Won't you add a drink tonight besides the open container in the center console? >> Oh, let me type it in my computer. He was going 40 m an hour. Let me type it about computer, little dumbass [ __ ] >> In policing, sometimes you run into the poster child as to why not become a sovereign citizen. And sometimes you run into the poster child for never drink and drive. But sometimes you run into that person wrapped up into one. This is one of those. >> Hello. >> How you doing? >> Good. I'm officer Blair Police Department. The reason I'm stopping is your speed. >> Speed? >> Yes, sir. So what? Like coming on the turn. >> Good tactical positioning. He's back behind the door jam. Gun hand is free. >> Coming up Rear Highway from Lindel Milford. >> What was my speed then? >> That was greater than 40. >> Greater than 40. >> Yes, sir. You got your driver speedometer. >> You got me clocked. >> I don't need to have your clock. >> No, you got to have your clock. >> Sir, do you have your driver's license proof of insurance on you? I do not, sir. >> Yes. Yes, you do, >> sir. I'm not I'm not going to argue with you to have me clocked, >> sir. I'm not going to argue with you. >> You do not have If you do not have evidence that you have me clocked to 40, then you cannot pull me over. Also getting some indicators that the driver is likely under the influence of something. I'm seeing some glassy eyes, some slur speech, and his movements is kind of off. And I'm also seeing that there likely is a passenger in the car. It's a little hard to see from here. >> You have your driver's license, proof of insurance on you, sir? >> You do not have me clocked at 40. You cannot pull me over. >> You have your driver's license on you? >> If you do not have me clocked at 40, you cannot pull me over. >> Okay, sir. I'm not going to sit here and argue with you on the side of the road. >> That's okay. >> All right. This is a traffic stop. >> That's okay. >> Are you going to produce a driver's license? That That's okay. No, >> you're not going to give me a driver's license. >> Okay, that's fine. We'll just hang tight right there. >> You do not have a right to pull me over. >> Okay. >> If you do not have me clocked at 40 when I wasn't going over 40, >> you had a drink tonight besides the open container in the center console. >> That's empty. >> So, just because an open container is empty does not mean it doesn't meet the criteria or elements of an open container in most jurisdictions. [music] A lot of people think just because it's empty that it's good to go. Sometimes in some jurisdictions because there's no content in it doesn't mean that it's not considered an open container. >> An infraction saying I'm going over 40 and you don't have evidence that I'm going over 40. So unless you want to pull your body cam footage, what am I detained? >> Absolutely. You're detained. You are not free to go. Yes, sir. >> I'm not free to go. >> You are not. >> What am I detained on? >> Sir, I've already explained it to you. >> What am I detained on? >> Sir, >> what am I detained on? >> I've explained it to you. >> What am I detained on? >> Sir, I'm not going to go run and round with you. >> Okay, then I'm free to go. >> You You are not. >> I am free to go. If you do not tell me what I'm >> If you do not tell me what I'm detained on, then I'm free to go. >> Okay. >> No, >> definitely a passenger. >> You can look all you want, but if I'm not detained, you cannot tell me I cannot go. >> Sir. >> Sir, >> you're detained >> for what? >> You're not free to go. >> What am I detained for? >> I've explained that to you. Okay. >> So, explain it to me again. >> You're speeding up Reed Hartman Highway. >> What's my speed? >> You are now refusing to identify yourself. I'm not refu cuz I don't have to. >> Yes, you do. >> No, I don't. Okay. >> So, soing. >> So, you're harassing me? >> Stay tight right there. >> So, you're harassing me? >> So, if you touch me again, I can see you. >> I haven't touched you, sir. >> Okay, then. So, I'm free to go. >> Stay in the car. >> So, I'm free to go. >> No, no, no, no, no, no, no, no, no. >> Keep your hands right there. Keep your hands Keep your hands up. >> My hands up. >> I'm not talking to you. >> When you have me behind my back on the car, pass through. >> Okay. For what? >> You good? >> Yep. >> For what? >> Tell me why I'm detaining. You said I was going over 40, but you do not have evidence that I was going over 40. >> This is why you hear me talk about being in your optimal shape. Because this officer was able to be tactical the entire time. Take the subject into custody when he got aggressive. If you watch the officer while he's handcuffing the subject, he's telling the passenger, "Keep your hands where I can see them." So, if he has to engage the passenger, he still has a good eyes on him. This is good tactical policing. Being ready for the fight of your life if it ends up happening. The officer's winning. I like it. >> Can you give me Can you give me evidence that I'm going over 40? >> Can you give me evidence that I'm going over 40? >> You said no. >> Do you have an idea on you, sir? He's refusing cuz I don't have to give you a idea. >> No, I to operate a motor, but I'm not operating a commercial vehicle. You driving right the >> So, we're going to walk back to this car right here. >> Tell me for what? What? What am I arrested for? You said you said going over what? You said I'm detained for what? Detained for what? >> Bro, y'all yucking stupid. Y'all are the dumbesting cops that I've ever met in my life. Cuz you know how much you're going to get sued for? >> Okay. >> Do you really Do you know how much you're going to lose your job for? >> Obviously right there. >> Do you really know how much you're going to lose your job? >> Do you really know? Do you really know? Like tell me like are y'all stupid? Do you have proof that I was going 40? Do you have proof that I was going 40 miles an hour? Did you clock me at my speed? No. You [ __ ] dumb ass. You did not print the ticket that I was going 40 miles an hour. You little dumbass. Oh, let me type it in my computer. He was going 40 miles an hour. Let me type it in computer. You little dumbass [ __ ] >> Can you step on out? You're not in any trouble or anything. I think you do have traffic a but we could probably recite you on that. But if you come on out, [clears throat] >> how much has your friend had to drink tonight? >> I don't know. >> Quite a few. >> I don't know. I don't know. >> Why? Why is he so hostile? >> Why? Why is he >> I really don't know, you know, because it is you you you people, you know, uh I don't know for my friend. >> Pretty nice to him, right? >> Yeah. >> Respectful. >> I hang out at the back there with my partner. >> Yeah. Yeah. Yeah. >> So, I just want to make sure that I mention to you a case that I've mentioned in other videos of mine, Brenland v. California, which is the case that a person in the passenger seat is considered seized during the car stop. So, this guy wasn't able to just get up and walk around and move or do whatever the officers has every right to engage [music] him during the stop. And this passenger is under the assumption that he sees during that stop as well from the Brenland case. >> Uh, this beer here in the >> Yeah. >> Is this yours or his? >> I don't know which one it is. You know, >> you both had one. >> Yeah. anything you >> What are you doing, man? >> Yeah, can you please untighten these mother? These shits are hurting my wrist. >> A lot of people who don't know a lot about policing just think that we don't have to recheck cuffs or if we didn't initially check them that there aren't some ramifications. Every police department has a policy on checking for tightness and the procedure done for checking for tightness and double locking the cuffs so they don't become too tight. Some people use it as a ruse and some people just don't like the non-comfort of handcuffs and that's legit. But it's a good practice that if a person complains and you haven't double-checked them to double check them and put that in your report because one of the most common complaints that I've seen as a supervisor is that people complaining that they were handcuffed improperly and that the handcuffs caused injuries to their wrists. >> Are you going to calm down? >> Obviously, I wouldn't bang on the door if they wasn't hurting. >> Are you going to calm down? >> Calm down for what? >> We're not going to get you out of the car if if you're going to resist more. Listen, why am I in the car? >> You're in the car because you're under arrest. For what? >> Minimum obstruction of official business. >> You You said You said I was I was going over 40 and you have no evidence that I was going over 40. You did not clock me for going over 40. You did not give me my ticket for going over 40. So So why am I in the back of your car? >> Sir, >> why am I in the back of your car? >> I've explained this to you. >> No, you've explained it, but you ain't showed me. You ain't giving me evidence for me to give me the time for that. >> Now is not the time for nothing. Listen, you ain't giving me justice. YOU LITTLE DUMBASS WHITE ASS. >> You doing okay? >> Yes. >> Okay. >> I don't know what's going on. >> So, what's going on right now is uh my partners are going to continue searching the vehicle. We saw it open containers. We have problems to search it. >> Um >> and you keep being cool and absent, us finding something absolutely crazy that uh you're associated with. You will be uh going into your hotel room here in a moment. >> Yeah. Yeah. He's not me, but I might be go I'm going to sleep with him. >> Yeah. Don't Don't do that. I know. I know. >> Just Just hang tight. >> I see that. I see that. >> Yep. Just hang tight here and in a few moments you'll be free to go. Okay. >> All right. Thank you. You really know that you are being so stupid. >> You have to calm down. >> You are being stupid. >> You are being the dumbest cop I have ever seen. Actually, no. I've seen it before. >> Exactly. Regardless of what I think, you're going to do what you think is right, which is stupid. >> For starters, bud, you got to calm down. Calm down for what? An illegal traffic stop. Oh yeah, let me put this citation so he can go to court here in Ohio. Yeah, you dumbass. Cuz it's going to get paid for and it's going to get nothing. I guess that's enough. >> No. How much have you had to drink tonight, bud? >> A lot. >> Are you interested in uh performing any field sobriety test? Anything like that? I >> mean, if you want me to to act stupid, it just doesn't make sense. >> Please. >> This doesn't make sense. >> No, I was very nice and professional with you. >> It does not. cuz you did not tell me why I was detained and you did not show me evidence of why I was detained. And then you wanna I want to get out and go in my whole tail and then you want to put my hands behind my own back without me letting you and then you want to put me in squad car without me letting you. Do you really think that's a part Do you really think that's that's justice? >> It's called resisting arrest. >> No. No, it's not called a arrest when you ain't gave me a reason of why I'm arrested. >> I explained to you that you were detained and you were not free to leave. >> But you did not give me evidence of why I was detained. Can you give me that? >> No, you cannot. >> Obstruction of official business, resisting arrest, and >> obstruction of official business. What business? >> You refuse to identify. >> Yeah, I don't have to identify. >> Yes, you do. >> No, because I'm not operating a mo a commercial vehicle, you little dumbass. I'm not operating commercial motorized vehicle. I'm a traveler. >> So you're a sovereign citizen >> technically by law. No. >> Is that what you're trying to say? >> No, but I cannot be pulled over for operating motor vehicle when I'm saying I'm traveling. >> I don't believe that he really believes this ideology. I think that he's just wording things and trying to make something stick. And he's obviously intoxicated in this situation in the back of the police car. So is he like a legit sovereign in my opinion? No. >> You understand that I lawfully stopped you and you refused to ID yourself? Stop me and you did not give me evidence. You did not give me evidence of stopping me. >> You understand that? That's what court is for. >> Yes. And you will not >> And court is not held on the side of the road. >> And you would not be able to you would not be able to hold me turning a right turn going 40. Are you stupid? >> Listen. I'm going to read this to you. Okay. >> Some of it applies. >> All of it. I want all of it right now. All that I am required to. Yes, sir. Some of this applies to you. Some of it does not. Okay. >> No. I need every single word read to me. >> If you would please stop talking and let me explain this to you. >> Every single word read to me. >> All right. I'm going to read all of this to you. >> Every single word. >> Okay. >> And I'm going to follow you with it. >> Okay. Good. >> Hey. Hey. Hey. No. Real quick. >> Yeah. >> The more you interrupt him, the longer you're going to stay in his handcuff. So, I don't care. >> So, let him do not care. >> We care. So, we don't want you. >> No. Okay. You care because Okay. Exactly. >> Some of the supplies you >> I've explained implied consent before. Nearly every state has implied consent when you get a driver license. and why sovereigns don't want to engage in a contract with the state by getting a driver license. Because the implied consent is that if you get pulled over on suspicion of being under the influence of alcohol, operating a motor vehicle while intoxicated, then you have to submit to evidentary tests. If you don't submit to those tests, your license is either suspended or revoked. The officer has to read implied consent to you during that process. >> You serve me. I pay taxes. You have an obligation to answer me, sir. >> Do you even know how fast you were going? >> Do you know? You're going greater than 40. >> Do you have evidence? >> Yes, I do. >> Give it to me. >> It'll be >> No, no, no. I need you to give it to me right now. You were supposed to give it to me when you pulled me over, but you could not. >> How am I supposed to give it to you? >> Because you're supposed to. You're supposed to clock it. If you cannot clock it, then you cannot pull me over. >> As I've told you, that is one way. >> No, no, no, no. That's the only way. >> No, it's not. >> Yes, it is. >> No, it's not. And in most jurisdictions, you can do radar. You can pace, which means that you drive at the pace of the vehicle and look at your speedometer and know what speed is because you're not gaining or losing distance. And some jurisdictions have estimation. You have to be certified in estimation. And usually that occurs coupled with radar certification. And you must be certified on radar. You can't just pick up a radar gun and go out and use it. That technology is pretty advanced. >> How much you want to bet? >> How much do you want to bet? I give you $100 right now if that's lawful in court. That's lawful in court. I I I I'll give you $100 in that courtroom cuz I'lling be there. >> I've mentioned this before that when people have this type of behavior in the back of a police car, it is really important to let the jail staff know because if they act like this in a holding tank with other people and are aggressive and obnoxious and rude, it could lead to them getting lumped up in a cell. And I've seen it happen. It's incredibly important to let the jail staff know that the person's acting in this manner. >> I hope so. Or else you're going to have your >> [ __ ] wrong. You prick ass dumb ass. >> Okay. >> So going 10 under is not illegal. >> Going 10 under. Yeah. 10 under 70. >> Who's doing 10 under 70? >> I'm just I'm just asking. >> I don't understand your question. >> My question is, is it illegal to go 60 on a 70? >> No. >> So, if I'm going lower than 70, it's not illegal. >> Well, it depends what the speed limit is. >> It's 70. >> If the speed limit is 70 and you're going under 70, no, that's not illegal. >> So, if I'm going 60, it's not illegal. >> What's the speed limit? 70 >> and you're doing 60. >> Yeah. >> No, that's not illegal. The only time that that will become a problem is if you're speed is so slow that you're impeding traffic. >> All right, Bo, come on out. Right over that way. Go to the right. To the right. To the right. To the right. >> Co. >> Oh, yeah. Yeah. Let me do that with handcuffs. >> You can do it. >> I can't do it. It's just impossible. >> Step over here. Oh, so step over here. >> This is forcing me. This is forcing me. This is forcing me out. They're forcing me to do this. >> There you go. >> I I definitely didn't oblige to this. >> They're breaking my finger to do this. >> Step back there. >> Footprints >> on those yellow feet right there. >> My feet. >> You don't see them? >> I don't see them. >> These things right here. Look, >> I don't see them. >> Over this way. So, force me to a little bit. Go ahead. Look at that camera for me, sir. >> Hey, you need to open your eyes. You need to go with the lady. Nope. >> You're going to go to a restraint chair, man. You want to do this game. You can sit for 4 hours. You can piss and [ __ ] to yourself or you can look at the camera. >> Okay, that's fine. >> That's what you want to do? >> Yep. >> All right. >> Deputy don't play that inside this jail booking area. I like the process of the thumbrint. Identify who the person is. Like they immediately get a photograph and then they set the tone as far as how it's going to go inside. Deputy don't play that. >> This is unlawful. >> He unlawfully arrested me without giving me evidence of me going over 40. You got to give me evidence of me going over 40 before you put me in handcuffs to detain me. Is that not right? >> Is that not right, sir? >> Is that not right, sir? >> We saw the officer mention the resisting charge, the obstructing charge, and the OWI operating while intoxicated charge that they likely brought him in on. This is another cautionary tale because I believe that this person's friends know that he can potentially behave in this manner, and he's mentioned that he's been arrested before. At some point, people have to step in and speak to their friends and family members and see if [music] they can get them some assistance so they don't behave like this. Because who wants to be on the road with this guy driving if he's going to not only be drinking and driving, but acting like this? Send this video to that person.
