Ma'am, get back in the car. What >> I don't like you. >> You're going to sit right here. >> In policing, we see people usually in their worst moments. Alcohol is often the cause of some people's rock bottom. And when it comes to being behind the wheel of a car, fighting with the police, and going to jail, that's a lot of people's rock bottom. This is one of those. >> So, where are you coming from tonight? >> What? Night club. >> So, you're coming from Key West? >> Yeah. >> Key West? What were you doing down there in Key West? >> Just exploring. >> Exploring? >> I just want to make note of this officer leaning in on the car like this. He may feel super safe because the female has her hands on the steering wheel or that he has a good clear vision of the car, but these are bad habits. Occupying your both hands and leaning in on the vehicle like that. Again, if it goes to a before situation, you're going on gun, and it's at best a draw. >> Where are you going? >> Home. >> Where's home at? >> Sarasota. >> Sarasota? You drive all the way up there right now? >> 4103 Gateway >> Or you don't have like no hotel or nothing like that? >> What? >> You don't have no hotel or nothing like that? >> The English, you're supposed to be a cop. >> I can I'm speaking perfect English. >> No, you're not. >> Yeah, yes, I am. Can I see your license, ma'am? Okay, thank you. So, you live in the state of Florida now? >> Well, I do now. >> You do now? How long you've been down here in Florida? >> 30 days. >> 30 days? Well, make sure you change this to Florida if you live here now. Are you drinking tonight, ma'am? You sure about that? So, no drinking down in Key West. All right, I'll be right back with you. All righty, ma'am. You want to do me a favor and help out the vehicle for me, please? So, down in Key West, you had nothing to drink? >> No. >> Not one drink? Are you sure about that? >> Yes. >> All right, so I feel that you're impaired by alcohol or drugs. Would you like to perform field sobriety exercises to dispel my belief of that? >> I don't think that I have should go under whatever you're saying right now because you pulled me over. >> Yes, ma'am, I did. And I'm ask I I think that you're impaired, so would you like to perform any field sobriety exercises to dispel my belief of that? Yes or no question. >> No. >> Couple of things to take note of on the female. Okay, if you look here, you can see that her pants are unbuttoned. That's something the officer is going to take note of. And I know that sometimes people when they go to the beach, they leave their pants like that, but that's considered disheveled appearance. A couple of other things you look at is the glazed eyes, the slurred speech, and the unsteady gait. Those in and of themselves are likely reasons. Now, when the officer was leaning inside the vehicle, sometimes there are officers who do that so they can see if they smell the booze. From a tactical perspective, not good idea, but I know that some officers do [music] it. But this she's definitely giving indicators of having booze on board. So, hopefully we see what happens from there. >> All right. By saying no, by saying no that I can be used against you in a criminal criminal proceeding. Do you understand that? So, by saying no, it be used against you in a criminal proceeding. So, with that in mind, are you still saying no to the field sobriety exercises? >> I feel like I'm talking to like a right now. >> Okay, it's obvious the officer has a speech impediment, so she's going to make fun of him thinking that that's going to help the situation. And it's likely because she's drinking. Making fun of his speech impediment is not going to help. >> You pulled me over for what? >> Failure to maintain lane. You crossed the white lane right lane four times and you crossed the other one three times. >> Okay, and then? >> That's it. So, would you like to perform any field sobriety exercises? No? All right. Well, have you place your hands behind your back. You're being placed under arrest for DUI. All right, ma'am? >> No, I don't like it. >> All right, I'm sorry. >> You're not a good person. >> Sorry about that. Ma'am, you guys sit right here. I need you to put your seat belt on. Come on. >> No. >> A lot of people don't realize that this is where it could go really, really bad. And in this case, it does. >> Ma'am. Ma'am, get back in the car. >> No, I don't like you. >> What are you doing? >> you. Get back in the car. Ma'am, you want to get pepper sprayed or no? You want to get pepper sprayed? Do you want to get pepper sprayed? Are you going to hop in the car? Are you going to hop in the car? Ma'am, listen right here. Are you going to hop in the car? >> No. >> Are you going to hop in the car? >> No. Get off the phone. >> No, you come with me. Come on. >> No. >> On three, we're going to stand up and we're going to go to the car. >> No. >> Yes. Yes. >> me. >> Ready? >> Get off me. >> Come on. Ma'am, get in the car. Get in the car, ma'am. >> No. STOP. >> WELL, you're done being with us, so get IN THE CAR. MA'AM, WHERE IS YOUR KEY TO THE CAR? >> I'M NOT telling you. >> You're not telling me? >> No. >> Okay, so you want to have your car be damaged? >> Why would it be damaged? Do you want to threaten me? >> If they going >> You think you're something special? >> If they going to tow your vehicle with your key. >> You're not something >> Where is your key to the car? >> You're not something special. >> Can you tell me where is your key to the car? >> Yeah, if you get me out of these handcuffs. >> Where is the key to >> You're not cute. Get me out of these. >> Do you have your keys in your pocket? >> You better get my purse. >> I did and your phone. See how nice of a guy I am? >> No, you're not. >> nicely tell where is your key. >> I'm not telling you cuz you are a snitch. >> All right. You got the car? >> Yep. >> All right, thank you. >> didn't go for >> WHO'S DRIVING MY [ __ ] CAR? >> YOU DIDN'T TELL. >> You didn't go you didn't go for a >> No, I think you're a You wanted to pull somebody over. You have nothing better to do with your life. >> Nope, man. This is my job. I'm just doing my job. >> Yeah, okay. Who's driving my [ __ ] car? >> You didn't tell. >> Why? >> Because I said it is. >> No, you're so dramatic. Oh my god, you're worse than my ex-boyfriend. >> If you think this is bad, her behavior gets worse at jail. >> You want to search her right here? >> Come this way. >> Come on, let's go. >> You can take Let me Let me take her. >> Okay, let me take >> We just Come on. Come on. We're good to go. We're good. We're good. All right, man. You got a wrist cuff on? It's over that side. I ain't trying to get kicked. >> So those restraints here are incredibly important and restrains a person's ability to move. And when they act like that, it's really important that they get housed alone because they go in and get mouthy with another inmate and they end up getting into a fight. There's liability on the police. That's why they ask a whole bunch of questions and she's within the police custody right now and they have to make sure that she's safe. I've seen things like that happen before. >> It's not going to happen. It's not GOING TO HAPPEN. KNOCK IT OFF NOW. DO YOU HEAR ME? Have a seat here or you go back in that chair. Do you understand? Yes or no? Answer me out loud. Stand here. Take your stuff off. Anything electronic. Stand here. >> Okay, they're attempting to give her a breath test. The steps to doing this breath test are very specific. She has to be observed and they have to go step by step, otherwise it's inadmissible. Attorneys will jump on this thing if it's not done properly. That's one of the reason why the camera's facing that way and there's probably a checklist right there and this woman is making it incredibly difficult. They make it too difficult, [music] you can just consider it a refusal. >> First off, nothing was said to me about >> I don't give a I don't give a crap whether it was or wasn't. >> Of course you don't. You're going to have a seat. >> Of course you don't. >> Have a seat. Come on camera, sir. >> It is, you're right. >> Yeah, it is. Watch your foot. >> As if my keys were in my mouth. >> We don't care. >> Oh, you do. You do care. YOU DO CARE. You're for no reason. >> HAVE A SEAT. >> YOU'RE FOR NO REASON. >> JUST STAND right here. >> Yeah, but you're not allowed to touch me. It doesn't affect me in anyway. >> Of course it doesn't. As you make $16 AN HOUR. >> [laughter] >> KNOCK IT OFF. STOP IT. SHE'S GOT TO BE IN here for this. But she keeps getting up and trying to push on us. So I need somebody to stay in here with her. >> No, because you keep talking and YOU'RE NOTHING. YOU'RE NOTHING. >> MY GUYS ARE RECORDING. >> I know, but she's got to be in here for it. That way she can if she changes her mind, but I'm not doing this over. >> You're not allowed to put your hands on me like that. Stop. >> It's already done. >> Stop. >> Ma'am. >> How do you want to be honest? >> I mean, she can sit there whatever, just so that she can she can't say I didn't give her every opportunity. >> You're making this >> You didn't GIVE ME NO OPPORTUNITY. >> Just chill out, man. >> No, dude. >> You're making this TO YOURSELF. >> I'M NOT MAKING IT WORSE FOR MYSELF. >> FIRST OFF, we don't >> need to holler. We're all right here. I'm trying to help you. I'm trying to help you. I'm probably going >> I don't give a >> Thanks, Eden. Ma'am. >> Like I said. >> Ma'am, chill out, ma'am. >> I'm putting my hands back so my wrists are not hurt. >> Okay. >> So, stop. Stop. Stop. >> Okay. Just don't STAND UP. >> IT'S ALL ON THE [ __ ] RECORDING. >> I DIDN'T DO ANYTHING. >> Y'ALL WANT TO TAKE THIS [ __ ] >> MHM. WHAT? >> MA'AM. >> MA'AM, WHAT? >> I'm just trying I'm trying to warn you, ma'am. >> WHY ARE PEOPLE AGAINST ME? >> I'M NOT DOING NOTHING to you. I'm just holding >> Hurt? >> Okay. I'm not >> hurting you. You think THIS IS ALL ON CAMERA? >> IT IS ON CAMERA. And it won't work in your >> Right up there if you want to >> It's not going TO WORK IN MY FAVOR? >> NO. >> OH, OKAY. >> You're disobeying lawful orders right now. That's not >> How am I disobeying lawful orders? >> They They tell you to sit there. >> Yeah, I am. >> I AM SITTING HERE. >> THAT IS A LAWFUL ORDER. EVERY TIME YOU TRY TO STAND UP >> Every time you touch me, you get a >> Every time you try to stand up, that is disobeying a lawful order to sit down. So, when we have to put our hands on you, every time is a new charge of resisting. >> You're making it worse. >> And the judge is going to see this, and the judge is going to agree with us. He's not going to agree with you. You can smile all you want, ma'am. It's just the law. And I'm sure it's the same way in Tennessee because I've been there many years, and I know many of law enforcement officers in Nashville, Tennessee. They'll agree with me, too. And this ain't Broadway. >> I tried to warn you when you came through the door. Just comply, ma'am, and chill out. >> Can I call my attorney and ask him what to do? >> Cross your Cross your leg in front of your >> All right, Jessica, are you going to provide a sample of your breath? No. >> I think >> I want my phone, and I want my purse, and I want my house. So. >> You're getting none of those things until you see the judge tomorrow. >> Okay. Whatever you say. >> Have a seat. Do not get up. >> DON'T HURT MY [ __ ] WRIST. >> MA'AM, IF YOU WOULD HAVE LISTENED TO US, WE WOULD not have to be hands-on with you. >> Okay. >> But, you don't want to listen. And that's why your mouth is going to get you beat. >> It's recording, right? >> It is, as well as the audio of us telling you to stop resisting AND >> I'M NOT RESISTING. YOU'RE HURTING ME. >> YOU ARE BREAKING A LAWFUL ORDER. >> YOU'RE HURTING ME. >> HEY, MA'AM, that's because of your actions. >> OH, I CAN'T GET UP? >> NO. >> I CAN'T GET UP? >> NO. WE TOLD YOU TO SIT DOWN. This ain't going to go well for you, ma'am. Trust me. Cuz once once we get clear from the nurse, you're in our charge. And guess what? We're a lot meaner than they are. They're a lot nicer than us. >> Stop! >> This people is likely going to be completely different when she's in court. When I would go to court with the person they would act something like this, they're in a nice outfit, their hair is put back, they're speaking all politely. It's a completely different person. When it comes to DUIs, in most jurisdictions, and I want people to chime in in the comments and while it is in your jurisdictions, the consequences. Your insurance is definitely going to go up. Your driver's license can be suspended or revoked, especially if you refuse. In some jurisdictions, the interlock system where you have to blow into a device in order to get your car to start and you have to pay for it.
