I'm going to >> Are you going to add another charge to stop resistance? >> Please. >> We don't want any cops involved. >> Grown-ups can talk [music] in circles until they're completely drained. Yet, the most trustworthy perspectives often come from those who say very little. >> With all due respect, I don't want to answer any questions while having the lawyer present. >> All right. So, you got that bottle right about there, huh? >> Yeah. >> Before she got in the bath, she broke my dad's phone. When children unintentionally become observers, long explanations begin to lose their impact, and the truth has a way of showing itself when no one expects it. >> Can I have my prescribed medicine, Derek? >> This woman's situation reflects how emotional strain and life pressures can deeply [music] affect an entire family. On September 23rd, 2024, police responded to a home after receiving a report of a serious disagreement between two adults. Upon arrival, they encountered a complicated situation as both individuals took turns sharing their perspectives while the children appeared frightened and overwhelmed. >> Sheriff's office. >> We're in there. >> Okay. >> All right. >> Okay. Can you guys step out for me? Sheriff's office. >> Right here. >> I explain the situation. Defended himself. We have the video evidence. I have marks on me from her. >> Okay. Where's she at? >> She is inside. I have people on the way for them. >> Hello. >> We have videos. Would you like to see my face? What's going on? >> Um, so my fiance is drunk. He came home from the bar. He's been aggressive. Hold on. We were arguing. The kids got in the middle of the altercation. >> I am up. He threw a chair at my face. >> I'm not aggressive. >> He's broke my face, too. I I would have had pictures. >> You guys I'm fine. Cigarette, please. >> Do you guys have any weapons on you? >> All right, sir. Can you go ahead and sit down for me? >> Yeah. >> May I go grab a cigarette? I'm not trying to argue. >> Look, I didn't do nothing. >> Just go ahead and sit down with me. >> I have to feel my key. >> Would you like me to show you everything? >> Do you have your ID on you? >> Yeah. Inside. >> Do you guys need fire rescue or anything? Do you need sir? Do you do you need the ambulance? >> Me? >> Yeah. >> No, I just have a video of anything. >> Kyla videos. >> She's been aggressive all day long. >> My forearms are swollen. There's scratches. I've gotten hit in the stomach multiple times by her. What happened tonight is they started arguing. She's hit him in the face multiple times. I didn't I didn't I tried my best to stay away from her and >> and then she came after him after she came after me and her and it was he had to defend his kids and himself. >> Can you 1066 fire rescue? >> Okay, >> let me go ahead and talk to you first over here on the side. Okay. >> I don't want him arrested. >> Are you guys married? >> We're engaged. He threw my ring tonight. He was at the strip club. >> Go ahead and tell me what happened. >> So, we've been arguing because he was not He We've had altercations since last week and we've had disagreements. He's not strip club. He was at the strip club all day drinking. My friend runs the strip club. She said he wasn't supposed to be driving home. I called him. He drove home. It's just been a fight ever since. >> We've been arguing. I got a chair thrown at me. >> And what what happened today? What started it? >> So, what started it was him being at the strip club. He told me it was he was on the way home. He wasn't on the way home. He was sitting up there drinking. That's been a problem. We were arguing about it. >> Can you stand right here for me? >> Yeah. >> Just so I can keep an eye on both of you guys. >> Yeah. No. The stepmother began with many complaints about her boyfriend, but was unable to provide any proof or recordings to support her statements. This suggests that strong emotions can sometimes make situations harder to understand clearly. >> So, you were arguing? >> Yeah, we were arguing. The kids were getting in the middle of it. Um, I told them to leave us alone while we were arguing. I went and took a shower. We had gotten into an altercation. I took a shower. He broke my phone. In the middle of that, when I went back outside, that's when we were arguing again. I told him I was done with the [ __ ] cuz tired of feeling disrespected. >> Okay, come closer to me. >> All right. Can you come here for me? >> Really, Derek? >> All you do is look at >> just so we can be more private. Um, so it happened. You guys were arguing to the strip club or >> just talk to me. Just talk to me. >> So, does he bite you for a second, please? >> Harley, >> I felt disrespected. >> So, you guys were arguing. I'm trying to see what happened today. Okay. You guys were arguing. You went to go to the bathroom. Nothing happened. >> I was in the shower. Um, no. We were arguing before that. We had some correspondence. I threw a candle. It didn't hit him. I hit the thing. I went and took a timeout. Went and got in the shower. While I was in the shower, he came in there and broke my phone. We got into an altercation. I came out of the shower. I said, "I'm going to call the police if you start." So, then he threw a chair at me. The chair hit me. >> Before she got in the bath, she broke my dad's phone. >> I did. >> Threw it on the ground. >> I did. It's not shattered like mine. >> Actually, yeah, it is. >> So, >> the phone's in my name, >> ma'am. So, you you broke his phone first? Yes. And then he broke your phone. Why did you leave that out? He can't be leaving things out trying to do anything. >> I broke his phone because he's been being He's cheated on me. He's lied. He told me he was going to my best friend. >> Okay. So, you broke his phone cuz you were mad at him. >> Yes. I went and took a shower. >> Went took a shower and then he broke your phone. >> He came in there and shattered my phone. We got into another altercation. >> Okay. >> I went finished my shower. came outside, sat down. I'm sitting there. We get into an argument and I'm like, why did you do this to me? I love you, okay? >> Like, stop disrespecting me. I [clears throat] told you last week I can't do this anymore. And then the chair got thrown at me. And then we got into another altercation and then the police were called, so this is why you're here. >> Do you guys have any kids in common? >> Um, no. >> Do you guys have any video of what happened by any chance? >> Not that I'm aware of. My phone's broken. His is shattered. So today, the first time that he touched you or he hit you. >> Yeah, I was thrown down on the ground and so >> So how were you thrown down on the ground? You're skipping stories. >> It happened so fast. I don't know. >> So you guys were in the bathroom. I see the I see the the and everything. So you guys were in the bathroom cuz I wasn't here. You got to you got to tell me step by step. >> I was in the bathroom literally taking a bath when he shattered my phone. >> So he shattered your phone and then after that you stepped out of the bathroom. Were you in your towel outside? >> I was naked. >> Okay. And did you run outside? >> I was >> How did you guys end up outside? >> I had got back in the tub, finished my shower, came outside. I was trying to take a breather and then he came back. He left for a little bit with the kids and then it started again. He's intoxicated. >> Are you um drinking as well? >> I've had two drinks. I threw two of them on him. I I'm not going to lie to you. >> You threw two of him? >> Yeah, I did. >> Ma'am, there's a lot of there's a lot of partest. [laughter] Yeah, I threw two drinks on him because he was lying and being he told me he told me I was fat. He didn't love me. I was piece of >> All right, ma'am. Every time I hear a new piece of evidence, I have to go back to zero. >> I'm being honest with you. I don't want to put him in jail. >> I need to know every little detail, though. You were in the bathroom. You stepped out because he shattered your phone. >> Correct. >> Okay. Why did you step out? What did you guys do when you stepped out of >> We started arguing. I was like, "What the >> I'm in the tub." >> Did you guys touch each other then or? >> Yes. I pushed him because I was like, "Why are you breaking my phone at this point? I'm in the shower. I'm leaving you alone. I want to leave." >> Okay. >> Her account gradually became inconsistent at times, saying her boyfriend caused the conflict while also stressing that she did not want him to face consequences. >> When you threw his phone first, did he push you at all? Did he touch you? So, he touched you when you threw his phone. So, before him that, did you guys touch each other? Then, did you guys physically each other or anything? Okay. So, he hit you first. How did he hit you? With what hand? How did he hit you? >> He pushed me first. I I don't want to press charges. I do love him. >> Well, it's not it's not about pressing charges at this point, ma'am. It's the fact that we got called out here for a reason. We want to make sure that you guys are all right. You're bleed. Okay. So, I need to make sure that I understand the story. And he pushed you with both hands. Or how did he push you? >> I fell over the table first and then I fell over a chair. >> Okay. So, you were outside of the bath in the middle of bath. Um, I believe so. It happened so fast. >> You were still naked. So, he pushed you over a table or something. And then what did you do after that? How did you react? >> After the altercation, when he shattered my phone, I finished my shower, took a timeout, and went and smoked a cigarette out back. >> So, you didn't push him back when he pushed you first? >> I did when we were arguing, but then I was just like, I'm going to take a time out. I'm going to finish my shower. He left. I was sitting outside. We >> How long did he leave for? 10, 15 minutes and got food with all the kids. >> Yeah, I told him he need to bring my child back. >> How long have you guys been together? >> Um, almost two years. >> Was it your phone first or his phone? >> Um, it was his phone first. I have two phones. He shattered both of them. >> So, he shattered both of them and then you pushed >> I tried to call my girlfriend Ava to see if I could go stay with her. >> Yeah. So, you pushed him >> whenever he grabbed my phone the second time. Yeah. I told him. I was like, I'm trying to leave. And then he threw the chair at my face. >> He threw the chair at your face before you went back into the bathroom. >> This was after this was when it was on the porch instead of it. It was like a 15-minute timeout where I was staying by myself. >> He came back and you were outside. >> I was sitting outside. He said um that I contacted my ex. Didn't contact my ex. I said I contacted Ava. I wanted to leave and he got started getting pissed off. Threw a chair at me. That's when I got the chair to >> So he took he threw two chairs at you. >> I think one or two. I'm not sure. >> Okay. No, cuz you said earlier he >> I know the metal chair hit me in the face. >> Okay. No, I see I see some swelling and stuff. So he threw the chair one time or two times at you. I >> I'm not sure to be honest with you. I don't want to fabricate the situation. >> Yeah. Are you willing to do everything on a sworn statement? I >> I don't want to put him in jail. >> Well, it's not up to you or your sworn statement. It's up to us. So, your swore statement is just basically stating that everything that you're telling me is the truth and the whole truth. >> I do not want him going to jail. I'd rather have a timeout if that's okay. >> You were outside in the back. Did you fall at all? I know you have some grass and stuff on. When did you fall? When you threw the chair or when >> Yeah, when I was trying to get up. >> So, when he threw the chair, when did you fall? >> There were like two incidents. >> Two incidents that you >> Please don't take him to jail. >> Well, like I said, it's not up to you guys. It's We came here for a purpose. They called us. We just want to make sure that you guys are okay. >> I'm fine. >> But you're >> I'm fine. >> So >> Jere, I'm trying not to put on the jail. >> Ma'am, can you can you just talk to me? I don't want to escalate anything. He's still on your side. I just want to make sure that I got the story right. You were on the floor. Did he ever punch you or did you punch him back? >> Not that I'm aware of. >> All right. Um, let me get your best contact information. I don't even have a phone now. So, >> do you have my email? Officers did not have to rely only on adult statements as the children had observed what happened. >> Give me your side of the story. >> Derek was up at the bar cuz that's where he works, right? He does air conditioning, HVAC, everything. He was sitting up there. He had a business offer. He was sitting with one of his buddies. He had two, three beers. He wasn't anything over the legal limit. >> Yeah. >> He was good. Came home. She thought he'd been >> She walked out, shoved him out. >> She came out there, roughing him around. He hit him in the face three or four times. >> Is that the first time that she >> Yes. So she reversed. How did she get him? >> Push your mouth in a chair. >> Yep. And she's thrown glass cuz there's glass all back there. >> All back there. >> And she pushed. So she pushed him. Why did they were arguing verbally? >> Yes. >> And then she pushed him first. Were they outside first? >> They were outside. >> They were outside and then I went out there. So just in case anything happened because like I'm a big guy. I'm big for my age. How old are you? I'm 14. >> Okay. And how old are you? >> 14. >> Okay. The daughter of him? >> Yeah. >> Did you guys see any phones being thrown? >> Yes. >> She walked out there. This was after the third altercation. Third or fourth. She kept hitting him. Dererick walked outside. We left to go get food. We came back. She hit him again and again and again. >> Kept getting in his face. >> He kept getting in his face. >> How does she keep my fist? >> Do you guys have video? >> Uh, she might have one. >> I don't have >> She has videos of her hitting me. She >> She threw a candle and then she was going to hit Derek in the face, so I stuck her arm out and she got in my face. She was screaming at me >> at one point. Did she yell at you? >> Yes. She was in my face 20 minutes ago. She said, "I hope >> don't ever come to me to ever take care of you." >> Stop. >> That's where he That's what you want. >> You want to lie to me? You want to lie about me? >> That's what you want to do. >> Can you send this to my show you. >> I got the mark on my arm. Show you. >> That's where the candle. It's real swollen right here. But see the line? That's from her. I got hit in the stomach two or three times trying to She's thrown five drinks at him. She's thrown wine. She's thrown coke. She's thrown everything. >> In the end, the person who made more accusations was the one found legally responsible. This shows that the decision was based not on emotion, but on the information gathered and concerns about the children's wellbeing. >> Yeah. Can I take my medicine, please? >> Yeah. Give me one second. What we're going to do today is based on our investigation today, you are going to be primary. So, I'm going to explain. >> No, that's going to add another charge. So, stop resisting. >> Stop resisting. I want to pee and I've got your arms. I'm serious. I just put your arms myself and please take my medicine. That is first. >> Let go of it. Look. Open your hand. Open your hand. >> Open your hand. >> Open your hand. >> That is triadone and I just p on myself trying to take my medicine. All right. So, let me double cuff you. Please. Can I please take my Are you serious right now? What? >> Can I have my prescribed medicine, Derek? All right. Before I pretend I got to go to I don't have anything on me. I don't have a bra or underwear on and I just my pants. Can you get closer to the vehicle? Go ahead and widen your stance for me. Put your forehead on. >> You can beat the out of me and it's okay, right? >> Do you have any weapons on you? Okay. Do you guys have anything, bro? Okay, that's okay. They'll provide that in the jail. Okay. So, you're just going to take a round? >> Jared, are you serious right now? Neither did I. YOU BETTER COME GET me out. I swear to you. >> All right, watch your feet. >> Do you have my medicine for tonight that you can give to the jail? >> They're not in a prescription bottle. So, >> I told you my prescription bottle was at the house. I was in the process of taking them when I answered the door. It's trazadone and I think it's called prop propens or something. >> What are you using for? >> I have PTSD because my ex-husband used to get the out of me. There's no way you can call my best friend and have her bomb me out now. Please, I'm asking you nicely so I can go stay with her. >> The bond isn't going to be set until a judge determines that. >> Yeah, I get that. But I'm requesting a bond immediately. I haven't did anything wrong. I I'm sitting here telling you guys what happened. Your right cuff is really tight, too. They're really tight. And I'm not trying to be an aggressor. I just want to go to sleep. This is why I don't call the cops when like this happens. Ma'am, may I get out, please? >> The cuff on the right. >> The cuff on the right side is cutting off my circulation. That is why I'm asking you. I already asked you to loosen that side >> to loosen your clothes >> on the right side. It's cutting off my circulation. >> Let me get another. >> Thank you. Thank you. See, >> is that better? >> It's a little better. >> Am I able to just get checked in, please? >> Mallerie, what's the problem? >> I just want to be checked in so I can call. >> They're getting there. They're getting there. >> I'm not trying to argue. >> No, you're not arguing. You're fine. You're okay. Listen to me. Take a breath. >> All right. I'm sorry. The stepmother was charged with battery, cruelty [music] toward a child, and resisting an officer. Under Florida law, she could face penalties of up to 3 years in prison, and [music] a $3,000 fine. This situation is a reminder that managing emotions, seeking support during stressful times, and keeping a safe, [music] stable environment for children are not only legal responsibilities, but also compassionate duties for every adult in a family. In your view, how might someone with legal knowledge respond when questioned about concerns regarding their conduct toward their own child? >> Corporal punishment is not illegal in the state of Florida. So, if that's why it was stopped, I'm just going to leave my comments there. >> Okay. >> This shows how an offduty officer spoke [music] with the officers. On January 25th, 2025, Florida police stopped a vehicle after receiving a report about a driver's concerning interaction with his 8-year-old son. When they approached, the man quickly identified himself as a law enforcement [music] officer, requiring the situation to be handled with added care to ensure fairness. >> Stay in the car. Get back in the car now. >> Thank you. >> First off, on a traffic stop, you don't. I'm a police officer. I apologize. >> Well, then you should know better. >> I apologize. >> You have your license on you? >> Yes. >> Do you have a your sack? >> Yes, sir. >> I don't want you to go for >> I'm not touching your gun. >> Trust me. >> You know why we stopped you? >> Yeah. >> What's that? >> The incident that happened by the pier. >> Okay. Can you explain to me what happened? >> What? What are you getting at? What do What do you want me to answer? >> Well, you said that you know why I'm stopping you. >> Well, I believe I know why, but I'd like you to tell me. >> Once we uh get more cops down here, we'll >> Okay. Who are you on the job? >> Mkasuki Police Department. Retired from Haley after 28 years and now I'm at Mikasuki. >> Okay. >> Who do you work under there? >> Um, Chief Handalfi. >> Well, I know, but who's your sergeant? >> Uh, I'm an acting sergeant. My lieutenant is James Garcia. Okay. >> Hey there, sir. Officer Bloomport Samples Police Department. Were you the caller? >> No, but I was >> Did you witness it? >> Yes. So, what did you witness? >> I witnessed a man beating a kid on the sidewalk with a belt. >> Okay. And then he got >> Then he got into that car. >> Uhhuh. >> And he's on the passenger side. >> The kid is in the car also. >> Kid's in the car also. >> Okay. And are you willing to do a statement? >> Yes. >> Okay. Can you just give this officer your ID? >> Sure. >> Thank you. >> He's going to He's a Mississippi cow. >> Um you're probably the best. I don't have kids. You have kids. It's an 8-year-old kid. So I said, "You know why he didn't stop?" He goes, "Yeah." I said, "Well, he wanted you to explain to him." I said, "Well, we got an alation belt on his fanny pack in the front." >> He said, "Yeah, I did." >> So, I I don't know, but >> all right. >> His professional background appeared to help the father remain calm while speaking with officers, leading to a cautious and controlled exchange. >> Just step out of the vehicle. >> Absolutely. I'll keep my hands where you can see them. >> I already told him, "I'm a police officer. You guys got nothing to worry about with me. I'm not >> I know you're doing your job. Put on the hood." Uh, that's okay. Oh. I mean, I'm just going to remove the fanny pack. >> Absolutely. >> So, >> what happened today? >> With all due respect, >> I don't want to answer any questions without having a lawyer present. >> Okay. >> Um, the only thing I will say is as a police officer, I'm pretty aggressive law. Corporal punishment is not illegal in the state of Florida. So, if that's why it was stopped, I'm just going to leave my comments there. >> Okay. All right. Three. >> Where did you Where did you see this happening? We saw this happening right at the uh the turnound uh back there. >> Uh the pier >> at the pier. Okay. So they weren't on the boardwalk. They were at the >> turn. They were walking on the sidewalk as though they were coming from the beach going toward their name. >> And it was a young boy down on the ground on his back being beaten and back down. And >> Juliet something that That's the guy. >> How old was a child? You had the gas. >> Like nine, maybe 10. >> Okay. So, it wasn't like a wasn't like a two, threey old I was getting. Okay. >> I tried to get in the water. See if it would help me. I'm starting to get chest pains. Would you be able to have a rescue check me out, please? >> You want EMS out here? >> Yes, please. >> All right. I got you. >> Is it uh is it sharp, acute like just happened? >> Yeah. >> All right. >> That's why I asked for the water. Hoping, you know, >> if you don't mind if you don't mind me asking, you don't have to answer if you don't want to. Did you have any history of chest pains or anything like that? Anything that like I should let EMS know about? >> I've had chest pains before. Yes. >> You had chest pains before? >> The hospital? Yes. >> Okay. >> Statements from witnesses can play an important role in helping clarify what may have taken place. >> Hi. >> Call us for witness. >> Were you the initial caller? >> Yeah, she called. >> Okay. >> But I don't want him to see. >> That's fine. You can stay here. >> Um, so what would what did you observe? is the one that you are the one who need to say >> uh I'm not the cop that called you over here but I'm going to be taking primary on the call would sorry I'm trying to get in touch with DCF and they have me on hold >> okay I I can't wait for you >> uh what would you observe >> well to be honest with you I heard like >> and when I look at it because we were picking up our family members that they were walking by when I looked I saw the guy with the belt >> going to the car and the little He was like touching, you know, like his back and then he told me, "You just saw what he did." And he and then >> I saw when the guy was walking, he rubbed his belt, he took it out, put it and and hit it on the back >> and he put the boy on the floor >> and the little guy the little kid like I don't know, eight, 10 years old. I don't know, maybe seven. >> He was so mad. >> He went to the floor and goes like this, you know. Okay. And then when he get into the car, I saw he was like he was at the guy who was so mad >> and the wife was driving the wife >> when he was hitting the kid. >> Yeah. >> How was he him like >> very kind of >> right? But like what was the motion of it? Was it overhead? >> Yeah. >> Or was it like down here? >> No, like this. >> He was coming from over his head. >> Like it when you hit a dog that you know he's because he's mad. He was very very very mad. >> How could you tell that he was mad? But I know it's just a screaming. He was screaming. >> Yeah. Okay. >> Everybody was like, "What?" >> He told the kid, "Don't do that. Don't do that." >> Okay. And you said that the kid fell to the ground. >> Yes. The kid fell to the ground. >> And then he >> and he went like >> And the kid was covering up prevent trying to prevent from being hit again and then he was again. >> No, he did. He did it one time. >> One time. >> Only one? >> Yeah. Only one time. >> Only one time that you saw. >> Okay. >> But he took the belt and and grabbed it like, you know, very hard. Very >> And when he was on the ground, he didn't again. >> No. Only one time and and he left. Okay. [snorts] >> And how did the kid react to being hit? >> I think he was struggling and he was defending himself. >> He's trying to defend himself. So >> the man the red thing and his hand was like but then he kept pushing like him down. So there'd be and >> so and yeah. >> Okay. >> What happened? >> Are you Yeah. >> Is your son okay? >> Yeah. >> No injuries. >> No. No. Nothing. >> Okay. Your husband was just saying that he had was having some chest pains, hoping the water would help. And the water wasn't helping. So, he asked us to call EMS to have him check him out, make sure he was all good, nothing crazy was happening. >> The mother expressed frustration. Like the father, she believed that discipline within a family is not always viewed the same way, and tried to explain her perspective, a viewpoint that reflects differing understandings of parenting. >> It's not like we we spank our kids all the time and we're beating on our children. I mean, my husband's a police officer. I work in the medical field. We don't, you know, >> I got you. >> You discipline your children when you need to. We take phones away. We take money away. Like, right now, he's only allowed to do karate because he gets bad grades in school. >> I got you. Again, we we are just responding to a call and like I'm sure your husband can attest to it, too. He's been very cooperative with us. >> Yeah. Of course, he's going to be he's been a police officer for for 30 years. >> So, yeah. And you know, we >> But but this gives you anxiety because we've never been on this side of the law. >> Yeah. No, absolutely. >> We're clean, decent people. We're actually on vacation. >> Yeah. Honestly, and like I said, we were just responding to something that we got >> and I even paid the the guy for the for the thing for >> the thing. >> Well, what happened was there was a shovel in the sand. He found the shovel. >> Okay. >> Right. He started playing with it and then we started calling him to come to the pier because we were leaving and you know, we were standing there watching him and he the shovel in the ocean and then the man told him, "Get in the ocean and get my shovel." He didn't know that that shovel belonged to somebody cuz he had found it in the sand. And the man goes, "That's my daughter's shovel. Go get it." Can't go in the ocean. So, we started calling him and he told the man, "I can't go in the ocean. It's too deep." So, he started walking towards me. And when we were getting to the car, the man calls my husband, tells him, "Listen, your kid threw my shovel." I turned around. I go, "How much is a shovel?" And I give him $5 and I walked away. So, I guess after that, then I guess that's when somebody saw my husband in the leg. That's what they're saying. I mean, that's what he said and that was it. >> Okay. >> While the father was taken for a health check, officers documented visible signs on the child to [music] compare with the reported information. >> Do the other officer uh come and speak to you at all? >> Yeah. >> Okay. So, you know, your husband is being transported to the NCH downtown? >> No, they didn't tell me that. >> Okay. So, he's being transported to NCH downtown probably per his request. Um or maybe they saw I wasn't there with the uh with them at all. So, >> what is that? Is that a hospital? Yeah. Yeah. It's literally right down the road. Ma'am, what's your name? >> Lisa. >> Lisa, do you mind if I speak to Jacob and just make sure he's all good? Cuz AMS was requesting with your permission, of course. >> Yeah. Yeah. Yeah. Go ahead. >> Okay. Can you be really careful for me? And can you step out of the vehicle and just meet me behind right here? >> Oh, be careful when you >> Yeah, just be careful. I'll I'll stand out there to make sure everything's all good. Oh, he's going to go that way. Okay. >> You got shoes on. You put your shoes on. >> All right. Everything all good, though? >> Yeah. >> All right, man. >> Hey, turn around, buddy. You can put your shirt down. Okay. I'm just going to take one more picture of you. Okay. All right. Hop in the car for me. Okay. Uh I'm going to ask her to go to the station, put her in the soft room with the kids. Uh the first couple they said they saw something red which is the hat cuz they said they walk in they threw the they saw him on the dashboard. So that's a hat on. I know they said a red hat. >> And then the kid does have a >> Yeah. He's got a wall on. >> You see it right there? >> Yep. >> And then that's right there. So it was at least two. >> Yeah. Ensuring the safety and well-being of the mother and child was prioritized [music] before the process continued to focus on the father. We >> all get off right. >> Yep. Everybody. >> Hi. So, just to make our investigation go a lot smoother and forward things along, do you mind if we get the keys to your car and search the vehicle? >> Yeah, go ahead. >> Thank you, ma'am. All right, hang tight for us. >> Let's go. >> Anything? >> Where'd you find that? >> In the >> in the glove box. >> Yeah. I don't know if that's a belt. This >> is definitely a belt though. >> All right, just give me a second. Get enough room over there. I don't have any block. >> This way. Just watch your head here. Nice and gentle. Careful your head. Itch. >> Got it. >> Just itching. Sorry. >> I got it. And then there's a little groove right here. >> It's like a little groove in your back. There you go. That's where you rest your hands. >> I'm sorry. >> All right. Go for it. >> Freaking pain they gave me. >> Gotcha. All right, sir. I'll put your seat belt on for you. All right. >> How far away is it? >> Uh, it's not that far. Maybe like 2 or 3 miles from it. Just be careful with the door when you close. I didn't want to get out the car cuz I didn't want to go in the um movie theaters were acting like that. So, I started >> How old are you? >> Who? >> I'm 15. >> 15. Where's your dad? Don't know. Okay. Who do you live with? >> My grandma. >> You don't live with your mom? I don't know. >> Okay. Does your granddad have a car? >> We'll talk to your mom. See if she's drunk. If we don't determine that she's she's drunk, you're going to have to get back in the car with your mom. All right. >> Now, when you said she started drinking, what do you mean by that? She went to 7-Eleven and then I saw her I saw her grab a drink but she said it was soda. I didn't believe her but I saw her throw it away cuz when she's lying I just like it's like how she starts acting. >> So what what >> she just I don't I think it was like >> or did she find the 7-Eleven drink there? >> Yeah, she she got a cup and I guess she poured in the cup and then she just threw it away and I didn't really see it clearly. >> Pour it in the cup. Uh, she poured it in. >> You see her pouring inside? >> That's all she was drinking. That's it. >> She stopped twice. >> The mother appeared calm as though nothing unusual had happened. During the initial conversation, officers were given vague explanations and unclear details. >> Hey, Kayla. Hey, I'm Officer Scales. I spoke with you on the phone. So, tell me what's going on. Um I tried to attempt to take my daughter to um movies or whatever. >> Yeah. Right over here. >> Mhm. And she's been crying cuz she didn't want to go. I guess she didn't like what I was doing cuz I was trying to deal with she didn't like it. So she started crying. We got here she started crying a lot. >> Okay. Has she done this kind of thing before? >> No. >> No. >> No. >> Okay. >> All right. So what's the issue with today? I mean, what's different today? Like, what? She just got upset, you think? >> The thing is it's because my grandmother sold her house and my grandmother sold her house. She gave me a lot of portion responsible and things like that. I'm not sure. What behavior? Just hang out right here with my This is your rental. The dad renovated. >> There's something in there. >> What am I seeing in there? Am I going crazy? Um, I dropped some wine out of this. >> Some wine. Been drinking a day then? Just a little bit. >> Okay. How much you think you been drinking? >> Ballpark estim. >> A container. >> Uh-huh. >> Like how big is that container of wine? >> You want the little bottles? >> Correct. >> And you got that at the 7-Eleven? >> Correct. >> Okay. And then you put it into the container. The 7-Eleven cup. >> Correct. >> Okay. And how long ago was that? >> 3 hours ago. >> 3 hours ago. She's telling us a different story. That's why >> I drove around iPhone came back around town. >> Why you driving around? >> Because I'm trying to figure out where I want to take my daughter to be at peace to go to the movies. >> But you left her. >> I didn't leave her. She walked away from me. >> Right. Right. But you didn't. >> And I tried to get her to go to the movies. We went to Winter Park Village where her schoolmates and everything else. She didn't want to go there. That's where she really want to go. >> Oh, that's the road. She wanted to go by her friends. I see. >> No, no, no, no. It's not there. Her friends don't even go there. Her friends go live somewhere in the area. Then I tried to get her to park. She started crying. So I decided to drive back to where I started to from fashion school tomorrow mall and she didn't want to go to fashion school mall. So I turned back over and then she didn't want to go there and I was like I'm turn around go maybe she'll change her mind and I was trying to get her change her mind so we get to the movies while she moves. We're >> talking about the uh driving pattern since you know you separated from your daughter. >> No, she walked away from me. That's the whole I'm not trying to be funny. I'm not trying to dictate the situation that I don't care about what we call She did walk away from me when I tried to get her to go to the movie theater. >> I'm not disputing that fact. What I'm asking you about is since that instance happened where you >> and then I couldn't find her dad. >> Can you let me finish? >> Find out what she did since she called my dad. >> Mhm. >> So pay attention. Listen to my question. All right. Then I want you to answer after I'm done asking. You understand that? So since your daughter left the car >> Mhm. >> where did you go? >> I went to my grandmother's. >> Okay. Then what? I got me something to eat and I'm going to head to McDonald's. >> Where'd she go? >> Um Publix >> Publix on Orange in Michigan. >> Right there. And what was the plan for the 15-year-old >> for her to call me >> and then >> for me to return back where she was? >> But you figured you'd get something to eat and go to your grandma's place? >> No, because I met trying to call her and she wouldn't pick up the phone. So I went to public. I couldn't find her. And guess what? >> All right. You will wanting to do some tests to make sure you're all right to drive? >> I mean, I'm okay. I'm trying to go to the movies and get my daughter. >> You wouldn't mind going through a few exercises to make sure that you're all right to drive? Come on over here. >> Signs that something was not right led officers to conduct standard checks. Her coordination suggested that continuing to drive in that state, especially with a child present, created a serious safety concern. >> I want you to stand right here for me. Put your feet together. Heels and toes touching side by side. Put your arms on your side. >> Are you at all? >> Um, a little bit. >> What's my hips? >> What happened to your hips? >> Just sides with some arms. >> Oh, so you're not You didn't get anything. >> It's like an ongoing thing. Okay. Have you been diagnosed with anything by a doctor? >> Bipolar. >> Oh, no. I mean with the hips that you brought up earlier. >> Nope. >> Okay. What I want you to do, you see this white line right here that you're standing on? I want you to face the curve. All right. Take one step back. We're going to do the walking turn. All right. So, put your left foot on that one. Put your right foot in front of your left foot with your heel touching your toe. All right. Keep your arms down to your side. Stand just like that till I tell you. You understand? When I say begin, I want you to take nine heel to toe steps out on that line. Now, you step out loud. Be down on your toes. Once you get to nine, you're keep that front foot on the line. Turn in a series of small steps until you're facing this direction and take nine heel to toe steps back down that line. Now, I'll demonstrate it for you so you know what I'm looking for. What's funny? >> Nothing. >> Okay. >> So, I'm going to show you what I'm looking for. All right. I've got you lined up. Right foot in front of your left foot. When they begin, you're going to take nine. Those steps on that line like this. One, two, three. Again, you're going to take nine. Once you get to nine, keep that front foot on the line. Turn in a series of small steps. So, you're facing the original direction. Now, you lift those steps back. One, two, three. Again, you're going to go all the way up to nine. What you need to remember, I'll have you put mine back up. What you need to remember is look down at your toes as you step out loud. Keep your arms down to your side and don't stop until you're finished. Do you understand all that, >> ma'am? I'm listening. >> Do you understand what I just asked you to do? >> Yeah. >> Do you have any questions? >> Why don't you get lined back up with your right foot in front of your left foot? Okay, begin. Do you remember what I asked you to do? >> Nine steps from left to right front. Nine steps. Are you done? I think so. >> Okay, come on back here. >> Stand right there. Put your feet together. Heels and toes touching side by side just like before. Keep your arms down to your side. For this one, what I'm going to have you do is pick up whichever foot you're more comfortable with. About 6 in up off the ground. That's about that much. Keep your front foot that you have raised parallel to the ground. Look down at that toe that you have raised and kind of allow 1, 1,002, 1,003, and so on to it. Stop. Now, I'll demonstrate it for you again so you know what I'm looking for. Does that sound fair? >> Mhm. Gretch lined up, your feet are together, your heels and toes are touching your arms down to the other side. When I say begin, you're going to pick up again whichever foot you're more comfortable about 6 in off the ground about that much. That front foot parallel to the ground that toe kind of 1,00 1,002,004 1,005 and so on until I tell you to stop. What you need to remember is look down at that toe that you have raised. Keep your arms down to your side and don't stop until I tell you to. You understand all that? >> Any questions for me? No. >> Are you ready? >> Mhm. >> Okay. Begin. >> Straighten your leg out. You can stop. >> Only later did the mother admit she was not in a condition to drive. Yet, she still refused to allow the child to go with her father, showing how emotions can sometimes delay clear safety decisions. >> Do you want to be honest with me about how much you had to drink today? >> Two what? >> So, how long ago did you stop? >> 3 hours ago. >> 3 hours ago. >> Okay. And uh so you had your your kid in the car with you earlier, right? >> She lost me. >> But before that, you were driving around with your kid in the car. >> And you were in this condition with your kid in the car. Well, you said you stopped drinking 3 hours ago. >> No, she left me. She left once. So conditional. She left me. I want to go to the movies, but she left me. >> Okay. So, which part are you lying about? Because right now, what I understand, you were driving around, but you stopped drinking three hours ago and you were driving around with your kid in the car. 7. Got me something to drink. >> Want to go trying to see the mag. I really wanted to take her for once and for all to go see the mag. Got some money. I had some money in my pocket. Went to her house. Got my daughter some money. Want to go take her see the mag. Didn't want to fit the way I was feeling. Got me a thing of barefoot wine. Small thing of bare foot wine. Went to was going ahead to what Dizzy decided I don't want to be bothered with this. I rather ride around town till I feel as if as if I'm better to take her. >> So you were riding around to try and sober up before you came and picked her back up. >> No, she was in the car with me the whole time before I decided to go to one last thing we're going to do. You see your front right tire right there? Just focus on that for a second. Okay. Is there someone that can come pick up your kid that's sober? >> No. >> I understand your parents are disabled. >> Yeah. >> Where is the child's father? >> I don't know. And I >> who else can be responsible for their child? >> I don't know. Don't call. Don't ask me. >> Can you go see your child? Go to your mom and your dad. >> No, cuz my dad let me drive the car. >> Do you have anything you need out of the car right away? Like your phone wallet or help? >> I didn't ask her to come out car. We're just going to hang out with her. I'll go get my car. >> I'll be right back. >> It's okay. Just get >> No, it's not okay. It's not okay. Make room for something else that happened. I don't think it's okay. It's not okay. >> You'll get some help. >> No, [snorts] I won't. >> Yes, you will. >> No, I won't. Cuz I got to stay here. >> I will get some help. >> It's not okay. >> You will get some help. >> It's not okay. >> It will be okay. It will not be okay. I gotta leave my daughter here with God's own. I don't know what the It's not okay. It's not okay. I can't even leave my child. Me and my child can't even go nowhere without nobody else. I don't give a It's not okay. It's not okay. >> Okay. >> It won't be okay. And it won't. And I don't give a I feel the same way they feel the I worry about all the time. How the going to pay for a DUI to get out of jail? I can't afford that. What you want my mother? Leave me the alone. >> Alone like I ain't never seen y'all. Leave me the alone. What's going >> Leave me alone? >> This reaction is often seen when someone who created a dangerous situation looks for sympathy instead of focusing on their responsibility to a child. >> Here's what's going to happen. All right, I'm going to talk to you about what's going to happen. >> You guys are calm down. >> So, you're going to go in the back of my squad car. >> Put the seat belt on. If you resist my officers, you will be put on the do ground and hobt tied and then put in the back of this car. Do you understand me? Do you understand me? If you resist anymore, your legs will be tied to your back and you will be put in the back of this car. >> Okay. Okay. >> Get inside this car and cooperate. >> Come on. Calm down. >> You are not going to resist anymore. >> We got that around the other side. >> Yep. Yep. female. >> Would you like some air conditioning? >> I cannot breathe. >> Can I Can I take your daughter TO YOUR PARENTS? >> NO. I ASK MY PARENTS to come and get her. I don't give a nobody in that mother. I don't want nothing like that going on. >> If I can't take her there, she's going to go to DCF. Then you got to have your way. Go ahead and take her then. What the? >> The positive outcome is that the girl was placed in her grandfather's care. This step was not only procedural but also compassionate, helping move her away from an unsafe situation. >> Hi, sir. >> Thank you, man. >> Yeah. Um, >> what's happening with her mother now? And today's probably half my fault for trusting her. I rented a car yesterday, take my granddaughter to the movies. >> Oh, I'm sorry to hear that. >> And she just screwed it all up. >> I'm sorry. you all right? >> Um, >> so what's happened with her? >> She's going to jail. >> I figured it was. >> Yeah, >> she needed She been there before. >> Has she? Okay. Yeah, she's going to go to jail. Um, this is where the car is. You can keep this. >> Okay. >> Um, I'm just >> Oh, they towed the car somewhere. >> Yeah, I said that address on Wilmer Avenue. >> Where is this at? >> Uh, it's not far. It's uh right down by Pine Hills and 408. >> So, it's pretty close. It's probably 10 minutes drive from here. >> Oh, you have a car. You know, >> that thing broke down the other transmission. That's why I rented a car for the weekend. >> Oh, just so they could go to the movies. >> Cuz my bicycle is where I rented the car. >> Oh, man. I'm sorry to hear that. >> And they charge you $100 to get the car back >> some around there. Yeah. If you go get it tomorrow, she'll pay you back. >> I hope so. I just got to since I released her to you, I just got to grab your info real quick. Yeah. You tried to do something nice and it I'm sorry. What' she call you saying? >> Huh? >> What did she call you saying? >> She called me to let me know what her mother was going through and her mother was beating on her. So, she jumped out the car. >> Yeah. Yeah. >> I said, "Baby, >> either." And she don't even know Florida that well. >> Okay. >> And you're her grandfather, right, >> okay, >> man. Thank you for bringing it home, man. >> Oh, yeah. Absolutely. >> That was my worry right there cuz she don't know too well about >> Yeah, she's a nice girl. >> I didn't mind at all. >> Any questions, guys? >> Uh, no. >> All right. Sorry this happened. >> All right. >> How long is she staying in there for? >> Um, >> it's up to you guys. >> So, it'll be uh a minimum of 8 hours. Well, she may be there for the weekend cuz it's the week or until Monday. So probably till Monday morning >> cuz unless Yeah, she'll have to It depends cuz it'll either be tomorrow or like Monday morning if I had to guess. >> Okay. >> I think I know this is at the end of Silverstar. >> No, it's um by 408 and uh like around Pine Hills JP area. >> I can look it up. >> Okay. >> Yeah, it's not far from here. >> Okay, let's see that. >> But bring your rental agreement. >> Oh, my rental agreement. Oh lord. Is it in the car? Okay, then they could probably just walk you over. >> She got the keys, too. >> Yeah. Well, they'll have the keys now. >> Oh, you have them? >> No, the the Okay. >> All right, man. Thank you. >> Yeah. Sorry. >> What's your name, man? >> McCarthy. Michael. >> Nice to meet you, sir. >> Have a good day. >> The mother was charged with DUI and child. Under Florida law, she could face up to 5 years and 9 months in [music] prison and fines of up to $7,000. This story goes beyond legal outcomes and opens an important conversation about adult responsibility, safety boundaries, and the importance of listening to children so they are never left feeling they must protect themselves alone. When emotions go too far, the law does not dwell on explanations. [music] It looks at possible risks to a child's well-being. >> He had me on the ground and I was scared and I'd upside the head >> with what? >> A bottle. A glass bottle. On May 17th, 2024, officers received a call from a neighbor reporting a family dispute [music] and concerns about a child's safety. When they arrived, the mother denied the claims and showed intense emotions, a sign that emotional strain can affect how someone interprets a situation. >> Good. What's going on? >> Where where's the house that this supposedly took place in? >> Right there. >> Which one is right there? >> The brown one. >> The beige with the brown. >> All right. So, who lives there? >> Tina Humphre is the owner. Okay. and the daughter and her boyfriend and this child. >> Okay. So, she's still in there. Do you know? >> I didn't. >> All right. What's going on? >> Nothing. >> Uh, don't tell me nothing. Tell me what's really going on. >> My partner and I were arguing. >> Uh-huh. >> We don't want any cops involved. >> Doesn't work like that. Commonwealth law says I have to be involved at this point. Where's your baby at? >> She's over across the street with my aunt. >> How did she get there? >> Well, we took her over there. >> Who took her over there? >> My partner. >> Your partner? When you say partner, can you give me a better like over the age of 40 description? Okay. So, it's a he and it's your boyfriend. >> Yes. >> Okay. What happened to him? >> We were arguing. It was a mutual physical altercation. He had me on the ground and I was scared and I upside the head >> with what? >> A bottle. A glass bottle. Okay. >> He had me pinned on the ground. He had my arms down. >> And what did this all start all over? >> I was upset. I was going on a drive. He said that my baby would not be here when I got back. I was extremely upset and irritable at the fact that he said that he was going to basically take my baby away from me. All because I wanted to go on a drive and clear my head. >> Okay. And where did this take place at? >> Here. >> Like where in the house? >> Living room right here. >> Okay. Do me a favor and step on out here with me until we can clear this up. Okay. >> Okay. Grab my >> You're not under arrest or anything like that? Yeah. Go grab it. You got your wallet? >> That's my mom. I believe it. >> Hi, officer. >> Yes, ma'am. >> I'm actually bringing camera. >> I am her father. Okay. >> I don't know what's going on, but get the baby. >> I'm still trying to figure that part out myself. The baby's fine across the street. So, >> yeah. But I'm going to come get her and get her away from that whole situation right now until it gets all sorted out. >> All right. Well, you can respond to the house, ma'am. But I got to finish out finish doing what I'm doing before we figure it all out. Okay. >> Okay. All right. Yep. >> The disagreement began when the mother felt overwhelmed and [music] wanted space to calm down. But instead of finding mutual understanding, communication broke down and the situation [music] grew more serious than either side may have intended. >> That's the question I was about to ask you, sir. >> A somewhat unruly gentleman with a gash in his forehead and a lot of marks on his neck. >> So tell me one more time it started and then over the argument about what now? >> I was just irritable and upset. So I went on a drive. I came back to grab my phone and he said that Gelani might not be here when I get back. So that's what set me off and that's why I got extremely upset and defensive. place on the floor. >> Okay. At this point, we're still talking about arguing back and forth. Then what happens? >> What you know, got physical basically, you know, I came, you know, inside said that I was going to take Gelanie and then he went over her and was pushing me away from her and that's initially how it started. He was trying to get me away from her. >> So, he's pushing pushing you off of the baby. Is that what I'm >> away from her? Yes. He's pushing me away from her >> cuz he had the baby in his arms at that point. >> He was laying down. >> Okay. >> And I was going to go pick her up and then he started pushing me away from her and that's when it got physical. I started to push back and that's essentially just how it started. We were pushing and arguing and then I, you know, he got up, you know, I grabbed the bottle and, you know, I hit him. I didn't, you know, break it on his head. It was just instinct. It was a reaction. But, >> well, when you say you hit him with the bottle, right? So, he's trying to keep you away from the baby >> and he had pinned on the ground as well. Like, I also could >> Well, see, you're leaving that part out. I'm trying to figure that part out. >> Well, I told you before he I was on the ground. He had me pinned on the ground, >> right? But I'm trying to figure out the time table of events. All of this comes into play. So it it starts off with him trying to keep you away from the baby. >> That's basically. >> And then you push back on him. >> Yeah. And then we both ended up on the ground. >> How? >> He pushed me down onto the ground. He was holding me against the ground. >> So when he pushes you down on the ground >> and I'm trying to push him off. >> Did you fall on fall from towards your back? Did you fall towards your front? >> It was more like on my side to my back. >> Okay. So now now you're on the ground on your side. Then what? >> Wait. He's pushing on me and I'm trying >> Well, he can't push on you if you're on the ground at this point. He's on top of me, >> ma'am. That's what I'm trying to get at my arms. That's what I'm trying to get. He's pushing on me. He's pushing on my arms and I feel on my chest like his arm or something. >> So, you're saying at that point once he knocks you down to the ground, he gets on the ground with you? >> Yes. >> Okay. That's what I'm trying to figure out. And then at that point, what what's going on at that point? He's trying to hold you to the ground. And then what? >> Yeah, we're just arguing and screaming at each other. I'm trying >> Huh. >> No. >> No. They got him somewhere over there and the baby's across the street. So, >> they're over there together. >> He's holding you down on the ground. And then what? I'm trying to push him off and get him off. And when I eventually get him off, you know, he walks away and, you know, I push him off. He's still arguing with me, threatening me, saying that he's going to take Gelanie, that she's not going to be here or whatever. And then that's when I get extremely upset and I grab the bottle and that's just the first thing I do. I just instinct grab it. >> But he's already off of you at this point, right? >> And but he's stilling me >> verbally. I get it. But he's already off of you at this point. And how far away are you guys at that point? >> Maybe like less than two feet. >> Less than two feet. And y'all And you're up off the ground at this point as well, right? >> Both of us. Yeah. Okay. And then this and we're back to verbally screaming at each other. And then you pick up a bottle and then you hit him with it. Right. Who's Olivia Parker? Ma'am, >> his other daughter. >> Is she anywhere here? >> Okay. So, that's not the same kid. I still want to talk to him though. So, where are you guys at? >> The focus shifted as officers documented [music] the father's account. They asked careful questions about timing, location, distance, and [music] sequence. Because in family disputes, small details can influence how events are understood. >> Hey, Bo. How you doing? Better, right? I got you. So, listen, man. I got a couple questions for you. Uh, you guys, can I do Can I ask him some questions right now? Are you guys still in the middle? >> You just give him a uh give us a second. Get his information. >> Yeah. Yeah. Yeah. Yeah. Yeah. I'll talk to him outside. I mean, at the end of the day, she had no cause to hit him because they were already separated, too. There was no self-defense in it by admission. If he had her by the neck or something like that or was holding on to her and she hit him with the bottle, I'd be like, "All right. All right. So, you're not going to go?" All right. Let me take a look at you. I'm not a medic. I just need to look. All right. So, you got hit with that bottle right about there, huh? >> Yeah. About it was an accident, man. >> First off, explain to me how it was an accident. >> We were sitting there arguing and this bottle was wet. >> Mhm. >> And you know how glass bottles are slippery and wet. She was shaking the damn bottle arguing. That thing slipped out of her hand. She was going like this. Why? Why the hell would she be doing that? >> Well, she's mad, right? >> Yeah. >> All right. So, look. What's your first name again? >> Cory. Cor. I heard that over. So, of course, let's back it up a second. Has she or you ever been arrested for like say domestic domestic or anything like that? This did I know one of y'all got any record or anything like that? >> Well, this that's what that's what I'm getting ready to explain. The sad part is who called police. >> The neighbors did. Yeah. Okay, that makes sense cuz they got the kid and that's Jo's kid in common, right? Okay. >> Well, I just wanted to take her out of the situation so she >> How did the kid wind up across the street? You sle after you got hit? >> Yeah. >> Now, where was the kid when you got hit? >> In the living room. Uh, watching >> Oh, I had >> on the floor. >> No. >> In the little bassinet thing. It's been a long time. My kids are walking their brain. >> All right. So, here's the thing. First thing I want to tell you is I'm going to be 100% honest with you in this this entire process. And I'm going to tell you why. I'm too damn old to lie. I don't do it very well. I've done a lot of these. This guy's done a lot of these. And the first thing you need to know is that 30 years ago or even 20 years ago, the Commonwealth would send one of us out and we'd say, "Oh, okay. You don't want to press charges. I got you, bro. Go back to a family member." The problem being is is the law has changed and it's been like this for a while. There is there is no ifs, ands, or buts about an arrest with a domestic situation once the facts are found to be probable. If that makes any sense. And it's not you doing it, it's me or him, right? So there's no prosecution on your part or her part, none of that, none of that stuff, right? There's nobody pressing charges on nobody but but the police because the law tells us we have to. Now, going back to what happened to you, the argument started over the kid, right? >> I think so. Yeah. >> Something about she So, what I'm getting from her is is that she didn't want you taking a kid, >> right? I mean, yes, because we was having an argument and she was going on and on about [ __ ] about some something. I don't know. I can't really remember. >> I can believe that. I understand that. >> Um, and then she was saying some other I was like, "Okay, you'll be back. Whatever." And she came back in and said, "If I lost my phone while I was walking her this morning, I don't even know where the hell that went. I even backtracked and still couldn't find." She came back in and got her phone and said, "I hope you like being single." And walk back out the door. >> Hope you like being what? >> Single. >> Single. I >> was like, I I opened up the door. I was like, "Maybe me and Gelani will be here when you get back." >> And that the door. Okay. When you say you close the door, the front door? >> Yeah. >> Okay. Yeah. Yeah. And then tell me about it. >> I sat down. I'm on the couch uh where I had my daughter. >> Okay. And she was filling that little basset thing. I got you. >> And I was sitting there watching TV with her and kept on running back in and out. Running back in and out. I was like >> back in inside the house and I was like, if you're going to leave, leave. Okay. You know, I'm not going to sit here and let you sit here and wake her up for nothing something stupid. The bottle went off. And >> was there anything it took I mean cuz the bottle seems to get like like So what happened before before the bottle hit you in the head? I got annoyed. >> I had the bottle in the warmer. >> And so this is a baby bottle we're talking. Is it plastic or glass? >> Glass. >> Okay. All right. >> Yeah. When when you have a glass in your hand, you're you know, and it's wet. >> No, I got you. You know, I got you. This just came out warmer. >> But she's still pissed off. You tell her like if you're going to leave, leave. >> Mhm. >> Before the bottle makes contact with your with your cranium. H what went on before that? Like >> uh nothing really. I mean, she just kept on coming back in and out in and out. So she So did at any time she tried to get the baby and you tried to keep her from getting the baby. >> Well, that's after I got hit. >> Okay. >> After I got hit, I was just like, "Okay, that's that's it. I'm not getting This is done. I'm I'm not I'm not You know how you get hit and you're like And when the bottle hit you, were you sitting or were you standing?" >> I was standing. >> You were standing. Okay. >> Did you guys Did you guys ever Okay. So you were did you So were you trying to keep her from getting the baby because she was all upset? >> Like like you know like sticking holding your hand out or pushing her back from the baby? >> Like god it's kind of hard to explain. >> No, not really. You can use your own words. >> Like I wasn't trying to keep her away from the baby. Like I had her and when as soon as I picked her up, she immediately stopped trying to grab me. >> Picked who up? >> My daughter. >> Oh, okay. Okay. So you picked the daughter up. Okay. And as soon as I picked up my daughter, she immediately stopped grabbing me cuz I had pieces of cargo. >> You mean uh Ashley? >> Yeah. >> Okay. So, she was trying to grab you. >> Yeah. So, I was trying to get my daughter out the house. >> Yeah. Yeah. Yeah. >> And I was I needed to get away. >> Where was she trying to grab you at? >> Like all around here? >> No, no, no. Yeah. Yeah. Yeah. I got it. You're making sense. And then then what happened? >> Finally grabbed her walked up. I mean, nothing happened. So from your recollection, you got with the bottle and then and at that point you're trying to get the baby out the house and she's trying to grab it. So there was no push or shoving prior to the bottle. >> No. >> Okay. You got an ID on him? >> Yeah. You have your phone or you want to get a photo? >> My phone's in the car. Get that photo. >> Early observations suggested the mother's actions may have created a serious safety concern, leading officers to place well-being first. >> All right, Ashley, if you would stand up, place your hands behind your back. >> I'm being arrested. >> You're being arrested for malicious wounding and domestic. I'll talk to you about it and we'll >> Can I put this in my bag? >> Yeah, that's fine. I'm going to explain everything to you as we take a ride down there. Riazi, if you can do me a favor. He doesn't have a lap and he doesn't have a DV packet. And if you have a voluntary >> I have a DV. >> I've got a DV packet. If you don't have that, >> um, come on back over here. I'll grab this for you. >> Thank you. >> It's a little bit more complicated than that. Plus, his story is slightly different than yours. But yes, um I'm sure that there's there's more sides to one story. I get it. That's why I went over there to talk to both of you. Um just have a seat the best you can. I'll talk to you a little bit more about it as soon as I get get him straight. >> My baby's not going to get taken, is she? But you promise she's not going to >> Yeah, I got no intention of taking your kid. Not at all. None at all. Your mom's still on the way down here. Okay. >> Is he going to come take custo? >> No. You said you were going to take her? >> I'm No. No. He's asking who's coming to get the kid. And to be honest, um, really honestly, he has I mean, you guys are boyfriend and girlfriend, so y'all have the joint custody. So, I would imagine that it's really up to him. I mean, whether you know, I mean, if he wants to get the I mean, take the kid back, then I can't really say no. You know what I'm saying? Your mom's not going to cause a scene with him, is she? >> No. She should. >> Okay. I mean, and she's not here yet. I >> No, she's probably like 30 minutes out. >> Okay. Well, I'm going to I'm going to talk to you some more, but I'm going to release release him to come back and then we'll talk about what happens. Okay. >> Am I going to be, you know, in jail till court? >> Probably not. You'll probably get a bond, but you're probably going to wind up having to bond out if I would have taken Yes. Only because of the the part, but we'll talk about it. >> Sitting in the patrol car, the picture that emerged was of a parent who had become overwhelmed, [music] someone struggling with unressed emotional pressure. >> No, there's nothing to be scared about. I'm going to walk I'm going to walk you through it. Unfortunately, I've done a lot of a a million of these. So, you're not the first person. >> Can you please have my hand? >> Yeah. Yeah. Yeah. Yeah. Yeah. >> No, no, no, no, no. I'm I'm >> so much anxiety. So, like I'm really restless. I >> I don't mind doing that for you as long as you you stay the way you are. >> Thank you. It's just freaking me out. >> Well, I mean, it's not a pleasant experience, but it is a process. Understand? My job is not to convict you. And you you know that my job is just for probable cause of the incident. >> I don't know. I was going to arrest you before. >> Well, I'm going to explain it all to you and you can ask as many questions as you want and I'll answer as many as I possibly can. >> Well, your mom might. >> I don't think she will. >> Why not? I mean, she seemed she seemed pretty nice over the ring camera there. >> I don't have any expectation of her. I can't even explain it. I just, you know, I did it to myself. So, you know, put yourself at >> Well, that is a true statement, but there's, you know, trust me, there's always worse things, and you are nowhere near the worst thing. >> I already feel like a horrible person in mom. >> I I would not say that. >> You call me a bad mom just for being depressed. >> Being depressed is is does not make you a bad person. You know how many police officers get depressed? officers. >> I honestly honestly to be honest with you, I pretty much stay depressed. I just manage it. >> I got you. >> I know it gets tough. >> Standard procedures were completed at the station. Despite her distress, [music] the mother remained cooperative, which helped keep the situation from becoming more difficult. A small but meaningful positive point. >> I'll be right there. All right. You help me for your children. I'm going to put this right here. >> Okay. >> Listen, is there anything in here that you shouldn't have? >> I don't know. I just have, you know, like a vape or something that that's the worst you would find in there, but I'm 21. >> No, I'm not worried about that either. I'm just I'm talking about like anything that is going to get you in trouble like weapons. >> Like there might be a lighter or something, but shouldn't be more than that. >> Nothing like that. No, no, nothing like that. >> Spoke to the neighbors at 7:05. They have right now. You you don't you don't sound confident on that part. >> Well, I I forgot that was in there. >> What's that? This? >> Yeah, it's a cart. >> It's a you know, like a vape cart, but one CBD THC. >> Yeah. Yeah. Yeah. Well, if you do go somewhere, just so you know, I got to toss that cuz they won't take it. You know what I'm saying? >> So, what's going to happen is is I'm going to put you in one of these for a very brief amount of time. I'm going to go get your paperwork and then I'm going to return. You're only going to be back here by yourself. You're not going to be sharing anything with anybody. And as soon as I come back from across the building and get your paperwork, then we're going to talk to the magistrate. Okay. And then I'll explain that process for you and get there. Okay. Do you have >> Do you have Huh? >> I feel by myself. >> You say it again. >> I have by myself. >> Oh, well, you ain't going to be back there long. And there's nobody that can get you. The only person can get you is me. You don't have anything in your bra or anything like that, right? No. >> Okay. I'm going to put these in front of you as soon as we get out of here. Okay. >> Do they have to stay behind me in here? Yes, but you're only going to be here for like 10 15 minutes. Okay. If that >> just have just have a seat. >> There's no way I can have it in front of me. >> Well, thank you. I can go anywhere. >> No, but it's technically I'm not supposed to have it in front of you at all. >> That helps. >> It does stick to chill out. I'll be here back here in a little bit. Okay. The mother was charged with malicious wounding by stabbing [music] or cutting and simple assault against a family member. Under Virginia law, she could face up to 6 years in prison. Although the child was not present [music] during the incident, the child's well-being guided every decision. The goal was to calm the situation, prevent further tension at home, and remind adults how important it is to seek help when emotions feel too heavy [music] to manage alone. Let's head to New York where another story of a wandering child gave the community much to reflect on. This time, [music] the central figure was a 3-year-old girl. >> Well, the kids went to school, so my brother left, went to go get my other kids, so I was sleep, so I didn't know. My doors usually be closed. >> On November 3rd, 2024, police received a report about a young girl found walking near her home in Watertown, New York. According to the report, a child briefly found outside without immediate adult supervision until a bus driver noticed and called police for assistance. >> How are you? >> Oh, I'm good. How are you? I had her up on the bus. She stay. >> Okay. >> Can you come here, please? >> Wait for me, baby. >> Let's find your home. >> Hi. >> Sound awesome. >> Yeah. >> Want to make sure you get home? >> Yeah. Hey. Do you know where you think you might live? >> Yeah. >> You want to show me? >> Yeah. >> All right. Come on. Let's go. You show me. >> Pardon? >> Yeah. Where'd you find her? >> Right here. She was actually following a gentleman and he stopped me. And so from that direction, I'm going to move my bag. Okay. I'll let you sit up front with me. Let me move my bag for you. Okay. >> You sit right there. Here. I'm going to move this bag real quick. Okay. >> I'll be in that. >> I'm going to shut the door. Okay. Where's mommy? >> I don't know. >> You don't know? >> Mommy's sleeping. >> Mommy's sleeping. >> Okay. >> Hey, what? >> I didn't say anything. >> Hey. >> Hey. >> Look at my shoes. >> Okay. Well, I got I got to work on my thing. I got to work on my computer. I got to see. Wait. I'm trying to find your name in here. >> What? >> I'm trying to find your name. >> All right. While comforting the girl, officers received signals from other children, guiding them to the residence. The mother was found asleep and was awakened. >> You guys know her? >> Yeah. >> Does she live here? >> Yeah. >> All right. Where's mom at? >> She's sleeping right now. >> Can you wake her up for me, please? >> Believe I have her address located. 715 Lancing. >> You're her sister. >> That's your sister. Hold on. I got to unbuckle. I got to unbuckle. >> There you go. >> Red jump. Big jump. Good job. >> I need to take my jacket off. >> You going to take your Well, let's wait for you to get inside. >> Hello. >> Yes. Why is you outside? >> Been outside for about an hour. >> Why? >> So, let's go inside. Let's go inside, Ariana. Crazy. >> Let's go inside. >> No. Wow. Not playing. Every All these doors is getting locked now. >> All right. So, I gather from her that you were upstairs sleeping. >> Yeah, I was upstairs sleep. My brother just left. So, he must have opened up the door. I don't even know. >> When did he leave? >> I don't know. He got the headphones on and he leaves the door cracked up. Open. >> Okay. Is he got a phone? >> No, he don't got no phone. >> He doesn't have a phone or anything? No, >> just letting her know that I she was walking around helping. >> Hi, dear. Located him. >> Okay, >> thank you. Um, how old your brother? >> 30. >> 30? >> Yeah. >> Okay. Was he supposed to be watching the kids or >> No, we all upstairs. >> Who all is upstairs? You mind if I come upstairs? >> Me, my brother, and No, me, my brother, and my other kid. >> Continuing their check upstairs, police encountered another man, which sparked disputes over the open door. You >> mind if I come upstairs with you? Come on, hurry up. Let's go. Dooring close. [ __ ] Don't make noing sense. >> Wow. >> What was you doing? >> Crazy. Outside for a wholeing hour. >> I thought you was upstairs. I just got here. >> Door [ __ ] open and every thing. Hello. All my doors is getting locked now. Noting playing. Every last one. One, two, and three. >> She did say she went through a lot of doors. >> Couldn't it be? Because the She don't even know how to open the middle door. The middle door is open downstairs. >> Well, still she still would have went through them, I guess. >> No, she don't know how to open up that third one. >> Well, no. I'm just saying she said she went through them. Not necessarily open them because they was open. Cuz she don't know how to open up them doors. When we go to school, she tries to open them. She does not open them. That's why you need to keep all the doors closed. >> I agree. What are you doing going outside? I'm glad that they were I'm glad they saw her out the window cuz I was riding around looking for somebody. I've been over here. >> So, bus driver found her walking that direction about >> Are you going crazy? >> Uh 2:55. I got over here about 3:00 and I've been >> Don't leave this house >> and I've been riding around trying to find cuz every every time I ask her where she lives, she's go, "Yeah, >> I >> No, don't leave don't leave this house again." And everybody keep the doors closed. All three doors. Oh, don't mess with that one. >> Oh, that makes sense. >> Go sit down that way. Go over there. >> All right. So, obviously we got an issue with Been an hour. >> Mhm. >> Thankfully, bus It was It was right around school letting out. So, bus driver was able to kind of scoop her up. She said she was going to go visit her teacher. Does she go to school? >> Yeah, she goes down the street. >> She at North or uh Starbucks. Okay. She said she was headed there to go see her teacher. You guys were up here sleeping. >> Yeah, I was asleep. >> You were asleep? Mhm. >> Okay. You just got here, correct? No, you said >> you said your brother was here but must have left. Are you you're not the brother? >> No. >> Okay. >> The mother also expressed frustration, insisting she had only been resting and did not expect to be drawn into the incident. >> You know when your brother's going to be back by chance? >> No, he's sitting right there. He probably not going to say anything. >> Oh, he's right. He's right there. Okay. >> Mhm. >> All right. And then you were asleep, right? So, did he know you were asleep? >> Yeah, everybody's here. Everybody's sleep. The door just got rushed open. >> She's all right. She's all right. She's all right. >> Nothing at all. >> Nothing. It's not play time at all. >> You You got to listen. You got to listen. >> Frustrated. Go that way. You got to go. You got to go listen. You got to listen. >> Not playing. You could cry all you want to. >> Do you normally keep the doors locked? >> Yeah. The doors always like somebody already open up the door. That's I'm like, >> "Okay." Were the other kids at school? >> What time? Yeah, the other kids was at school. >> What time did they get home? >> They all leave at 2:55. That's why I'm like if they seen him. That's why I'm like how she was out there for an hour. If it was like 2:55 cuz I just went to sleep. She was up here. So I'm like an hour. I probably don't think it was a hour hour. >> We got called at 2:55 and it's it's 3:55 now. So not quite not quite not quite an hour, but you know what I mean. >> So she just left when everybody went to go get get out of school. >> We're over over 30 minutes anyway. And that's that's thankfully the bus driver saw her and not somebody else that wanted to do her home. The presence of another individual further complicated the situation as responsibility among the adults was unclear. >> You called me. >> What happened? >> You called me. >> Kid got out. >> Yeah. They want to get your information cuz she left the house. >> Somebody else going to have to give it to them. Just give it to them. I'mma step outside. What happened? >> Cuz she left the house. All the doors get locked now. No, we're gonna >> We're going to hold up before you walk out >> because responsible adults here let a three-year-old child go for over a half hour. >> Okay. >> And I got and Well, someone's getting arrested. That's why getting arrested. >> I'm going to break it down like that. Somebody >> I left I'mma walk outside. I went to go pick my daughters up. >> And if and if you left the doors open and you were the only responsible party that was awake, you left all the kids here by themselves unattended because she was asleep. >> No, I we don't know if you left We don't know who left the door open. my brother. >> I explained to you cuz I'm going to walk right out that door. So, I need you to move out the way. When I had went to go get the kid, remember when I walked by, the doors were open already. >> That's what I'm like. >> When I came up the stairs, I wasn't even I thought she was still in school. So, when I had went out the doors, of course, I closed both doors. So, when I had left, I actually thought I might have had saw her, but it didn't really focus in my mind like that because she shouldn't be leaving the house like that anyways. You know what I'm saying? >> You think you may have saw her outside? >> Yes. Look, if I would have took if I would have stayed on the crosswalk and kept on walking, I would have actually saw her. Then I would have been like, "Yo, what the hell?" But I had went on the side of the bus, you know. >> Yeah. Let him go because Hold on. >> Said you're going to jail. Jessica didn't say that. >> Everybody's about to go to jail. >> So I'm about to get >> The conversation between the two adults grew increasingly tense as neither wanted to take responsibility for allowing the girl to be outside. This raised serious questions about the role of adults within the family. >> I'm about to take the fall cuz period. >> It's not taking a fall. Just ask them before I walk out the door. [cough] Have nothing. >> That's what I said. I don't know who is I'm not trying to arrest a person that's not >> but it could be it could. But listen, it don't matter if somebody We don't know who who responsible. That's what we're telling right now. Who left the doors open? >> I can investigate. I'm pretty sure that the door was closed and she opened it. >> Yeah, but it's that middle door that she can't open. So that middle door need to be closed, >> right? But that's not the only thing. Now hold on. Be quiet. Everybody be quiet because the situation could have been worse. Now shut up. Now wait. Be quiet. You're not going to tell me nothing to do with it. >> You do have something to do with it. >> No, I don't. You were irresponsible. You don't know. >> No, not my kid. And I'm not no responsible party. No, he's not. I just My brother was here. >> When I had walked outside, right? When I had walked outside. Go. I did see her bottle right there by the couch. You know what I'm saying? But it's not thinking to me that, oh, she left outside because she's supposed to be in the house. So when I walked outside to go get go get my daughter, she must have left 20 minutes prior. >> They said 2:55. Yeah. That's when they called. That's when the kids got released from school. >> Yeah. Like around that time. Yeah. >> When I did think that I had >> When you went to go pick my When you went to go pick my kids up, >> right? When I did with the girl, >> you need to ask her was the doors closed or locked. You know what I'm saying? Because if they are locked, then you need to don't be opening the doors. You know what I'm saying? Cuz she could have just opened the door to walk out to go um cuz he left before me to go to go get him. >> So, >> I don't know. I'm just taking it. Don't nobody know I'm taking the L cuz I don't got time. >> It's not taking a L. >> It's just going to be a CPS case drop. So, I don't care. >> Let them figure it out. Whatever case they say go to jail. We're not figure out the CPS case. Then we >> Nobody's Nobody's going to jail. I said somebody I got arrested. I didn't say nobody's going to jail. >> Arrested forest. >> Arrested for what? >> If it's that, we'll just call the CPS lady. So if you're going to arrest her, you want to just hurry up and go right now. It doesn't even matter. Should I go? Make up your decision. Excuse me. Can you cuz I have nothing to do with that. I could have I could have came from somewhere else in the area and come here. You could give him my information. >> Due to the nature of the case, CPS had to step in. This was also when the mother shared the personal difficulties she had been facing. >> Let me see where does that last CPS case lady cuz I didn't get no closure for that. Here you go. Cuz they already came up in here. She's not neglected. She's she's well taken care of. Thank you very much. This was an accident. >> So, yeah. What happened? How did >> I sleep? I don't know. The doors just got open. I don't know how she got out there. I was sleep I usually do sleep. They usually sleep right here when they not in school. >> Yeah. >> You sleep when they're not in school. You said >> no I sleep Yeah. I work 12 hours. I'm seeing that I work 12 16 hours. I can get some sleep while they That's the point. But the doors I don't know what happened to the doors. The adults was here. I don't know. My brother was here. I was here. So I'm trying to figure out my daughter was in there sleep around school time. All the other kids go to school. My baby, she the only one that don't go to school. So, I don't know why she decided, my three-year-old decided to leave the house cuz she usually don't open up the doors. So, that's my thing. Whole accident. >> Open up the doors. But I don't see Ariana playing with the door. >> Who else was present that could have been supervising her? >> Well, the kids went to school, so my brother left, went to go get my other kids. So, I was asleep. So, I didn't know. My doors usually be closed. Ain't nothing like this ever happened. >> I was up. >> Did you get his information? I was doing my essay, but I didn't know that Zana was not. >> Would you say I'm sorry? You didn't know she was in the house? >> No, I was up doing my essay, but last time I was on my room, I saw her in the house. >> Does she go to school every day? >> Yeah, she mostly mostly every day. >> Did she go to school today? >> No, she didn't. She's sick. >> Okay. Yep. She was coughing a little bit. >> After reviewing the situation, police and CPS agreed on a solution to help the mother improve supervision and care for her child. >> I let her play on my computer. I was hoping she could point out her house. I would say if also working on that [clears throat] was pointing out just let her know what her house looks like so she can point it out cuz that would have cut down on a lot of cuz we were literally right there. >> Yeah. >> How are you? >> So I just spoke with my supervisor. She said definitely the door alarms. If you're able to get them, awesome. If not, we'll get them for you. >> Yeah, if y'all can get them for me. >> And then for a safety plan, if you will, it was just that amongst the adults, just better communication to make sure somebody's got eyes on her. If she's home and all the other kids are gone, somebody has to be awake to supervise her. >> I'm not worried about She takes a nap. >> No, she takes a nap. It's going to be her. She's going to have to go upstairs and watch TV. When I go take a nap, she takes a nap. >> Okay. >> She was supposed to be watching TV and stuff like that. >> With CVS, if anyone's sleeping, it's not supervised. So, if you can have someone be awake while you take a nap, that would be ideal. >> He's always here. He just had an appointment. Yeah. He's always here. This the kids's father when I go to sleep. Well, it seems like a clear lack of communication today. It happens. I get that. But 45 minutes is a long time. That's what I'm saying. She's adorable, too. Such cute. >> Beautiful. And will the sentence be fair? Share your thoughts in the comments below. No family hopes for legal authorities to become the last line of involvement. But when safety limits are crossed, outside help can become [music] necessary. These stories show that responders do more than apply rules. They also make human- centered decisions under intense time pressure. What stands out is that even in difficult moments, the top priority is moving children away from unsafe situations, regardless of differing public opinions.
