They're going to break my arms. I don't know what conditions I have. >> This [ __ ] right here pulled me from under my elbow. >> Every officer has encountered a person who attempts to make us think they're not intoxicated when they really are. And when they're behind the wheel of a car, and then they get out of the car and start stumbling around quoting law to us that doesn't exist, and then getting aggressive, they're definitely going to end up in handcuffs and on their way to jail. This is one of those. >> What are you doing? >> Hi. What are you doing? >> What are you covering up? >> I'm not covering anything up. >> You literally just threw everything down onto the floorboard. >> my bag for my license. >> You were literally throwing [ __ ] down. >> I'm parking here because I work here. >> covering something up on the floorboard. >> Already seeing signs of intoxication. You see the glassiness of the eyes, you see the motor skills seem to be off, and the speech is a little bit slurred. Initially, I'll be getting signs of intoxication. >> You did. >> You know why I'm pulling you over? You know why I'm pulling you over? >> Sienna. >> You know why I'm pulling me over? >> Why? >> You're going to give me attitude right now? Like you're annoyed because you went right through the red light in front of us at Orange and Wa- Okay. What is working here driving through a red light on Orange and Washington? >> I'm late from work, and I'm sorry. >> You're late from work? >> Yes. >> Okay. >> Where do you work? >> Here. >> Ma'am, do me a favor, put your car in park. >> Yeah, it's a >> I can't because I pulled over cuz I saw you behind me. >> Put your car in park. >> Um, yeah. There's a bottle in there. You want to talk to me? So, what do you do for work? >> What I do for work? >> Uh-huh. >> Sales vacation. >> Sales vacation? >> Vacation sales. >> It seems like the officers are really on it. They're super observant. They see everything around the car. Huge challenge with the positioning. Is this the safest way for us to operate with our hands over the door jam, our torso exposed, even though we know we do have a vest on, and then the other officer is in exact crossfire position? Getting behind the door jam and having the person turn towards us seems to me to be a better practice. I know sometimes officers do this to see if they can smell booze, but when we practice this continually, then that becomes a second nature motion. The safer practice is to make a habit of standing behind the door jam because your partner can even take visual cues from that. >> So, there's an open bottle of tequila in the car. How many How many Ma'am, I'm not arguing with you. I'm I'm Ma'am, Ma'am, Ma'am, let's talk. How many drinks do you have today? >> None. >> Oh, okay. Why is there open bottle of tequila in the car? >> There's not. >> Why did you blow by that red light? >> I didn't blow by that light. >> Okay, you did. Obviously, the observations exist and then you see the cup there that's in the center console right there. Again, that's something that the officers are definitely going to check. Do me a favor, put your phone up. >> I'm not going to hang up. I'm not going to hang up. >> Ma'am, just take your phone out. Right now, you're you're detained for a traffic stop, okay? Do me a favor >> I'm already parked. >> Ma'am, do me a favor, step out of the car for me. >> I'm going to bring my >> No, you're not, Ma'am. Please step out of the car. Ma'am. >> You can take my phone. >> don't resist. You're going to you're going to go to jail. >> Relax. >> I'm not resisting. It's not resisting. You can't take my >> Stop. Stop. She's She's fighting. Stop. Stop. Let go. >> Let go. Do it now. I said let go. I said let >> You're pulling You're pulling your arm back. >> Let go. >> You reek of liquor right now. >> Hello. What is going on? Sienna, make sure you stay on the phone, please. >> if she's involved in signal 3 utilities. >> In 73, what is that? >> We're not talking to you. >> Yes, you are. >> We're talking to each other. >> Sienna. >> What's on the back >> Where's my phone? >> It's up here. >> is going on with you today. >> Sienna. >> What is going on with you right now? >> Sienna. >> You don't need to be here. I'm hanging up with you. >> Ma'am, no. Do not hang up my phone. That's illegal. >> Ma'am. >> I have a I have a brother who's a police officer. >> Okay, well, guess what? >> You hanging up my phone is illegal. >> So, a couple things. In the comments, I'd like to know what your thoughts are on the officer hanging up the phone. I know why he hung up the phone. I know it can become incredibly distracting while they're trying to conduct business. I know some people are going to say, "Why Why he hang up the phone?" Because some people say, "Well, maybe you're presenting another witness that's going to see her bad behavior. I can completely understand why they hung up the phone. A lot of times people will debate that. It makes sense to them because the female on the phone was starting to get aggressive and obstructing what these officers wanted to do and kind of setting her off. >> I'm doing her a favor because if she comes here to this location >> She's She's not going to come here. >> this investigation, she goes to jail. So, I'm doing her a favor. >> She's literally looking for your location right now. >> No, she's not. >> You've been extremely uncooperative at this point. >> I'm I'm cooperative. What do you What do you guys need from me? >> You reek of alcohol. >> What do you guys need from me? >> I'm trying to talk to you. Stop talking over me. Answer my questions. >> I'm sorry, sir. >> How many drinks did you have because you reek of alcohol? >> I have not had any drinks. >> Nothing? >> Nothing. >> Okay. So, if I do some exercises, are you willing to do some exercises? >> Is that legal? >> You don't have to do them. >> Okay, let's do it. >> Do you want to do them? If I take you out of these handcuffs, are you going to cooperate? >> Yes, sir. >> All right. >> I promise >> If you If you act up, you will you'll be charged with additional charges. Do you understand that? >> Yes, I will not act up. >> Okay, I want you to take a look at this officer's uniform and you see here a positive. The other officer has the exact same thing on his uniform with the A positive. This started in the military. You can have it tattooed, which is our blood type in the event of a critical situation and they need to get blood. You very quickly know what the officer's blood type is. However, a hospital almost always guarantee that this is correct cuz an officer could be wearing someone else's or not necessarily know. So, a lot of times people see that, they don't know what it is, but that's what it's for. >> You're on that with your right. >> Yeah. >> So, 18. Uh check if they're 18 or 19. >> I work here. So, >> Delta 1997. >> This is Hilton. You might not see it on the building, but this is Hilton Vacation Sales. >> Okay. >> How many drinks did you have today? >> None. >> Come over here. Turn off your front lights. If you would like to take them off, you have that opportunity to take them off. >> You know, you can't pull over somebody who's parked. >> This is not to be vulgar in any way, shape, or form. I think you know that I really present myself in a professional manner and for a reason. But, if you look in her crotch area, I can't tell if that's a wet spot for urine or if that's just a design of the shorts. If it is urine, that is definitely something the officers are going to want to document on the paperwork when they're doing this type of investigation. And we've seen in videos that I've done before, and every cop knows that some person that you've arrested for has urinated on themselves. And a lot of times, if a person is being investigated for a DUI type situation, urinating on themselves is something that you must document. And again, I don't know if that's the design of her shorts or not. >> Ma'am, I don't understand I don't know what you know, but I you committed a traffic violation at Orange and Washington. >> pull over somebody who's parked. >> Who said that? >> You can't. >> Ma'am. >> I know that. >> Okay, ma'am. So, are you going to cooperate uh >> Yes, I am. But I'm telling you right now you cannot pull over somebody >> Ma'am, that's not helping, ma'am. Ma'am, once we're done with this, but right now you are detained. Can you put your feet together, hands onto your side? I want you to follow this blue light. It's called the stimulus, with your eyes and your eyes only, without moving your head. Do you understand? >> Yes, sir. >> You're moving your head. >> I've explained HGN before, but for new viewers, I'm going to explain HGN, which is horizontal gaze nystagmus. This is probably one of the most effective field test that officers can do, aside from maybe even a PBT. It's scored on a six-point scale. You follow a stimulus with your eyes without moving your head, and you look for three different things. One is what the eyes do at 45°. If the eyes can smoothly pursue the stimulus, and what they do at max deviation. And what you're looking for is an involuntary jerking of the eyes. There are medical people who have trained them before. A nystagmus can be caused by a medical condition, but when a person drinks alcohol, there is normally a horizontal nystagmus, and sometimes there's a vertical nystagmus as well. Drug recognition experts, or HGN certified, will know what those are. >> So, we're going to start this off >> Am I moving my head? >> I'm not asking you. I'm telling you you're moving your head. >> How did I move my head? >> With your neck. >> I didn't. >> Ma'am, I'm not >> Can we do it again? >> We're going to do it again. >> Okay, please say >> All right, keep your feet together, hands onto your side, not behind your back. We're going to go over here where it's dry, okay? It's a walk. Hands out to the side, not up. So am I. Can you put your left foot on that line? Your left foot. That's your right. Your left foot on the line. Your right foot heel-to-toe, just like this. Keep that right there. All right? >> I'm actually a clumsy person. >> Okay. You're going to take nine heel-to-toe steps. Plant your lead foot, take a series of small steps, and take nine heel-to-toe steps back. Do you understand? >> Yes, sir. >> You may begin. >> One. Two. Eight. Nine. 10? >> Same way I instructed you. >> That was nine. >> Same way I instructed you. You said you understand my instructions? >> nine. >> Okay. >> So, do you like me to do more? >> The way I instructed you. >> One. Two. Eight. Nine. I have now done 18. So, anything else you would like? >> The way I instructed you. Remember my instructions? >> Yes, sir. >> All right, then do it the way I instructed you. >> I did that. >> She's failing this miserably. So, you you're done? >> No. >> Okay. >> So, you want me to go heel-to-toe. You want me to make my toe to touch the heel? >> The way I instructed you, ma'am. >> One. Stepping on my toes. Two. Eight. Nine. And we're at the end now. >> Okay. You're And you're done? Are you done? >> This is what you instructed me. >> Okay, so you That You believe that's the way I instructed? Okay, cool. >> Let's go. >> All right, we're going on to the next one. All right? All right. >> Face me. All right, the next exercise we're going to do is the one-leg stand. You're going to raise your foot, you're going to look down at your foot, and you're going to count aloud. 1,001, 1,002, 1,003. >> 1,001, 1,002. What am I counting to? Three? >> You're going to keep counting until I tell you to stop. >> Okay. >> Okay? So, you may begin at any time. >> Here? >> Yep. >> 1 2 3 4 5 This hurts. 26 27 >> All right. >> 28 29 >> Okay. So, how many drinks did you have today? >> I have not had any. >> None at all? >> No. >> Okay. Look at my partner. All right. And then, can you do a forward dive like this with your hands behind your back? >> A dive? >> Yeah. Like put both of your hands like you're praying behind your back. Yep. All right. Now, you're officially getting charged with a DUI, okay? >> But I have not had any drinks. >> So, when officers ask people how many drinks have you had, the most common response is two. The second most common response is none when they've been drinking. >> So, what happens when you are advised that you may still have no drinks? >> Well, that's up to the judge to decide. I made my determination roadside based on my training and experience and all my other observations. So, you're going to be afforded that opportunity to disprove what I believe um Well, in a couple of minutes. It's going to get towed. >> And you went inside my car? >> We will be because it is >> No, without legal um >> No, we're not going to discuss this with you. >> No, you do. There's something on top of my car. So, you went inside my car? >> Yeah. Please get in the car. >> So, you went inside my car? >> Yes. We did. >> Without permission? >> With probable cause. Get in the car. >> Without permission? >> With with probable cause. Get in the car. >> I need my phone. >> You'll get that. >> I need my phone. >> It's going to come with you. Get in the car. >> I need my phone. >> You're going to get another charge. Get in the car. Get in the car. Do it now. >> What's the other charge? >> have a resisting charge. Don't get another one. >> We're giving you a lawful order. >> My phone has to >> We will go get your cell your phone will go with you, but it's not coming with you in the back of the car. It's going to come up front and then it's going to go to you with into jail. >> So, can I please get that? >> The officer's 100% correct. All they need is probable cause at that point. Vehicles are mobile. It's an exception. We're able to go in and take out the items that was related to this. Watch your feet. Watch your toes. Ooh. I did not realize that was back there a year ago. No. Don't get in there. >> All All ma'am. How are you? Come on out. I'm just going to search you, okay? >> Search me? >> Yes. >> What do you have to search me for? >> Cuz you're going to jail. >> So, don't you search me when I get there? >> We're going to search you right now. Get out. >> So, we have to search you now. Don't search me. >> All right. >> Does that make you feel tough? >> Not really. >> I wouldn't talk back if I were you, ma'am. >> I'm just sitting here watching the party. >> You got to stand still. Can you do that? >> You have me off the curb. >> No, I'm actually >> I can't put it like >> There's only a centimeter from the curb. >> Widen your stance. >> Look at her cuff is basically off and I don't know if she's trying to take it off, but her cuff is pretty much off. >> Wider. What else do you want? What else do you want? >> Wider. >> It can't go wider. >> Yes, you can. I promise. >> No, I can't. >> Try. There you go. >> Hey, hold on. Hold on. Hold on. Hold on. This thing's about to >> Oh, wow. >> They already have you for resisting as well, so >> Yeah, so you're >> Okay. >> Do not do that. >> Stop. No, leave your hand. Let's get on the ground. Get on the ground. >> Are you going to break my my finger? >> If you make it so I can't >> Are you going to break my hand? >> fault. >> Are you going to break it? >> Yes. >> Yeah. >> Make sure that one's You're searching me to go to jail. >> We're We're there already. >> Don't push me. >> I don't want to >> Stop pulling away from me. >> Stop. >> Don't I'm not pulling away from you. Don't push me. >> Got it? >> Hello! >> [screaming] >> Go ahead. Yeah, we're good. >> Someone >> I'm being arrested. I'm being arrested unlawfully. >> I'm going to say it every time. It's not a tactically safe way to carry your hair with that long ponytail. We just saw the female ripped her cuff off of her hand. What could she have potentially done and then do we have to escalate the situation to become more violent? Put it in a bun. The officer looks like she's in great shape. She may have great defensive tactics, but why give a suspect the ability to pull that long piece of hair that's behind your head? >> Hold it like this. >> Record this if you can. Record this if you can. >> right now. >> No, they're recording as well. Are you going to arrest them, too? Cuz you guys knocked up my phone. >> Only you're going to jail. >> You guys knocked up my phone. >> Okay. >> You don't You right to take my phone. You don't have a right to do that. >> Sure do. >> Get off my arm. Get off me. >> And she slipped one of the cuffs already, so just just keep an eye on it. Rosario, you need transport. >> Uh, let's put her in Rosario's car. >> This is not the right way to hold somebody. This is not the right way to hold somebody. This is not the right way to hold somebody. >> Stop resisting, ma'am. >> Oh, not the right way. Not the right way. All right, you're going to get hurt. >> Stop resisting. >> You're going to break my arm. >> Stop resisting. >> You are going to break it yourself by dropping like that. You are going to self-inflict your injury when you drop all your weight to the ground purposefully trying to make it difficult for us to walk. >> Super smart thing that the officer did. I don't know if all of you picked up on it, but he's narrating the behavior that we're witnessing so that if this goes to court and she makes the complaint, he's narrated in real time what she's doing to potentially hurt herself. Kudos, good stuff. >> Improper. >> Rosario. Where's your car? Let's throw her in your car. Unlock it. Plus, she's going to go Rosario, he's throwing her over here. Get your arm >> And his car's over here. Okay, are you >> They're going to break my arm. They don't know what conditions I have. They don't know what conditions I have. >> Stop resisting. >> Tell them to get from under me. >> It's not happening. >> Stop, [ __ ] right here holding me from under my elbow. >> Because of the way you're acting, yes, she's going to continue to hold you like that. >> I have not physically arrested anybody. >> You keep dropping your weight trying to get out inside of our frame. >> She's holding me wrong. >> You've been resisting every step of the >> Like holding my shoulder like that. And now you're pushing me against the car. I am. Now you're pushing me against the car. Stop doing that. Stop. >> I'm going to tell you right now you are not running the show, okay? >> I don't care. >> Stop fighting. >> You're not going to hurt me. >> The more you fight back >> You're here to help people. >> I I'm trying to help you. >> helping me. >> I'm trying to help you. >> her do this to me. >> No, as right now, no. She just wants to run the show. >> I don't want to be taken by her. >> Ma'am, that's not how this works. >> You're here. >> You're not You're not You're not in control of this arrest. I am, and she's going to take you cuz it's another woman. >> Come on. >> Go. >> So, you just said you're going to >> to catch another You don't understand. >> I'm being cooperative, but you have been disrespectful. >> And you've hurt me. >> I was rude to him, yes, at least he hasn't hurt me. >> This type of DUI arrest takes a significant amount of time and takes a lot of officers off the street, as you can see, especially when it's a female and they have to get another female that has to do a search, depending on the jurisdiction. So, in this one, we saw the resisting charge, we saw the battery on a law enforcement officer charge, and then ultimately, the DUI charge. I've seen this happen many, many times. When this young lady sees herself later on down the road in court and she's completely sober, she's going to be like looking at this and say, "Oh my goodness, I can't believe I acted like that." Hopefully, so that it can adjust her behavior. Daytime drinking is a serious challenge, especially when you're on break from work, allegedly. But, here's the thing, a lot of people look at DUI and call it a misdemeanor, and it is a misdemeanor in most jurisdictions, but the seriousness of what can happen [music] if a person drives drunk, we've already seen, and I know there are people watching this video who have [music] lost loved ones and family members to people who have driven under the influence of alcohol. So, this is a video you should share with someone that you know who could potentially [music] act like this because it is a horrific decision. Share the video with that person, like the video, subscribe to the channel, and there should be a video on your screen. Click on that video for more content just like this.
