> The first person to have handcuffs on the door. >> Let me get your property. I'm I'm going to give it right back to you. >> All right. You got anything in your pockets? Uh, just my key. >> Key to your vehicle. You want to leave it here or you want to take it with you? I'm going to take it with you. >> The mother was charged with battery and endangering [music] a dependent. Under current Georgia law, she could face a sentence of 2 to 10 years in prison. Discipline is guidance, not punishment. Every child who makes mistakes needs support, [music] understanding, and patience, not fear. >> So, why are you driving? You know, did you know your license is suspended, right? Yeah, it's been suspended since 2018. Despite previous concerns, this mother still drove in a way that required official attention with four children in the car. August 16th, 2024. A routine traffic stop on the highway turned into a situation needing careful handling when officers noticed the mother appeared distracted and four children were in the vehicle. She seemed confused and had difficulty presenting her driver's license. Officials also noted prior interactions with authorities for her well-being from two months earlier. pass by her and I look in the rear view and she's at 55 miles an hour, both tires in the grass. Like literally riding down the side of the grass here. >> Okay. >> And I start look back and I pull and she's literally just riding in the grass. So I pull over, I'm like, "What's going on?" And she's just like, >> she keeps trying to hand me her bills. I asked her for her license. She's handing me like five different credit cards in the car, too. >> Four kids. Looks like every one of them's probably under. So, I don't know if she had them at the beach and it's been drinking. I tested her eyes real quick and her eyes were out. >> She's like, "No, no, I haven't drank anything." I'm like, "Do you not remember driving down the median over here?" And she's like, "Where are you?" >> So, she was on this side of the >> on the right side both time like basically like she is now, but at 50 mph just going straight down the grass. >> I'm sure your cam picked it up. >> Yeah. No. So, she's she was back to my right when I cuz I it'll it'll pick up probably the um going over the lanes, >> but at that point I had passed her and I looked over to see if she was on her phone and she wasn't. So, I was like, "That's weird." Then I looked back in the rearview mirror. >> We already got I got your case number on our on our thing there. So, where did you start observing her? >> Uh she could just north of What would this be? Sunset. >> Sunset's on the other over the hill. >> Yeah, over the hill. So just before sunset is when she was kind of drifting over to Vandenberg. >> Yeah, Vandenberg to the right. And then right actually up here and as you're coming down the hill is where she went completely off and was going full speed. >> And you're Golf Course 10 alpha. >> Uh yeah. >> Okay. All right. I'll talk to her real quick and see you. >> Hello. How are you? What's your name, ma'am? Huh? See, you have your ID on you, your license. Hi guys. Where you guys doing? Where you coming from? Indian rocks. You're on the beach today. All right. Do you have a driver's license? >> All right. Can you find that for me real quick? Who's this car registered to? >> My husband. >> Your husband. Okay. All right. Get your license out real quick. >> Who's that? Uh >> your mom. >> Where you heading off to? Home. Where do you live? >> Oldsmart. >> Yeah. >> Is your husband home? >> He should be. Okay. >> To all the um >> What's that? that apartment complex. >> Mhm. All these your kids. >> These all yours. Okay. >> I have. >> Yeah. But I need your license. Where's your license? >> That's >> Did you have anything to drink today? >> No, sir. >> No. >> No. >> You sure? Okay. I was baker. >> What's that? >> Two months ago. >> You were baker acted two months ago for what? Did you make stuff hurt and harm yourself? Okay. All right. But you can't find your driver's license. You got a valid driver's license. All right. Let me see if I can look you up real quick. >> You can have that. This is This is you right here, right? What's your date of birth? >> Yes. Yes. That's March 22nd, 198. March 22nd, 1980. >> All right, give me a second. >> Yeah, I can smell alcohol coming from her breath. >> Yeah, she's just so glazed. Like I said, I've asked her so many times for the license. >> Yeah, she can. She gave me her passport. >> She keeps looking at the same like credit cards and like and at one point she went like, "No, she goes, "Wow, that'll be like >> Yeah, I I'll look her up. Make sure she has a valid license. I'll see like I said, one of the night cars cuz I get off at 7 myself, so one of the night cars on her way. So, I appreciate me. >> With a history of multiple traffic incidents, the mother appeared not to have adjusted her driving habits. Police observed signs of stress and inattention during their interaction. >> So, she don't even have a valid driver's license. She only has a ID card only. She has one fire DUI, DUI, and two DWSRs. That's where it got my attention too is I can see gun standing up in the map and bouncing around the car and I saw her completely off. >> Yeah, she's going to jail regardless just for that too. John ID card, but all those tires >> prior and so she has prior DUI. >> One DUI, two DWSRS. So, I looked I looked up don't smoke. I looked up your license. You don't have a valid driver's license. Your license no good. Okay. How many kids you got in here? >> Huh? >> Four. >> Four. Okay. How come the ones in the back aren't seeded in? >> Is that your husband? >> Huh? Am I going to jail? >> No, I don't know. >> We're We're going to talk. I got another female deputy coming here. We're going to talk to you about some stuff cuz right now you can't you should be driving. You got only an ID card. Okay. You know, there's the officer that was behind you. He was following you and you're all over the road. So, why are you driving? You know, did you know your license is suspended, right? Yeah. It's been suspended since 2018. You know, you don't supposed to be driving, right? >> You don't pay for it. >> Huh? >> That's my husband. >> You're a grown adult. You know your license. No. >> What's that? Yeah, but you know you're not allowed to drive with a suspended license. >> You got four kids in the car, ma'am. >> Huh? >> Okay. She has four young kids in the car. >> Hi, my name's Kayla. Would you mind coming back here and talking with me for a minute and will watch over a little bit? >> I'm going to watch over your kids. All right. I'm going to talk with them for a few minutes. >> Here, let's go over here on the road a little bit. >> So, what's going on today? >> Whoa. I don't know why. Fancy, you're a little upset. What's going on? I've been on a program, you know, fit two months ago. Um, my husband gave me corrective. >> That's That's definitely tough. Yeah. >> Why did he do that? >> Because I pulled him out of the ship. >> Okay. So, it's Christa, right? Am I pronouncing that correctly? >> What is it? >> Christina. >> Christina. Okay, Miss Christina. I guess there were some concerns about the sergeant that saw you driving a little bit and the other deputy that's talking to you and I'm talking to you. I can kind of smell some alcohol on your breath. Are you okay with me checking your eyes to make sure that you're okay to drive? >> Yes, I am. >> Yeah. Okay. Let's go somewhere a little more flat so you're we're not on like a weird slope. I'm going to have us walk. I don't know if there was any way to get around this water. Um the water >> the husband >> Oh, I don't I don't know. Did another deputy speak with him? Let's go. Um I guess let's go this way around the the water. Or actually, we'll just go back towards my car. How about that? That way. I just don't want you to have to walk through the water. Since four children were involved, following safety protocols was essential. Police and the mother went through assessment steps to ensure everything was handled responsibly and fairly. >> Did they Did you try them at all to see if they helped? >> Okay. Would they does Cakquil sound familiar for what they prescribed you? Okay. I've heard 50/50 on it. Some people have told me it makes them feel kind of zombie-ish. Other people have told me it really helps them. So, it just depends on your body, you know. So, since you're okay with me checking your eyes, what I'm going to have you do is just stand with your feet together, your arms at your side, just like this. Okay. Perfect. I guess everybody knows though. >> That's okay. You see the tip of my pen? All right. You're going to follow it with your eyes and your eyes only. You're not going to move your head. Do you understand? >> Yes. I'm not drunk. Okay. By any means, I just need a tissue. >> That's okay. We I can get you a tissue. Got a few more passes to go. It's going to go back and forth a bunch of times. Okay. That's all right. Keep watching. Right at that tip there. Okay. >> Sorry. Here, let me turn you away from the sun. There you go. Let me turn you away from your sunlight. I have sunglasses on. You don't. There we go. Nice little shake of hands, too, right? >> Yeah. It's all the caffeine I drink. I'm telling you. >> I'm sorry. >> No, [laughter] it's okay. It's the caffeine I drink. I chugged an energy drink on the way into work. So, >> you're like, you know, you have to shake your hands. That's why I wasn't a surgeent. >> I understand. Okay. >> Just the process. Yep. >> Got to make sure I go through all of it that way. >> Yes. I'm just >> It's just going to go up and down this time. Okay. Put your feet together for you. There you go. Okay. Um, so are you sick or today in any way? No. Okay. Um, are you diabetic? Do you take insulin? No, not yet. But I think a husband, huh? >> Okay, that's your husband. Okay. I think he's just checking on the kids, that's all. Are you epileptic? No. Do you take Thailand? >> No. >> Do you have any physical conditions? Like, do you have a heart problem with that heart problem? >> Uh, a >> Okay. Are you on any medications for that? >> No. >> Where's medication? >> I take blood for my blood pressure. >> Do you take those every day? >> Yes. >> Okay. Have you already taken them for today? >> Yes. >> Definitely. Perfect. >> Do you have any physical defects? One leg shorter than the other. A fake arm, fake leg, fake foot. >> No. >> Do you have a glass eye? >> No. >> And do you wear contacts? Okay. Your eyes are like a hazy green. Did I get that right? >> Yep. Good. >> So, I am seeing a couple signs of impairment in your eyes. Okay. I would like to ask you to perform a couple more field sobriety tests to dispel my suspicion that you're driving under the influence. Is that something you're willing to do? >> Sure. >> All right. Do me a favor. Stand with this sergeant for a second. I'm going to get my tape out. I'm going to make a little line. >> You can stand for a little bit. >> While officers completed their checks, the children's father also arrived and was briefed on the situation. >> You dad? >> Yes. >> Okay. So, the other officer who's from golf court was traveling northbound following behind your wife and she was all over the road. >> Okay. So he went around her thinking she might have been on her phone and she wasn't on her phone and she was still riding almost into this grass. She was in the grass area. So he pulled her over as a precaution. Notice there a bunch of kids in there and obviously right now we're >> Yeah, she did have this smell of alcohol coming from her breath. Are you going to be able to park your truck somewhere? >> Um >> or or actually do you have enough room to put your kids in there? got a whole bunch of stones on the back and there's only one seat. >> Okay. >> Okay. So, we're going to go over to this side of the white line that I put down. Okay. You see where that white tape is? >> So, he's in the car. >> Uhhuh. >> What is he doing over there? >> Yeah. >> Yeah. That's awesome. >> And he's sitting on the side of this, right? >> I believe so. I don't know who called him and what why he's here. My main thing is with you. I haven't been over there. So, Okay. >> All righty. I'm going to put you in what's called a starting position. Okay. I was going to say you can either do it with your shoes on or off. I'm going to put you into a starting position. >> You're going to remain in that position while I give you instructions. Okay. >> So, go ahead and put your left foot on the line. >> Your left foot on the line. >> Miss Christina, go ahead and put your left foot on the line. There you go. Now, put your right foot ahead of your left with your heel and your toe touching. There you go. Stay just like that while I give you instructions. Okay? All right. So, when I tell you to begin, you're going to take It's okay. When I tell you to begin, you're going to take nine heel totoe steps down the line. You're going to turn the way I'm going to show you, and you're going to take nine heel totoe steps back. Okay? So, I want you to watch me. It's going to look like this. Okay? So, you're going to be in your starting position that we just talked about. >> I'm going to show you how to do it. Okay? Once you begin, you're going to take nine heel to toe steps down the line. So, one, two, three, all the way up to nine. When you get to nine, you're going to use your back foot to make a series of several small steps to turn around. Okay? Same thing with the nine back. You're going to take the back foot they used to turn. One, two, three, all the way up to nine. You're going to keep your hands down by your side. Look down at your feet. Count your steps out loud. Touch heel to toe. All right. Do you have any questions? about the instructions I gave you. No. Okay. So, go ahead back in that starting position. Your left foot on the line, your right foot ahead of your left, and then whenever you're ready, you can begin. Nice. Nice. Nice. Nice. >> Just like I instructed you. >> And go back. >> Yep. Just like the instructions I gave you. Miss. Okay. So, for this next one, I'm just going to have you stand right here for me. >> Okay. All right. So, this one's called the one leg stand. Okay. Same thing. I'm going to give you directions. I'm going to show you how to do it. If you have any questions, you can ask me and we'll go from there. Okay. All right. So, for this uh starting position, all you got to do is stand with your feet together, your arms down at your side. Perfect. When I tell you to begin, you're going to raise one leg, either leg approximately six inches off the ground. It's about the height of a soda can. Okay? You're going to point your foot and you're going to count out loud in the following manner. 100 one 10 1 2 100 3 and so on until I tell you don't start yet. Until I tell you to stop. Okay? I don't want you to put your foot down. If you do put your foot down, I want you to pick it back up and continue counting where you left off. All right? Keep your arms down at your side. Point your toe. Look down at your foot the whole time. Okay? Do you have any questions? What leg are you going to stand on? Your right. Okay. Give me one second. All right. Whenever you are ready, you may begin. Keep your arms down to your side for me. Make sure you count out loud. Keep your arms out your side. Arms out your side. There you go. >> Do I have to respond? >> You're good. You can stop. Put your shoes on. I just have a couple questions for you and we'll go from there and I'll get you a napkin for your nose. Okay. >> The assessment showed that the mother was distracted and slow to respond, but she continued to maintain that she had not acted unsafeely. >> Just stay right here for me. I'm going to grab a tissue for you. Here's an accent for you for your notes. Okay. So, I'm literally going to read to you from a sheet of paper. Okay. It just has some questions that we asked. All right. Like I said, I'm literally just reading off the sheet for these. Okay. These questions are very specific because they're specific and have the chance of being incriminating. I have to read your Miranda. It doesn't mean you're under arrest right now. It just means I have to ask you specific questions about the situation that's going on. All right. You have the right to remain silent. Anything you say can will be used against you in a court of law. You have the right to talk to a lawyer and have him or her present with you while you're being questioned. If you cannot afford to hire a lawyer, one will be appointed to represent you. You can decide at any time to exercise these rights and not answer any questions or make any statement. Do you understand what I just read to you? >> Okay. Do you still wish to continue speaking with me? >> Uh, where are you coming from? >> Indians. >> Indian rocks. Where are you going to? >> Where's home at? >> Okay. Um, without looking at any street signs, what street were you driving on when you got pulled up already? >> Do you know what the name of the street is without looking at any street signs? >> Do you know what direction you were traveling? Norths, east, west? >> I don't know about that, but I was coming home to >> That's okay. Have you had anything to drink today? >> No. >> Is there any other reason why I would be smelling alcohol coming off your breath? >> I don't know, cuz I didn't drink anything today. Uh, have you been smoking one today? >> When did you last eat? >> Um, last night. >> What time? >> 7. You didn't have anything for breakfast at all this morning? >> No. >> Okay. What did you have to eat last night? >> Um, some chicken. >> Chicken. >> When did you last sleep? to sleep. >> Mhm. >> Last night, but I woke up around 2:00. >> Okay. What time do you think he got to sleep last night? >> 10:30. >> 10:30. >> Had a little bit of sleep, but I whatever reason. >> The father's presence appeared to be a minor distraction. >> He's going to see if he can get his sister and her boyfriend or husband or whatever. >> They're not together anymore. >> I don't know. I'm >> assuming cuz she did not seem happy he was here and she couldn't even focus on Kayla giving her the instructions. She was just evil eyeing him the whole time and she's like, "What's she doing here? He's just going to take off with the kids, isn't he?" >> They still live together. She said she lives at that edge. Yes. I mean, I'm sure they're going through their He said she's doesn't supposed to be driving. He's like, "I don't know why she's even driving." But the kids say she drives all the time. She has all kinds of jobs she does. >> Like she's going to say, >> "Is she still has a prior DUI but has never had a license? Is she still suspended for the DUI or >> Well, yeah. She had a DUI and two DWLSRs. So, >> so she's still >> Yeah. Yeah. Oh, yeah. Her license was revoked, I think, since, let me check. I think it's I think it's 2018. >> In your opinion, do you feel like you're under the influence of alcohol or >> No. >> All right, Mr. Christina, do me a favor. >> Yep. Based off my observations, I do believe that you're under the influence. I don't know if it's necessarily alcohol or something else, but something's definitely in your system that's impairing you enough where you shouldn't be driving. What I'm going to have you do, because I don't want your kids to be able to look and see, we're going to step back by my cruiser so we don't have to have them see. Okay. >> All right. I just heard you before you get in the back of my car. Do you have anything on you that's going to hurt me? Stick me, poke me, and like that. >> I got nothing. Let me just move this real quick. Step on that. All right. Go ahead and slide in there for me. All right. Just give me a second. We're about to go down to the jail. I'm going to ask you for a breath test down there. It's up to you whether you want to give one or not. And we'll I'll read you the the implications of that. Okay.
