I'm pulling away. I'm pulling away. >> Quit pulling away from me. >> I wasn't. I wasn't pulling away from you. >> In policing, when we get ready to pull you over, there are several tells that there might be something going on more than just a traffic stop. If when we get behind you, you make a turn on the first street, that's a tell. If you pull over quickly to the right side of the road and the passenger jumps out of the car, that's a tell. And after all those tells, if we figure out what's going on and decide to take you into custody, don't fight because you're going to lose and you're going to go to jail. This is one of those. >> Mom, that's better help, h e l p.com. >> So, it looks like he's going after that white SUV and he made a quick U-turn, which kind of let me know cuz if an officer makes a U-turn after they pass us, we think that they're coming after us. And that car turned really quickly and the officer went through the light. I'm led to believe he's going after this SUV. >> help.com >> Another quick turn. If this is radar, there are two types of radar that I'd like you to know about because I believe this is likely radar. So, there's lidar and there's Doppler. Lidar goes off laser, Doppler goes off radio waves. That would have been a Doppler radar that he picked this vehicle up on if this was a speed thing unless he has a some other reason. Couple other quick things. If you get pulled over speed, it's usually radar, estimation, or pacing. Those are the three most common ways. >> Go ahead. Stay in the car. Stay in the car. 1524 here on February 4th at Outdoor World, Louisiana. North 639905, VIN 639905. And we all watch what it is. >> So, this is really interesting. So, I can tell the officer has some good tactics. On the PA, he tells the passenger to get back in the car after he got out of the car and then he calls out the radio stop. I've mentioned this before, it takes some dexterity because it's the same mic, you just have to push different buttons. One to broadcast to the passenger and the other to broadcast the dispatcher location and the vehicle plate. I've seen officers make mistakes and I've made mistakes myself where you accidentally broadcast what you wanted to say off the PA. So, it's good that he has the dexterity to handle that and also the presence of mind to have the passenger get back inside of the vehicle. >> I was going to work. >> Okay. >> I was going to work. >> Okay, well, we're we're through with this stop. You're you're free to leave. Okay, but until then you're you're detained as well. >> I'm Trooper Earls with the State Police. Reason I pulled you over is you were going 72 in a 55 zone. Can I see your driver's license and registration, ma'am? >> So, we see it was speed that he pulled them over and he mentioned the passenger has to stay throughout the stop. Brendlin versus California, 2007 US Supreme Court ruling. Not only is the driver seized during a traffic stop, the passengers are considered seized as well during the traffic stop. >> Yes, ma'am. Where are you coming up there? South Back in Gas. Do what? >> on cruise control doing 60. >> Well, I doubt that. Do you have an ID on you as well, sir? >> I don't know, you I didn't do anything. I was the passenger. >> Okay, so I'm just going to work, right here. I'm trying to go to >> You hopped out from the scene of the traffic stop and tried to take off. >> No, I wasn't trying to take off. I didn't know we was being pulled over. She stopped here and I was getting out to go to work. I wasn't trying to take off. I didn't even know you was behind us until I stepped out and looked and I was like, "Oh, it's you." >> Okay, so this is where I want legal people to chime in here because this is an interesting dynamic and I'm going to explain my understanding of the law here. If the vehicle is stopped, the Brendlin case that I mentioned before, US Supreme Court, passengers are seized. If the passenger jumped out and he's walking off to work, which I don't believe that's what he was really doing, but he's walking off to work, does he have to provide his information to the officer? Because under normal circumstances, if the passenger was inside the car and had their seatbelt on and committed no crime, normally the passenger does not have to provide the information to the officer because they didn't do anything wrong. After the person jumps out, legal minds, chime in as to whether you believe that the passenger is required to give the officer his information at this point. And I'm leaning towards [music] yes, but I'd like to hear your thoughts. >> And then you said I'm running up here. >> No, I said you're not running up here. You're going to stay here. >> I said I go to work. I said I work right here. I didn't say I was running up here. >> Okay. >> I said I work here. >> Okay. Do you have an ID though? >> No. >> Okay. >> Uh this is a rental as well. I totaled my car out and so >> Do you have the rental agreement with you? >> Uh it's in my email too. I was pulling up my insurance for my other car. >> I'd like you to just take a look at this. I've never been inside a Ford Edge, I don't believe, but I can kind of guess what the configuration of this vehicle is. I'd like you to zoom in on the trooper, his campaign cover, and his positioning inside the car right next to the passenger. What is his field vision? What is his field of view if this person, the driver or the passenger, decide to engage him in some type of violence? I told you and I'll always say the campaign cover is amazing-looking, is it tactical at this point and position, especially when the male says I don't have an ID and we have this suspicious attempting to jump out of the vehicle. This field of view and field of vision is very, very small and it's concerning. At least a one glance back as you're walking back to the vehicle, especially if the person hasn't been identified, best practice. At least one glance back, look at the passenger or passenger and the driver as you go to your vehicle. We've seen people [music] jump out and attack officers. >> Hey Monica, you can step out here with him real quick. Do you have any weapons or anything on you? Okay. You're on probation for what? >> I drugs. >> Drugs, okay. You understand one of the conditions of your probation is you can't do drugs. What do you got in your pocket there man? >> Put in my pocket. >> What is it? Turn me inside out. Do you have any weapons or anything on you? >> Get back out of the car, please. Pick it up. Come up out of that window. Why'd you pull over and try to take off? >> Honestly, I did not know we were being pulled over at all. >> Got stopped at the >> We were at the >> Then why did you stop right here instead of driving him all the way up there? >> This is where I always pull over at. >> No, I don't believe you. >> I promise you that's why I mean I literally >> Listen to me. Listen to me. Stop the lying. It's not going to help you at all, okay? >> I'm not in trouble for him being seated. >> Okay. >> You're not going to stop right here if you're going to drop drop him off all the way up there. That just doesn't even make sense. Okay. >> I always get that. >> Okay. How long have you known him? >> Um not very long. >> Like how long is not very long? >> Uh maybe a week or two. >> Yeah. What's his name? >> Uh Buddy's what we go by. >> Okay. What's his name? >> His name's Buddy. >> Buddy what? >> I have no idea what his last name is. I just met him. I was just giving him a ride. >> Just giving him a ride. I've heard that dozens and dozens of times. Just giving him a ride. This super sharp. Some things that I'm going to critique about safety. If I watch a video of myself, I'll find things about safety as well, but I'm going to mention them cuz I want officers to go home safe. There's an interesting thing that you may or may not have caught that when he ran her on the computer, something came back that she's on parole. One of the stipulations of parole is that they're free to search her person, likely her vehicle, and maybe even her residence. I've seen it where they have all of those stipulations. Shout out to parole and probation officers, unsung heroes. They do a lot of good, specially when they operate within the confines of the law and follow up on people and make sure that they're doing the right thing cuz some people end up making it right after they get out. And sometimes it's the parole and probation officer that helps them stay in line. And parole officers have a whole lot of leeway that officers on the street don't necessarily have. The other thing that I want to mention is that I'd like how he brought her back, got her inside the car, out of earshot of the driver, and locked her into a story. Now she says, "I don't know him. I'm just giving him a ride. It's only been about a week or two." Now she's married to that story. As this goes forward, we'll see how that can play out in a very positive way. If the troopers continues to work this the way that I see him working it. >> Buddy. Buddy. What's your last name? He wants to know what your last name is. I know. >> I can't exactly hear what he's saying, but when she called out Buddy like that, he didn't respond and then she says Buddy again, it almost feels like she's trying to tell him that that's what I told him your name is. And I don't know that that's the case, but my police mind it, that's how I think through these kinds of things. And you could be wrong, but it's always good to think about half what you see, none of what you hear. >> Kippah. All right, well go stand back up there till I'm ready to talk to you. >> He said stand back up there till >> Go stand back up there till I'm ready to talk to you. What did you say? >> He said well >> Let's look at his shirt. All the way down, pants are baggy enough to easily conceal a firearm. We don't want him to be able to walk all that way before we tell him to go back. The control needs to happen way back there or have him patted down if he's going to be out of the vehicle. >> You have reached Mike Davis without a dial tone. >> So one of the things that I notice is and I always pay attention to is the fact that if a person starts smoking like that, I always feel like they may be thinking I'm about to go to jail and I want to get this cigarette in. The intensity that they smoke is also another thing that makes me feel like partial nervousness and another part like I may be going to jail, I'm getting this smoke in. >> All right, I want you to go and go in front of the car for me. Turn it off. All right. >> Woah, woah, woah, am I being arrested for? >> All right. >> What am I being arrested for? >> Right now, the drug paraphernalia. >> I don't have any drug paraphernalia. I don't have any drug paraphernalia. What are you talking about? >> Well, there's paraphernalia in that cup. >> My cup is right there. >> Okay, my cup. >> I'm looking at my cup. >> Do you have any ID on you? >> Man, no, I don't. >> What's your name? >> I didn't do anything. >> There's drug paraphernalia in there. I have reason to ID you. What's your name? >> That That's not mine. Hold on, man. Hold on. >> This configuration is incredibly challenging, especially when it's just one trooper in these rural areas. A lot of times they do [music] this stuff by themselves, and I get it. However, I'm going to share what I believe is best practices. Don't have the person who's the driver of the vehicle looking at when you're searching inside. They're going to know when you find whatever you find. And it appears that he found some contraband inside of a cup inside of the car. Now, they know, and they can formulate a plan. And being sandwiched in the people is an incredible challenge. >> Don't Don't jerk me around me, man. >> I can't pull away. >> Can I get my phone? >> You can't get anything right now. >> Can I get my phone? >> You can pull it out right now. >> Okay, no, that's Okay. OKAY, I'M GOING. I'M GOING. I'M GOING. GOD damn it. Okay, I'm going. Listen to me. >> He's got a hernia and a big >> Listen to me. >> big hernias and you >> Quit pulling away from me. >> I was not pulling away from you. >> She's yelling that he's got a hernia, but she says that she just met him. It's just strange, and I mean, I don't normally meet a person like, "Hello, my name is Buddy. I have a hernia." I mean, it just doesn't really make sense. It's just really strange that she knows that, but obviously she's emotionally involved in this, too. These things are all going to play out as you see this going. People tell you whatever they want to tell you. >> Now you need to calm down. And when I tell you to come back here with me, don't pull away from me. Man, I got double hernias and it's god damn. God. >> Get your hands out of your pants. What are you reaching for, man? >> my hands in my pants. You shoved my hands in there. Come on, man. >> Did you see that? It looked like when he the officer is searching the male and around his pants, the female reaches down into her waistband. It's looks like she's shoving something down into the crevice between both of her cheeks. She could be scratching or adjusting her undergarment. I don't know and I'm not trying to be funny. If we watch that again, there was definitely something going on with what she was doing back there. It's interesting that it was as the officer is searching the male maybe in that area or keying off what the trooper is saying to the male. Now that was peculiar. >> I don't have nothing on me right now. I don't have nothing, man. >> Can you not smash on me right there? Well, I'm trying to figure out if you have any weapons on you. >> man. >> You're trying to pull away from me. >> have any weapons. I don't have any drugs. >> Well, I'm just trying to confirm you don't have any weapons. >> I'm trying to go to work, man. >> You're detained right now. >> You're fixing me under arrest. >> Can you please stop >> me? >> my hernia right there, man. Please. Thank you. >> Okay, he said, "You're detained right now. You're fixing to be under arrest." If a person is detained and not under arrest, we know that we can pat them down, but we cannot do a search. >> I don't have anything. I really don't have anything. >> You're making this a lot worse than it has to be. >> But I'm not doing anything wrong. >> You want to do this this early in the morning. >> Man, I didn't do nothing. I'm trying to go to work today, officer. I'm trying to go to work. That's all the I'm doing. >> You want to play games. >> How was I playing >> These are the prizes you win. >> How was I playing games? >> Whenever I say walk with me, >> I was. >> and you start pulling away, >> I wasn't pulling away. >> I'm not playing these games. >> I wasn't pulling away. >> Roll over. >> Can you please quit pulling hands handcuffs? >> I can't put on anything right now. >> Put your hands behind Throw me aside. Yeah, and I know you're going to stick a poker prod in me. >> Man, I didn't have anything to stick a poker prod in you to start with. Jeez. >> I wasn't going to poke you. >> Okay, so when we see the trooper retrieving these items and tossing them to the side, I can't see where he's retrieving them from. But again, we just have to be careful. Are we now inside of pockets where it would be deemed a search? Now, he could have made the decision in between when he said you're detained that you're under arrest cuz I saw an arrestable offense myself. He could have made that that distinction. It's just that we should be cautious when we say you're detained switching over and not necessarily saying, "Well, you're under arrest." We have to be really, really careful in these spaces because we want to make sure we operate within the confines of the law. >> I can't lay like this very long, brother. You're going to lay like this without paying attention. Throw me aside. What do you mean you suggest? Oh my god. I can't >> I don't have a phone on me and this hot pocket. Like I said, I got Yeah, me too, but you want to frisk me and Come on. Can I please get my phone? >> No. >> Come on, baby. >> No. >> What did I ever do to you? What did I do? >> Have a seat in there. Right now she's resisting arrest. >> I wasn't resisting. I wasn't resisting arrest. >> Your hands flat on in there. So now you know it was earning, huh? What's up, man? You come down here all hot boy. I'm telling you I got Huh? Well, I know you didn't want to cooperate, but He's over the county line or something. >> Oh, so I'm going to need some assistance from someone who has a radio ear that can assist me cuz I couldn't piece together exactly when he broadcast that he was in a struggle with this guy. I will tell you this that I do know is that there are several ways that an officer can know that they need to roll code to your situation. That means with lights and sirens. Sometimes you can just be in a struggle with someone, key the mic, you they'll hear and then there is no response when dispatch does like a roll call to say who was that, is everyone code four, is everyone okay? And then they'll figure out if you don't respond, everyone's going to roll to your location. There's a button on most packs that where you could push a button, they'll go to your location, GPS. There's a whole bunch of ways that officers will end up rolling code even you don't call. He may have called and said that this guy's resisting. I just did not hear it. So just know that even if you just garble something that the dispatch is going to be on it and then units are going to start rolling to your location. If you're the one person that doesn't respond on a roll call, meaning they call every unit and then figure out that it's you and if they know where everyone else is. >> I got one in the back right now. >> Do what? How dare you do? >> Yeah, he's all for some that I didn't do. >> Oh. >> I'm sure it is, Ernie. >> At the Sergeant Curtis Channel, I wanted to take a moment to acknowledge the fact that this is Police Memorial Week, which is a very somber week for those of us in law enforcement. If you notice my badge and my dad's badge in the back are shrouded. Every week we commemorate the loss of the wonderful officers, men and women who lost their lives in the line of duty and I have shrouded my badge many, many times throughout my career and I'm hoping that through this channel we can help that doesn't have to happen anymore. So I want to give thanks to all the families who are going through a rough time right now, who have lost a family member, those who have lost friends and just know that somewhere in some briefing or some end of watch shift, there's a chair that is empty and we acknowledge that person for the sacrifice that they gave for our country and their community. Sergeant Curtis Channel, we thank you for acknowledging National Law Enforcement Memorial Week. The guy admits that he had a warrant, that's why he didn't want to give his information and likely why he was trying to get out of the car that quickly. Some really interesting things to look at in this stop that you can think about to figure out what works best. From From perspective, there are some things that I think that the trooper definitely could have done to be safer, but I know that they do work alone a lot. I want to make sure that they go home safe at the end of the night. And then some legal things that you can bounce back and forth, especially in your briefings and debriefings, or just amongst friends if you're not into law enforcement, cuz these are interesting things. Everyone should know the basis of what laws work [music] and don't work. Arkansas, another super sharp trooper. It appears that they found a hypodermic needle, from what I read in the report, inside of a cup inside the center console, [music] and that would likely be a violation of the driver's probation or parole, which the trooper said that she was on.
