Only thing I'm asking you to do is say the English alphabet. >> That's way off. Okay, switch it back. >> In policing, responding to hit and run calls, usually the vehicle that did the hitting is already gone. But it's a lot of fun when you put the pieces together, find the suspect vehicle and the suspect, and they're under the influence of alcohol. This is one of those. How are you? >> Good. Very good. >> Hanging in there. >> Hanging in there. >> Going for a a little walkie, right? >> This is interesting. When most people walk by the police and they turn their head and look down and don't at least make eye contact, it raises red flags. Granted, she's looking at her dog, and there could be a lot of other reasons, but it will definitely get an officer's attention if you don't make eye contact, but engage in conversation. >> Hey Dave, can you see if um you can get those two gentlemen again? No. Somebody hit a car and took off. And this looks like it might be the car. >> That's my car. >> That's your car? >> Yeah, I got hit in Brooklyn. locate him. I don't have visual >> in in Brooklyn. A truck run over to me. I went to get my hair done. >> I'm originally from New York, born and raised. I love hearing the East Coast accent, but included with her accent, I'm detecting a little bit of slurs in the speech. We'll see what's going on if this is the suspect vehicle. >> When? >> Today in Brooklyn. I went to Lucas to get my hair done. >> When did you get back? >> Uh, an hour ago. I don't know. >> No, this you just got back. His car is hot. >> Okay. I don't know. like 30 minutes ago. I don't know. >> I didn't hit anybody. Hold on one second. Hold on. Hold on. I did not hit anybody. >> All right. Cuz it came in as a white car and it matches right here. This is >> I understand. And I parked and there's a truck that it it was a UPS or something that ran into me. >> Okay. >> I'm sorry. I was in Brooklyn getting my hair done. >> All right. >> I was in town. >> You live in Where do you live at? >> Yeah. >> Okay. She says she's in Brooklyn getting her hair done. hair looks really nice and sometimes it takes a long time to get the hair done. From an investigative perspective, what happens a lot of times when women go to the hairdresser and get their hair done? Yes, they give them wine a lot of times. I don't know that that's what happened here, but if I hear that, I'm going to think that that could be potentially something because I'm coupling that with the slur speech and the potential hit-and- run situation. These are things you think about in policing. All right. >> I'm sorry. I didn't >> No, no, no problem. I'm just saying cuz >> if I were in Well, first of all, I didn't I would have respect to [ __ ] Sorry. Oh, >> good. >> But no, no, I'm right there. I live right there. >> Located those two gentlemen. >> All right, I'm going to come down with this female. You walk down here with me? Yeah. I'm not saying it's you. I'm just saying the it matches perfectly. >> I'm sorry. >> Hey. Hey, hey, hey, hey. BUFFY, PUPPY, PUPPY, PUPPY, PUPPY, PUPPY, WATCH OUT. GET OUT OF THE WAY, HONEY. GET OUT OF THE WAY. I GOT IT. I GOT IT. MOVE, MOVE, MOVE, move forward. I got it. I got it. I got it. Move forward. I got him. I got him. I got him. I got I got I got him. Relax. It's okay. Friendly. >> Everyone's okay. Everyone's okay. >> Are you okay, honey? Friendly. >> Hey, honey. Are you okay? Yeah, I'm >> okay. All right. I know. I got the dog. I got the dog. Go ahead. Keep walking straight. Keep walking straight. >> He's friendly. He's friendly. >> Are you okay, honey? >> Yeah, I'm fine. >> Okay. See, my foot did it. I got it. We got it. Everyone's okay. >> He's friendly. He's friendly. >> All right. Okay. All right. >> Has a mean guard. >> I got you. I got you. It's okay, puppy. >> I did not see that coming. However, good job by the officer. I mean, these are the kinds of things that happen in policing. A call inside of a call potentially. And that lady really needs to get better control of her dog. >> So, I got a white infinity up here. Fresh damage. >> The hood's hot. She's saying the car accident happened in Brooklyn. >> Okay. This is something I'd like all of the legal minds to jump in on. Do the police have the right to move this lady this distance during this investigation? This is a very good question because is it considered a seizure by moving her from this place to that place during this investigation? I'm going to talk more about it towards the end of the video. So, I want to get them the ID. >> All right. >> If this is her, >> she's saying no. So, I got a white infinity here. Why don't you walk up here with me? I got a white infinity. The damage matches perfect. It's fresh. >> Uh-oh. >> She said it happened in Brooklyn. >> Amazing. >> No, it happened right here. >> Okay. Well, just take a look at the car for me if this is it. >> Wow. >> I'm not sure. I'm not saying I'm not sure if it's her. >> I I >> You know, >> is that the car there? >> Yeah. You said it came up here. There's a car parked right here. >> Was the SUV? >> Yeah. And she has higher end one. >> She has blonder hair. She reeks of a >> boo. Like she pulled into here. >> She just Yeah, there's a car right here. She said it happened in Brooklyn. >> No, it happened right here on the I saw it. >> It's like fresh damage. It's pouring It's pouring off of it. Yeah, >> she's lying. >> Is this it? Look at the dams over here. >> Oh yeah. So that's like Yeah. This could be her car. I don't want to say like it's white and it's me and I said it was a higherend SUV. >> She's saying it happened in Brooklyn >> and she pulled into here. This exactly when I saw her back into that and she came right into here. So >> So how did the accident happen? She backed into you on an angle. >> No. No. So he was the witness. >> So she was on Hillside Avenue. Mhm. >> She was driving in reverse. >> This Okay. This a white SUV. She was driving in reverse coming down the hill and I'm like, "What the hell is she doing?" Then I'm like, "Oh, I wonder if she's like, you know, trying to get a parking spot on Portland." So, and then I'm like, "Okay." Then she passed us and then we were walking the dogs and then I heard crash and I turned around. I said, "Holy [ __ ] she just hit that car." And then she after she hit the car, she took off and came right into here. And then I told my friend, I said, "Let's go find her." I said, "This ain't right that she took off." Okay. And then I'm like, "Let's go see if we can find her." So we just walked there. >> She's out there. Theo's out there. >> Lady of the owner of the car. >> Bill, this is so fresh. >> Yeah. >> She says it happened in Brooklyn. That's what I'm saying. >> It's coming off. >> It just happened, right? >> Yeah. >> The investigation is now moving and leaning more towards this female being the suspect and more towards probable cause. I don't know in the officer's mind where he feels like he has probable cause to say that he can make an arrest. But interesting thing about the witness, if you ever placed in a situation where you could potentially be a witness, it's very fair to if you don't 100% know to not say that it's the person, don't just feel like you have to appease the officer cuz you can mess up the case by doing that. Just state the facts. And here's another important point, and I've mentioned this in other videos. If you do a written voluntary statement, understand that that's discovery and that the defendant side gets to see that stuff. So if you put personal information that you don't want on that witness statement and that's discoverable and you have to be really careful cuz every jurisdiction protects that information differently just a little bit information if ever you get asked to complete a voluntary statement body camera is great but sometimes you still have to do [music] a statement or still asked to do a statement that >> the hood is hot this is the car then >> I guess so I can't say per se but it's a white >> okay I would say this is it 450 say definitely this >> so when you s when you saw it happen is when >> you called correct >> well no then I I saw it happen she took off she pulled in here right and I said I told my friend I said this don't feel right we shouldn't walk away let's go see if we can see if she's hiding somewhere in here no we didn't see this cuz I didn't see this right >> so we came through here and like I guess we lost her then we came back through here and then the lady came and she goes, "Oh my god, >> oh, I didn't realize this is closed off right here." >> I said, "Oh my god." She goes, "My car." And I said, "We saw it happen." I said, "Call in." I said, "Call the police so you can get insurance so that you don't get like, you know." >> All right, I'll go have a chat with her. >> But I can't like I can't say, "Oh, it's definitely >> Yeah. No, there's no way that that happened in Brooklyn because they're still shaving." >> That's what I'm saying. It's fresh. >> Yeah. No, that's >> She said she got back an hour ago and I said, "Your car is hot." Yeah. >> That's her. And I said she was a blonde lady and >> and she's and she's blonde. >> She's like gray blond. >> It's gray blonde, but it's blonde. Yeah. >> That's your vehicle. >> Yeah. >> Okay. That just happened. That didn't happen in Brooklyn earlier today. That damage is so fresh. There's still shavings on there. Okay. >> I drove to Staten Island and I dropped her food in my daughter's house. And >> no, that just happened here cuz we got a witness that saw you pull up in here. That just happened. That damage is so fresh. You're not telling us the truth. And if you're if you're deliberately lying to us, that's going to be an additional charge. I wouldn't lie to us. Be just be honest >> and it won't go as bad for you. But you got to be honest. >> Do you think if I hit her car, I would not know? >> Obviously. No, I I think you know. >> No, I didn't. I went I I went to my kid in Staten Island and I came home. That's when I noticed. >> So, listen. Let me explain something, Dick. >> So, this is half an hour old, maybe. >> Okay. From Brooklyn to here, you got here in half hour? That's impossible. No, I saw where I spent time in my daughter's house. I dropped off the food. >> Now, the question at this point with what the officer has developed, it looks like he's a sergeant. I see the three stripes on there. Would Miranda be appropriate at this point? Is this an investigative detention? Is she free to go? A lot of times when you watch these videos, ask yourself at this point, would Miranda be appropriate? And I don't know if in another segment he read Miranda, but at this point, would Miranda be appropriate if you're going to start asking these questions related to this accident? >> I noticed it here. You know, no you didn't cuz you told me a box truck hit you, man. >> It broke. Right. I >> So, how did you notice damage here if you know what kind of truck? >> And when I got here, >> listen, stop playing games. Okay. What are the chances of someone saying a white female with blonde hair hit the car? It was a white SUV that went right there and sure as [ __ ] right around the corner is your car with damage matching perfectly with that. And the hood is hot. And you said you got home an hour ago. >> Half an hour. >> You did. You You backed down and you backed into a car. Somebody saw you. There was a witness. Okay. What you're doing right now is you're lying to the police. That That is a charge. You don't want that charge. >> Just be talk to this officer. Go be honest with him. >> Just go be honest with him. >> I didn't know I didn't hit anybody if I did. There is no possible way you could have backed into that car >> damage. I'm sorry. There's no way I would have heard it. >> There's no way you could not hit a car like that and not know it. >> Exactly. That's my point, >> right? You're not being you're not being honest with us. >> No, they probably had damage before. And if if let's say for example Let's say for example, if I did hit them like Yeah, I had to back up here because of the construction. But if I hit some something like that, don't you think I would hear it? I'm sure you would. >> Okay. So, there's probably that many. >> There's no doubt that you you hit the car because we have a witness that saw it. Okay. Whether you heard it or not, I I don't know how you could not hear it. >> That's my point. >> But you definitely hit it and you can feel it. Whether you hear it or not, you hit a car like that, you feel it. It's not like you're driving a big uh a big pickup truck and you back into something and you don't feel it. your car there. You do that. You feel it. Do me a favor. Go speak with that officer. Ma'am, >> go tell him the truth before he charges you with lying to him. Just go talk to that officer over there. Go tell him the truth. >> Well, go ahead. I'm going to give you one last chance. You go talk to that officer. That's your car. You didn't have any damage on it before, right? >> Brand new. >> Okay, Kev, she wants to talk to you. What's up, man? >> Hey, it basically gets like the driveway. So, we have this drunk lady over here trying to say she didn't hit the car, but it matches >> absolutely perfect with that car. Would it hit that? Would it get that, you think? >> I don't think so. I could I could get my phone and show you that. >> So, apparently she was backing down here on on the hillside all over the road and then passed here and then she turned into here. This is her right here. And then the witness said that she slammed right in the back of the car and took off in here. Uh I could I could show you my like the view. >> Okay. You did it. >> I I didn't steal it. >> You did it. Okay. >> I I didn't. >> Like I said, this isn't my first day. >> There's no way I would have could have done that dumb and damaged. >> But the damage matches perfect with your car. And listen, the reason the reason why you're you're saying you didn't do it is because you wreak of alcohol. That's why. >> What? >> You smell like alcohol. >> Okay. This isn't my first day, ma'am. Okay. Hey, I'm not I'm not stupid, okay? I There's a witness saying you did it. The car is right there. You wreak of alcohol. The witness said you're all over the road. Okay? So, this is where we're at, okay? So, just stop lying. It is what it is. It's It's an accident. Whether you said you there's no way you didn't feel that, you know what I mean? That's pretty >> Look at the damage. How How did you not feel that? >> I'm sorry. I did not do that damage. There had to be damage before going to take advantage of the situation. I'm sorry. >> All right. So, you know that >> you didn't do any of that damage? You have could have passed when you come on. >> I look at the damage on your car. >> Well, come on. You think about it. First of all, come on. Let's be honest. There's no way I could have done that damage. >> That means I had to let >> you drive an SUV. It the damage matches perfect. >> Look, my name is Olga, right? And to do that damage, if I did it, let's say, and I didn't feel I was backing up, which I was. Do you understand? Like that's they had that damage before. Maybe I I'll take the blame if I did put >> Well, if you're saying you didn't do it, don't take the blame. >> No, but I'm saying like there's no way I could have done that. That That's like That's like backing out like full force. Are you kidding me? I've been driving for 20 something years. >> Just hang tight one second here. Okay. >> Still lying about it. >> She wants to take the blame, but she doesn't want to take, you know, she's saying she didn't do that damage. >> Nobody takes the blame for something they didn't do. >> That's what I'm saying. The damage match is perfect. Yeah. And I didn't have a scratch before. >> Let's say it happened. I'm already going along with your story, but that's like that's like >> Sam, it's not our story. It's the story of an eyewitness. It's the story of someone who identified you backing down this road in that car and then pulling up there. It's not our story. It's a witness. >> Okay. So, please don't get aggressive because >> I'm not aggressive. >> Okay. But let's say I I did it. Let's say I did it. Okay. Let's say I I'll go along with it. But that's like backing up full force. Like how did I hit the front and the back? I mean there there was damage there before. I'm sorry. There was no damage before. I just got this car. It's like months old. >> Well, here. Let's go out of the over there. >> Yeah. Okay. >> Since you entered your house, did you have anything to drink? Any alcohol at all in your house? >> No. I I No. >> Okay. That was the key question right there. Because if she went in her house and she drank, they can't conduct a DUI investigation because what booze was on board when she was behind the wheel and what booze is on board now post driving the vehicle? That was a very tricky question and I was looking to see when he was going to ask it. So since you got home, >> no, nothing. >> You went up the driveway, you parked, you got your dog, you didn't have anything to drink? >> No, I did not. >> Since you exit since you entered your house? >> No, I did not. >> You sure? >> Yes, I'm sure >> you had nothing to drink since you got in that house. >> No, I didn't. >> Okay. Did you have something to drink in Brooklyn? >> I went to lunch with my mother-in-law and my mom. >> Okay, just put the pocketbook up here. Okay. >> I just feel like if I did that damage, I would have felt it. I'm sorry. She definitely had damage before. >> I don't know if she had damage or not. You know, she said she had no damage. >> Obviously, she's going to say that. >> You know, well, she's an older lady. I don't think she would lie. You know, what's the chances? Like, what's the point of that? >> And I'm a lady who would step up and say, "Take care of it." And >> Well, I know. You've been lying since we got here. So, how why should I believe you? Well, because I I came home thinking this happened in Brooklyn, >> you know, like I'm not I'm not lying. I >> just put your pocketbook on top of here for me. Okay. Eye glasses. Do you wear glasses? >> Yes, I do. >> You do? Okay. Wait. Can you see close though? Like, can you see this pen? You can see this pen, right? >> Um I'm I'm um reading glasses. >> So, for my new viewers, this is called the horizontal gaze nagmus HGN. This is conducted on nearly every field sobriety investigation. They're looking for six points. detection. It's smooth pursuit that the eyes follow smoothly 45° and maximum deviation. You also have the possibility to have vertical nice stagments and officers will check for that as well. And sometimes you can detect narcotics as well. >> Well, I'm asking here. Stand right in front of me like this. Put your feet together. Put your hands by your side. Can you see this pen right here? >> Yes. >> Okay. All right. So, you're going to follow this pen with your eyes and your eyes only. Okay. You're not going to move your head. Okay. So, you're just going to follow the pen with your eyes and your eyes only. >> It's kind of close. Yeah, it's it's supposed to be close. >> Okay. >> All right. So, don't move your head. >> This is crazy. I can't believe I've been doing this. >> All right. Listen, I know I know you got a lot going on, okay? But I just want you to relax, okay? Put your hands by your side. Relax. Okay? And you're going to follow that pen with your eyes and your eyes only. Okay? You're not going to move your head. But >> you're too close. I mean, oh, >> I have to be close. It got to be 12 in. Okay. Okay. You're moving your head. Okay. >> Okay. Just remember just so look at my eyes. Okay. Just look at my eyeballs. Okay. So, look at my eyes. >> Okay. Okay. Let's do it again, please. >> I know. I just want you to understand. That's all. Okay. >> Excuse me. I'm not drunk. So, let's do it. Let's do it. Let's do it again. Let's do it again. It's just that I >> Is that what you want me to do? I don't know what you want me to do. >> The only job you're doing oga, right? >> Yeah. >> Your job is just to stand there and just follow this pen with your eyes. >> Did I? I don't know. >> You're not. You're moving your head. That's why I'm asking you. >> Pretend your head is in a vice. >> Yeah. All you got to do is move your eyeballs. >> That's what I thought I was doing. >> You're not doing that. Okay. >> Okay. Let's do >> So, in front of you, what I want you to do, you're just going to stand there for now. Okay. In front of you, what you're going to do is, you know, we could use this. You see this line right here? >> Okay. >> We're going to use that line as the guide. Okay? You understand that? So, what you're going to do is you're going to put your left foot on that line. And you can do that now. Go ahead. Now, take your right foot. >> But what do you want me to do? >> I'm trying to explain it to you. Okay. So, right now, I just want you to just just be quiet. Okay. So, you're going to put your left foot in that line. You can do that now. >> You're going to take your >> Yep. Take your right foot and put it in front of your left. Just like that. Now, you'll tell. Now, put your hands by your side. Now, you're going to stay in that position until I tell you to move. Do you understand? Okay. Hands by your side. Okay. So, when I tell you to, what you're going to do is you're going to take nine heel totoe steps down that line. Okay? As you're walking down that line, you're looking down at your feet. Okay? You're counting your steps allowed. Okay? And make sure uh to walk heel to toe. >> This is the heel to toe test, which is another one that's frequently done. But there's something I found interesting during this is the officer to the left on your screen, but to the right of the female that's sitting down during this investigation. I don't know if he has some kind of injury or requires him to have to sit down. And this is not me trying to knock him, but sitting down like that is, in my opinion, not a professional way to engage in investigation. Maybe sit inside your car if you really need to sit down. It just doesn't look good. And optics matter [music] in policing. >> Okay. At the end of your ninth step, >> the reason why this is happening because >> Yes, absolutely. Cuz I feel that you're intoxicated. Okay. >> All right. >> All right. At the end of your ninth step, you're going to keep your lead foot planted, which is your front foot. Okay. >> I'm here. Okay. Now, what are you going to do? You want >> You just got to be quiet. That's right. Now, all you're doing is being quiet and you're just observing me. Um, I'm going to explain and demonstrate the test for you. Okay? So, at the end of your ninth step, you're going to keep your lead foot planted, which is your front foot. You're going to do a series of small steps and then come back down that line. Okay? I'm going to demonstrate it for you so you understand. Okay? Remember, I'm only going to do three, but you're going to do nine. Okay? So, it's going to look just like this. One, two, three. I'm doing three. >> I got I got you. Okay. This is nine. I got you. >> I'm doing three. You're doing nine. Okay. At the end of your nine step, you're going to keep your foot planted. You're going to do a series of small steps like this. Then you're going to walk back down the path. Remember, look down at your feet. Count your steps aloud. Walk heel to toe and keep your hands by your side. Okay? Any questions at all? >> Can I stop walking? >> Any questions at all? I want you to fully understand the test. I >> I I my question is why am I doing this? But okay, >> I already explained that. >> Okay. Hold on. One second. Tell me when I'm done. >> How many steps did I tell you to take? >> I wasn't counting. I think you will count. >> I don't No, I don't count for you. >> Okay, I can do it again. >> Okay, go stand back. You got to relax. I'm going to explain the whole thing again. >> I'll do your nine steps. >> Okay. Well, you just did you just did >> I I just feel like I'm being harassed right now. >> There's nobody's I'm doing We're doing our jobs. That's all we're doing. No one's harassing you. Okay. >> And I'm doing whatever you want me to do, but I feel like this is >> Do you want me to explain and demonstrate the test again? >> Okay. You want nine steps, right? >> Okay, >> 2 3 4 5 Okay, I can't count. Okay, hold on. Can I just walk? Okay, now you got to do nine steps back. >> Want me to do it again? >> No. Come on, ma'am. This isn't that hard. I [laughter] >> What are you going to do? >> Let me explain. I'm going to listen. I'm going to demonstrate the whole test for you. Okay. So, you understand? >> You want me to count? >> I explained that to you already three times. Okay. >> But I >> I'm not trying to be >> You just sit there. >> Okay. >> He's going to demonstrate the whole test for you. >> This is what I want you to do. Just like this. Nine steps. One, two, three, four, five, six, seven, eight. >> You want me to I want you to shut your mouth. Okay. Just be quiet. Okay. One, two, three, four, five, six, seven, eight, and nine. That's what I want you to do. Okay? Just remember to walk heel to toe. Look down at your feet. Keep your hands by your side and count your steps aloud. >> 2 3 4 5 6 7 8 9 10. >> You're not even listening here, ma'am. >> He's going to do another test. >> You stand over here. >> Oh my god. >> Okay. What I want you to do is you're going to put your feet together like this. >> Okay? >> Put your hands by your side. Now, when I tell you to, >> either foot of your choice, either your left foot or right foot, it does not matter. You're going to extend that foot approximately 6 in from the ground. Put your foot down when I tell you to. Okay? When I tell you to, you're going to look the top of your foot. You're going to count up by thousands. 1,00 1,002 1,003. >> In addition to not doing the test properly, tell you to follow the instructions as something else that's documented normally, and it doesn't look good. so on and so forth until I tell you to stop. If you happen to put your foot down, just say 104. Just pick it back up. >> Say 101. >> Ma'am, listen. I just want you to be quiet. That's it. I'm trying to explain this thing as >> I never did this before. >> Well, I could, you know, I know. I'm just I'm trying to explain this thing. >> Okay. If you happen to put your foot back down, just say 1004. You're just going to pick it up and start from 105, 1006. Put your foot down. Okay. Do you understand the test? because I can explain it and demonstrate again for you if you want. >> I'll do it. Just help me with I never >> I can't help you do this. I just showed it. >> I'll do it myself. Okay. So, what am I counting? 10,00 1. >> You're going to count up by I just explained the whole thing to you. Okay. Like this. >> Feet together, hands by your side when I tell you to. Either your left foot or right foot. You're going to extend either foot of your choosing approximately 6 in from the ground. Just like this. You're going to keep your foot parallel from the ground. From here, you're going to count up by 1000s. 100 1 2 100 3 until I tell you to stop. If you happen to put your foot down, just say 1005. Just pick it back up and start from 106 and continue when I tell you to stop. >> Okay. >> Okay. Any questions at all? >> No, I mean, >> okay, you may begin then. >> Okay. 1,00 1,00 2 1,003 1,004 1,005 1,006 1007 1,89 1,01,23 1,56 >> Okay, put your foot back down. What's your highest level education? I'm a I'm a surgical coordinator supervisor and a while for nail card surgery. >> Okay. So, it's um easy to say that you you understand the English alphabet. >> Yeah. What what are you wrong now? >> Nothing. I'm not done with my test yet. So, all right. Okay, >> please. >> You're not going to have a criminal record. >> Oh my god. >> So, it looks like this lady received some citations. The accident obviously happened. If there were no witnesses and the police didn't get notified, that victim would have been responsible for fixing her car. Sometimes people, no matter how old they are in age, don't end up taking responsibility for things that they need to. This was an appropriate response by the police under the circumstances. And my constructive criticism for the officer sitting down, I would say it to his face. Professionalism and policing matters. And I hope that he doesn't have any kind of injury that precludes him from standing for long periods of time. But that's not my business. It's just what I saw on the screen. So I want to talk about difference between investigative detention and arrest because I wanted to discuss the officer moving the female during this what I believe to be an investigative [music] detention period because that movement can turn it into being an arrest if the officer moves a person far enough or the degree of custody that they take the person in and how far they move. There's an interesting case, a 1985 case, United States versus Sharp with an E at the end. It's 1985 case. It was a [music] 7 to2 ruling and it was about the time that the police can hold a person during this investigative detention period. And they did not make a time. They just said that it has to be diligent and without unnecessary delay.
