Can I get you in there and stop whining? He'll stop. You get there and stop whining. He'll stop. Okay. I'm so y Step out quick, bud. I'm asking you to step out. So if you step out, you get away from him. So behavior, addition to marijuana use, your uh kind of slurred word, your up and down emotions. We're going to do some field sobriety test. I think you might be under the influence of something. Okay, so we're going to go over here to this nice flat surface. I'm going to take those handcuffs on you. You're still detained. You're not free to leave. You understand that? I'm not going to chase after you. He's not going to chase after you. My dog will chase after you. Okay. You don't want that. Listen. I'm not running, bro. I'm not saying, bro. I ain't trying to run, bro. As long as we agree on that, we'll be good. All right. Enough, bro. And I want my [ __ ] Do you drink vodka at all? No, bro. When you drink alcohol, what kind of alcohol do you drink? I don't drink alcohol, bro. Okay. I'm being honest. Let's kill some lights. I'm dead. You got him for a second. I just got to turn my lights off. Just wait right there, please. Ellie, come on. Let's stand up. Feel like you're a 27y old man here for a bit. Want to help up? I I give myself up, bro. All right. All right. So, we're going to be doing a few tests here. These are the field sobriety tests, and I got a few other ones are called aide test. They're just to help me better gauge uh if there's any impairing uh clues that I see here, okay? or clues that might show that you're impaired. So, the first test is going to be the horizontal gaze and stagmas test. For this test, I need you stand with your feet together like this and your arms at your side. And you're going to stay like that. Okay. Are you wearing contacts at all? No. Okay. Make sure you keep your head straight. Okay. You're just looking as far as you can. So, hold my feet like this. Yep. And arms at your side out of your pockets like this. Against your side. Put your arms down. Remember, don't move your head part. Okay. Okay. Okay. I I'm I have a very hard time understanding. Okay. Okay. Arms at your side. We're tracking again. Still got some head movement or heavy sway. Can I take my socks off, bro? Cuz like I want you just stand with your feet together and your arms at your side. Okay. In a level area, bro. Like even if you were to do it, bro. Come on, bro. Where do you see a level area you'd like to go to? Yeah. All right. You show me. All right. You feel like you're in a level area right now? You're okay doing this in your socks? Is that correct? Okay. Feet together. Feet together. Arms at your side. I'm on some at your side. This you're looking right here. Go back to like a smooth pursuit. Where you looking right now? You're looking over here. I need you to look right here. I can see it though. No, you're not using peripheral. You're focusing on the tip of my finger. I'm seeing your hand though, bro. It's not seeing. It's focusing. Okay. What do you want me to do? You want me to look at the tip of your finger or just the hand? Cuz if you go like this, I'm seeing the hand. Okay. I need you to focus on the tip of my finger. And you're going to follow with your eyes and eyes only. You're not So look just straight only the tip. Only the tip. Right. Okay. Focus right here on the tip of my finger. I can see a finger, but the nail I can't see. I'm being honest. Yeah. But your nail should be like that. But your nail should be like that, though. Okay. You're arguing with something I've never heard anybody ever argue about before. So, why don't you keep your arms at your side and keep focusing right here. Okay. Okay. The next test is a walk and turn. For this one, we're going to pretend like there's an imaginary line. Okay. Using our nice flat surface here, you're going to put your left foot on that imaginary line. Go ahead and do so. Imaginary line right where my light is. Right here. So, you think it'd be easier to walk uphill? You know, I'm just saying even people that are regular. Bro, turn around. Are you good that way? No. I'm going try up the hill. I like the channel. Oh, you're going both ways. You know what I'm saying? I I go both ways. Like, bro, I can walk. So, look. Let's go down here around the corner. Cuz I'm low, Ali. What? We're going to go down here around the corner. If you feel like this is uphill and downhill, let's go this way. This can't go too. You got a belt? Yeah, but look belt right here. Look. Mhm. I'm just letting you know I'm being out bagging. Cool. Let's go down here around the corner. Okay. Just walk normal. Go. We're moving. Would you agree this is a nice flat surface right here? That's decent. Okay. So, stand right here where my light is. Should I take my pants off just to show you? Like, you know what I'm saying? Cuz that is very strange request. Why? But I got underwear that this long. Why would you do that? Because look, these pants are going to hold like Why don't you put your shoes back on? Can you roll them up? Can I get Can I get my shoes? He'll grab the shoes for you. Officer had a good point. Can you roll your pants up? I ain't trying to leave y'all, bro. I swear to God. I even see you behind me, bro. Like the lights, bro. I swear to God, bro. Are you Are you bipolar at all? Bipolar? Yeah. Like, have you ever been diagnosed for that? Like, are you trying to make fun of me, bro? No, I'm asking you. Yeah. You said, but I don't know. I don't know by pull that even means. Okay. Well, then you don't have it then. Do you know where I'm at? Oh, I know where you're at. Do you know where you're at? Do you know what county I'm at? I don't know where I'm at being. That's not good. I just go off GPS, bro. Okay. Okay. Like, I swear to God. Where? Let's get your shoes tight so we can do these tests here. Good. All right. Stand right up here. Like I said, we use this nice flat surface. Stand right here. Face me. Okay. All right. So, like you said, we're going to have pretend like this imaginary line going right down the middle of the sidewalk right here. Okay. Go ahead and put your left foot on that imaginary line like so. I'm going to pretend like my line's going this way. Put your left foot on the line like so. Go ahead and do so. All right. Hold up. Let me You got a little knife real quick. I'm not giving you a knife, buddy. I don't understand required to stand. How about you just tuck it in your pants? Yeah, but bro, listen, bro. Your your pants are fine. No, they're not. Bro, these are Look how big these are. I do. Now, put your left foot on the line like so. Go ahead and do so. Y officer, bro. I swear to God, bro, if I was trying to run, bro, I would have kept running, bro. You know what I'm saying? We need to focus and stay on topic here, okay? Hey, you're jumping all over the place mentally. I need you to put your left foot on the line. Can you please do that? Officer, I I need to tie my pants so I so I can perform this test. They have not fallen down since I've been in contact with you. I think they'll be just fine. Okay. They've fallen down a lot of times. I think you have a lot of excuses and you're not focusing on our task at hand right now. I have a lot of excuses, bro. I admit I've been honest with you 100%, bro. I don't think so. I don't feel that at all. Oh, obviously. That's just my opinion. Okay, bro. What are you doing? All right, you got her. Let's go. Right here. Imaginary line straight down the sidewalk. Go ahead and put your left foot on that imaginary line. Go ahead and do so. I'm going just go like how it is, bro. If you feel like I can't do this [ __ ] I come on. Right. Arms at your side. Left foot on the imaginary line going right down the middle of the sidewalk. Right foot in front of it, touching heel to toe just like my feet are. So your right foot should be in front of your left foot. Okay. But I don't want my right facing off the left. So look, is your right heel touching the toe of your left foot? My right heel? Yep. See how my feet are? I need you to exactly like my feet. So like right foot in front of your left foot. Now put your right foot in front. So you're touching your left toe like that. Like this. See? See? I'm clicking them together. I need you to do that. You need to stand back over here. I'm not going to shoot you down, bro. Stand over here. You keep moving. You started here. Work all over here. Just trying to get you in the right position here. Walking down the hill, though, bro. You call this as the flat spot. Can I just walk up the hill and show you? This is a level surface. You are fine. That's not a level. Left foot on the line. Right foot in front touching heel to toe like so. See, that's what I'm saying, bro. I can't I can do it on that surface perfectly. Okay. Right foot. No, no, no. I can go up here perfectly, bro. Show me. Come on now. We'll pick the best surface that you think you have most advantage here. You want to do it right here? What's the one bed, bro? All right. Left foot. Imagine your line going right here. Right. Right. Put your left foot. Now, put your right foot in front touching heel toe like this. Don't start. You're not doing anything until I tell you to. I got to explain this SG to you yet. Arms at your side. Stay like this. Do not start. Do not move until I tell you to. Do you understand? Can you get back like I am? Please. I just don't get it, bro. So, this is your right foot. This is your left foot. And you put your right foot in front of your left foot touching heel toe like this. Like that. You're backwards. So, right foot. So, like this? Yes. Okay. Arms at your side. Arms at my side. Wait. Like this? Like this? Exactly like this. Like this. Can Can I do this? No, you cannot. You can stand just like this. Like I am. Okay. I'm putting my pockets down like that. If you want to hold your pants up, I don't care. Now, put your right foot in front of your left foot. I'll do this. Officer, if I do this, this is I'm not going to tell you again. Otherwise, I'm going to count this as a refusal cuz you're just you're just giving me issues at this point. Okay. Come on. So, right foot in front of your left foot, just like I've been standing for the last couple minutes here, waiting for you to do it. You're backwards. Right foot. There you go. Stay like this. Don't start. You're not moving until I tell you to. Okay. So, for this test, you're going to take nine heel to toe steps looking at your feet. You're going to count out loud each step and keep your arms at your sides. Passes. It's going to look like this. One, two, three, so on and so forth till you get to nine. Simulating this is your nice step. You're going to take a series of small choppy steps. Pivoting on your lead foot. Listen, I'm showing you. And take nine heel to toe steps back from where you came. One, two, three. So on and so forth till you get to nine. All right. Come on. Throughout the steps, make sure you're looking at your feet. Count out each step so I can hear you. Keep your arms at your side. Make sure each step feel the toe and do not stop until you're finished. So if I don't look at my feet, I feel you have to look at your feet the whole time. That means I feel the test, right? you. My instructions are for you to look at your feet the entire time. No. So, right foot in front of your left foot. I just have a question. If I don't look at my feet, I fail the test. I didn't say that. It's a clue. I need you to stand with your right foot in front of your left foot. Don't be looking down on my feet, bro. Like, cuz Okay, you're just giving me issues again. Do you want me to count as a refusal? I'm not refusing. Okay. Right foot in front of your left foot just like I'm right. Now you're backwards again. That's your left foot in front of your right foot. I need your right foot in front of your left foot. I should use them backwards every time I'm doing it. One. There you go. If you understand the test, you may begin. All right. Using arms for balance. One. Broken structural position. Step off on three. Both of you. Step off multiple times on three. No, cuz I can't. His pants, bro. Hold up. Stop the test. Can I see his pants? I'm going to show you, bro. I swear to God, bro. It's his pants, bro. I'm not even Your pants are not giving you any issues. They're not even touching the ground. My instructions are not to stop until you're finished. They are touching the ground. These are my work pants for real for my construction job. I swear to God, bro. For real. For real. Look, these are all pens, but they're heavy. They like Are you done with the test? What? Are you done with the test? Not with these pants. Are you done with the test? Um, no. Could you please finish it then? Okay, I'm going take off my pants and be able to do it. It's the same thing, bro. We're not doing that. Your pants your wear these pants and do them. Ellie, I'm not arguing with you anymore. Are you going to finish the test or no? finish like this. Y'all think I'm intoxicated and like I try to run from you and all that, bro. I didn't hear you, bro. I didn't hear no sirens. I didn't speed up. I didn't do any of that, bro. Are you going to finish the test, Ellie? Yes. Come on. Go. So, wait. You can start all Do you want to start over? No. No. Which feet? Which feet you said? Are you starting over? Yes, bro. Right foot in front of your left foot. Right. That's backwards. Arms at your side throughout the test. If you understand, you may begin to on one, stepped off line on two. Stepped off on three. Seal toe. Seal toe. Feet are side by side. Stop the flying on it. You see toe stuff flying out. Whatever stuff this is. How many is that, bro? You're counting out loud like I instructed you to. Actually, I'm not count. Don't stop until you're finished. I don't know how many I got to go. I I have not been counting, but I'm sorry. I could restart. All right. No, I think we're we're good there. So, the next test restart. Listen. No, you cannot. No, no, no, no. Ellie, you cannot restart. We're done with that test. Listen, I have Okay, the next test is the one leg stand. For this, while I explain it to you, I need you to stand with your feet together and your arms your side like this. Okay, one test. Look, we're done with that test. One. 2 3 4 five up. 6 7 8 9 to tell staggered was instructed. Stop the test. All right. The next test is the one leg stand. For this test, you can face me. Put your feet together, your arms at your side like this. Okay, stay right there. For this test, you're going to lift your left foot, your right foot, whatever one you have the best balance with. Okay, what you're going to do is you're going to lift your foot. Watch what I'm doing. You're going to lift your foot. You're going to count out loud. 100 1 2 1 3 1 4 so on and so forth until I tell you to stop. If at any time during this test your foot goes down, pick it up and keep counting before you left off. But the point of this test is to not put your foot down. So throughout this test, make sure listen throughout this test, make sure you're looking at the toe of the foot you have raised. Count out loud 1000 1,002 so I can hear you. Keep your arms at your side. Make sure your toes pointed 6 in off the ground just like mine is right now. Do you understand that? Okay, do you understand that? Okay. Okay. I don't understand one. Like you don't understand how to count or No, I don't I've never counted that way. Okay. But if you could tell me how many seconds I have to be on that position, I You've never counted 1,00 1,002 1,00 You know what? I'll let you count. One, two, three. Does that work for you? Yeah. Okay. So, feet together. Feet together. Arms at your side. Are your feet together right now? Are your feet together right now? Yes. No, they're not. They're like a foot apart. Arms together, bro. Look. Feet together like this. Together. Arms at your side. Which foot are you going to raise? Your left or your right foot? Why don't you just point to the one you're going to raise? How about that? I don't know. All right, we'll wing it. Are you ready? Do you understand the test? Yeah. If you understand, go ahead and begin. So, can I If you understand, go ahead and begin. No, no, no. Can you clarify this? Officer, do you want my leg to be on the side of I want you to do exactly what I just showed you how to do. I don't know like how you were doing it. You You lift your foot 6 inches off the ground. Count 1,00 count 1 2 3 4 while looking at your toe until I tell you to stop. You can't move this other leg while doing you keep one foot. It's one leg stand. You're standing on one leg holding the other one up. One. All right. If you're ready and understand, I'm letting you start over. We're not going to count that. Are you ready? Yes. If you understand, go ahead and begin. So, I don't get this [ __ ] bro. So, you like this 6 in off the ground just like my foot is right now. Leg straight in front of you. In front of you. There you go. Just like that. Keep going. Arms are balanced. Swing. Make sure you're looking at your toe. Down, bro. You can go ahead and stop right there. That's That's the 30 seconds. We're all done with that test. I have not tried, bro. You haven't gave me the opportunity. We only got 30 seconds for that test. You haven't gave me the opportunity. I gave you a whole 30 seconds. Look, bro. So, one. Wait. Is it like that? Yeah. So, you're going to be under arrest for OWI right now. Okay. So, go and put your hands back behind your back. You want to give us a PBT to show you don't have any alcohol in your system? Bro, I don't have alcohol in my That's what I said. Do you want to give us a PBT to show you don't have Yeah. Yeah. Yeah. I I want to show you, bro. I was just in the car accident, but you talking about my silence and then you want to put me in the hill. We're going back over to my gray squad over here. Okay, we're we're going to do this breath test, though. It's going to show you don't have any alcohol in your system, right? I bet you. All right. I bet you my life on it, bro. Just the marijuana. Bro, I don't want the marijuana, bro. You already told me there's marijuana in your system. You can't backtrack on that. Yeah. At 6 a.m. You said there's marijuana system right now. No, I never said that. So, let's do a blank test. Never say this. Doing a blank test right now. Triple zero, right? So, blow it up like you're blowing a balloon. Okay. Keep going. Keep going.
