Can you fold me over in what capacity? >> Speed violation. 90 m an hour on the freeway where it is marked 70. >> So you can hand me the ticket. >> I can't ticket you if I don't know who you are. >> The Michigan State Police have a reputation for being pretty hard-nosed and not to be messed with. Pretty much the trooper don't play that. However, sovereign citizen decides to press his luck and next thing you know, we have him barricaded inside of a car. The cavalry gets called and he ends up getting booked and off to jail. This is one of those. in the car. >> You stop car. >> Stop. >> Hello, I'm Trooper Chini. Mission State Police. You got your driver's license on you? >> Speed, sir. I had to go 90 mph down the hill back there. I was trying to catch up for a long time. >> When people continue to go and you try to stop them, we call that slow rolling. And a lot of times that raises us some serious red flags. And a lot of times they're trying to conceal something in the car. We think that maybe they're trying to run or maybe they're formulating a plan on what they're going to do when we get to the car. Or maybe they just didn't hear us. All things can happen, but it's definitely going to raise red flag. >> I need to see your driver's license. >> Anybody else? How did you >> my radar? Sir, I need your driver's license. Where is your radar at? >> My radar is mounted in my vehicle. Where is your driver's license? I'm not traveling at a place. >> Yeah, you don't have to be. Did you see? Did you see the plate? >> Ding, ding, ding. The plate. He's traveling for commerce. We got a sovereign. There's other things that I want to make sure that we take really close attention to right now. Is the officer's positioning, how he's crunched over like that inside of the vehicle. He could be incredibly tall. Does he train like that? And if he does, fine. But it's something that I take note of. And and again, if he's super tall, he may have to crouch down like that. But it's something that I take note of. The other thing that I want to mention is this thing about the radar. when he says you point to a radar. I mean, that's going to matter cuz I can know that he's going somewhere with that. I >> I don't know what that plate is. If it doesn't matter to me on your speed, but the traffic violation I have a violation, right? >> Yes, sir. >> Okay. So, violation for >> capacity. >> No, it does not matter what capacity you are in. It's a violation of speed. Where is your driver's license? I'm going to private driver. >> Okay. Where is your driver's license? Can I give you an identification? >> Yes, you do. >> I am conducting a traffic stop. By law, you have to identify yourself. >> Then you I have to identify myself. >> Yes, sir. >> For what reason? >> Because I am conducting a traffic stop, aren't you? >> You are in violation of the law. >> No, >> I stopped you. I am conducting an investigation of the violation. >> You must identify yourself. Where is your driver's license? >> I Okay. Where is your driver's license? >> Yes, you do. By law, you are required to identify yourself to a police officer. >> I'm not traveling in a promotional. >> It does not matter what capacity you're traveling in. >> It matters. >> It does not matter what capacity you are traveling in. >> The police. >> Okay. So, we know that we're going to have the sovereign back and forth with the officer. However, there's something that I'd like to share with you and show you that a lot of people haven't seen before cuz this is only a few jurisdictions. If you look at the front of the trooper's car, you see this stop police. This like front mounted stop police. It's a deployable bumper sign that they use. They're actually a lot safer a lot of times than putting out traffic cones. I just think it's a cool device and I know some people are looking at they're like, "What the heck is that thing?" And they just deploy that and it's a more effective traffic cone in a lot of ways. >> What about the plates? What are the plates supposed to mean? I know nothing about what that plate means. >> I don't really drive. >> What does that even mean? That means nothing to me. >> Who are you? >> Who are you? >> I'm Drew Perchini with the Michigan State Police. I work at the Brighton Post. My badge number is 12:45. >> Now I have asked you to identify yourself and you will identify yourself. >> Reasonable articulated indication for the stop is a speed. >> Yes, sir. >> From a from a radar gun? >> Yes, sir. >> That you think that you pointed at? >> It's mounted in my vehicle. It's pointing at everybody. >> Yeah, it's Did you know that state troopers and all police officers all around the world have testicular cancing these guns at themselves all day? >> Okay. Well, I I haven't I I haven't experienced that. So, I I wish >> I feel for those state troopers. >> In the beginning when he said, "Did you point that radar gun?" I knew that this was going to be coming up. The driver is saying that there are a whole bunch of officers who have testicular cancer from the radar gun being pointed at them. He's telling the truth to the extent that in the 70s or ' 80s, there was a lawsuit that was filed because there were officers saying that they had cancer from some type of radar gun. and some national institute did a study and found that there was some minor leakage from a handheld radar gun older older model, but they didn't come to that it was conclusive. So again, this is that sovereign just cherrypicking something and then throwing it out there. I knew when he said about pointing the radar gun cuz I've heard people say that before. >> I need you to identify yourself. What is your name? >> You don't have a reason to ask for my >> What is your name? >> You don't have a reason to ask for my identification. >> Yes, I do. >> Do not. >> Yes, I do. I am here on the side of the road with you. You need to identify yourself. >> I need to identify. I didn't do anything wrong. >> Yes, you did. That is why I'm stopping you. >> Oh, no. You don't understand. >> Why did you roll? >> Please call your supervisor. >> For For what reasoning? What reason do I have to call my supervisor? Because you don't want to listen to me. Because you are not obeying the law. >> So in in line with the law. >> You are not identifying yourself. >> I don't have to identify myself. >> You have to identify yourself. >> You don't see >> identification now. You need to step out of the vehicle. >> Yes, you have. That's why I am stopping you. >> Okay. If you want to sit here and keep on doing that, >> I you are escalating the situation. You need to identify yourself to me. I am not going to argue with you anymore. You will step out of this vehicle and you will identify yourself. >> Look at all of this high-speed traffic going by while the officer is engaged in this argument. The ask tell make model can be more effective sometimes in this because if you keep asking them asking them asking them or telling them telling them telling them he's continue to do this. The other thing is you always hear me talk about the passenger side approach. There may be a reason why there might be a b or something over there. I don't know but again you can see how dangerous with that traffic there. >> The faster you cooperate with that the faster we can get you back on the road. >> It's trooper. I already said that. Match number 1245. What am I calling my supervisor for? What am I going to tell them? Let me let's let's have you call him right now. What are you What am I going to tell my supervisor? >> You fold me over in what capacity? >> Speed violation, 90 m an hour on the freeway where it is marked 70. >> So you can hand me the ticket. >> I can't ticket you if I don't know who you are. >> Don't want this to get in a little bit. >> Then identify yourself. I don't >> I can take your name. What is your name? >> Help me to identify myself. >> I'm not going to. >> Do not leave. >> I think he's a sovereign citizen. >> Watch yourself. He's not listening to anything I'm saying. So, we're going to get him out of the car. >> Tactical challenge with the trooper turning his back completely to the suspect. Why do the officers have to look each other in the face to talk? We can hear each other just fine, but maintaining our eyes and the vantage point of looking at the suspect and also being away from all of that heavy traffic might be a more tactical advantage. I say these things only because I want to make sure that people can listen to him and officers can go home at the end of the shift. >> He's not identifying himself. He's not tell I've told him to step out of the car multiple times. >> All right. Are you listening to me? >> If you look closely, you can see partial of that weird ambassador looking plate that he was telling the trooper to look at. >> Okay. I need you to step out in the car like I've asked multiple times. My supervisor is not going to come all the way down here for you not listening to me. I do not need a supervisor for you to identify yourself or step out of the vehicle. >> You are disobeying lawful order. You are not free to go. Not obeying lawful order to identify yourself or step out of the vehicle. >> I have the right. >> You are to step out OF THE VEHICLE AND IDENTIFY yourself now. You have the right to talk to me, right? >> You are being detained right now. >> You need to step out of the vehicle. Unlock the door. >> You are not understanding anything that I am saying up to this point. >> Yes, you will identify yourself. >> Ponytail. Put it in a bun. >> Let me pop my supervisor real fast. >> What' you catch? >> I think he's one of those sovereign cit citizens. He hasn't said it, but >> I don't think that's a real plate and he won't identify himself. Won't listen to anything. He said that he's not traveling in a commercial capacity. So, he's sovereign citizen. Want me to try as a office employee or an elected official and they usually believe in that. >> If you think you could talk to him, it would be better. >> I think I'll throw my vest on real quick. >> So, here's what's happening here. There are a few different jurisdictions there and sovereigns will many times believe that the sheriff who is an elected official who is in charge of the deputy sheriff's is a person that they'll deal with and they'll often ask for that person. This person I believe is one of the people that work for the sheriff and so that's why they're electing to switch from the state trooper who the sovereigns don't believe that have any jurisdiction over them to the deputy who's from the sheriff's department is what I believe is happening here. >> My supervisor is on his way. We've also got an elected employee that's here if you would rather talk to him. >> He's coming up here to talk to you in just a minute. All right. >> You want to call anyone? You can make I can't I'm not going to stop you from making a phone call. I mean it's a crank window. We can just push down on it >> probably. >> If I go that route though, he's going to jail. >> Huh? >> If I go that route though, he's going to jail. >> 1233 secure. >> Oh, I mean, we're all We're pretty much already there. If he doesn't have >> What's going on? >> I do have 193 lawsuit. >> Okay. Are they a criminal? >> No, I'm saying. >> Okay. I'm not worried about that because I I'm acting within the law right now. >> You are not acting with within the law. I am giving you one more chance to step out of the car on your own. >> Well, you're not going to give me talk. >> You don't You don't get one right now. >> I have >> You don't get one right now. You'll get one. You'll get one before you see a judge. >> Right now. >> Yes. You will get one before you see a judge. You have a right to remain silent if that's what you would like before talking until you have talked to a lawyer. >> I have a right to talk to you. You're not getting me yet. >> No, not right now. >> So, I can I >> step out of the car. >> That was your last chance. >> Hey, hold on. >> Second window I got to fix, man. >> All right, put your phone down. >> I'm going to come out. >> Step out of the car. Turn and face your vehicle. >> He said I could keep my phone recorded. >> No, put your phone down. I'm going to be elaborated. >> I'm going to leave it recording. I'm just going to set it here. >> You had way too many chances to step out of that car. >> No, you give me a a lawyer and you won't. >> You can get a lawyer before you see a judge. >> If we look here, I've not seen this tactic to get a window down. It's, in my opinion, incredibly dangerous. If the window shatters with no gloves on, this trooper's hands are going to be completely destroyed. We have the exposure. If this subject decides to go to gunfire, we have crossfire situation. None of the officers seems like they're ready to engage the person if this decides to go lethal. The other thing is if this goes south, where do these four officers have to run but into the busy street as cars are going by. There's just a lot of different exposure that could potentially cause challenges to the officers and I don't want to see anyone get hurt. >> We gave you 100 chances. I did not illegally search you. You're under arrest. It's >> been illegal. >> None of this has been illegal. >> You will. >> The only illegal part is you not listening to us. >> You will be in federal court. >> All of this is on camera. You've been escalating this whole time. >> Okay. >> Sovereign or >> Yeah, allegedly. >> Yeah, I think that's what it is. >> Okay. >> He never said it specifically, but >> he was saying never said it. He was quoting all the stuff. >> Yeah, he's quoting all the stuff. And I've never seen that before. >> Yeah. No, that's a point. >> You know, it would have ended the same way if it was just the the sheriff's out here, right? >> No, >> because you still did not identify yourself. You still would have been pulled out of the vehicle. >> I'm not going to talk to you no more. I tried. I'll see you in court. You guys are trying to generate revenue and I was just happy to be the target. You don't know that's what you're doing, but that's what you're doing. >> Okay, >> I get the public servant part. I get, you know, serve and protect, but >> stalking people and and being a a road pirate is a you you poaching people from the blind is ahead. That's not serving or protecting. >> I was behind you. I wasn't poaching anybody from the blind. >> Same. You're hunting. I'm not hunting. I'm just traveling. You're hunting me. You hunted me down. how you're going to escalate this. So, you're in federal court, you're going to remember this part. >> You're seeing something that you don't normally see is the front passenger seat transport. My beginning of my career, front passenger seat was the place that we transported people. Sometimes when you have a vehicle that's not equipped for transporting in the rear seat, then you're transporting the front. Some officers actually prefer to have a person right next to them because you can kind of see what they're doing if they're moving around. If they're grabbing anything, and if they start to get crazy in the passenger seat, you can put your arm across them and hold them as you take them in. Some officers are going to say, "There's no way I'd want anyone sitting next to me, especially if you have a spit or a person that's getting really, really wild." But some people still do front passenger seat transport. >> Do you need to go to the hospital for any reason? >> Yeah, I got I'm serious stress. >> We're not going to the hospital for stress. >> Oh, my heart's racing. Really bad. >> 12:33 Chelsea Hospital for reports of racing heart. >> So, I've mentioned what we call in policing incarceris where a person's going to jail and they want to go to the hospital instead. I don't know if this person legitimately has any kind of medical issue. Under the circumstances, one would think that it was incarceritis, but the best practice is if they say take me to the hospital, they go to hospital. >> Do you want to go to the hospital? >> I'm well regardless. >> That's what I'm saying. >> They're going to reject me out of the jail. >> If I take you to the jail, if I take you to the jail right now and you tell them that you're you need to go to the hospital, they won't let me take you in. >> Tell them that they're going to figure out. These are vitals, dude. >> What does that mean? the >> I have never once steered you in the wrong direction, bro. And you've been you've been escalating this the whole time. You I'm telling you what's going to happen if you step away and you just keep doing it. >> Let's Let's do it. Let's Let's live for it. And you're going to see it. >> Okay. My question is, do you need to go to the hospital? >> You don't need to go to the hospital. >> Go to the hospital. Yep. >> Okay. We're going to the hospital. >> I hope it was a trooper, man. I got a number of respect for you guys. I know my rights. >> Commercial capacity versus traveling privately, it's different. Thank you so much for educating me. >> Let's talk about it, man. I don't want to educate you like that. I want to be real. >> Can we talk about what happens when they reject me? >> What do we do? >> We'll figure it out when we get there. >> Come on, man. Save me some time, bro. I want to get out of jail. >> You could have saved yourself a lot of time. >> Oh, dude. >> You wouldn't even be going to jail if you >> 10 miles hour over. Look at him going to the hospital before jail. >> If you think he's indignant going here, wait till you see him while he talks to the judge in court. >> The speed limit is 70. 20 mph over >> commercial speed libert >> 10 miles hour over >> 20 miles hour over >> 90 what 90 - 70 since you are so smart and can do the math >> Daniel >> resource drain >> it's on my computer >> when you post this online so my team knows >> oh he's going YouTube video. >> Yeah, >> you can't obey two masters. >> We only have one. >> Did you take an oath for the constitution? >> I did. >> Right. But you also have to uh protect and serve in the commercial capacity. These procedural stops that violate your own time. The right to travel is a privilege. It >> is a privilege that can be taken away. >> My guy, do you hear yourself? That's like saying sovereign >> right >> to travel in a vehicle >> is a privilege that can be taken away. Listen, listen. You got to we got to we got to work on that. >> You cannot say your right >> is a privilege. I don't care what it is. >> You can't say that. >> Your right to travel is your right under the Bill of Rights. >> He's wrong about the Bill of Rights, but he's right that if it's a privilege or a right, those are two different things. If it's a right, it's not a privilege. You have the right to certain things, but the driving is a privilege. if you suspected me of a crime or or you you guys don't even know this, but your whole only reason you can stop people is because of the uh uh international vehicle theft prevention program. That's it. That's it. Otherwise, your guys is stopping people would be violating people's rights to travel all the time. But you guys have the right to pull people over and verify that that car is not stolen. >> You That's it. When you registered the VIN, when you checked my VIN, that was as far as your your stop could have gone. As far as my rights go as far as my rights go. You could have checked to make sure it wasn't stolen. If it wasn't stolen and I wasn't IDed specifically for a crime, you didn't think I did something, >> then I'm free to leave for >> not a crime violation. >> That's a Thank you. violation. >> You got to know this stuff, man. >> I understand that they're pumping these systems with you officers and troopers, and I just want you to do the best in your career. >> So, the trooper charged him with driving while suspended, driving without security, which means insurance, the obstructing charge, and refusal to obey a PO. This never works. Every time we see sovereigns get pulled over for this, they get the same types of charges for refusing to get out of the vehicle or barricading inside of the vehicle.
