What are you doing, man? Why are you being so rough with me? >> Chill, I'll get you in the car. Why don't you relax? >> I know, you just got to be a tough guy cuz you got me in handcuffs. You think they gave you some title and you think you're king. >> Well, why don't you call the jail? >> The sovereign contagion has weaseled its way into nearly every facet of society. Sadly, people can just be at their business relaxing and their business gets hit by a vehicle and they encounter a sovereign. If that sovereign is so headstrong that when the police arrive, they're willing to play the sovereign game and not identify, they're going to jail and hopefully you get reimbursed for the damage to your building. This is one of those. >> What's going on? >> Do you have a valid driver's license or identification? So, if you cannot identify yourself, you'll be going to jail. >> I'm going to jail? You're going to kidnap me? What crime did I commit? >> Right now, we are here to identify you. >> So, what do you need my ID for? What is the crime I committed? >> Because you were involved in an accident. I'm not saying you committed a crime right now. But, because you're >> Why are you shaking, man? Are you all right? Are you nervous? >> No. >> You're shaking. That makes me kind of nervous, man. You're over there with all these guns and [ __ ] all suited up and you're the one shaking. Are you all right, man? You see what's going on here? You see him shaking? >> Yep. >> Are you all right? Do you Do you need medical attention? >> No, I'm What I want right now is for you to identify yourself. >> That's what you want. That's nice. You can call anything you want, you're not going to get it. >> That's me dressed up police shaking. There's a lot of reasons an officer can shake. In my 20 years, there were times that my hand shake. It could be just straight adrenaline. It could be a too much caffeine. It could be muscle fatigue because you had your hands holding on to something. But, the one thing I'm not going to do is engage a person back and forth as to why my hand might be shaking for whatever reason. You just take care of business. So, it's not uncommon. It happens. I just gave you three of a multitude of reasons why an officer's hand could be shaking. But, I'm not going to engage a person back and forth with why my hand might be shaking. >> Get out of the car. >> with that man right there. >> Put your hands up on the car. >> I I said hey, maybe >> Put your hands up on the car. >> Okay, and I worked out with him that I will cover the damages. That has nothing to do with you. Nothing to do with you. >> to do a report. >> Do your report. That's lovely. >> So, you've heard the ask, tell, make model of policing. You ask a person to do something, they don't do it, you tell them to do it, they don't do it, you make them do it. This person is an ideal ask, tell, make person. I told you before that I've trained in the academy, I was a field training officer, and this would be a person that I would say this is an ask, tell, make person because the verbal interaction with the person is telling you that they're a no to a maybe person at best. >> Hands up. >> At this point, I wish to remain secure in my person, papers, and effects. Sir, I will charge you with assault and kidnapping. Not resisting. Why are you both up on me? >> He's not on you. He's holding your arm. >> I do not wish for this to happen, gentlemen. >> You were given a lawful order. >> No, that's not an order. Yeah, dude, my wrist is backwards. Come on, man. >> It's not backwards. It's on right. >> Come on. >> It's supposed to be like this so you can't >> So, I'm supposed to be like this and like break my wrist? Come on. >> It's not broke. >> No, but you're going to go try and sit me down in the back of your car like that? You want me to break my wrist when I sit down? >> going to break when you sit down. >> The guy was actually correct. The way that his hand was handcuffed inside of the handcuff was not the proper handcuffing position, and it would have potentially caused him damage. That's why you saw the officer fix it. Very good job. It happens sometimes when a person is somewhat non-compliant, you can put them on the wrong way. If a person asks to have their handcuffs checked, best practice, check the handcuffs, make them right, check for tightness, double lock, policy in nearly every department. Now, for people who say handcuffs weren't made for comfort, I've said it before, I know it, and police shouldn't be doing people saying that anyway because I'm going to tell you why. There's a case I'd like you to look up, Grouse versus LAPD. A surgeon was arrested, he said the handcuffs were too tight, I believe the handcuffs weren't checked, he said that it caused nerve damage. $33 million settlement. As long as my arm is are the number of times police departments have been sued for handcuffs that were considered to be too tight and they looked and found out that the officers could have readjusted the handcuffs. As a sergeant, I would get that complaint frequently. So, from law enforcement professional, if someone wants to have their handcuffs checked, check them because it can cause you liability issue. And then the other one is life. Make sure they're right so they don't slip out and do something to you, but also your liability. No one wants to get sued. So, this was good. The officer realized the cuff could have been put on differently. You adjust the cuffs. The officers LAPD is probably the highest one, but there are several. As long as my arm number lawsuits. >> Look at this. Am I even resisting? Is there a need for this or is it just so that you guys can feel better >> Oh, yeah. Real good. [ __ ] this off. >> Yeah, you too, huh? You know, there's real crime in this city. There's like murderers >> There is like failure to identify yourself when you're involved in an accident. >> What law did I break by failure to identify? Let me see. Is South Dakota a stop and ID state? >> We're No, it's not a stop and ID. You're involved in an accident. >> Woah, woah, woah. Show me show me what law you're saying I'm breaking. You're over here throwing me in a car. >> The challenge with a lot of sovereigns and a lot of people who listen to this ideology is they feel like the initial infraction was a civil infraction that if the police get involved that they don't have to identify themselves. But there's an interesting connection between where this occurred where it was an accident and the initial thought why the officers responded was that the person did not it was a hit-and-run type of situation. Therefore, the officers were attempting to do a traffic accident report. So, they had to identify him. So, there was a link and a bridge and that's the officer's perspective of this thing. The failure to identify is going to cause an issue and some people are just so headstrong but dead wrong that they're willing to go to jail for it. It's wild. >> Any knives on you besides this one? >> I have all kinds of stuff on my pockets that you are not afraid to touch, sir. That is my property. >> Exactly and you're under arrest. Any other knives? >> I'm sure I got plenty on me. See you later. New Enfield. >> All right, have a seat. >> What are you doing with my property? >> Your property is in the front seat right next to where you're going to be. >> Now you can see this guy is completely overcomplicating a situation that doesn't need to be this difficult. Just like how Medicare companies seem to overcomplicate things for [music] potentially millions of people each year, which is exactly why Chapter was created. You see, trying to navigate Medicare can be very overwhelming. And because of that, many seniors end up choosing plans that don't align with what they actually need. But Chapter solves that by connecting you with independent salary-based advisors who compare every plan that's available to you. The call to them is completely free. It takes about 20 minutes. And if you're [music] already on the right plan, they'll tell you that. Plus, on average, they've saved seniors around $1,100 per year. So, call Chapter today at 844-533-6078. And again, that's 844-533-6078. And the call won't cost you anything. >> Well, it might behoove you to know that there's another small knife in my right pocket. And I really No, you are not allowed to reach into my pocket. Untake the cuffs off and I'll get it my [ __ ] self. >> It's in your front pocket. You can't reach it anyway. Get in. >> Do not [ __ ] touch me. Oh, you can't just take the cuffs off, though, huh? >> During the search, the guy tells the officer, "I have another knife, a small one in my front pocket." The officer says, "Well, if it's in your front pocket, you can't reach it." And the guy ends up reaching around and pulling out a knife. And the knife was about this size. And this is a handcuff key. Best practice, remove all of that stuff from the pocket, things that could potentially cause you safety challenges going forward. >> All right, have a seat. >> I'd rather not. >> I don't care what you I'd it. the car. >> What is your name? >> Sergeant Newenfeld. >> Newenfeld and Weber. What is your first name? >> Rob. >> Rob Newenfeld and what Weber? >> Zack. >> Zack Weber. >> This is against my will. How the [ __ ] does someone fit back here, really? >> Not very good. >> So, Hussein used to cook at Perkins. Big negative guy. His mom's not going to go came and I was like, "What's going on?" She said, "Someone just hit your building and then drove away." I was like, "Well, did you see where they went?" Yeah, they backed in and drove by the um whatever you call it, restaurant. I was like, "Okay." So, she sent me a something to order already. She sends it and I said, "Do you have a picture?" She was like, "Yeah." So, she sends me that from the apartment they live in. >> Okay. >> So, I walk over there and I'm looking around the truck and she's walking back up. She said, "If I need to test, well, test what I know what's right, what's wrong, what's wrong." I was like, "Okay." Um and she goes, "Oh, I saw the license plate." She goes, "Oh, it's on the dash." So, I took a picture of the license plate on the dash. So, there's no plates anywhere else on the truck. And as I sit there, the lady in the other car said, "Can I help you?" I'm like, "Is this yours or do you know whose this is?" "It's my husband's. Why?" So, he hit my building. I said, "It's not a big deal. He just hit it. Just want to figure out what's going on." Uh well, let me back up. Right away she said, "We didn't He didn't do that. He's been here forever." I wondered it happened to someone like 10 15 minutes ago. I said, "He's in the office." "He's been here for a long time, but that truck hasn't moved." So, I called Weber so I said, "Hey, somebody hit my vehicle or office. They're claiming it didn't happen." It's easier to just get a police report cuz if I try to do insurance, they don't want to do it. So, he comes out. Right away Yeah, sorry. If I did it, I don't know if I did or didn't, but if I did it, I'll I'll just fix it, take care of it. I'm like, "I've been on it. Just put it on a year ago." I had him come back over and figure out what's it's take to patch it. It's not going to be over a long time. There's a reason we put that break in there for reasons like this. If we can't We're going to cut it all out and blend it better. Well, and he's like, "Yeah, no problem. Whatever." And I said, "Hey, all that Zach is I just called the cops in case they're turning into insurance. I need to push them over." And then you took over. You got a boyfriend right away. >> So, you didn't make no deal with him that he's going to pay for it? >> I said I would have Han come look at it and we can figure out cuz I gave him my number. Okay. I said we'll figure out what it's going to take to fix it. I said, "But I don't know." He was, "I'll fix it, man. I'm going to have Dan fix it." I said, "If you're You're going to fix it or you're going to pay to fix it, we're good. But I don't" And then you pulled in and then you got a boyfriend. >> So, he didn't identify himself to you yet, either? >> Well, he said his first name, but I didn't catch it. He kind of mumbled through it. But that's his wife. She identified herself to me as his wife. She said, "That's my husband's pickup." He said he just got it. He didn't deny doing it. He said, "I just got this and I It's a big old truck I'm not used to driving. I ran my light off." I'm like, "Well, I have a picture of you against it." Uh Hussein. What's the the old cook from Fajita's about the stone eating guy? Big dude. Oh. You know who I'm talking It's not Hussein. It's >> Hazen? >> Hazen. >> Oh, Hazen K >> His mom came over. She's the one that took the picture and saw that. She was I was outside having a cigarette saw the whole thing. So, >> So, I'll tell you about these private property accidents where people say, "Let's work it out amongst ourselves." I've said this in another video. It is best to go official with it because people flip on you so quickly if you say, "Okay, we'll take care I'll take care of I'll take care of it." Wrong phone number, you never hear from them again, they blame you. Go official. It is the best practice. >> So, that's his wife that's in the >> That's what she told me. That's my husband's truck. >> The one that's in the driver's seat of the white car? >> Yeah, she said that's my husband's truck cuz she went inside get it. >> Okay. >> Here's what she told me. He said his first name, but it >> [bell] >> mumbled through it. I don't know if you have a What are the end of the plates that are on the windshield? >> I don't know. I can check here, but They're possibly expired. Well, if he just bought it, they might not even be to him. >> Yeah, maybe not. Cuz I was walking around trying to get a plate, so we started a picture in case it left. She's going to tell me there's no way he did it. That truck's been parked here for a long time. >> So >> So she just told me he hit it. >> Yeah. >> And she's like, "I don't want to create problems, but if she was right, she's right. Wrong's wrong. If I need to testify, I'll testify." Watch the whole thing. He's outside having a smoke. >> Yeah. So he hit it and then >> backed over there and went in the restaurant. >> Okay. >> He's claiming he didn't know if he hit it or not. I didn't think he hit it. That's what he told me. I said, "I called him. I said I didn't know if I could figure out whose truck it was or even if it was here at the time, so figured just in case for insurance purposes, I needed to write a report." >> Uh-huh. Orange right there. >> Possibly check out the air there. If he goes down really, he overheats really fast. >> I cranked the air when I turned it off. >> He said he was really hot. >> All right. Step out. So, Frank said he had You dropped something? >> Yeah, my phone. >> Here, I got it for you. So, the statute that you need to identify yourself for is you hit the building. >> the law? >> Yes. >> Is that a statute or >> South Dakota state codified law is a statute. It's not law. >> It says codified law. I know. >> What sovereign writ that law? >> Huh? >> What sovereign writ that law? >> State of South Dakota is not sovereign. >> I know. It's a state. That's where you're at. >> No, I'm in a state of bliss. I'm in a state of being. I'm in a natural state. >> All right. So. >> I am not in the state of South Dakota. I am on the land of South Da- >> to the judge. All right. I don't need to hear what you're going to explain to the judge. >> Well, you guys are going to release me and stop wasting my time or I'm going to charge you for my time. >> Yep, you tried that once already. Didn't work so well, did it? >> Oh, you think I tried that? >> Yes, because I know who you are. >> Oh, okay. >> This is more sovereign nonsense. The circle talk, the word salads, it doesn't work. >> Let's see how that goes. >> You can identify yourself. >> Are you guys going to keep running your extortion racket because I've worked out with that man that I will compensate you in all damages. >> And I don't need no third-party interlopers interfering in my affairs. >> said you didn't identify yourself. >> I identified myself to him. >> Not according to him. >> Okay. Then he can go to court and we'll have this conversation in court. But I have nothing to do with you two clowns. >> Yep. You're going to get a safety for leaving the scene of an accident. >> Oh, I left while I was here the whole time? >> Did you? >> What was I not doing? >> go in the Did you go in the building and tell him that you hit the building? >> I didn't know I hit the building, sir. >> Okay. So now we're going to come out here and told you that you did. >> Yeah, actually someone else came in there and told me that I did. And then I came And then I came running right out as soon as I was told that I hit someone's building and I came out to see what was going on and I told the man, "Hey, if it was me, I'm sorry. I [ __ ] up. I will gladly fix it. What is it going to cost?" I can fix it myself or if you want to hire your guy to fix it, that's fine. I have no problem compensating damages of anything I've done wrong. I do have a problem with road pirates sitting here trying to extort me and waste my time. >> So, the road pirate, all of the other stuff about they'll take care of it on their own. But, let's just think about this for a second. Is it possible that he hit that building with that big truck and didn't know it? And then when he was notified, he went back. It's possible. However, his behavior right here is causing this entire issue. Cuz it could have been resolved when the officers got there. Had he just been a responsible adult and provided his information. But, some people want to prove a point and it looks like his point is not being proven except for him heading to jail. >> So, what you want to do? I'd love to be left alone to go about my day. >> going to be left alone as soon as we get done with the crash report. >> Then, why are you wasting my time? >> I'm not wasting your time. You're wasting my time cuz you won't give us your name so we can write it in the report and get this over with and get you on your way. >> My name is none of your [ __ ] business. >> It is. It needs to go in the accident report. It needs to be given to the victim. >> Okay, I'll go talk to that. >> Victim. Now, you think only government can solve problems. Your daddy didn't teach you right. He didn't know that your daddy never taught you that two men could go talk to each other. >> dead. >> Yeah. >> Don't ever talk about my >> he was here, he didn't teach you right, did he? He didn't teach you that another man He didn't teach you that another man could go talk to another man and solve his problems. You don't need government intervention. >> when I was 1 years old? >> I don't know. >> Exactly. >> But, it's brought you to what you are today. >> No, it isn't. >> So, this guy's being disrespectful to the officer's father who unfortunately passed away and the officer took it to heart. He got upset. There was emotion that was involved. In those kinds of situations, and I've seen it happen before. It's happened to me in my career. When I'm younger, someone says something, sometimes it can get you get get you in your feels a little bit. It's very important in that case for the other officer to engage and let the other officer step back. Sometimes officers make emotional mistakes when they have their emotions leading for them. But, this officer is doing a good job to get himself back in the mode of just being about the whole legal aspect of it, not about the personal aspect of his dad. Condolences to the officer about his dad if he sees this. >> you can continue with him with his investigation or you can go to jail. We don't really It's not up to you. >> citizen. What are you doing, man? Why are you being so rough with me? I don't know why you're being so rough with me. Why are you throwing me around? Chill, I'll get in the car. Why don't you [ __ ] relax? I know, you just got to be a tough guy cuz you got me in handcuffs. You got that uniform on. The state gave you some title and you think you're king. I know, but why don't you calm the [ __ ] down? >> He was willing to go to jail very, very calmly. What else is he willing to do if he feels like his rights are being violated? >> And that is the challenge that exists in the things that we have seen with sovereigns in the past. That's why I take this so incredibly seriously. This is something that has to be addressed. So, it looks like this guy was willing to go to jail for failure to identify when he could have simply just provided his information. They could have [music] done the accident report and looks like they could have had the situation resolved. But again, the sovereign contagion, it is real and it doesn't seem like it's slowing down at all.
