Sir, there's nothing in here. Please, can I take my medicine? My chest hurts. Can I use the bathroom, please? I I'M FEELING SICK. >> [screaming] >> YOU'VE HEARD ME SAY THIS BEFORE AND I'LL SAY IT AGAIN. WHEN IT COMES to road rage, the best rule is never ever do it. But if you do decide to do it, pulling out a gun is the worst decision that you can possibly make because if you do, you're going to get caught by the police and you're going to end up in the back of a police car and heading straight to jail. This is one of those. >> 49-42, you can take Roosevelt to see if you can find him. I'll be 30 West. >> If you can take Roosevelt, I'm at the habit temple. >> Okay, I want to talk about these in-progress type calls where an officer rolls code. When you hear lights and siren, everyone knows that you should pull to the right side of the road and give the officer the lane. It gets confusing, I get it. When I hear sirens, sometimes I don't know the direction they come from. It's really interesting to observe what people end up doing when an officer is rolling code because there's a lot of things that the officer has to think about while en route cuz things change, directions change, getting more description of the suspect, important stuff. [music] >> All of this is decent and he definitely believes he's got a firearm on him. >> 42 letter up, did we ever get a 28 on the suspect? >> Code run looks really really clean. In policing, we have a saying, you can't assist if you don't arrive. That's why a reckless code run is indefinitely not helpful to anyone involved. That's why I love when I see these clean code runs. >> Callen's going to take the 65th exit and wait for a trooper. >> So now you see he shut down here and he's now stopping at the red lights and stuff. So he may be in the area of where the suspect is in this road rage situation with the firearm. It's interesting of when you think about when you're going to shut down cuz you don't want to alert the suspect. And it's good that he did this and that he has the presence of mind and high police IQ to know that we don't want to alert the suspect potentially and we can just take our time at this point and listen. >> 49 litter out. Can I give you anything identifiable about this Honda? Have a black door, white bumper. Hood's brown in color. >> It's four-door, all white car, Honda, possibly Civic. >> 10-4, we'll be out with that vehicle description. We'll be at the gas station. Right up the road from 10-4. 10-4. >> Show me your hands. Hands. >> 42, I'll be in route to the >> SHOW ME YOUR HANDS. >> 10-4. 10-4. >> Keep your hands up. Keep your hands up. Come out of the car. Come out of the car. >> This is very peculiar because he rolled code to the scene, the suspect potentially had a firearm and he goes head-on and then I looked and the officer did not have his firearm on him when normal process would have been to come in behind, felony car stop position, on gun if we think the person has a gun. Uh there may be another reason, I don't know, but he definitely didn't have his firearm drawn and he's head-on with the suspect, which is not the normal practice. >> Keep your hands up in the air. Come out of the car. Get out of the car. Get out of the car. Do it now. >> Okay, it's hard to see but I think that he told the suspect to put the hands up in the air and the trooper is standing to the left side of the screen. >> 49 litter out. Can you give a description of the male driver? >> That alert tone, emergency traffic only in most jurisdictions, I believe it's the same in Arkansas. >> Can you give a description of the individual? Was it a skinny black male? 10-4, was he wearing a black toboggan? Gold chain. All black. Can you give me that individual's description? Calling all cars, be on the lookout 10-4. >> Hey, check it out, man. The reason I'm I'm up on you is because we got a call of road rage Describing this vehicle, okay? >> It's a white Honda, white Civic. Okay, well, they specifically described this vehicle, same model, same color, one male one male driver. Black male. I mentioned this that I've seen this positioning of the Arkansas State Troopers. I believe that this probably is a position that they train in cuz I've seen many of them in that position. So, I'm going to be pretty sure that they train in that position. I would I'd like to mention something. When the Trooper was standing back here but as he was approaching the vehicle and he had the suspect with his hands up here, how quickly does it go to where a person could potentially be talking to the Trooper in this quickly? I'm not even going fast. And this is not a real firearm. This is just a plastic little training firearm that I keep for different training reasons. And can the Trooper engage the person that quickly? I didn't even go fast. Hands up. Okay, you're you're good. We're going to figure it out. It's not a big deal. You You having weapons in the vehicle? You don't have a gun at all in here? Okay. Okay, where is the gun at? Okay. Okay, it's no big deal, dude. Check it out. Where is the gun at? Okay, cool. I don't know if you caught that, but he first said no, there's no firearm and now he's saying yes, there is a firearm in the glove box. >> Hey, get out of the car now. Get out of the car now. Because I told you to. Get out of the car. Do it now. >> Told you to get out of THE CAR. GET OUT. THEY TRYING TO KILL ME, JAY. I DIDN'T DO I DIDN'T DO NOTHING. JAY, I don't I don't have nothing. >> You're good. You're good. >> What am I doing? >> You lost your mind? >> I DO I HAVE NOTHING. I'M AT THE GAS station by your house right now. Your old apartment. Get here now. Hurry up, JAY. JAY, I'M AT THE GAS STATION. LET ME SEND location to her, please. Please, y'all send my location to her. Y'all send my location to MY KIDS. JAY. JAY, I'M AT THE I DON'T THEY I YOU DON'T HAVE THE RIGHT TO DO NOTHING. >> HEY, you're being detained right now, dude. Chill out. >> Okay. >> In custody. Some interesting things. The one trooper never ever drew his firearm, which is an interesting choice. His choice. It's not my position to tell him whether to have his firearm or not. My position of watching it, I know that if it's a felony car stop type situation where there's a firearm, you're going to get a lot of cops are going to say they would have drawn down on that suspect. Interestingly enough, the backup trooper came up and I chuckle a little bit cuz he fixed his cover and he pulled his firearm out really quickly and drew down on the suspect and it was a really kind of cinematic form that he did it. This is something that I have to mention to people. Do not reach for your phone if you're being given commands by an officer to get out of the car. Don't reach for anything. You think that it's the benign phone that you're grabbing. To an officer, it looks like a dark object that can be anything. People have been shot with phones, with wallets, and lots of other things. Show your hands and follow the commands. Don't reach for your phone. >> Put your phone down. >> Okay, let me send my location to her. My kids, bro. >> I'll tell her where you're at. >> My kids I got here, bro. I just got out of the hospital. You can look in the car. I just got out of the hospital. Okay? >> Thank you for your honesty, dude. >> Man, give me my phone, man. >> You're not under arrest right now. You're detained. We're investigating a crime. Do you understand that? >> How could it be a crime? I didn't do nothing. Am I going to jail? >> Not at this moment. >> I don't have nothing on me. I have a little a little bit of weed in my like a half of a gram, bro. They got his name written on it. It's my girlfriend's name, bro. I know it's not mine. It's not mine, man. Please, man. Man, please send the location to my my kids' mom. Please. >> I'd I'd to cover what I mentioned earlier in the video was about the felony car stop. So, there's a misdemeanor car stop and a felony car stop. And a misdemeanor car stop is the general reason you have nothing else to think of except for the fact that they committed a misdemeanor and that's the only reason that you're stopping or traffic violation. Traffic violations, you do a misdemeanor car stop. If it's a felony or in progress type thing for most officers, most situations, it's a felony car stop. It's conducted from a different distance, a different positioning, and I don't have to go into details of that. And there's a hybrid because sometimes the position or the situation dictates that you have to do a hybrid of the two. The head-on situation or the front-to-front situation is extraordinarily dangerous because you could end up having to go gun-to-gun. But sometimes it dictates that you have to do that and that may have been the reason why the trooper pulled in this way. I can't tell if he couldn't have pulled in from behind, but that's the more tactically advantageous position. Misdemeanor, felony, and the hybrid. >> That's it. That's all I want. I just want to know I'm okay. >> Okay, dude. I don't know what's going on. You're fine, dude. Are you hurt right now? >> Yes, I have hemorrhoids. >> Have I hurt you? Have I done anything >> I have hemorrhoids and everything. >> to make you think that you're going to get hurt? >> I see that. I just got out of the hospital. Literally just got out of the hospital. Am I going to jail? >> You are not as of right now. We have to investigate this first and I'll let you know. >> Mike, Mike, put him in your car so I can call her. >> Yeah. Can I just get my phone? That's it. >> That's right over here. >> That's my right, ain't it? >> What do you have on you? >> I don't have anything. I don't have anything. I don't have anything, sir. >> Well, when we give you a lawful order order to >> I followed it. I followed it. I followed it. I was trying to I was just trying to get my location. >> I had to open the door and pull you and point you and hold you at gunpoint. >> You're right. You're I'm just scared, so >> You should have just got out. >> I'm scared. >> You know what that's called? Obstructing governmental operations. >> What am I supposed to do? >> And that's an arrestable offense. >> So, I'm being arrested on that? Sir, there's nothing in here. Please, can I take my medicine? My ass is hurting. >> No, I can't. >> Please, my ass is hurting. I just got out of the hospital. Sir, you can look at the man in the in the car. >> I don't care where you came from. What's that have to do with anything? >> I just literally got out the hospital. Literally. The car is clean. There's nothing nothing No I don't have nothing. >> Do you have any weapons in there? >> It's her It's my girlfriend's the person stuff that car it is. I I There was no right to search. There was no right Nobody did nothing. I didn't do nothing. I'm not trying to be I'm not trying to just It's a lie. It's a You know what? You I'm going to just be quiet. I'm going to be quiet. >> Sir, are there any weapons in there? You said your girlfriend's What is it? Come on, let's go. >> Can I use the bathroom, please? I I'm feeling sick. I'm about to use the bathroom on myself. >> Sit down. >> Am I going to jail? >> Get down. >> Am I going to jail? I didn't do nothing. There's no way I should be detained. >> Get your feet down. >> I'm being I'm being to understand it. >> down. >> You don't have a right to do this, sir. >> Get down. >> I don't want to GET IN THE CAR. I I HAVE A IN MY BAG. I If you do, I promise >> I don't care what you do. >> The police just bust my window. THIS WILL BE >> [screaming] >> HELP! HELP! HELP! HELP! HELP! >> [screaming] >> HELP! HELP! >> THIS SOUNDS LIKE crisis acting to try to create a narrative for witnesses to make the officers look bad. This happens frequently. It's not fun to deal with. And it's also really incredibly challenging to put a non-compliant resistant person into a car by yourself. It seems like it might be easy. There's a lot of things a person can spit, they can kick. You got to get partially inside of the vehicle as well. >> Help! I got a in my bag, man. Please, man. so bad, please, sir. Yeah. Yeah. bad, please. I don't want to go, man. I have hemorrhoids. I can't sit down. I can't eat. I'm I'm going to like can't. I was just sitting on my jacket. I'm not lying, bro. >> the car. >> I'm not lying, sir, please. I'm not lying. Man, can you please call my kids' mom? Please. Please, man. I'm sorry. I just got out the hospital, sir. I can't. I can't. >> Quit resisting. >> My ass hurt. My ass is hurting so bad. Please. >> Get in the car. >> MY ASS HURT. [screaming] GOD, I SWEAR I'M NOT LYING. >> Get in the car. >> I'm not lying. >> Get in the car. >> Sir, I'm not lying. I'M NOT LYING. >> NOW. SIT DOWN. >> ARE YOU GOING TO LOCK ME UP FOR RESISTING? I don't want to be I JUST I JUST DON'T WANT TO BE MY ASS [screaming] OH, MY ASS. OH, MY ASS HURTS. OH, MY ASS HURTS. I can't breathe. It's tight. You have my money. >> And look how quickly they come. >> Sir, can you roll the crack in the window, please? And can I have my Sprite? That's all I ask. I won't say nothing else. I promise I won't say nothing. May I just have something to drink, sir? My ass is killing me, sir. I I just got out the hospital. I swear on my name, bro. That The gun, you can It's clean. That's my my girlfriend's on name. I don't know I don't know I don't >> Where's the gun at? >> Huh? >> Where's it at? >> Did I do something for it to be searched? >> You're under arrest. >> For what? >> Obstructing governmental operations. >> What is that? >> I already told you. >> I'm saying what is the felony? What is the felony? >> Who said it was a felony? >> I'm saying what is it? Like what is what is it? What is it for? Like what I'm saying like what class is it for? I just want to know what I'm getting I'm willing to I'll cooperate. I'll do whatever you say. I'll do whatever you say. I just need my phone so that my so I can sell my phone when I when my girlfriend get here. I can give it I can give my phone as collateral to get out so she can sell it. That's it. That's all I want. >> What's your last name? >> My name is Markevion Jackson. M A R K E E V I O N. I'll I'll do anything you want, sir. I'll do whatever. I promise. >> Spell your first name one more time. >> M A Can and can have my drink? I'm My mouth is so dry, sir. I promise. >> Your first name? >> to wet my mouth, please. I'm getting bored. Please, I don't I I don't want any issues, sir. I take the I take whatever you want to charge me with. Like I said, the gun is in my girlfriend's name. It's my girlfriend's car. I literally just dropped my children off. Whatever wrong I did, I I accept. I don't know what's going on. I don't know what what happened. I really don't know what happened. Could you tell me what happened, sir? I don't even know what I was being stopped for. I didn't I what I wasn't stopped. I was just I don't know what I was being held for. I'm just curious. I I don't want to get on your nerves or nothing, sir. I I'm sorry. But I I do ask, please. >> What did that other trooper tell you when he first came up to you? >> He didn't tell me nothing. He just told He just told me to He pulled up. And it stopped It just shocked me. >> He didn't tell you anything? >> No, sir. He didn't tell me it was an investigation. I didn't know what was What I didn't do it. I literally just dropped my children off. Like literally, you can read the messages in my phone. Like literally, read the messages. Like literally, I just dropped them off, sir. Less than like 10 minutes ago. But like I said, for the obstruction, I'll take that. I don't know I was just scared. You wouldn't know. Take whatever punishment you You know what I'm saying? I accept it. I accept I really do. If you would just talk to me like I don't want to be treated like I'm not like I did nothing. Can I have my pain medicine, too, please? Please, please. >> Not right now. >> I have to go to the bathroom. Like my cleaning and everything is in my backpack. Please, I literally just got out I'm like It's probably bad like right now. I promise you. I'm not. I could show you, sir. Where you can look. >> So, he's mentioning that he was recently in the rear. It might be And he's saying that he has some kind of other issue where he might end up pooping inside the officer's vehicle. Looking at these seats, that causes a biohazard, and it's different in every jurisdiction on how those are cleaned. But if that [music] vehicle ends up with blood and defecate inside of the seat, that vehicle could end up out of service. In a lot of jurisdictions, I know that that ends up happening until it's clean cuz you can't put someone else back there until that's done. And if you know in your jurisdiction how that's handled, please share. I've asked this in another video before because I just find these kinds of things of learning really interesting and other people can find it in the comments and maybe adjust something in their jurisdiction to be better. So, this is a very interesting learning point. We're going to talk Miranda and attorneys and anyone who has a legal background, please chime in. In my opinion, it's best if it's read off of a department-issued card so you get it right every single time. Second, you must get a definitive yes or no. A head shake or nod is not sufficient. It needs to be a verbal yes or no. And then the officer should act accordingly. From what I believe that I heard the trooper say was something like after he finished stating Miranda cuz it didn't sound like he read it off of a card was that he said, "So, now you want to talk to me so we can figure things out." I don't know that hitching that onto the end of Miranda is necessarily a good idea and there may be a reason why he hitched that onto the end. In my training experience, a lot of times it's best to just get your definitive yes or no and then figure out what you're going to do from there. The other thing is the suspect starts asking for medication, sometimes they'll ask for water. You have to be very careful that we're not bartering a yes for medication or water. Everything must be distinct and clear. Your Miranda is Miranda, get your definitive yes or no and then everything else after that. Please share if you have any understanding as to why it was done this way, or if you have an even better way, or why you would do it a certain way. This is a great learning opportunity, and I would love to learn some other tools that make Miranda even more effective. >> What did I do? >> Well, you tell me. Why would we be here at this gas station with you? >> I don't know why you guys called. >> I really don't I'm clear, man. I literally just dropped my children off. You can read my >> Where did you drop your children off? >> My kids' mom's house. >> Where is that located? >> It's on Peach Road. >> Say on Peach Road. Peach Road. >> Peach Road. >> Uh give me a like a exit off of the state 630. >> I use GPS. I don't I'm not from I'm from out of the park right there. >> Okay. We'll check it out, man. So, somebody called in and said that you were pointing a gun at them. They described your car. They've identified your car 100%. You have a gun in your car. >> Okay, they described a black handgun, blue things hanging hanging from the mirror. Your car to a T. >> Okay, what what the heck I did not I did not do that. I apologize. I didn't I didn't say that I had a gun and I didn't do that, though. >> But did you have the gun out waving it around at them? >> I didn't I didn't do that. >> You have it out of the glove box at all? >> No, sir. >> So, there's two things whenever you watch these, two things you should look for. Probable cause, the facts and circumstances that would warrant a prudent man into believing a crime had been committed and that the accused committed it. Those are the basic definition of probable cause. It changes here and there a little bit. And then looking for the elements to the crime. So, I have this crime, check off boxes as far as if those things occurred. That's what's occurring here. Do I have a PC? Are the elements there for the specific crime? Every time you watch one of these videos, look to see that that is what occurs. >> Tell us what did happen, then. >> I don't know what happened, sir. I I literally when I got out of the car Well, I didn't get Like I said, I got out of the car, I dropped my kids off. My kids have my medicine to drink, please. My mouth >> Tell us about the road rage. If you didn't wave the gun around at them, then what did happen? >> I I don't know, sir. All I remember is a a car pulled up, a gray car pulled up. They kept driving, and the next scene, I don't I don't remember anything. I don't remember doing any road rage. >> What do you mean they pulled up? Did they try to hit you or what? >> No, sir. They swerved over in front of me. You heard me? Like >> Like cut you off? >> Basically. >> I do whatever I take whatever y'all want to throw on me and say that I did. I mean, I don't know. >> It didn't get >> I'm not saying it like that. I'm saying I'm saying >> Don't say it like that, dude. >> Well, that's stupid. That's not I didn't do that. >> I did I understand you. I'm not a liar, bro. I I told you everything. I didn't lie about the gun. I didn't lie about the gun. >> To me, it looks like they've got the elements and it looks like they've developed their PC really well. The Miranda, I can't really see how that went down, but again, I just wanted to make sure that Miranda is fortified for the viewers when they watch this. The charges are here. Again, this is not an official document, so please take it with the fact that I'm letting you know that this is from the original video. He had a misdemeanor warrant, aggravated assault, which would have been displaying, I guess, of the firearm and possession of firearm by certain persons, which is very often a person who's convicted of a felony, driving while license canceled, suspended, or revoked, obstructing governmental operation, which we heard the other trooper mention, and possession of controlled substance, which the officers or troopers must have located inside the vehicle. Obviously, innocent unless proven guilty. I really enjoy sharing these kinds of things, and especially if it's something that can provide education and safety. And I want to shout out a group of people right now, and it's the people that when they hear lights and sirens, do the right thing and pull to the right side of the road. We all have seen someone who thinks that getting behind an ambulance helps them speed to their next location that they're going to. Those people would almost always get a ticket from me because emergency lights and sirens are for a reason. Pull to the right side of the road. Make it safe for everyone else. So, shout out to the people that abide by that rule and regulation. This is a good video to learn from. Share it in the briefing. Again, shout out to the sergeants who showed these in briefings, and the officers who showed them in briefings. Hopefully, this young man makes better decisions going forward. Road rage is never worth it. If you like this kind of content, like the video, subscribe to the channel, and click on the video that's on your screen for more content just like this.
